In terms of clause as per Para 2.4.3 of Instructions to Tenderers for Electronic tenders Rev 1.21 of April 2024 regarding Restrictions on procurement from a bidders of a country which shares a land border with India, I, hereby confirm that I have read the clause regarding restrictions on procurement from a bidder of a country which shares a land border with India and I certify that I am not from such a country.
No Exemption for EMD will be given to firms except to those firms as mentioned in the Instruction to tenderers 1.21 of April, 2024. If the firms, other than those exempted, fail to submit EMD along with the offer, their offer will be summarily rejected.
Security deposit (SD) Performance Security for stores contracts will be applicable as para 12.0 of Instruction to tenderers 1.21 of April, 2024.
The tenderers in their bids shall indicate the details of their jurisdictional assessing officers (Designation, address & email ID). Also tenderers are required to furnish the correct HSN code for the offered item along with their bid.
In case of third party inspection being applicable as per estimated value of the tender , tenderers must upload a letter from OEM on OEM's letter head giving address of manufacturers premises where inspection shall be done otherwise the offer will be liable to be ignored. This may be combined with letter of authorization itself.
Tenderer to note that the consignee may consists of more than one consignee at that location. The stores to be delivered to each of them directly. The complete address and quantities to be delivered to each of the consignee in that location will be given in the Purchase Order. Railways reserves the right for change of locations, however change of location may be made by Railways for locations as per site conditions. Any change of location shall be intimated to the Contractor sufficiently in advance and before the approval of GAD.
Loading and unloading of the Transformer with good packing condition should be done by supplier at consignees location.
Each tenderer should clearly specify essential technical and commercial parameters in a transparent manner. No deviation to such Essential Technical & Commercial conditions shall be permitted to the vendors in the electronic bid form. Offers with deviations in respect of any condition for responsiveness of offer shall be declared as Ineligible for award of contract.
The bidder shall indicate in the offer, the facilities available with the bidder or local agent for providing the required after sales service during warranty and post warranty periods. The bidder will also mention service organizations located in India and the availability of trained staff and maintenance spares, etc.
In cases of Contracts/ POs for a value in excess of Rs. 10 cores, the contractor shall be required to provide a certificate from the statutory auditor or cost auditor of the company (in the case of companies) or form a practicing cost accountant or practicing chartered accountant (in respect of suppliers other than companies) giving the percentage of local content. Such certificates shall be required to be submitted by the contractor along with their each online bill in IREPS. The supplier must nclude PO number & PO date, name of item, name of firm, local content percentage, and details of the location(s) at which the local value addition is made, in the certificate. In case the contractor/supplier does not meet the stipulated local content requirement and the category of the supplier changes from Class-I to Class-II/Non-local or from Class- II to Non-local, a penalty in the form of deduction of 10% of the contract value shall be imposed. For severable contractor in case of part supply, a penalty in the form of deduction of 10% of the value shall be imposed commensurate to that lot only. This penalty of 10% on the contract value will be over and above the liquidated damages & other deductions/penalties if any applicable in the contract. However, contract once awarded shall not be terminated on this account.

Inspection of the item will be govern by the special condition of Third Party Inspection ( TPI). Special Condition of TPI is attached with the NIT.
Warranty Clause: - 1. The firm shall ensure that systems supplied including all parts, components etc. used are free from defects and faults in design, material and workmanship and shall be of the highest quality and in conformity with the contract specifications. 2. The warranty of the transformers shall be for 30 months from the date of the delivery or 24 months from the date of placement in service. 3. The firm, on its own, shall supply and keep sufficient spare parts required to maintain and keep the system operational during the warranty period to minimize system downtime. 4. The firm shall provide at his own expenses the services of competent service engineers during the warranty period as and when required. Response time for attending the machine in case of failure shall be 24 Hours. The machine shall be attended by the service engineer within 24 Hours of communication of failure. 5. Maximum down time during the warranty period will be 5 days calculated on quarterly basis. 6. A penalty of Rs 1500 /- per day would be imposed for a down time of more than 5 days per Quarter as well as for a response time for more than 24 Hours for each case under break-down. 7. Maximum penalty to be levied on account of warranty failure will be 10% (Ten Percent) of the value of the machine calculated during whole of warantee period and after that if there is any delay on the part of supplier, the consignee shall be entitled for encashment of WG bonds. The decision of the consignee regarding performance of the contractor shall be final and binding in this regard. 8. The firm shall ensure that all Preventive Maintenance Schedules as per OEM must be carried out during Warranty Period
Delivery of Material, Installation and commissioning to be done as per location given in description of Transformer.
1-It shall be the responsibility of the bidder to ensure that they quote correct GST rate and HSN number. 2- Purchase shall not be responsible for any misclassifcation of HSN code or incorrect GST rate.
Mode of Despatch :By Road on freight prepaid by supplier an door delivery basis upto destination.
Two nos. transformer will be supplied of coaching/freight handling terminal / Bijwasan and Two nos. transformer will be supplied at Sarojini Nagar.
Standing Indemnity bond : Bidder will accept FORM - A ( standing indemnity bond ) with sign and stamp.
Corresponding level as per BIS amended up to date of receipt of tender.
