   Railway reserves the right to procure the material only from Proven Sources having satisfactory past performance for supplying the tendered item .Tenderers should upload documents pertaining to their credential / past performance in Zonal Railway/PUs/Other Govt./ Private Railway siding i.e. copy of joint commissioning certificate etc. of the tendered item in support of the same. If firm failed to upload/attach the said documents then their offer will not be considered as a valid offer and summarily be ignored. No back reference on either side will be made or entertained in this regard.

   Tenderers should upload valid Prototype Approval documents issued by RDSO for the offered design of High Capacity Dead End Energy Absorption Buffer Stop (STR No. RDSO/2016/CG-Rev-01, Nov 2024). Offers without prototype approval will be summarily rejected. Prototype approval should cover design, simulation, and dynamic testing as per RDSO guidelines. In case of TOT/MoU arrangements, prototype approval should be in the name of the OEM, and the bidder should submit documentary evidence of valid tie-up.

   The procurement of the item is restricted to Class I /Class II local suppliers only and the vendors who do not qualify to be Class I /Class II local suppliers should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a Class I /Class II local supplier for the tendered item and participates in the tender it does so a at their own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor. Requirement of a vendor to be a Class I /Class II local supplier for the this item, shall be a mandatory condition in addition to other qualifying eligibility criteria/conditions. Please refer para 29.0 of GCC attached to tender for details.

   Reciprocity Clause: Bidders may please note that- Entities of countries which have been identified by the Nodal Ministry/Department as not allowing Indian companies to participate in their Government procurement for any item related to that Ministry/ Department shall not be allowed to participate in Government from in India for all items related to that nodal Ministry/Department, except for the list of items published by the Ministry/Department permitting their participation. The term entity of a country shall have the same meaning as in the FDI policy of DPIIT as amended from time to time.

   Bidder are reminded to carefully go through IRS conditions of contract (included and uploaded along with the bid document) particularly those pertaining to Code of Integrity, Misdemeanor and penal measures. If two or more bidders are found to be sister concerns or affiliates (having common partner/director/promoter/owner/holding company decision control, etc.) the offers of all such sister concerns are liable to be rejected as per relevant provisions of IRS terms and condition.

   MSE sources, for availing benefits under MSME Act, should upload valid documents maintained under MSME Act such as NSIC Certificate etc. duly marking the tendered item in the certificate . Otherwise, claim for benefits under MSME Act may not be entertained.

   MSE sources owned by SC/ST, should upload necessary documents to get the benefits being owned by SC/ST. Otherwise, claim for benefits under MSME Act may not be entertained.

   Time is the essence of contract. As time is the essence of contract, the tenderers are to note the Railway s required delivery schedule given in the tender schedule and quote accordingly. Vague delivery period or a very high delivery period compared to Railways specific delivery period in the tender schedule may be considered commercially unresponsive and is liable to be ignored.
