SPECIAL CONDITIONS OF TENDER

BPCL BAITALPUR DEPOT:-

1. Completion time of this work is 12 months from the date of LOI.

Site Restriction: The entire works are to be carried out in BPCL BAITALPUR

Depot, DEORIA. The contractor will have to follow the timings of BPCL and must

work under restricted conditions & as per availability at the site. The normal

working hour of site is 09.00 Hrs to 17.00 Hrs on Monday to Saturday except

holidays. Working beyond above normal working hours / holidays / Sundays are to

be with prior permission of Engineer in Charge and relevant location officers.

Contractor is required to plan his work within the normal working hours & days

and accordingly he must mobilize the resources to complete the job within the

scheduled time. However, all efforts will be made by BPCL to give extended

working time beyond normal working time of 9.00 to 17.00 hrs to help the

contractor for early completion of the work. No additional payment / charges shall

be payable for such works. Not getting permission for working on holidays /

Sundays or beyond normal working hours will not be considered as reason for

delay in work/extra payment. The contractor and his personnel must obey all rules

and regulations of the plant. Trained and experienced supervisors / engineers are

required to be present at the work spot always. The tenderer must visit the sites

and familiarize him with location, operating /working conditions as well as any

other local factors which could influence the working before quoting for the job.

His quote should take care of any such restrictions; conditions etc and any claim

afterwards will not be entertained. The contractor shall confirm himself fully of the

conditions under which the work is to be executed and shall satisfy himself of all

existing local working conditions, limitations, Central Govt., State Govt. and local

body rules and regulations etc. complete. Vendor shall confirm himself fully of the

conditions under which the work is to be executed and shall satisfy himself of all

2. Billing: Billing will be done as per joint measurement done by Engineer in Charge

and Vendor. Running account bill shall be raised preferably monthly or on

mutually agreed period. However, running account bills are to be preferably for a

minimum value of 25% for contract value in case of Contract Value less than

Lakhs and 10 % of contract value in case of Contract value more than 50 Lakhs

except for Pre-final and final bills. However, Engineer in charge may release

payment at any stage/ for any value considering the work requirement The

payment will be released by Electronic Fund transfer to Vendor’s bank Account

after necessary deductions like Retention Amount , Income Tax ,WCT etc and

other statutory deductions as applicable and as per GCC.

3. Payment terms shall be as per Standard Payment terms of BPCL.

4. Other conditions:

I. Adherence to fulfillment of the conditions relevant to the Job as stipulated in latest

editions of OISD 192 (SAFETY PRACTICES DURING CONSTRUCTION), OISD

GDN – 105(WORK PERMIT SYSTEM) , OISD 207 (CONTRACTOR SAFETY ) by

the contractor. The conditions have though been elaborated in the General

Conditions of Tender, however the conditions of above referred OISD std. will

supersede in case of any inadequacy.

 Contractor shall compulsorily impart training as per OISD 154 to all its

employees to be deployed at site before start of job

 Confined space entry should have valid permit.

 Job safety plan should be prepared by contractor & approved by BPCL.

 Contractor supervisor should be selected who possesses job knowledge and

ii. The party should provide all workmen with necessary boiler suit, yellow color

safety helmets, safety harnesses, safety shoes and other standard safety

equipments irrespective of nature of job. Provision of necessary safety

equipments for working at height shall be in vendor’s scope of work. No extra

payment shall be made for this. Any delay on account of nonadherence to safety

norms, rules and regulations of plant as well as obtaining work permits from the

plant shall not be accounted for the delay in completion of job.

iii. Electricity, potable water required for construction must be arranged by the vendor

at his own cost. Also, water storage arrangement shall be made by vendor at

BPCL designated place only.

iv. Vendor should comply with all rules and regulations as per EPF/ESIC, minimum

wages act, workmens compensation act, Labour laws (Central) and other statutory

regulations etc. complete as applicable. He should produce and submit necessary

documents as proof of compliance.

v. All the parts like the tender schedule, Technical Specification, Special Conditions

of Tender, General Conditions of tender etc are to be read together and shall be

supplementary to each other. In case of any contradiction between provision of

GCC and SCC, provisions in SCC shall overrule that in GCC only to the extent of

contradiction. Similarly in case of any contradiction between provisions in

Technical specification and SCC, provisions in SCC will overrule that in Technical

Specification only to the extent of contradiction. SCC and Technical specification

are supplementary to Schedule. Hence in case of any contradiction to schedule,

the same has to be brought to the notice of Engineer in Charge and his decision

shall be final and will be binding on vendor. No claim will be entertained on account

of any such changes.

vii. Engineer –in-charge shall have right to take possession of or use any completed or

partially completed work or part of work. Such possession or use shall not be

deemed to be an acceptance of any work completed in accordance with the

Contract Agreement.

viii. Site clearance- Vendor has to clear all unwanted materials, equipments etc to be

cleared off immediately from site. He is required to get necessary clearance for

Engineer in charge of ‘having cleared the site satisfactorily’ before submission of

5. Receipt & storage of material at Site: Vendor is required to make his own

arrangement for unloading and storage of materials at site. Vendor is required

to inform BPCL prior to dispatch of materials and his representative is required to

be available for receipt and unloading of materials at site. Security / safety &

safekeeping of material, supplied by vendor, will remain sole responsibility of

vendor till entire completed facility is handed over to BPCL by vendor.

6. Contractors Scope of Supply of Materials: Contractor shall supply at their cost

all materials required for completing the job as per schedule of quantity and

specifications and conditions. All materials supplied by contractor shall be as per

the relevant IS code / mfg. Recommendation, BPCL standard and as advised by

the Engineer in Charge. Technical specification of items to be supplied by

contractor need to be attached with the offer.

7. QC & QAP: All materials are to be as per specification and as directed by

Engineer in charge. Necessary tests are to be carried out and recorded as per the

approved QAP and shall be available at site at all times for inspection. The rates

offered shall be inclusive of charges for all such tests.

8. The successful vendor has to arrange and submit to plant the proper POLICE

VERIFICATION DOCUMENTS of all the labors, site in charges, supervisors,

welders, grinders, civil workmen and all associated workmen who will be coming

inside the installation for carrying out related jobs. Delay because of

noncompliance of police verification shall be accounted on the part of vendor.

9. For carrying out the jobs inside the plant the vendor has to arrange for electricity

(sufficient nos. of acoustic DG sets only along with their valid fitness certificate),

working water, associated tools, tackles, manpower, machinery of his own and no

extra payment will be made to vendor on account of the same.

10. For arranging the electricity, vendor to note that only Acoustic Proof, box type DG

sets will be allowed inside the plant premises. Vendor to also note that proper GI

plate type earthing system as per IS 3043 (LATEST) must be provided by the

vendor for DG set and no extra payment will be done for the same. There should

be two nos. earthing system connected in a grid at a location as instructed by

BPCL site in-charge

11. All the scrap, cut pieces, pipeline etc coming out of work area cleaning will have to

be shifted by the vendor to a location inside or outside the plant premises as per

the instruction of BPCL site in-charge and no extra payment will be done for the
