The contractor should adhere to the accepted execution plan submitted by him under any circumstances without linking to the pending payment of the work & also Land acquisition problems if any.

Typographical errors, if any, will not be the ground for any claims by the Contractor.

The necessary Certificates / documents in support of eligibility criteria fulfilled as stipulated shall be scanned and attached to e- tender document. The original certificate / documents shall be produced for verification when demanded, otherwise the tender will be treated as non responsive bid and rejected.

As per the Karnataka Building and other Constructions Workers Welfare Cess Act 1996, 1% of the bill amount will be deducted from the bills.

Restrictions on Public Procurement from Bidders of certain countries as per Government order No. FD 455 Exp-12 2020 Bengaluru dated:25-08-2020.

During the execution of works, if any minor minerals are required, contractors have to abide by the prevailing rules and Acts applicable to Minor Minerals. As per the prevailing rules, for any use of Minor Minerals, the contractor has to submit the mineral Dispatch Permit (MDP) obtained from Mines and Geology Department. If mineral Dispatch permit (MDP) is not submitted by the contractor along with the bill, the prevailing penalty DMF contribution as per Karnataka Minor Mineral Concession Rules 1994 (as amended from time to time) will be deducted from the contractors bill.

The agencies participating in the tender shall be registered in the Construction Labor Board as per the G.O. No. LD 300 LET 2006 Dated:18-1-2007 and Addendum No. LD 95 LET 2013 Bengaluru Dt:1-4-2013. Also the contractors entrusted with the work shall employ the labors only who have registered in the Karnataka Building and Construction Workers Welfare Board failing which the contractor shall be liable for any further action as deem fit by the authority.

Within 20 days of receipt of the Letter of Acceptance, the successful Tenderer shall deliver to the Employer a Security deposit in any of the forms as mentioned in bid document for an amount equivalent to 5% of the Contract price plus additional security for unbalanced tenders in accordance with Clause 25.5 of ITT and Clause 44 of the Conditions of Contract for all works.

The Bidder shall quote Rates Without GST for either materials or works Contract (Service).All other duties (Including recovered from the contractor bill), taxes, and other levies payable by the contractor under the contract or for any other cause shall be included in the Total Tender Price submitted by the Tenderer.

The contractor has to make his own arrangements for procurement of all the required materials and the materials so procured shall confirm to the relevant IS Specifications and obtain necessary quality certificate from authorized quality control

The Contractor is fully responsible for the Equipment / Material until the same is handed over to the EXECUTIVE ENGINEER in an operating condition after commissioning. The Contractor is responsible for the proper maintenance of equipment / material as well as protection of the same against theft, elements of nature, damages etc., while in his custody as well as after erection until the same is taken over by the EXECUTIVE ENGINEER under due acknowledgment in writin

The tenderer shall also disclose if there are any bankruptcy proceedings against him.

The Work Done Certificates shall be issued by the Executive Engineer with indent number mentioned (if work done in Karnataka State), otherwise it shall be issued/counter signed by Superintending Engineer (if the work is done in other states).

Sub-Leasing/G.P.A of Work is Prohibited.

Each Item Of BOQ To be read as with all lead and lifts and including loading and unloading charges and all other charges and as per the direction of Engineer in charge.

Uploaded drawings are for TENDER PURPOSE ONLY.

The statements showing the value of existing commitments and on-going works as well as the stipulated period of completion remaining for each of the work listed should be countersigned by the Employer in charge, not below the rank of an Executive Engineer or equivalent.

Income Tax : Latest copy of the Income Tax Clearance Certificate and Sale Tax Clearance PAN and TAN Nos. to be uploaded.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee into the respective receiving bank accounts of KPPP Portal on or before the last date and time of bid submission.

The tender processing charges paid by the bidder/ firm/ company are not refundable even if the tenders are cancelled.

All other terms and conditions as per KW-3 tender documents.

Technical Criteria

General

Minimum financial turnover (civil engineering construction works) not less than two times the annual payments from this contract (Rs. xxxxx Lakhs)

Satisfactoriy completed (atleast 90%) as prime contractor at-least one such similar work of value not less than Rs. xxxxxxx (80% of estimated cost of tender)

Executed in any one year the following minimum quantities of work (Cement Concrete - xxxx cum, Earthwork - xxxx cum, etc) (80% of peak rate of construction)

Tenderer or his identified Sub Contractor should possess valid Electrical License for executing building electrificatio works and should have executed similar electrical works totallng Rs. xxxxxx (not less than 50% of electrical works) n any one year

Tenderer or his identified Sub Contractor should possess valid license for executing water supply / sanitary engineering works and should have executed similar works totallng Rs. xxxxxx (not less than 50% of electrical works) n any one year

Owning the following key and critical equipment for this work (xxxx, xxxx, xxxx)

Liquid assets and /or availability of credit facilities of no less than Rs. xxxxxx Lakhs (estimated cash flow for 3 months of peak construction period)

Total value of civl engineering works executed and payments received in the last five years (year-wise)
