OHE Modification works over Firozpur division against deposit funds through NHAI Projects (i)- Construction of ROB at KM 10/2 between LKK-JME on JUC-NKO section, (ii)- Construction of ROB at KM 10/5-6 between KUPR-BLND on JRC-HSX section, (iii)- Construction of ROB at KM 10/11-15 between AWL-SCPD on JUC-PTK section and (iv)- Construction of ROB at Road KM Chainage 0.000 to KM 43.319 against NR project ID No. NR-FZR-0055

The tenderers must submit the copy of valid Electrical License along with their offer. Offer shall rejected be summarily, if tenderer does not have valid Electrical License on the name of an individual / Proprietor / Partner / firm issued by the State / Central government.

I/we hereby declare that I/we have downloaded the tender documents from Indian Railway website www.ireps.gov.in . I/we have verified the content of the document from the website and there is no addition, no deletion or no alteration to the content of the tender document. In case of any discrepancy noticed at any stage i.e. evaluation of tenders, execution of work or final payment of the contract, the master copy available with the railway Administration shall be final and binding upon me/us.

I/we declare and certify that I/we have not made any misleading or false representation in the forms, statements and attachments in proof of the qualification requirements.

I/We also understand that my/our offer will be evaluated based on the documents/credentials submitted along with the offer and same shall be binding upon me/us.

I/We declare that the information and documents submitted along with the tender by me/us are correct and I/we are fully responsible for the correctness of the information and documents, submitted by us.

I/we certify that I/we the tenderer(s) is/are not blacklisted or debarred by Railways or any other Ministry / Department of Govt. of India from participation in tender on the date of submission of bids, either in individual capacity or as a HUF/ member of the partnership firm/LLP/JV/Society/Trust.

I/we understand that if the contents of the certificate submitted by us are found to be forged/false at any time during process for evaluation of tenders, it shall lead to forfeiture of the Bid Security and may also lead to any other action provided in the contract including banning of business for a period of upto two year. Further, I/we and all my/our constituents understand that my/our offer shall be summarily rejected.

I/we also understand that if the contents of the certificate submitted by us are found to be false/forged at any time after the award of the contract, it will lead to termination of the contract, along with forfeiture of Bid Security/Security Deposit and Performance guarantee and may also lead to any other action provided in the contract including banning of business for a period of upto two year.

Bid Security: Tenderer (s) may please note that offers received without Bid Security either in cash through e-payment gateway or as Bank Guarantee bond from a scheduled commercial bank of India or as mentioned in tender documents (as per Annexure- 21) valid for a period of 90 days beyond the bid validity period, will be considered as incomplete & invalid offer and for which contractor shall have no claim on Railway. Following documents shall be submitted by Tenderer in support of Constitution of Firm: (A)SOLE PROPRIETOR SHIP FIRM: (i)Undertaking that he is not blacklisted/debarred by Rlys/other Ministry/Deptt of Govt of India from participation in tender on date of bid opening, either in individual capacity or as a member of partnership firm or JV in which he was/is a partner/member. Concealment/wrong information in regard to above shall make contract liable for determination under Clause62 of GCC. (B)HUF: a. Copy of notarized affidavit on Stamp Paper declaring that he who is submitting tender on behalf of HUF is in position of Karta of Hindu Undivided Family (HUF) and he has the authority, power and consent given by other members to act on behalf of HUF. b. Undertaking that HUF is not blacklisted or debarred by Rlys/any other Ministry/Deptt of Govt of India, either in individual capacity or as a member of partnership firm or JV in which HUF was/is a partner/member. (C)PARTNERSHIP FIRM: (i)Notarized copy of partnership deed. (ii)Notarized or registered copy of Power of Attorney in favor of the individual to tender for the work, sign agreement etc and create liability against firm. (iii)Undertaking by all partners of partnership firm that they are not black listed/debarred by Rlys/any other Ministry/Deptt of Govt of India from participation in tenders/contracts as on date of bid opening, either in their individual capacity or in any firm in which they were/are partners. (D)JOINT VENTURE (JV): APPLICABLE ONLY FOR WORKS COSTING > Rs.10 Cr (Not applicable for this tender). (E)Company registered under Companies Act-2013: Tenderer must submit/upload tender along with following documents: (i)Copies of MOA (Memorandum of Association)/AOA (Articles of Association). (ii)Copy of Certificate of Incorporation (iii)Copy of Authorization/Power of Attorney issued by Company (backed by Resolution of Board of Directors) in favor of the individual to sign tender on behalf of company and create liability against Company. (iv)Undertaking that Company is not blacklisted/debarred by Rlys/any other Ministry/Deptt of Govt of India from participation in tender on the date of opening of bids, either in individual capacity or as a member of partnership firm or JV in which Company was/is a partner/member. (F)LLP (Limited Liability Partnership) Firm under LLP Act-2008: Tenderer shall submit along with tender: (i)Copy of LLP Agreement (ii)Copy of Certificate of Incorporation (iii)Copy of Power of Attorney/Authorization issued by LLP in favor of individual to sign tender on behalf of LLP and create liability against LLP. (iv)Undertaking that LLP is not blacklisted/debarred by Rlys/any other Ministry/Deptt of Govt of India from participation in tender on the date of bid opening, either in individual capacity or as a member of JV in which LLP was/is a member. (G)Registered Society & Registered Trust: Tenderer shall submit: (i)Copy of Certificate of Registration. (ii)copy of Deed of Formation. (iii)Copy of Power of Attorney in favor of individual to sign tender documents and create liability against Society/Trust. (iv)copy of Rules & Regulations of Society. Note: Offers received without proper Power of Attorney shall be considered in-completed and rejected summarily.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

