Special Eligibility Criteria

   Bulk/Developmental quantity of the tendered item is restricted to be procured from approved sources of RCF for RCF Item ID 2400048, Sub item id 2400048001 only. Clause No. 2.5 of IBD (V- 3.0) of ECR attached herewith may be referred to for details. Note: It is the responsibility of the tenderers to upload copies of such approval letters along with their offers.

   In keeping with the Public Procurement (Preference to Make in India) Order, 2017 as amended, it has been found that there is sufficient local capacity and competition in supply of the tendered item of required quality and therefore public procurement of the item is restricted to class I local suppliers only and the vendors who do not qualify to be class I local supplies should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a class I local supplier for the tendered item participates in the tender it does so at their own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor. The minimum local content for the local supplier of the above item, to be categorized as Class-I local suppliers shall be 50%.

   If the tenderer himself is not the manufacturer of the item offered by him, he/she must be duly authorized by the manufacturer of such item. Such tenderers must enclose with their offer a certificate of Tender Specific authorization from the manufacturer, to participate in the tender.

   In case of procurement for a value in excess of Rs. 10 crore, the local supplier shall be required to provide a certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing cost accountant or practicing chartered account (in respect of suppliers other than companies) giving the percentage of local content. (Refer para 29.2 (b) of IBD (V- 3.0) of ECR for more details).

   Price Variation clause : The quoted basic price of the battery is based on HZL's price of lead (min. 99.99%) of ex-Chanderiya smelter per MT (exclusive of all statutory duties & taxes and also without referring any discounts offered by M/s HZL's circular) with base date as on 1st working day of the month, one month prior to the date of opening of tender. The Basic price will vary for every increase/decrease of Rs.100/MT(exclusive of all statutory duties & taxes) and part thereof, the price of the battery quoted will be subject to a corresponding increase/decrease of Rs.34.20 per battery set (exclusive of all statutory duties & taxes) in the event of variation in lead price as declared by M/s. HZL . The price of the lead prevailing one month prior to the date of offering the material for inspections will be considered for computing PVC and incase of consignee inspection, HZL prices prevailing 30 days prior to the date of billing will be considered for computing the PVC.Further for the purpose of aforesaid PVC, the basic price of lead ex Chanderia smelter shall be taken into account without referring to any discounts mentioned in the HZL circular. Note:-The offer of the firm quoting fixed price OR different PVC formula as mentioned above will be summarily rejected. Clause 21.0 of IBD(V-3.0) of ECR attached herewith may be referred for details.

   MSEs, who are interested in availing benefits under MSME Act, will enclose with their offer a copy of valid Udyam Registration Certificate only. MSE benefits will not be admissible based on any other document. However, traders dealers will not be eligible for such benefits. (Refer para 3.0 of IBD (V- 3.0) of ECR).

   Bidders should confirm following certificate for Compliance (a) I have read the clause No. 32 of IBD (V- 3.0) Instructions to tenderers and general conditions of tenders for supply contract attached with the tender regarding restrictions on procurement from a bidder of a country which shares a land border with India and on sub-contracting to contractors from such countries. (b) I certify that this bidder is not from such a country and will not subcontract any work to a contractor from such countries unless such contractor is registered with the Competent Authority. I also certify that this bidder will not offer any products/services of entity from such countries unless such entity is registered with the Competent Authority. (c) I hereby certify that this bidder fulfills all requirements in this regard and is eligible to be considered. (d) I hereby acknowledge that in the event of acceptance of my bid on above certificate and if the certificate is found to be false at any stage, the false certificate would be a ground for immediate termination of contract and further legal action in accordance with the Law.    Packing instruction: -Packing as per standard packing or as specified in the specification of the Item. It should be ensured that item should not rub during transportation: The item should be packed with adequate strength. Transit damage if any shall be at the cost of supplier.

   GST DECLARATION:-"We hereby declare that in quoting the above price, we have taken into account the full effect of input tax credit available under GST. We, further agree to pass on any financial gain/benefit as may become available in future in respect of all the input tax credit on the date of supply by way of reduction in price and advise the purchaser accordingly". We also undertake that we are aware of the provisions of section 171 of the CGST act and consequences thereof if we fail to comply with the same.
