Financial Eligibility Criteria: The tenderer must have minimum average annualcontractual turnover of V/N or 'V' whichever is less; where V= Advertised valueof the tender in crores of Rupees N= Number of years prescribed forcompletion of work for which bids have been invited. The average annualcontractual turnover shall be calculated as an average of "total contractualpayments" in the previous three financial years, as per the audited balancesheet. However, in case balance sheet of the previous year is yet to beprepared/ audited, the audited balance sheet of the fourth previous year shallbe considered for calculating average annual contractual turnover. Thetenderers shall submit requisite information as per Annexure-VIB, along withcopies of Audited Balance Sheets duly certified by the Chartered Accountant/Certificate from Chartered Accountant duly supported by Audited BalanceSheet. The tenderer are advised to submit the Bid Security with the tender for the dueperformance with the stipulation to keep the offer open till such date asspecified in the tender, under the conditions of tender. Note for b(i): Separate completed works ofminimum required values for each component shall also be considered forfulfillment of technical eligibility criteria. (b) (ii) In such cases, What constitutesa component in a composite work shall be clearly pre defined with estimatedtender cost of it, as part of the tender documents without any ambiguity. (b)(iii) To evaluate the technical eligibility of the tenderer, only components ofwork as stipulated in tender documents for evaluation of technical eligibilityshall be considered. The scope of work covered in other remaining componentsshall be either executed by The tenderer himself if he has work experience asmentioned in clause 7 (a) (ii) of Part- II of GCC or through subcontractor fulfillingthe requirements as per clause 7 of Part-II of GCC or jointly i.e., partly himselfand remaining through subcontractor, with prior approval of Chief Engineer inwriting. However, if required in tender documents by way of Special Conditions,a formal agreement duly notarised, legally enforceable in the court of law, shallbe executed by the main contractor with the subcontractor for thecomponent(s) of work proposed to be executed by the subcontractor(s), andshall be submitted along with the offer for considering subletting of that scopeof work towards fulfillment of technical eligibility. In case after the award of thecontract or during the execution of work it becomes necessary for thecontractor to change subcontractor, the same shall be done withsubcontractor(s) fulfilling the requirements as per clause 7 of Part-II of GCC,with prior approval of the chief engineer in writing.
The similar nature of work for this work should be "Supply, installation, testingand commissioning of any LT/HT electrical work". The tenderer should haveexecuted the similar nature of works in Central /State Government departmentor PSUs of Central /State Government." No any credential from any privateorganization will be acceptable.
Tenderer must have to submit valid Electrical Contractor license as per IndianElectricity Rules for the respective category of works issued by GovernmentElectrical License Board on or before closing date of tender. Copy of whichshould be submitted along with the tender offer, otherwise tender will besummarily rejected. Tenderer should also submit letter of confirmation ofemployment of electrical supervisor along with current and valid electricalsupervisor license of the engaged supervisor for the respective category ofworks, otherwise tender would summarily rejected.

The Tender Security shall remain valid for a period of90days beyond the validity period for the Tender. v. The Bank Guarantee shall be placedin an envelope, which shall be sealed. In addition, the Bid Due Dateshould be indicated on the right hand top corner of the envelope. vii.The envelope shall be addressed to the officer and address asmentioned in the tender document. viii. If the envelope is not sealedand marked as instructed above, the Authority assumes noresponsibility for the misplacement or premature opening of thecontents of the Bid submitted and consequent losses, if any, sufferedby the Bidder.
The Tenderer(s) shall keep the offer open for a minimum period of 60days from the date of closing of the Tender. It is understood that thetender documents have been issued to the Tenderer(s) and theTenderer(s), is / are permitted to tender in consideration of thestipulation on his / their part that after submitting his / their tendersubject to the period being extended further, if required by mutualagreement from time to time, he will not resile from his offer or modifythe terms and conditions thereof in a manner not acceptable toRailway. Should the tenderer fail to observe or comply with theforegoing tipulation, the amount deposited or Bank guarantee bondsubmitted as Bid Security for the due performance of the abovestipulation, shall be forfeited to the Railway.
