(1) Firm should ensure to quote as per Specification mentioned description. (2) The firm will clearly mention deviation, if any in any parameter in technical deviation statement. The deviation mentioned elsewhere in uploaded document, will not be considered, unless it is detailed in Tech. deviation Statement. In Case No deviation is quoted, it is responsibility of firm to supply as per tech. specification of tender.
ONUS OF SUBMISSION OF REQUISITE DOCUMENTS: The onus of submission of requisite documents as given above for establishing their eligibility for bulk or developmental order lies with the tenderer. Tenderers are to note that non submission of the documents as detailed above shall be taken as they are not having any such documents. In such case their offer shall be considered based on their past supply performance as available from Railway's internal digital platform iMMS. No back reference in this regard will be made to them.
Tenderers with satisfactory past performance within 03 years (minimum 50%) for the same/similar item and work to any of the Zonal Railways/PUs shall only be eligible. Tenderers are instructed to upload Receipt Note, Receipt Challan, Inspection Certificate or any other receipt document along with bid as a proof of supply document failing which their offer will not be considered. No reference after opening of tender will be considered in this regard and Railway decision will be final.
Tenderer other than manufacturer or OEM must enclose/attach authorization certificate of manufacturer or OEM along with their offer, offer without authorization certificate of manufacturer or OEM will be summarily rejected. This can is uploaded as an attachment to the offer. OEM authorization certificate with registered trademark. Supplier should submit delivery challan of OEM or of authorized dealer only with test certificate and warranty certificate issued from OEM at the time of supply.

Jurisdiction of Court :- As per Para 2703 of IRS Condition of Contract the Courts of the place from where the acceptance of tender has been issued shall alone have jurisdiction to decide any dispute arising out of or in respect of the contract.
Offers with longer delivery period with respect to the delivery period/schedule in the tender conditions liable be ignored in the interest of the Railways.
