Liquidated Damages : Railway will recover from the contractor as agreed liquidated damages and not by way of penalty, A sum equivalent to 0.5% ( Half percent ) of the price of any stores( including elements of Taxes, duties,freight etc.) which the contractor has failed to deliver within the period fixed for delivery in the contract or as extended for each week or part of a week during which the delivery of such stores may be in arrears where delivery thereof is accepted after expiry of the aforesaid period,subject to a maximum of 10% ( TEN PERCENT) of value of delayed supplied and same will not be waived off except in cases where delay is on account of RCF. Note: - (THIS IS AAPPLICABLE FOR TENDERS OPENED AFTER 31-MAR-2019)

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.