Compliance with the GST Act, 2017 under Clause No.6 of GCC2022(Care In Submission of Tenders :)(a) (i)Before submitting a tender, thetenderer will be deemed to have satisfied himself by actual inspectionof the site and locality of the works, that all conditions liable to beencountered during the execution of the works are taken into accountand that the rates he enters in the tender forms are adequate and allinclusive to accord with the provisions in Clause-37 of the StandardGeneral Conditions of Contract for the completion of works to theentire satisfaction of the Engineer. (a) (ii) Tenderers will examine thevarious provisions of The Central Goods and Services Tax Act,2017(CGST)/ Integrated Goods and Services Tax Act, 2017(IGST)/Union Territory Goods and Services Tax Act, 2017(UTGST)/ respectivestate's State Goods and Services Tax Act (SGST) also, as notified byCentral/State Govt.& as amended from time to time and applicabletaxes before bidding. Tenderers will ensure that full benefit of InputTax Credit (ITC) likely to be availed by them is duly considered whilequoting rates. (a)(iii) The successful tenderer who is liable to beregistered under CGST/IGST/UTGST/SGST Act shall submit GSTIN alongwith other details required under CGST/IGST/UTGST/SGST Act torailway immediately after the award of contract, without which nopayment shall be released to the Contractor. The Contractor shall beresponsible for deposition of applicable GST to the concernedauthority. (a)(iv) In case the successful tenderer is not liable to beregistered under CGST/IGST/UTGST/ SGST Act, the railway shalldeduct the applicable GST from his/their bills under reverse chargemechanism (RCM) and deposit the same to the concerned authority.(b)When work is tendered for by a firm or company, the tender shallbe signed by the individual legally authorized to enter intocommitments on their behalf. (c)The Railway will not be bound by anypower of attorney granted by the tenderer or by changes in thecomposition of the firm made subsequent to the execution of thecontract. It may, however, recognize such power of attorney andchanges after obtaining proper legal advice, the cost of which will bechargeable to the Contractor.
Security Deposit: The Security Deposit shall be 5% of the contractvalue. The Bid Security submitted by the Contractor with his tenderwill be retained/ encashed by the Railways as part of security for thedue and faithful fulfillment of the contract by the Contractor. Providedfurther that, if Contractor submits the Cash or Term Deposit Receiptissued from a Scheduled commercial bank of India or irrevocable BankGuarantee Bond from a Scheduled commercial bank of India, eithertowards the Full Security Depositor the Part Security Deposit equal toor more than Bid Security, the Railway shall return the Bid Security, tothe Contractor. Balance of Security Deposit may be deposited by theContractor in cash or Term Deposit Receipt issued from Scheduledcommercial bank of India or irrevocable Bank Guarantee bond issuedfrom Scheduled commercial bank of India, or may be recovered at therate of 6% of the bill amount till the full Security Deposit is recovered.Provided also that in case of defaulting Contractor, the Railway mayretain any amount due for payment to the Contractor on the pending"on account bills" so that the amounts so retained (including amountguaranteed through Performance Guarantee) may not exceed 10% ofthe total value of the contract. The Irrevocable Bank Guaranteesubmitted towards Security deposit shall be initially valid up to thestipulated date of Maintenance period plus 60 days and shall beextended from time to time, depending upon extension of contractgranted in terms of Clause 17A and 17B of the Standard GeneralConditions of Contract. Note: Security Deposit deposited in cash bythe Contractor or recovered from the running bills of a Contractor orsubmitted by contractor as Term Deposit Receipt(s) can be refunded/returned to the contractor, in lieu of irrevocable Bank Guaranteebond issued from scheduled commercial bank of India, to be submittedby him, for an amount equal to or more than the already availableSecurity Deposit, provided however that, in a contract of value lessthan Rs. 50 Crore, such refund/ return of the already availableSecurity Deposit is permitted up to two times and in a contract ofvalue equal to or more than Rs. 50 Crore, such refund / return of thealready available Security Deposit is permitted up to three times.
Refund of Security Deposit: Security Deposit mentioned in sub clause(1) above shall be returned to the Contractor along with or after, thefollowing: (a)Final Payment of the Contract as per clause 51.(1) and(b) Execution of Final Supplementary Agreement or Certification byEngineer that Railway has No Claim on Contractor and (c)Maintenance Certificate issued, on expiry of the maintenance periodas per clause 50.(1), in case applicable. 16. (2) (ii) Forfeiture ofSecurity Deposit: Whenever the contract is rescinded as a wholeunder clause 62 (1) of these conditions, the Security Deposit alreadywith railways under the contract shall be forfeited. However, in casethe contract is rescinded in part or parts under clause 62 (1) of theseconditions, the Security Deposit shall not be forfeited. 16.(3) Nointerest shall be payable upon the Bid Security and Security Depositor amounts payable to the Contractor under the Contract, butGovernment Securities deposited in terms of Sub Clause 16. (4) (b) ofthis clause will be payable with interest accrued thereon.
