In case of no offer is received for the tendered item from registered vendors of railway board, Railway reserves the right to consider the offers of unregistered vendors. Such unregistered tenderer must submit supply proof for having supplied the tendered item to any railway hospitals/ Govt. hospitals by way of attaching receipted challan/ consignee receipt note/ receipt note/CRAC etc. If no supply proof is attached their offer will not be considered and summarily rejected.

Mode of dispatch: By road on door delivery basis.
Firm must indicate the HSN code and GST number of their firm. Purchaser will not be responsible for any misclassification of HSN number or incorrect GST rate quoted by firm .The offer shall be evaluated based on the GST rate as quoted by firm and same will be used to determining the interse ranking. The vendor shall be responsible for quoting correct HSN code and GST rate
Land Border Clause- All the bidders are advised to submit certificate of compliance for sharingland border with India as per the clause 32 and proforma at annexure- 8 of the tender GCCattached. Note:Authorised agents/dealers to submit the certificate duly signed by OEM and authorized by the dealer both or they can submit two separate certificates of compliance.
Sharing of Land Border with India Clause: Bidders are requested to go through Clause No. 32.0(32.1 to 32.6) of SER Instruction to Tenderers and General Conditions. Bidders should confirmfollowing certificate for Compliance. (a) I have read the clause Sr. No. 32 of Instructions to tenderers and general conditions of tenders for supply contract attached with the tender regarding restrictions on procurement from a bidder of a country which shares a land border with India and on subcontracting to contractors from such countries. (b) I certify that this bidder is not from such a country and will not subcontract any work to a contractor from suchcountries unless such contractor is registered with the Competent Authority. I also certify that this bidder will not offer any products/services of entity from such countries unless such entity is registered with the Competent Authority. (c) I hereby certify that this bidder fulfils all requirements in this regard and is eligible to be considered. (d) I hereby acknowledge that inthe event of acceptance of my bid on above certificate and if the certificate is found to be falseat any stage, the false certificate would be a ground for immediate termination of contract andfurther legal action in accordance with the Law. (Bidders confirming this certificate for Compliance shall select Yes in the Complied column. However in case you do not confirmabove certificate for Compliance, select NO in complied column. In such cases you are requiredto submit the certificate for Compliance as per Part B of Annexure-8 Instructions to tenderers and general conditions of tenders for supply contract along with their Bid/Offer.)

MRP and Brand Name of the offered Drug/Medicine must be mentioned in the bid and scanned copy of package indicating the same must be enclosed.
In case the delivery period offered by firm is given in range value, then the upper value of range will be considered as delivery period. For example if delivery period is quoted as 4 to 5months, then delivery period offered by the firm will be taken as 5 months.
Any contents or part of contents offered by tenderer in remarks column for which provision is there at pre-nominated place in offer form may not be considered by the purchaser. In case of any conflict normally the offer at prenominated place will prevail notwithstanding the discretion of purchase to consider otherwise and any claim by tenderer will not be entertained later on.
In case of any conflict regarding inspection clause, delivery period, eligibility criteria, special condition etc mentioned on e-offer form with those appearing in the documents attached with tender, then the contents of e-offer will prevail.

I/We hereby certify that no other concerns or affiliates (such as having common partner/director/promoter/owner/holding company / management control etc.) have participated in this tender which give rise to a conflict of interest or fall under anti-competitive practices. We understand that the offers of all such related concerns including ours are liable to berejected as per relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of Integrity in general, with specific reference to conflict of interest [Para 2502 (e)], anti competitive practices [Para 2502(c)] and obligation to proactive disclosures [Para2503]. I/We understand that we are fully responsible for the above declaration and it shall not be the Railway's responsibility to verify the same. I/We are aware that we shall be liable for all consequences of violation of Code of Integrity, if detected at any stage.
Payment Terms: No deviation from the Payment Terms stipulated in the tender is permitted.
Unloading of material: Unloading will be arranged by the firm at the consignee end at his ownrisk and cost. No deviation from Unloading of material stipulated in the tender is permitted
