   Standard General Conditions of Contract-2018 as amended/corrected up to latest correction slips, copies of which can be seen in the office of Chief Medical Superintendent, Divisional Railway Hospital of S. E. C. Railway Raipur or obtained from the office of the Chief Medical Superintendent,South East Central Railway, Raipur on payment of prescribed charge.
6. 2.2

   Tenderers shall quote the rate above/below/at par against the Tender value (i.e. Estimated/ Departmental Value of the work). The quoted rated must be inclusive of all expenditure related to consumables, transportation charges, all type of taxes and fee payable to Local/municipal authorities which are necessary for the Continuance of the service under the contract.

   Earnest money:-

8. 2.3.1 The tender must be accompanied with earnest money of Rupees as mentioned in NIT in A/c of F.A.& C.A.O. S.E.C. Railway Bilaspur deposited on time failing which the tender will not be considered & will be summarily rejected.

9. 2.3.2 The Tenderer(s) shall keep the offer open for a minimum period of 45 (Forty Five)days from the date of opening of the tender. It is understood that the tender documents has been sold / issued to the Tenderer(s) and the Tenderer(s), is/are permitted to tender in consideration of the stipulation on his/their part that after submitting his/their tender subject to the period being extended further, if required by mutual agreement from time to time, he will not resile from his offer or modify the terms and conditions thereof in a manner not acceptable to the Divisional Railway Manager (Medical) of South East Central Railway Raipur, Should the Tenderer fail to observe or comply with the foregoing stipulation, the amount deposited, as Earnest money for the due performance of the above stipulation shall be forfeited to the Railway.

10. 2.3.3 If the tender is accepted, the amount of earnest money will be retained and adjusted as security deposit for the due and faithful fulfillment of the contract. This amount of security deposit shall be forfeited, if the tenderer(s)/contractor(s) fail to execute the agreement bond within 7 days after receipt of notice issued by the Railway that such documents are ready or to commence the work within 15 days after receipt of the orders to that effect.

11. 2.3.4 The earnest money of the unsuccessful tenderer(s) will, save as here-in before provided be returned to the unsuccessful tenderer(s) within a reasonable time but the Railway shall not be responsible for any loss or depreciation that may happen to the security for the due performance of the stipulation to keep the offer open for the period specified in the tender documents or to the Earnest money while in their possession nor be liable to pay interest thereon.
12. 2.4

    Performance Gaurantee

13. 2.4.1 The Performance Guarantee (PG) shall be released after physical completion of the work based on "Completion Certificate" issued by the competent authority stating that the contractor has completed the work in all aspects satisfactorily. The security deposit shall, however, be released only after expiry of the maintenance period and after passing the final bill based on "No Claim Certificate" from the Contractor.

14. 2.4.2 Performance Guarantee at a rate of 10% of the contractual value shall be deposited by the successful contractor. The successful contractor shall have to submit a Performance Guarantee (PG) valuing 10% of the contract value in four separate parts of 2.5% each of the contract value, within 30 (thirty) days from the date of issuance of LOA. Extension of time for submission of PG beyond 30 (thirty) days and up to the date of submission of PG from the date of issuance of LOA may be given by the authority who is the competent to signed the contract agreement. However, a penal interest of 15%per annum shall be charged for the delay beyond 30 days i.e. 31st day after the date of issuance of LOA. In case the contractor fails to submit the requisite PG after 60 days from the date of issuance of LOA, a notice shall be served to the contractor to deposit the PG immediately however not exceeding 90 days from the date of issuance of LOA. In case the contractor fails to submit the requisite PG even after 90 days from the date of issuance of LOA, the contract shall be terminated duly forfeiting EMD and other dues, if any payable against the contract. The failed contractor shall be debarred from participating in re- tender for the work. In case 60th day is a bank holiday or office closure next working day should be considered as the last day for submission of the PGs. Decision of competent authority to sign the contract agreement would be final in case of any disput.

