Bulk procurement, at-least 80 percent of the procurable quantity, will be covered invariably on the past proven suppliers. The tenderer must have supplied the same item to N.F. Rly or other zonal Railways and documentary evidence of the performance must be furnished along with their offer. (a) The tenderer with past performance of satisfactory execution of contracts for supply of the same item for a quantity of 20% or more of tender quantity against a single contract. The period to be reckoned to consider the above performance will be current financial year upto the tender opening date of the tender under consideration and preceding 3 financial years. Credential (Receipt Note and /or inspection certificate)must be uploaded along with the offer for the same item otherwise the offer is liable to be ignored. (b) If such past performance level is lower then the offer may be considered as responsive to N.F. Railways requirement for placement of developmental order not exceeding to 20% of the net procurable quantity. (c) The tenderer who have no past performance as above may also be considered for such developmental order, but for consideration of such offers, tenderer must submit the- details of M&P, testing facility, QAP and ISO 9000 / 14000 / 18000 certificates if available, technical manpower available with them or NSIC registration certificate for same item along with their offer.
Any firm quoting on behalf of OEM must submit valid & tender specific authorization certificate from their OEM along with their offer and agree for inspection by the nominated agency (as the case may be) at the premises of their principal, failing which their offer is liable to be rejected.
T h i s tender complies with Public Procurement Policy (Preference to Make in India) Order No P- 45021/2/2017-PP (BE-II) 2019 dated 16/09/2020 of Ministry of Commerce. Under this policy it is found that there is sufficient local capacity and competition in supply of the tendered item towards required quality hence procurement of this item will be restricted to Class I local suppliers only ( i.e. having local content equal to or more than 50%) and the vendors who do not qualify to be Class I local suppliers should not quote in this tender as their offer shall not be considered for any ordering. In case any vendor who does not qualify to be Class I local supplier for this tendered item participates in the tender it does so at its own Risk and Cost and Railways shall not be liable for any loss or damage caused to the vendor.
Delivery at single point is not acceptable. In case tenderer quote for delivery of entire tendered quantity to one consignee against Railways present requirement of delivery to multiple consignees, such offer shall be considered valid only for quantity required as per tender schedule by the consignee to whom delivery is offered by the tenderer and it shall be considered that there is no offer for the remaining consignees.
Time is the essence of contract. As time is the essence of contract, the bidder is to note that the deliver y schedule given in the bid document and quote accordingly. Vague delivery period i.e. 2-28 weeks, 3-8 months etc. or a very high delivery period compared to Railways specific delivery period in bid document ma y be considered commercially unresponsive and offer is liable to be ignored.
The tenderers shall submit a copy of certificate stating that all their statements/documents submitted along with bid are true and factual. Standard format of certificate to be submitted by the bidder is enclosed as Annexure-I. In addition to Annexure- I, in case of other than Company/Proprietary firm, Annexure%u2013I(A) shall also be submitted by each member of a Partnership Firm/Joint Venture (JV: if permitted to participate in the tender)/Hindu Undivided Family (HUF)/Limited Liability Partnership (LLP) etc. as the case may be. Non-submission of above certificate by the bidder shall result in summarily rejection of his/their bid. It shall be mandatorily incumbent upon the tenderer to identify, state, and submit the supporting documents duly self-attested/digitally signed by which they/he is qualifying the Qualifying Criteria mentioned in the Tender Document. It will not be obligatory on the part of Tender Committee/Accepting Authority to scrutinize beyond the submitted document of tenderer as far as his qualification for the tender is concerned. The bidder shall be mandated to submit Annexure-I. Wherever applicable Annexure I(A) shall also be submitted by the bidder.

Bidders to sign the following : Bid securing declaration to be signed by bidders availing exemption from submission of E.M.D. I/we certify that my/our offer is eligible for exemption from submission of bid security /Earnest Money Deposit, in terms of the tender conditions. In case my/our claim to exemption from submission of bid security /Earnest Money Deposit is not found valid as terms of the tender, I/we understand and accept that Railways has unquestionable right to summarily reject my bid and my offer shall not be considered for o r d e r i n g . Further, I/we hereby understand and accept that if I/we withdraw or modify my/our bids during the period of validity, or if I/we are awarded the contract and on being called upon to submit the performance security/ Security Deposit, fail to submit the performance security/Security Deposit before the deadline defined in the request for bid document/Notice Inviting Tender, I/we shall be debarred from exemption of submitting Bid Security/Earnest Money Deposit and performance security/ Security Deposit for a period of 6(six) months, from the date I/we are declared disqualified from exemption from submission of EMD/SD, for all tenders for procurement of goods issued by any unit of Indian Railways published during this period.