The tenderer shall study the Indian Railway General Conditions of Contract Regulations for Tenders & Contracts (GCC)- April'2022 or latest along with tender documents before submission of the tender.

The tenderer shall submit all the requisite documents alongwith tender offer. Tender offer without these documents shall not be considered. "No post tender correspondence for submission of additional documents shall be entertained after opening of the Technical & Commercial offers. Even suo-moto post tender letters of the tenders shall be treated as NULL & Void".To assist in the examination, evaluation and comparison of offers received, the Railway may at their discretion, ask any Tenderer for clarification on attached document with their Tender. The request for clarification and the response shall be in writing or by FAX but no change in the price or substance of the Tender shall be sought, offered or permitted. In case no credentials enclosed or statement to that effect is mentioned, the identity of working contractor of division shall be taken as fresh.

Period of Completion : The entire work is required to be completed in all respect within specified period from the date of issue of the letter of acceptance. The contractor shall maintained steady and regular progress to the satisfaction of the Sr.DEE/TRD/FZR or his authorized representative and to ensure that the work will be completed in all respect within the stipulated time, failing which action may be taken by the Railway Administration in terms of clause 17 and clause 62 of the General Conditions of contract (GCC)- April'2022 or latest.

Non-compliance with any of the conditions set forth therein above is liable to result in the tender being rejected. NOTE: (i) Copy of GCC of April'2022 is uploaded with NIT as ready reference of Tenderers. (ii) The offers received without proper Power of Attorney shall be considered in-completed and rejected summarily.

The rates quoted by the bidder are to be inclusive of all charges and all taxes levied by the Union of India, State Government and Local Bodies etc., from time to time including Surcharge except GST. However, GST @ 18% shall be paid extra as per Schedule- 04 on all items of Schedule-01, 02 & 03.

Night working : Though normally no work is carried out in night i.e., from sun set to sun rise the progress of the work if not coming up to the time schedule laid down in clause above the Engineer-in-charge can order for night working by the contractor and the contractor shall make all arrangements for adequate lighting and safety precautions etc., for night working.

Contractors will have to upload details of their LOAs, engaged workmen, wage payment details, PF/ESI details, bonus details etc, on website www.shramikkalyan.indianrailways.gov.in on monthly basis. (Railway Board's letter No. 2018/CE-I/CT/4 dated 17.10.2018)

Guarantee : The tenderer shall guarantee the equipments/installations for satisfactory performance for a period of 12 months or mentioned in special condition / technical specifications or as mentioned by the manufacturer, which ever in higher from the date of commissioning against any defect. The contractor should promptly attend complaint and replace/repair the defective equipments/parts free of cost promptly and satisfactorily. The equipments/parts so replaced by the contractor, shall be further guaranteed for a period of 12 months or mentioned in special condition / technical specifications or as mentioned by the manufacturer for satisfactory service from the date of such replacement.

The tenderers shall keep their offer open for 60 days (Sixty days).

The Performance Guarantee (PG) shall be released after physical completion of the work based on 'Completion Certificate' issued by the competent authority stating that the contractor has complete the work in all respects satisfactorily. The Security Deposit shall also be released based on 'Completion Certificate' issued by Consignee / Engineer In- charge of the work to the contractor, submission of authentic documents that firm has paid GST as applicable by the extant rule and on completion of guarantee / warrantee period of ONE Year or as stipulated in Tender Documents.

Ambiguous and incomplete (i.e. not filling the rates or controversial rates and not attaching all the required documents) offer may be summarily rejected.

Any typographical error shall not be construed to be benefit of the contractor; in such cases the interpretation and decision of Sr. DEE/TRD/FZR shall be final and binding upon the tenderer.

Contractors are allowed to make payments against this tender towards tender document cost and earnest money only through only payment modes available ON IREPS portal LIKE net banking, debit card, credit card etc Manual payments through Demand draft, Banker cheque, Deposit receipts, FDR etc are not allowed.
