The Bidder should have satisfactorily completed similar works involving repair of faulty RMUs and Supply of RMUs for not less than 50% of the Amount Put to Tender in DISCOMs/Govt. Electrical Utilities/PSUs network in preceding 5 (Five) Years (FY 2020-21, 2021-22, 2022-23, 2023-24 & 2024-25) as on the date of Bid Submission.Note: The value of the completed works shall be given a weightage of 10% per year to bring them to the price level of the FY in which the tenders are invited.Scanned copy of the Satisfactory work completion certificate issued by an officer not below the rank of Executive Engineer or equivalent of DISCOMs/Govt. Electrical Utilities/PSUs network shall be uploaded.
The Bidder should have successfully executed the work for 80% of the qty of repair of RMUs and supply of RMUs in any one year of the preceeding 5 (five) years in DISCOMs/Govt. Electrical Utilities/ PSUs network as a prime contractor, as on date of bid submission. (113 Nos. and 6 Nos.) Scanned copy of the satisfactory Work completion certificate indicating the number of RMUs repaired and number of RMUs supplied issued by an officer not below the rank of Executive Engineer or equivalent officer of the concerned DISCOMs/ Govt. Utilities/PSUs network shall be uploaded.
The Bidder should be in existence as any of the following: a) Company incorporated in India under the Companies Act, 1956/2013 including any amendment thereto b) LLP incorporated in India under the Limited Liability Partnership (LLP) Act, 2008 including any amendment thereto c) Partnership Firm under Partnership Act, 1932 in India d) Sole Proprietorship Concern. Documents to be uploaded: a) i. Certificate of Incorporation issued by Registrar of Companies as per Companies Act 1956/2013 along with Memorandum of Association and Articles of Association of the Company.ii. Declaration from Directors of the Company in MBP-1 Form stating that they are not disqualified to be a Director of the Company along with the list of Companies in which they are Directors as on the date of inviting tender (s). b) i. Certification of Incorporation issued by Registrar of Companies as per LLP Act 2008. ii. Limited Liability Partnership Agreement of LLP. c) i. Partnership Deed, GST Registration certificate. ii. Shops & Establishment Registration certificate, as applicable. d) PAN/GST Registration certificate.
The Bidder should possess a valid Super Grade/Class-1 Electrical Contractors License issued by Electrical Inspectorate as on the date of Bid Submission. Scanned copy of Valid Super Grade/Class-1 Electrical Contractors License shall be uploaded.
Bid capacity: Bidder who meets the above specified minimum qualifying criteria, will only be qualified, if their available tender capacity is more than the total tender value. The available tender capacity will be calculated as under: Assessed available tender capacity is equal to (AxNx1.5-B) Where, A is equal to Maximum value of works executed in any one year during the last five years (updated to FY in which tenders are invited), taking into account the completed as well as works in progress. N is equal to Number of years prescribed for completion of the works for which tenders are invited. B is equal to Value, at FY in which tenders are invited price level, of existing commitments and on-going works to be completed during the next 12 months. Scanned copy of the statements showing the value of existing commitments and on-going works as well as the stipulated period of completion remaining for each of the works as per the format prescribed in the Techno-Commercial sheet shall be uploaded. The bidder shall note that the value of pendency of work should be considered based on financial progress achieved in the particular work as on the date of bid submission. The statement should be certified by the Employer in charge, not below the rank of an Executive Engineer or equivalent.
Even though the Bidders meet the above criteria, they are subject to be disqualified if they have: i) made misleading or false representations in the forms, statements and attachments submitted in proof of the qualification requirements. And/or ii) record of poor performance such as abandoning the works, not properly completing the contract, inordinate delays in completion, litigation history, or financial failures etc. and/or iii) Participated in the previous Tender for the same work and had quoted unreasonably high tender prices and could not furnish rational justification. and/or iv) Black-Listed due to non-performance in execution of works by any ESCOMs/Govt. Utilities/PSUs as on date of bid submission. and/or v) Defaulted/short closed due to non-performance in execution of works against the order placed by any ESCOMs/Govt. Utilities/PSUs as on date of bid submission. Scanned copy of the self-declaration in the prescribed format as per Annexure on notarized stamp paper of Rs.500/- shall be uploaded. The self declaration shall clearly indicate the tender enquiry no. and date on which declaration is done.
Litigation History: The Tenderer should provide detailed information on any litigation or arbitration arising out of contracts completed or under execution by it over the preceding five years. A consistent history of awards involving litigation against the Tenderer or any partner may result in rejection of Bid. Scanned copy of the self-declaration on notarized stamp paper of Rs.500/- shall be uploaded.The self declaration shall clearly indicate the tender enquiry no. and date on which declaration is done.
Any Tenderer/ Bidder from a country which shares a land with India will be eligible to bid in this tender only if the Tenderer is registered with the Competent Authority. (As per Government Order No. FD 455 Exp-12/2020 dated 25.08.2020.) Registration certificate issued by the competent authority shall be uploaded.
A certificate for having read the clauses is required to be submitted/uploaded by the tenderer separately in the following format: I have read the clause regarding restrictions on procurement from a Bidder of a country which shares a land border with India. I certify that this Bidder is not from such a country or, if from such a country, has been registered with the Competent Authority. I hereby certify that this Bidder fulfils all requirements in this regard and is eligible to be considered. (Where applicable, evidence of valid registration by the Competent Authority shall be attached.) (As per Government Order No. FD 455 Exp-12/2020 dated 25.08.2020.) The Annual Turnover of the Bidder in at least two financial years should not be less than twice the amount put to tender during preceding five financial years i.e., (2020-21, 2021-22, 2022-23, 2023-24 & 2024-25). Note: Updated to the FY in which the tenders are invited. Financial turnover of previous years shall be given a weight of 10% per year to bring them to the price level of the FY in which the tenders are invited.Audited annual accounts statements such as P&L statement, Balance sheets for the FY 2019-20, 2020-21, 2021-22, 2022-23 & 2023-24 shall be uploaded.
The Liquid Assets as on last day of previous month or at a later date before submission of the bid consisting of Cash at Bank plus Term Deposits plus availability of fund based credit facility in any Nationalized or scheduled commercial Bank shall not be lesser than 25% of the amount put to tender. If the Bidder has banking with more than one Bank, then the available liquid assets balance on a particular date i.e., as on last day of previous month or any date before submission of bids shall be the same date for all the banks. The details shall be supported by a certificate issued by any Nationalized or Scheduled Commercial Bank with whom the Bidder is having banking facilities. In case of Fund based credit facility, the certificate should have the sanctioned limits, funds utilized so far and balance available as on last day of previous month or at a later date, before submission of the bid shall be uploaded.

