Other offers will not be considered. (2) Dealer/RDSO approved/developmental vendors should enclose latest valid tender specific authorization letter from OEM of the above mentioned Makes along with offer.Otherwise, offer of the firms will be summarily rejected.

   (a) Bulk Order: Bulk order will be placed on the manufacturer or its authorized agent having proven performance. The manufacturer firm must have satisfactorily executed at least of 10 percent of total tendered quantity up to date of tender opening against one single purchase order of Zonal Railways/ PUs/CORE for the tendered item, placed during three preceding completed financial year and%A0current financial year up to date of tender opening. (b)The onus of submission of requisite documents in support of supply {[i] Receipt Notes/Proof of acceptance of material by consignee OR [ii] Inspection Certificate with self declaration by the bidder that supply has been accepted by consignee. Furnishing of false declaration shall render termination of contract and further action as per terms and conditions of contract} lies with the tenderer. In case the tenderers do not submit the requisite documents as detailed above along with their offer, the tender will be decided on the basis of their past supply performance of Southern Railway, if any. The decision of Railway in this regard shall be final and binding on the bidder. (c) In case tenderer participates as an authorized agent, then the performance as required above shall be that of Principal authorizing the agent. It may so happen that the agent has credentials of past supply for a different Principal but this will not be considered as performance for placing bulk order in case of change of Principal. "Capacity-cum-Capability" for Developmental order: For consideration of developmental orders up to 20% of NPQ, the tenderers must be able to demonstrate their Capacity-cum- Capability to manufacture the tendered item. For this purpose they should submit along with their offer, documented past performance reports of same item of equivalent rating or equivalent performance parameters, details of M&P, testing facilities, QAP (if available), technical manpower available with them, registration for same item with other Government agencies or PSUs etc. or any other details as may be warranted as per the technical specification and drawing. Such tenderers are to note that non- submission of such documents shall be taken as their not having any such past performance and/or capacity, and their offer shall be considered further as per extant rules and no back reference in this regard will be made to them.

   i) In case of road delivery, the date of delivery at destination (Consignees end) shall only be treated as delivery date irrespective of F.O.R./F.O.T. condition mentioned elsewhere in the contract/tender. (ii) The bidder confirms that rates and other financial terms quoted in relevant columns of financial bid will only be ruling terms for acceptance, and such terms i) In case of road delivery, the date of delivery at destination (Consignees end) shall only be treated as delivery date quoted anywhere else should be ignored. (iii) (a) Regarding MSE purchase preference firms, please refer clause 15.0 part B of Southern Railway tender conditions available under the link Public Documents- >Stores/Supply. (b) Goods and service Tax: Please refer part A Para 14.0 of Southern Railway tender conditions available under the link Public Document -> Stores/Supply. (d) Tenderers are advised to refer instructions to tenders (Part A) and Tender conditions (Part B) for other terms and conditions available under the link Public Document -> Stores/Supply.

   Please enter the percentage of local content in the material being offered. Kindly enter 0 (Zero ) for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions. For PUBLIC PROCUREMENT POLICY (Preference to Make in India ), please refer Para 16.0 Part B of Southern Railway Tender Conditions available under the mentioned link. Procurement of the item is restricted to Local suppliers with minimum local content of 20% (Class-I or Class-II Local supplier as defined in Railway Board letter no: No.2020/RS(G)/779/2/Pt.1 dated 25.09.2020) only and the vendors who do not qualify to be "Local suppliers" (i.e., "Non-Local suppliers" with local content less than 20%) should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a "Local supplier" for the tendered item participates in the tender, it does so at it's own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor

   Tenderers shall confirm the following declaration failing which the offer will be ignored. " I have read the clause regarding restrictions on procurement from a bidder of a country which shares a land border with India. I certify that this bidder is not from such a country or, if from such country, has been registered with the Competent Authority. I hereby certify that this bidder fulfills all requirements in this regard and is eligible to be considered. Where applicable, evidence of valid registration by the Competent Authority shall be attached."

   (i) EARNEST MONEY DEPOSIT (EMD) : EMD shall be deposited by all vendors for tenders with estimated value above Rs.25 Lakhs subject to the applicable exemptions. For the exemptions and other details please refer Para 2.0 Part A of Southern Railway Tender conditions. (ii) In case of submission of Earnest Money Deposit in the form of Bank Guarantee, please refer Annexure- 6 of Part - B of Southern Railway Tender conditions. SECURITY DEPOSIT (SD) shall be 5 % of total value of contract and shall be taken from all vendors for contract value above Rs. 25 Lakh subject to the applicable exemptions. For details please refer 10.0 Part A of Southern Railway Tender Conditions. In case of submission of security Deposit in the form of Bank Guarantee, please refer Annexure - 5 of Southern Railway Tender conditions.
