Enactment of GST Act, Board (ME) as per clause 6 of IndianRailways Standard General Conditions of contract, April'2022 ismentioned below:-

Before submission a tender, the tenderer will be deemed tohave satisfied himself by actual inspection of the site andlocality of the works, that all conditions liable to be encounteredduring the execution of the works are taken into account andthat the rates he enters in the tender forms are adequate and allinclusive to accord with the provisions in clause-37 of theStandard General Conditions of Contract for the completion ofworks to the entire satisfaction of the Engineer.

Tenderers will examine the various provisions of the centralGoods and Services Tax Act. 2017 (CGST) / Integrated Goodsand Services Tax act. 2017(IGST) / Union territory Goods andServices Tax Act.2017(UTGST)/ respective state's State Goodsand Services Tax Act(SGST) also,as notified by Central/StateGovt & as amended from time to time and applicable taxesbefore bidding. Tenderers will ensure that full benefit of InputTax Credit (ITC) likely to be availed by them is duly consideredwhile quoting rates.

The successful tenderer who is liable to be registered underCGST/IGST/UTGST/SGST Act shall submit GSTIN along with otherdetails required under CGST/IGST/UTGST/SGST Act to railwayimmediately after the award of contract, without which nopayment shall be released to the Contractor. The contractorshall be responsible for deposition of applicable GST to theconcerned authority.

In case the successful tenderer is not liable to be registeredunder CGST/IGST/UTGST/SGST act, the railway shall deduct theapplicable GST from his / their bills under reveres chargemechanism (RCM) and deposit the same to the concernedauthority. (a) When work is tendered for by a firm or company,the tender shall be signed by the individual legally authorized toenter into commitments on their behalf. (b) The Railway will notbe bound by any power of attorney granted by the tenderer orby changes in the composition of the firm made subsequent tothe execution of the contract. It may , however, recognize suchpower of attorney and changes after obtaining proper legaladvice, the cost of which will be chargeable to the contractor.

The Earnest Money : There is only one mode for submssion ofEMD i.e on-line submission. Necessary document (EMD receipt,where applicable) to be submitted while submitting the tender.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

This tender is governed by Standard General Condition of Contract -2022 & various letters issued by Railway Board withlatest amendments and Special Conditions of Contract. Howeverwherever the terms of Standard General Condition of Contract 2022 contradicts the Special terms & Conditions of Contract oftender document, in such case Special Condition of Contract willprevail. Tenderer must go through General Conditions ofContract (available at www.indianrailways.gov.in) and SpecialConditions of Contract before quoting the rates.

The intending tenderer is advised to study the tender paperscarefully and also acquaint himself with the nature of work andthe matters pertaining there to. Submission of tender shall bedeemed to have done after careful study and examination oftender papers with full understanding of implications thereof.

The tenderers whose tender is accepted shall be required toappear at the office of the Sr.DME/RNC,S.E.Railway in person (orif a Firm or Corporation a duly authorized representative) shallso appear and to execute the contract documents within sevendays of the call issued by Engineer. Failure to do so shallconstitute a breach of the agreement effected by theacceptance of the tender in which case the full value of theearnest money accompanying the tender shall stand forfeited bythe Railway without prejudice to any other rights or remedies.

In the event of any tenderer whose tender is accepted shallrefuses to execute the contract documents as herein beforeprovided, the Railway may determine that such tenderer hasabandoned the contract and there upon his tender and theacceptance thereof shall be treated as cancelled and theRailway shall be entitled to forfeit the full amount to earnestmoney and to recover the damages for such default.

If the tenderer(s) deliberately give/gives wrong information inhis/their tender or create/creates circumstances for theacceptance of his/their tender, the Railway reserves the right toreject such tender at any stage.

If the date of opening happens to be a BANDH or Holiday or Natural calamities, the tender will be opened at the same time on the following working day.

The tenderer(s) must keep themselves updated through thewebsite www.ireps.gov.in regarding corrigenda, if any, to theNotice Inviting Tender along with tender documents, which shallbe uploaded in the same website.

Performance Guarantee: Successful bidder has to submitperformance guarantee as per clause 16(4) of Part-II of GeneralCondition of Contract for Works (April-2022) or latest.

Security Deposit: Successful bidder has to submit Security Deposit as per clause 16(1) of Part-II of General Condition of Contract for Works (April-2022) or latest

The tender is under single packet system.

Details of Bid Security:- Bid security amount to be deposited bythe bidders as per clause no 5 of Part- I of General Condition ofContract for Works (April-2022) or latest.

Tenderer must upload the scan copy of all documents relating toTender compliance along with the offer.