1 We, the undersigned Bidder, having read and examined in detail the specifications and all the Bidding documents of the said work and hereby proposed for:

2 PRICES AND VALIDITY :
2.1 The price basis are as per the clause 12.0 of ITB.
2.2 The taxes and duties are as per clause 13.0 of ITB.
2.3 We declare that we have noted and considered Clause 13.0 of Section ITB of Bid Document Vol I regarding Taxes and Duties and quoted our Prices accordingly. We further agree for TDS as per Statutory stipulations.
3 CONSTRUCTION OF THE CONTRACT : We, declare that we are making the Offer on the basis of supply and erection contract in accordance with all Clauses of "Instruction to Bidders (ITB)" of Vol I of Bid Document.
4 We having studied clause 13.0 of Section ITB Vol - I, relating to Tax and we hereby, declare that if any income-tax, surcharge on income tax or any other corporate tax is attracted under the law, we agree to pay the same.
5 Bid Security : We have paid a Bid Security as per clause 19.0 of Section ITB Vol - I.

Further, we agree that additional conditions, if any, found in the Proposal Documents other than those stated in Deviation Schedules, save that pertaining to any rebates offered, shall not be given effect to.
7 PERFORMANCE GUARANTEE ; We declare that the ratings and performance figures of the equipment to be supplied and erected by us are guaranteed. The Guaranteed particulas of different equiment in our Scope are enclosed in Volume - III, Data Requirement Sheets.
8 BID PRICING : We further, declare that the Prices stated in our Proposal are in accordance with your 'Instructions to Bidder's Vol.I of the Bid Documents.
9 QUALIFICATION DATA : We confirm having submitted the Qualification Data, as required by you in your 'Instruction to Bidders' included in Volume - I in a separate envelope along with this Proposal. Further we have filled in the information for Qualification Requirements in Schedule 3. In case you require any further information in this regard, We agree to furnish the same in time.
10 CONTRACT PERFORMANCE GUARANTEE ; We further agree that if our Proposal is accepted, we shall provide an irrecoverable Contract Performance Guarantee, of value equivalent to Five percent (5%) of the Contract Price for supply and erection portion separetely, valid up to the end of ninety (90) days after the end of the Contract Guarantee Period in the form of Bank Guarantee in your favour of CGM (Ele.,) Procurement, BESCOM and enter into a formal agreement with you within fifteen (15) days from the date of issue of Letter of Award of Contract.
12 BID PRICING : We further, declare that the Prices stated in our Proposal are in accordance with your 'Instructions to Bidder's Vol.I of the Bid Documents.
13 CHECK LIST : We have included a Checklist duly filled in Schedules.
14 We, hereby, declare that only the Persons or Firms interested in this Proposal are named herein as Principals and that no other Persons are interested in the Proposal or in the Contract to be entered into, if we are awarded the Contract, and that this proposal is made without any connection with any other Person, Firm or Party likewise submitting a Proposal and that this Proposal is in all respect for and in good faith, without collusion or fraud.
