Special Eligibility Criteria

   Concrete Sleeper Plant should be RDSO certified for undertaking production of PSC Main Line sleepers for IR. For this purpose, the plants, which were given orders for supply of mainline sleepers against Railway Board?s previous contracts CS-169/2016 and CS-172/2018, will be considered RDSO certified. All other plants will have to upload RDSO certification along with their tender.

   1. As per Board letter No. 2004/RS(G)/779/11/pt. Dt.23.12.19, the Earnest Money will be @2% of the estimated value of the tender subject to Max. Rs. 20 lakh (estimated value of tender above Rs. 25 lakh and upto Rs. 50 cr.). There shall be no exemption from submission of EMD by any tenderer except exemptions as mentioned in Rly BD letter dtd. 23.12.19. Tenderers are required to upload scanned copies of necessary documents in support of their claim for EMD exemption 2. EMD should remain valid for a period of 45 days beyond the final offer validity period, EMD (without any interest) will be refunded to the successful tenderers on receipt of security mony. EMD (without any interest) will also be refunded to unsuccessful tenderers after finalization of tenders, offer without Earnest Money shall be summarily rejected, if not under valid exemptions 3. Tenderers intending to supply PSC sleepers line sleepers from their existing RDSO certificate/approved sleeper plants, can submit their tenders without Earnest Money. The tenderer should upload either of the following documentary evidence in support of their claim: ( i ) Latest letter of RDSO indicating approval/ provisional approval of layout plan of CSP. ( ii ) Latest Oversight Inspection Report of RDSO for the CSP.

   Minimum Quoted quantity by a tenderer for a plant should not be less than 50% of RDSO certified targeted production capacity for period of two years under considerations i.e. minimum quantity to be quoted by a tenderer should not be less than or equal to 2 x 0.5 x 12 x monthly certified production capacity by R D S O . Offers quoting for less than specified minimum quantity or tendered quantity (whichever is lower) as cited in Para- 6.4 of SCOC will be summarily rejected.

   Firm should not be blacklisted/suspended for business by IR/PUS as such tenderers have to submit the requisite/valid certification by RDSO along with certifying production capacity, the reckoning on the date of opening of tenders. Year wise supply performance of CSP in last 5 years indicating closure and rejection details if any has to be submitted by the tenderer.

   Any increase in quantity beyond (+) 30% shall only be with the mutual consent of the supplier and purchaser. ln case of default by any other contractor in the form of shortfall in supplies by defaulting CSP/s, Railway, at its sole discretion may cancel the quantity of defaulting CSP/s and may approve commensurate increase in the contract quantity of performing CSPs (i.e. those performing satisfactorily in contract) at price, terms and conditions of the initial orders during the currency of the contract This clause shall be operated with the concurrence of associate finance. This increase would be in addition to 30% quantity referred to in clause 5.1 and would be limited to further 30% of the ordered quantity.

   Statutory Variation Clause:- Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/Central Governments in respect of the items stipulated in the contract ( and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railway? account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tender has clearly indicted in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/contractor.