16. 2.4.4 Performance guarantee shall be initially valid upto the stipulated date of completion plus 60 days beyond that. In case, the time for completion of work gets extended, the contractor shall get the validity of PG extended to cover such extended time for completion of work plus 60 days. The value of PG to be submitted by the contractor will not change for variation up to 25% (either increase or decrease). In case during the course of execution, value of the contract increases by more than 25% of the original contract value, an additional Performance Guarantee amounting to 10% for the excess value over the original contract value shall be deposited by the contractor. On the other hand, if the value of contract decreases by more than 25% of the original contract value, Performance Guarantee amounting to 10% (Ten percent) of the decrese in the contract value shall be returned to the contractor. The PG amount in excess of required PG for decreased contract value, available with Railway, shall be returned to contractor as per their request duly safeguarding the interest of railways.
17. 3

    SUBMISSION OF TENDER DOCUMENT COST:

    Tender must be accompanied with tender document cost of requisite amount as mentioned in NIT in A/c of F.A.& C.A.O., S.E.C. Railway, Bilaspur. Payment of Tender document cost (TDC) in respect to e-tendering, should be accepted through net Banking or Payment Gateway only.

    SUBMISSION OF EARNEST MONEY:
20. 4.1

    Tender must be accompanied with Earnest Money of requisite amount as mentioned in NIT in A/c of F.A.& C.A.O., S.E.C. Railway, Bilaspur. Payment of Earnest Money Deposite(EMD) in respect to e- tendering, should be accepted through Net Banking or Payment Gateway only. Note: Fixed Deposit Receipt (FDR) will not be accepted as EMD for tenders invited on IREPS (e-tender portal)

22. 5.1

    I/We also hereby agree to abide by the IR's-General Conditions of Contract- 2018, with all correction slips up-to-date and to carry out the work according to the special conditions of contract and Specification of materials and works as laid down by Railway in the annexed Special Conditions/Specifications, with all correction slips up-to-date for the present contract.
23. 5.2

    Amount of Earnest money in favour of F.A. & C.A.O. S.E.C. Railway Bilaspur is herewith forwarded along with. The full value of the Earnest money shall stand forfeited without prejudice to any other right or remedies in case my/our tender is accepted and if:

    I/We do not execute the contract document within stipulated period after receipt of notice issued by the Railway that such documents are ready, and
25. 5.4

    I/We do not commence the work within stipulated period after receipt of orders to that effect.
26. 5.5

    Until a formal agreement is prepared and executed, acceptance of this tender shall constitute a binding contract between us subject to modifications, as may be mutually agreed to between us and indicated in the letter of acceptance of my/our offer for this work.
27. 5.6

    I/We have read the various conditions to tender attached hereto and agree to abide by the said conditions. I/We also agree to keep this tender opened for acceptance for a period of 45 (Forty Five) days from the date fixed for opening the same and in default thereof, I/we will be liable for forfeiture of my/our Earnest Money. I/We offer to do the work for South East Central Railway, at the rates quoted in the attached schedule and hereby bind myself/ourselves to complete the work in all respects within as mentioned in NIT from the date of issue of letter of acceptance of the tender.

    Rights of the Railway to deal with tender: The authority for the acceptance of the tender will rest with the Railway. It shall not be obligatory on the said authority to accept the lowest tender or any other tender and no tender(s) shall demand any explanation for the cause of rejection of his/their tender nor the Railway undertake to assign reasons for declining to consider or reject any particular tender or tenders.

    In case of any problem with the portal is faced while filling the e- tender, Tenderer(s) are advised to contact with the Helpdesk of IREPS portal who will render all help and assistance related with the website and portal except that related with the details of the tender. Railway will not take any responsibility for non-participation in the e-tender online for the reasons related to the website and portal or server etc beyond the control of railways.
30. 8

    Railway and the IREPS website will not take the responsibility for any online payment made by the tenderer(s) and debited from his/their account towards Tender Document Cost or Earnest Money Deposit due to wrong or mismanipulation or any reasons related with the IT or found unsuitable for the tender etc. In this regard Railway and IREPS website will not entertain any claim or refund the paid amount.

