Annual Maintenance Contract (AMC) of different capacity of EOT cranes for the period of 02 years and breakdown attending of EOT cranes with standby spares in Electric Loco shed, Ajni

The tenderer must have minimum average annual contractual turnover of V/N or 'V' whichever is less where V= Advertised value of the tender incrores of Rupees N= Number of years prescribed for completion of workfor which bids have been invited. The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year isyet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover. The tenderers shall submit requisite information asper Annexure-VIB, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet. Note: As per Railway Board Letter no. 2019/Elect(G)/165/1 dtd. 22-04-2020, Eligibility criterion shall not be applicable to those Firms who are either OEMs or who are sources approved by RDSO/CLW for related works contractsincluding sources approved by production unit's (RDSO/CLW) for various safety / vital items. However, for other Firms work will be awarded only if they fulfill the above eligibility criteria.

The tenderer must have successfully completed or substantiallycompleted any one of the following categories of work(s) during last 07(seven) years, ending last day of month previous to the one in whichtender is invited: (i) Three similar works each costing not less than theamount equal to 30% of advertised value of the tender, or (ii) Two similarworks each costing not less than the amount equal to 40% of advertisedvalue of the tender, or (iii) One similar work costing not less than theamount equal to 60% of advertised value of the tender.The followingwork shall be considered as similar nature of work for criteria above."Repair, reconditioning and rewiring / re-cabling of EOT cranes of any capacity OR manufacturing of EOT cranes of any capacity OR AMC of EOT cranes of any capacity and work must have been carried out in the the following organization a) Central Govt. Dept. or State Govt. dept. b) Central Govt. PSU or state Govt. PSU". (Ref. HQ's letter No.L.253.AC/Div- Work Dated: 17-02-2015) Note - Work experiencecertificate from private individual shall not be considered. However, inaddition to work experience certificates issued by any Govt.Organization, work experience certificate issued by Public listedcompany having average annual turnover of Rs 500 crore and above inlast 3 financial years excluding the current financial year, listed onNational Stock Exchange or Bombay Stock Exchange,incorporated/registered at least 5 years prior to the date of closing oftender, shall also be considered provided the work experience certificatehas been issued by a person authorized by the Public listed company toissue such certificates. In case tenderer submits work experiencecertificate issued by public listed company, the tenderer shall also submitalong with work experience certificate, the relevant copy of work order,bill of quantities, bill wise details of payment received duly certified byChartered Accountant, TDS certificates for all payments received andcopy of final/last bill paid by company in support of above workexperience certificate. Note: As per Railway Board Letter no.2019/Elect(G)/165/1 dtd. 22-04-2020, Eligibility criterion shall not beapplicable to those Firms who are either OEMs or who are sourcesapproved by RDSO/CLW for related works contracts including sourcesapproved by production unit's (RDSO/CLW) for various safety / vitalitems. However, for other Firms work will be awarded only if they fulfillthe above eligibility criteria.

The tenderer shall clearly specify whether the tender issubmitted on his own (Proprietary Firm) or on behalf of aPartnership Firm / Company / Registered Society / RegisteredTrust / Hindu Undivided Family (HUF) / Limited LiabilityPartnership (LLP) etc. The tenderer(s) shall enclose the attestedcopies of the constitution of their concern, and copy of PAN Cardalong with their tender. Tender Documents in such cases are tobe signed by such persons as may be legally competent to signthem on behalf of the firm, company, association, trust orsociety, as the case may be. Tenderer has to submit all thedocuments mentioned below, as the case may be. : (a)SoleProprietorship firm: An undertaking on suitable stamp paper tothis effect clearly mentioning PAN number. (b)HUF : (i)A copy ofnotarized affidavit on Stamp Paper declaring that he who issubmitting the tender on behalf of HUF is in the position of'Karta' of Hindu Undivided Family (HUF) and he has theauthority, power and consent given by other members to act onbehalf of HUF. (c)Partnership Firm :(i) A notarized copy ofpartnership Deed or Copy of Partnership deed registered withthe Registrar.(ii) A notarized or registered copy Power ofAttorney in favour of the individual to tender for the work, signthe agreement etc. and create liability against the firm.(iii) Anundertaking by all partners of the partnership firm that they arenot blacklisted or debarred by Railways or any other Ministry /department of the Govt. of India from participation in tenders /contracts as on the date of submission of bids, either in theirindividual capacity or in any firm/LPP in which they were/arepartners/ members. Any Concealment /wrong information inregard to above shall make the ineligible or the contract shall bedetermined under clause 62 of the standard general conditionsof contract. (d)Company registered under Companies Act-2013:(i) The copies of MOA (Memorandum of Association) / AOA(Articles of Association) of the company (ii) A copy of Certificateof Incorporation (iii)A copy of Authorization/Power of Attorneyissued by the Company (backed by the resolution of Board ofDirectors) in favour of the individual to sign the tender on behalfof the company and create liability against the company. (e)LLP( Limited Liability Partnership ) registered under LLP Act 2008:(i)A copy of LLP Agreement (ii)A copy of Certificate ofIncorporation (iii)A copy of Power of Attorney/Authorizationissued by the LLP in favour of the individual to sign the tender onbehalf of the LLP and create liability against the LLP. (iv)Anundertaking by all partners of the LLP that they are notblacklisted or debarred by Railways or any other Ministry /Department of the Govt. of India from participation in tenders /contracts as on the date of submission of bids, either in theirindividual capacity or in any firm/LLP or JV in which they were /are partners/members. Concealment / wrong information inregard to above shall make the contract liable for determinationunder Clause 62 of the Standard General Conditions of Contract.(f)Registered Society & Registered Trust: (i)A copy of Certificateof Registration (ii)A copy of Memorandum of Association ofSociety/Trust Deed (iii)A copy of Power of Attorney in favour ofthe individual to sign the tender documents and create liabilityagainst Society/Trust.(iv) A copy of Rules & Regulations of theSociety.