Performance Guarantee The procedure for obtaining PerformanceGuarantee is outlined below: (a) The successful bidder shall have tosubmit a Performance Guarantee (PG) within 21 (Twenty one) daysfrom the date of issue of Letter of Acceptance (LOA). Extension of timefor submission of PG beyond 21 (Twenty one) days and upto 60 daysfrom the date of issue of LOA may be given by the Authority who iscompetent to sign the contract agreement. However, a penal interestof 12% per annum shall be charged for the delay beyond 21(Twentyone) days, i.e. from 22ndday after the date of issue of LOA. Further, ifthe 60thday happens to be a declared holiday in the concerned officeof the Railway, submission of PG can be accepted on the next workingday. In all other cases, if the Contractor fails to submit the requisite PGeven after 60 days from the date of issue of LOA, the contract is liableto be terminated. In case contract is terminated railway shall beentitled to forfeit Bid Security and other dues payable to thecontractor against that particular contract, subject to maximum of PGamount. In case a tenderer has not submitted Bid Security on thestrength of their registration as a Startup recognized by Department ofIndustrial Policy and Promotion (DIPP) under Ministry of Commerceand Industry, DIPP shall be informed to this effect. The failedContractor shall be debarred from participating in re-tender for thatwork. (b) The successful bidder shall submit the PerformanceGuarantee (PG) in any of the following forms, amounting to 5% of theoriginal contract value:- (i) A deposit of Cash; (ii) Irrevocable BankGuarantee
(iii) Government Securities including State Loan Bonds at 5% belowthe market value; (iv) Pay Orders and Demand Drafts tendered by anyScheduled commercial Bank of India; (v) Guarantee Bonds executedor Deposits Receipts tendered by any Scheduled Commercial Bank ofIndia; (vi) Deposit in the Post Office Saving Bank; (vii) Deposit in theNational Savings Certificates; (viii) Twelve years National DefenceCertificates; (ix) Ten years Defence Deposits; (x) National DefenceBonds and (xi) Unit Trust Certificates at 5% below market value or atthe face value whichever is less. Also, FDR in favour of FA&CAO (freefrom any encumbrance) may be accepted. (c) The PerformanceGuarantee shall be submitted by the successful bidder after the Letterof Acceptance (LOA) has been issued, but before signing of thecontract agreement. This P.G. shall be initially valid upto thestipulated date of completion plus 60 days beyond that. In case, thetime for completion of work gets extended, the Contractor shall getthe validity of P.G. extended to cover such extended time forcompletion of work plus 60 days. (d) The value of PG to be submittedby the Contractor is based on original contract value and shall notchange due to subsequent variation(s) in the original contract value.(e) The Performance Guarantee (PG) shall be released after physicalcompletion of the work based on 'Completion Certificate' issued by thecompetent authority stating that the Contractor has completed thework in all respects satisfactorily. (f) Whenever the contract isrescinded, the Performance Guarantee already submitted for thecontract shall be encashed. (g) The Engineer shall not make a claimunder the Performance Guarantee except for amounts to which thePresident of India is entitled under the contract (not withstandingand/or without prejudice to any other provisions in the contractagreement) in the event of: (i) Failure by the Contractor to extend thevalidity of the Performance Guarantee as described herein above, inwhich event the Engineer may claim the full amount of thePerformance Guarantee. (ii) Failure by the Contractor to pay Presidentof India any amount due, either as agreed by the Contractor ordetermined under any of the Clauses/Conditions of the Agreement,within 30 days of the service of notice to this effect by Engineer. (iii)The Contract being determined or rescinded under clause 62 of theseconditions
Force Majeure Clause: If at any time, during the continuance of thiscontract, the performance in whole or in part by either party of anyobligation under this contract shall be prevented or delayed by reasonof any war, hostility, acts of public enemy, civil commotion, sabotage,serious loss or damage by fire, explosions, epidemics/pandemics,strikes, lockouts or acts of God (hereinafter, referred to events)provided, notice of the happening of any such event is given by eitherparty to the other within 30 days from the date of occurrence thereof,neither party shall by reason of such event, be entitled to terminatethis contract nor shall either party have any claim for damagesagainst the other in respect of such non-performance or delay inperformance, and works under the contract shall be resumed as soonas practicable after such event has come to an end or ceased to exist,and the decision of the Engineer as to whether the works have been soresumed or 50 shall be final and conclusive, PROVIDED FURTHER thatif the performance in whole or in part of any obligation under thiscontract is prevented or delayed by reason of any such event for aperiod exceeding 120 days, either party may at its option terminatethe contract by giving notice to the other party.
The new tax structure shall be applicable as per the provisions of theGST Act, implemented with effect from 01.07.2017, along with anysubsequent amendments issued thereafter.