    TENDERERS POSTAL ADDRESS
32. 9.1

    Address of tenderer: The address, email - Id and Mobile phone, other phone nos. and other details given in the portal while registering will be considered as official address and all correspondences to the tenderer will be made in these registered modes. All communication sent in time to the tenderer by post at the said address shall be deemed to have reached the tenderer duly and in time. Important documents shall be sent by Registered Post. However, an undertaking has to be given in the enclosed annexure by uploading a scanned copy of duly filled in form in the portal.
33. 9.2

    Tenderes can also contact Office of the Assistant Nursing Officer, Divisional Railway Hospital, S.E.C. Railway Raipur on any working day with in working hours for any information in connection with this tender.
34. 10

    OPENING OF TENDER
35. 10.1

    Opening of e-tender online:- The e- tenders will be opened online using the IREPS portal. No representative is required to be present for opening of tender and taking notes of rates quoted and ranking as the complete details of rates etc. of all the bidders shall be available to the bidders in the website after the opening of the tender.
36. 10.2

    In case the date of closing mentioned in the Notice Inviting Tender is declared a holiday/bandh/ strike etc. on any account, the date of closing tender online will not be changed as the application in the website of IREPS does not permit submission of any offer after closing date and time of the tender. However, opening of tenders online will be on any convenient day after the closing date/time of tenders.
37. 11

    If the tenderer(s) deliberately gives / give wrong information in his/theirtender or creates/create circumstances for the acceptance of his/their tender, the Railway reserves the right to reject such tender at any stage.

    If the tenderer(s) deliberately gives / give wrong information in his/theirtender or creates/create circumstances for the acceptance of his/their tender, the Railway reserves the right to reject such tender at any stage.

    If the tenderer(s) expires after the submission of his/their tender or after the acceptance of his/ their tender, the Railway shall deem such tender cancelled. If a partner of a firm expires after the submission of their tender or after acceptance of their tender, the Railway shall deem such tender as cancelled, unless the firm retains its character.

    Tenderers Credentials: - Documents testifying tenderers previous experience and financial status should be produced along with the tender or when desired by the competent authority of the South East Central Railway. Tenderer(s) who has / have not carried out any work so far on Railway and who is/are not borne on the approved list of the contractors of South East Central Railway should submit along with his/their tender credentials to establish -

    E-tender have been invited for and on behalf of the President of India through website www.ireps.gov. in for the work mentioned against the tender notice number available in the website. Tenderer(s) are to bid online only in the above mentioned website. All Mandatory fields marked have to be filled in by the tenderer. No Manual offer is acceptable against this tender. No Tender document in hard copy will be sold against this tender. Please read the Instructions to Tenderer(s) for e-tendering, IR's General Conditions of Contract, Special Condition of Contract before filling the e-tender through online.

    The Railway may of its own or in response to any clarification requested/suggested by any person including that from the tenderer, may modify this tender document at its sole discretion at least 15 days before the due date of closing of the tender as corrigendum. Corrigendum as required may be issued at least 15 days prior to the closing of the tender. These corrigenda of this tender, if any, as issued time to time will be available on website at least 15 days in advance of closing of tender. The tenderer(s) are requested to check the website before submitting their offer whether any such corrigendum to the tender has been issued or not and revise the offer if required accordingly. Failure on the part of tenderer(s) on this aspect will be solely tenderer(s) responsibility.

    The submitted e-tender forms will be considered as digitally signed by the tenderer as a confirmation from the tenderer that the tenderer has read, agreed and accepted all the conditions and laid down documents referred in the Schedule of Tender, General and Special Conditions.

    The Railway and the website will have no responsibility for incorrect evaluation of cost and thereby incorrect cost of work and ranking of tenderer(s), if the schedule is not filled in correctly and unambiguously for each item. No claim or clarification of a tenderer regarding applicability, inclusion or exclusion of any element of tax or duty or any other change in the offer subsequently (after opening of the tender) will be entertained. For this the tenderer(s) are advised to read the Instructions, General Conditions, Special Conditions and other Instructions carefully before submission of tender.
46. 20

    The tender offer complete in all respect and with all documents is to be submitted online by e- tendering process through the website www.ireps.gov.inbefore the closing time/date of this tender as mentioned in the NIT (Notice Inviting Tender). Tenderer can revise the bids any number of times till the closing time/date of the tender. No manual offers shall be accepted.

    This document is the Standard Tender Document which consists of the Instruction to the Tenderer(s), NIT (Notice Inviting Tender), General Conditions of the Tender, Special Conditions of the tender, Tender schedules, and Specifications of the works & various Annexure/Schedules etc. All the above mentioned documents taken together if not scored off shall constitute the complete tender document hereafter referred to as Tender Document & have to be read together & acted upon accordingly. No part of the tender document can be relied upon or acted upon in isolation.
