Special Eligibility Criteria

   This item is to be procured from RCF approved/Developmental sources registered under RCF Item ID: 2400048 as available on IREPS vendor directory. The status of firm shall be reckoned as on date of tender opening and not thereafter, unless changed because of downgrading/removal/suspension/banning. BULK ORDER: - Railway reserves the right to order entire or bulk quantity on RCF approved sources. In case there are not more than three Indian Suppliers categorized as Approved Vendor (without any condition) for a particular item, unconditional developmental vendors can be considered for placement of bulk order without any quantity restrictions as per Para 1.3.1 of Annexure-B of WCRs e TENDER DOCUMENT FOR SUPPLY CONTRACTS.DEVELOPMENTAL ORDER: - In case there are more than three Indian supplier as Approved Source (without any condition of prototype/field trial), the development orders may be placed on firms which are unconditionally approved by RCF as developmental vendor as per Para 1.3.1 of Annexure-B of WCRs e TENDER DOCUMENT FOR SUPPLY CONTRACTS. CONDITIONAL APPROVAL BY RCF FOR FIELD TRIAL : - When a firm is approved by RCF for developmental orders but with conditional approval subjected to field trials of the specific quantity as on the date of tender opening, firm should attach the details of orders received already. In case firm do not attach details, it will be presumed that firm has not received any order for the tendered item. Such firms shall be considered only up to 20% of net procurement quantity or the balance quantity Required for field trial whichever is minimum. However, if after opening of the tender, such firms receive any order, it will be responsibility of the firm to inform it to this office at the earliest. In case the firm get any order against this tender but RCF do not entertain the order for carrying out trials/ inspection then the order will be cancelled as per relevant instructions mentioned in the tender conditions. CONDITIONAL APPROVAL BY RCF SUBJECT TO PROTOTYPE APPROVAL : - When a status of firm as on date of tender opening, is approved by RCF for developmental orders with remarks that "Supply (even for field trials, whichever applicable) shall commence only after approval of the prototype by the RCF, offer of such firm shall be passed over. Note:- No back reference will be made in this regard & communication received after opening of tender will also not be entertained.

   TENDER SPECIFIC AUTHORIZATION: - Authorized agents of OEM must submit Tender Specific Authorization of the OEM. No back reference will be made in this regard & communication received after opening of tender will also not be entertained. The material supplied by the traders will be inspected at the OEM premises by the inspecting agency before supply. Neither one agent can represent two OEMs nor can one OEM authorize two agents. Purchaser reserves the right to reject both bids in such cases. In a tender either the Agent on behalf of the OEM or OEM itself can bid but both cannot bid simultaneously for the same item in the same tender. In cases where both OEM and their agent participate in bidding for same item, any or both the bids shall be liable to be rejected.

I/We hereby certify that none of our sister concern or affiliates (such as having common partner/director/promoter/owner/holding company decision control etc.) have participated in this tender which can give rise to a conflict of interest or fall under anti-competitive practices.    Jurisdiction of Court :- As per Para 2703 of IRS Condition of Contract the Courts of the place from where the acceptance of tender has been issued shall alone have jurisdiction to decide any dispute arising out of or in respect of the contract.

   PLASTIC WASTE MANAGEMENT RULE 2016 :- It is certified that for execution of this contract, the plastic packaging material or commodities which are made out of Compostable Plastic or Biodegradable Plastic shall be purchased form firms having certification by CPCB for manufacture or sale of plastic packaging or commodities made from Compostable Plastic or Biodegradable Plastic as per rule 4 (4) of Plastic Waste management rule 2016. It is also certified that we shall also not use any other category of plastic, such as Bio compostable or Oxo-degradable or Oxo-bio-degradable or the like, which are not recognized under Plastic Waste Management Rule 2016 with all amendments."    "Tenderers, in their own interest, are advised to avoid quoting of deviations as the deviations that are not acceptable to the purchaser may result in the offer being ignored/adversely considered. The decision as regards acceptability of a deviation shall lie with the purchaser only."

    LOCAL CONTENT CERTIFICATE:- Order shall be restricted to Class-I Local Suppliers only (with minimum local content of 50%) as per Make in India Policy for the tendered item and as such, the vendors who do not qualify to be Class-I Local Suppliers for the tendered item, should not quote in this tender as their offer shall not be considered for any ordering. In case, any vendor who does not qualify to be a Class-I Local Supplier for the tendered item participates in the tender, it does so at its own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor.

    Price Variation Clause PRICE VARIATION CLAUSE (PVC) : Quoted basic price of the battery shall be based on HZLs price of Lead (Min. 99.99%) @ Rs. 2,04,300/- per MT Ex-Chanderia Lead Zinc Smelter(exclusive of all statutory duties Taxes) as indicated in Price Circular of Hindustan Zinc Limited as on 27.02.2025 also considering all discounts offered by M/s HZL (Ex- Chanderiya Smelter) in its price circular. For every increase or decrease of Rs. 100/- (exclusive of all statutory duties taxes) or part thereof, the price of the battery set quoted will be subject to an increase or decrease of Rs. 34.20 per battery set (exclusive of all statutory duties taxes). In the event of variation in Lead price as declared by M/s. HZL, adjustment in the contract price upward/downward will be regulated with reference to the date of call of inspection. The price of Lead prevalent 30 days prior to the date of offering the material for inspection as indicated in inspection certificate will be considered for computing the PVC. Further, FOR the purpose of aforesaid PVC, The basic price of EX-Chanderiya Smelter shall be taken into account without referring to any discount mentioned in the HZL circular.