The Tenderer shall submit copy of Bank Mandate Form as per format in tender booklet.

The Tenderer shall submit copy of complete details of the firm including postal address for correspondence, telephone number (mandatory), Mobile number (if any), Email ID (mandatory) and fax number (if any) with the offer.

The Tenderer shall submit copy of Goods and Services tax (GST) Registration Certificate containing GST Registration Number and copy of PAN card.

As per GM office, Vigilance branch/CMST letter no. VIG/EL/2022.03.01 dated 13/05/2022 circulated by PCEE/CSMT/CR office vide letter no EL.CEGE/Conf/22-23 dtd 26.05.2022, "In case a tenderer is participating as Sole Proprietor in a tender, it is mandatory to submit an undertakingof sole proprietorship clearly mentioning PAN number also on stamp paper along with tender documents at the time of submission of tender." Non submission of this document by bidder shall result in summarily rejection of his/her bid.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

In case of other than Company / Proprietary firm, Annexure-V(A) shall be submitted by each member of a Partnership firm / Joint Venture (JV) / Hindu Undivided Family (HUF) /Limited Liability Partnership (LPP) etc, as the case may be as per format given at page no 7 of tender booklet. Non submission of above certificate by the bidder shall result in summarily rejection of his/their bid. Note: 1. For Partnership firm / Hindu Undivided Family (HUF) / Limited Liability Partnership (LLP) etc - Name of constituent partner should be mentioned in point no. 1 of Annexure V(A).

The tender must be accompanied by a bid security as per clause 5, part I of tender booklet, failing Which tender shall be summarily rejected. A bid security shall be deposited either incash through e-payment gateway or submitted as Bank Guarantee bond from a scheduled commercial bank of India or as mentioned in tender documents in favour of Sr.DFM/ Nagpurdivision/Central Railway. The bank Guarantee bond shall be as per Annexure-VI A and shall be valid for a period of 90 days beyond the bid validity period.

The Tenderer shall submit copy of list of the plants & machinery of tenderer available on hand and proposed to be engaged for this tender.

The Railway reserves the right to verify all statements, information and documents submitted by the bidder in his tender offer, and the bidder shall, when so required by the Railway, make available all such information, evidence and documents as may be necessary for such verification. Any suchverification or lack of such verification, by the Railway shall not relieve the bidder of its obligations or liabilities hereunder nor will it affect any rights of the Railway there under.

(a)In case of any information submitted by tenderer is found to be false forged or incorrect at any time during process for evaluation of tenders, it shall lead to forfeiture of the tenderEarnest Money Deposit (If applicable) besides banning of business for a period of upto two years. (b) In case of any information submitted by tenderer is found to be false forged or incorrect after the award of contract, the contract shall be terminated. Bid Security / Earnest Money Deposit (EMD), Performance Guarantee and Security Deposit available with the Railway shall be forfeited. In addition, other dues of the contractor, if any, under this contract shall be forfeited and agency shall be banned for doing business for a period of upto two years.
