Special Eligibility Criteria

   THE RAILWAYS RESERVES THE RIGHT TO PROCURE THE BLUK/FULL QUANTITY FROM RCF APPROVED SOURCES [ RCF Item ID: 2400073- 002 ONLY FOR SUCH ORDERING . IN CASE OF AUTHORIZED DEALERS, FIRM HAS TO UPLOADED TENDER SPECIFIC AUTHORIZATION ALONG WITH THEIR OFFER,OTHERWISE THEIR OFFER WILL BE LIABLE TO BE REJECTED.THE STATUS OF FIRM SHALL BE RECKONED AS ON THE DATE OF TENDER OPENING AND NOT THEREAFTER, UNLESS A CASE OF DOWNGRADING/ REMOVAL/ SUSPENSION/ BANNING.CLAUSE NO. 16.3 OF EASTERN RAILWAY GTC IS APPLICABLE.

   New Make in India w.e.t (02.05.25) In terms of Railway Boards letter No. 2020/RS/(G)/779/2/PT.1(E3322671) Dated: 20.08.2024 and in keeping with the Public Procurement (Preference in Make India) order, 2017 as amended time to time, it has been found that there is sufficient Local Capacity and competition in supply in the tendered item of required quality and therefore public procurement of this tendered item is restricted to Class I local supplier only (Class I local supplier means a supplier having local content to or more than 50%). The vendors who do not qualify to be Class I local suppliers should not quote in the tender as their offer shall not be considered for any ordering. In case any vendor who does not qualify to be a Class I local supplier for the tendered item participates in the tender it does so at its own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor.

   Since the estimated value of tender exceeds Rs. 10 crore, the local suppliers are required to provide a certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing cost accountant or practicing chartered account (in respect of suppliers other than companies) giving the percentage of local content. The necessary certificate of local content must be signed with UDIN duly indicating brief description of tendered item. (Clause 28 under section-2 of ER GTC regarding Public Procurement Policy for Preference to Make in India may be referred).

   Delivery schedule indicated in the Tender schedule is tentative and may vary as per the requirement of Railway at the time of finalisation of tender/release of purchase order. However, offers with large variations from tendered delivery schedule may be ignored or considered for restricted order quantity.

   In terms of DPIIT/Ministry of Commerce and Industries order no. P-45021/2/2017 PP (BE II) dated 16.09.2020 which is circulated vide Rly Board letter no 2020/RS (G)/779/2/Pt. 1 dated 25.09.2020 and Keeping in view with the public procurement (Preference to Make in India) order 2017 as amended time to time, only class 1 and class 2 local suppliers are eligible to participate in this tender.    Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

   This is a Reverse Auction and two packet tender. All documents uploaded and remarks /confirmation entered by the bidders against any eligibility condition shall be opened as part of technical bid only.

   EMD & S D Money shall be applicable as per para No. 8.0 & 9.0 of GTC of Eastern Railway.

   In case of authorised dealers, firm has to upload tender specific authorisation along with their offer, otherwise their offer will be liable to be rejected.

   firm willing to avail benefit of micro and small enterprises, must submit documentary evidence of being micro or small enterprises for tendered item in the certificate issued by nodal agencies as per public procurement policy, failing which firm's status will be treated as Non-MSE firm.

   The offer shall be evaluated based on the GST rate as quoted by each bidder and same will be used for determining the inter se ranking. while submitting offer,it shall be the responsibility of the bidder to ensure that they quoted correct GST rate and HSN number.

   Whether the successful bidder invoices the goods at GST rate or HSN number which is different from that incorporated in the purchase order, payment shall be made as per GST rate which is lower of the GST rate incorporated in the purchase order or billed.

   Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate if quoted by the bidder.

    Any amendment to GST rate or HSN number in the correct shall be as per the contractual conditions and statutory amendments in the quoted GST rate and HSN number, under SVC
