IRGCC 2022 TENDER FORM SECOND SHEET & ACS 1 CLAUSE 10.1 1.Technical Eligibility Criteria: (As Per IRGCC Clause 10.1) (a)The tenderer must have successfully completed or substantially completed any one of the following categories of work(s) during last 07 (seven) years, ending last day of month previous to the one in which tender is invited: 1Three similar works each costing not less than the amount equal to 30% of advertised value of the tender OR 2Two similar works each costing not less than the amount equal to 40% of advertised value of the tender OR 3One similar work costing not less than the amount equal to 60% of advertised value of the tender Note for Item 10.1: Work experience certificate from private individual shall not be considered. However, in addition to work experience certificates issued by any Govt. Organisation, work experience certificate issued by Public listed company having average annual turnover of Rs 500 crore and above in last 3 financial years excluding the current financial year, listed on National Stock Exchange or Bombay Stock Exchange, incorporated/registered at least 5 years prior to the date of closing of tender, shall also be considered provided the work experience certificate has been issued by a person authorized by the Public listed company to issue such certificates. Tender will be governed as per latest standard Indian Railways General Conditions of Contract, works 2022 and their all correction slips. Tenderer are requested to read the latest IR GCC works 2022 and their all correction slips before submission of their offer and must be submit the all Annexures, documentary evidences, data as mentioned in IRGCC Works 2022 and their all correction slips.
All the documents in support of the Minimum Eligibility Criteria including Letter of Acceptance/Work Order, Documents showing the nature and total value of work, Completion report, Audited balance sheet, Attested certificate from Government employer, Copy of I.T. return etc. should be submitted along with the bid. Railway reserves the right to make or not to make any further reference to the tenderer regarding the fulfillment of the Minimum Eligibility Criteria and to award the tender only on the basis of the documents submitted by the tenderer along with the bid. The tenderer will not have any claim on this account.
Rights of the Railway to deal with Tender: The authority for the acceptance of the tender will rest with the Railway. It shall not be obligatory on the said authority to accept the lowest tender or any other tender, and tenderer(s) shall neither demand any explanation for the cause of rejection of his/ their tender nor the Railway to assign reasons for declining to consider or reject any particular tender or tenders. If the tenderer(s) deliberately gives / give wrong information in his / their tender or creates / create circumstances for the acceptance of his / their tender, the Railway reserves the right to reject such tender at any stage.

1.As per Railway Boards letter no. 94/CE-I/4 Pt.17 dated: 13.08.2012, for all work contract valuing more than Rs.10 Crore, "two Packet System" of tendering mandatorily be followed. 2.As per Railway Boards letter no. 2002/CE-I/CT/37 JV Pt.VIII dated: 14.12.2012, "JOINT VENTURE FIRMS" shall now be applicable to the works tenders of value More than Rs. 10 Crores. 3.This is highly technical work to be executed only by qualifying MEC stipulated in tender document as per IR GCC 2022 with similar work issued vide CSTE office letter no. WCR/N- HQ/150/Wks/Policy/14 dated: 03.08.2018. No any relaxation in MEC will be given for any consideration. Firm failing to satisfy the MEC will be treated as ineligible firm. (IF MEC APPLICABLE) 4.In terms of railway board's letter no. 2020/CE- I/CT/3E/GCC/Policy dated: 30.12.2020, If the bidder is banned for submission of bids on the date of closing of tender, such bid, even if received, shall be treated as invalid while evaluating the bids. 5.Change of inspection authority may be done by engineer- incharge at a later date. 6.In case of more than one valid & eligible L-1 bidders, tender may be awarded to tenderer having higher bid capacity. In case bid capacity is also the same, tenderer having done more value of similar work in last three previous financial years and current financial years up to the date of the opening of the tender, may be selected for the award. Instructions with respect to bid capacity will follow. Supporting document for this may be clearly uploaded by tenderer with their offer. 7.The provisions contained in railways circulars, JPO's regarding penalties will be applicable for works requiring digging. 8.As per railway boards letter no. 2017/CE- I/CT/9 dated: 31.05.2023 "for all contracts costing more than Rs.5 crore, Contractor's e-MB is mandatory and contractor's e- MB should be part of Tender Document. All other provisions of railway boards letter no. 2017/CE-I/CT/9 dated: 31.05.2023 will be followed. (If applicable)

WCR/N-HQ/110/JPO Corrsp/Sig.-99 dated: 08.01.2024 instructed vide GM (S&T) JBP letter no. JBP/N.H.Q.120/Policy/T-1/Part-V dated: 10.01.2024 and procedure for undertaking digging work in the vicinity of signalling, electrical and telecommunication cables issued by railway board vid eno.2021/Tele/5(2)/3-Part(1)(3425647) dated 12.06.2023 or any other latest JPO by railways will be applicable in this contract
It is responsibility of the contractor during execution the work near the track, that all safety precautions will be taken like; Safety Jacket, wearing of Safety Shoes and Helmet to avoid any type of causality.

RATES: The rates (if accepted) quoted by the bidder will be inclusive of all taxes & duties, GST livable by state/central government/local government. COMPLIANCE OF LABOUR LAWS & REGISTRATION: Contractor should comply with the latest applicable labour laws. You will be advised to contact Regional Labor Commissioner, Jabalpur for necessary action. Contractor is to abide by the provisions of Payment of Wages ACT & Minimum Wages ACT and all other Labour provisions as per IRGCC Works and all its Advance correction slips
SHRAMIK KALYAN. : You will be advised to register yourself on Railway Board website www.shramikkalyan.indianrailways.gov.in & upload the required information regarding the awarded tenders to bidders by this office.
ENGINEER INCHARGE: Sr. Divisional Signal & Telecom Engineer/Co. /JBP will be the Engineer in-charge of the work
FINANCE OFFICER: Sr. Divisional Finance Manager / Jabalpur will be the Associate Finance Officer
CONSIGNEE: Consignee depot as mentioned in tender documents attached herewith or as nominated by Engineer In- charge will be Consignee depot for supply materials. Sectional SSE In-charge of the respective station or as nominated by engineer in charge will be site supervisor for the execution of the work. Measurement of execution of work will be certified by sectional SSE/SIG duly endorsed by respective ADSTE's and measurement will be recorded in MB by Consignee depot as mentioned in tender documents attached herewith. Sectional ADSTE will be Field Engineer for the execution work of respective section.
TEST CHECK: 20% check shall be certified by the officer as mentioned in tender documents in Measurement Book.
SUBSTITUTE: The Engineer-in-charge of the work may substitute these officers/supervisors at a later date as per Railway requirement.

IRGCC works 2022, Part-I, clause 7 i.e. 7. "Right of Railway to Deal with Tenders: The Railway reserves the right of not to invite tenders for any of Railway work or works or to invite open or limited tenders and when tenders are called to accept a tender in whole or in part or reject any tender or all tenders without assigning reasons for any such action. In case if tender is accepted in part by Railway administration, Letter of Acceptance shall be issued as counter offer to the Tenderer, which shall be subject to acceptance by the Tenderer. However, performance guarantee, security deposit and other financial transactions in the tender will be as per total contract value evaluated by e- tender module of IREPS and no any relaxation on performance guarantee, security deposit and other financial transactions will be given on account of banning of any/some items for procurement in this tender.
