   Railway reserves the right to purchase Bulk Quantity from those sources who have been approved by RDSO on or before the date of tender opening. But in case of removal or suspension or banning or degradation after opening the tender, such cases will be taken into account while deciding tender ( for details regarding ordering on Approved / Developmental vendors please refer para 3.2 & 3.3 of Part B tender conditions)

   The Railway reserves the right to order bulk quantity on the approved sources, and the offers of unapproved sources may be considered only for developmental order of small quantity. The status of approval of tenderer shall be reckoned as on the date of tender opening and not thereafter, unless it is a case of downgrading/removal/suspension/banning. Minimum 80% of Net Procurable quantity shall be ordered on approved vendors.

   If the tendering firm(s) has been placed as developmental source in vendor directory, then offers from these firms may be considered for developmental order upto maximum of 20% of the Net Procurable Qty.

   . Where there are not more than three Indian Suppliers categorized as Approved Vendor for a particular item, developmental vendors can b e considered for placement of bulk order without any quantity restrictions. However, while considering such vendors, factors including past performance, capacity, delivery requirements, quantity under procurement, nature of item, outstanding order load etc. shall be considered in a transparent manner, subject to rates being reasonable. Quantity allocation among eligible vendors shall be based on pre decided splitting criteria. Such orders shall be treated as bulk orders.

   Please enter the percentage of local content in the material being offered. Kindly enter 0 (Zero ) for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions. For PUBLIC PROCUREMENT POLICY (Preference to Make in India ), please refer Para 16.0 Part B of Southern Railway Tender Conditions available under the mentioned link. Procurement of the item is restricted to Local suppliers with minimum local content of 20% (Class-I or Class-II Local supplier as defined in Railway Board letter no: No.2020/RS(G)/779/2/Pt.1 dated 25.09.2020) only and the vendors who do not qualify to be "Local suppliers" (i.e., "Non-Local suppliers" with local content less than 20%) should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a "Local supplier" for the tendered item participates in the tender, it does so at it's own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor

" I have read the clause regarding restrictions on procurement from a bidder of a country which shares a land border with India. I certify that this bidder is not from such a country or, if from such country, has been registered with the Competent Authority. I hereby certify that this bidder fulfills all requirements in this regard and is eligible to be considered. Where applicable, evidence of valid registration by the Competent Authority shall be attached."

   i) In case of road delivery, the date of delivery at destination (Consignees end) shall only be treated as delivery date irrespective of F.O.R./F.O.T. condition mentioned elsewhere in the contract/tender. (ii) The bidder confirms that rates and other financial terms quoted in relevant columns of financial bid will only be ruling terms for acceptance, and such terms i) In case of road delivery, the date of delivery at destination (Consignees end) shall only be treated as delivery date quoted anywhere else should be ignored. (iii) (a) Regarding MSE purchase preference firms, please refer clause 15.0 part B of Southern Railway tender conditions available under the link Public Documents- >Stores/Supply. (b) Goods and service Tax: Please refer part A Para 14.0 of Southern Railway tender conditions available under the link Public Document -> Stores/Supply.    EARNEST MONEY DEPOSIT(EMD) shall be deposited by all vendors for tenders with estimated value above Rs.25 Lakhs subject to the applicable exemptions. For the exemptions and other details please refer Para 2.0 Part A of Southern Railway Tender conditions. In case of submission of Earnest Money Deposit in the form of Bank Guarantee, please refer Annexure-6 of Southern Railway Tender conditions for the Proforma for BG.

   SECURITY DEPOSIT (SD) shall be 5% of total value of contract and shall be taken from all vendors for contract value above Rs. 25 Lakh subject to the applicable exemptions. For details please refer 10.0 Part A of Southern Railway Tender conditions. In case of submission of security Deposit in the form of Bank Guarantee, please refer Annexure 5 of Southern Railway Tender conditions for the Proforma for BG.

   Conditions for Responsiveness of Offer: I/We have carefully gone through the IRS conditions of contract (included and uploaded along with the bid document) particularly Para 2500 pertaining to "Code of Integrity, Misdemeanor and Penalties". I/We hereby certify that no other sister concerns or affiliates (such as having common partner/director/promoter/owner/holding company decision control etc.) have participated in this tender which can give rise to a conflict of interest or fall under anti-competitive practices. We understand that the offers of all such sister concerns including ours are liable to be rejected as per relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of Integrity in general, with specific reference to conflict of interest [Para 2502 (e)], anti competitive practices [Para 2502(c)] and obligation to proactive disclosures [Para 2503]. I/We understand that we are fully responsible for the above declaration and it shall not be the Railway's responsibility to verify the same. I/We are aware that we shall be liable for all consequences of violation of Code of Integrity, if detected, at any stage.
