Preferably manufacturers should participate. Participating traders/agents must provide authorization letter issued by the OEM.Authorization letter should preferably be tender specific. In case of general authorization letter, it must clear lyindicate the validity period/expiry date.Offers with general authorization letter silent on validity period/expiry date will not be considered for placement of order and that offer is liable to be ignored. Bidders must submit authorization letter along with their offer failing which the offer is liable to be ignored.
For placement of bulk quantity order [Minimum 80%], The OEM [Principal Firm] shall have supply performance of at least one single purchase order of any Zonal Railway/PUs/Core for the tendered item for a minimum of 20 percent of the tendered quantity during previous 3years. This period of 3 years shall be counted with respect to date of tender closing. Firms should submit documentary evidence certifying proof of execution of PO, such as scanned copies of Purchase Order along with copy of I/C s and R/Notes with the offer. Failure to submit necessary documentary evidence will imply that firm has no such performance and the offer is liable to be ignored.
Railway reserves the right to place order for up to 20 percent of Net Procurement Quantity as developmental order in deserving cases. If considered essential, placement of development orders can also be considered on deserving firms whose rates are higher than the rates available from firms eligible for bulk quantity order. Total developmental order quantity shall be limited up to 20% of Net Procurement Quantity in regular tender
Bidders must attach only relevant and limited documents required to be submitted as per the above eligibility criteria. Submission of any irrelevant PO, I/C & R-NOTE copies and any other un- related documents which has no relevance to the above eligibility criteria may lead to rejection of the offer. No claim/representation of the bidder shall be admissible in such cases

Vendors claiming to avail benefits and preferential treatment extended to be Micro and Small Enterprises [MSEs] must necessarily upload Udyam Registration Certificate with their offerm in terms of Clause 4.0 of Section II of IMPORTANT TERMS and CONDITIONS OF TENDER (Updated) JANUARY 2024. The vendors/bidders who fail to submit UDYAM registration certificate number shall not be able to avail the benefits available to MSE.
LAND BOARDER : All bidders shall confirm declaration as below in terms of Clause 5.15 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated) JANUARY 2024 in compliance of restrictions under Rule 144(xi) of GFR- 2017:- a) I have read the clause regarding restrictions on procurement from a bidder of country which shares a land border with India. b) I certify that this bidder is not from such a country or, if from such a country, has- been registered with the competent authority. c) I hereby certify that this bidder fulfils all requirements in this regard and is eligible to be considered. (Where applicable, evidence of valid registration by the competent authority is attached). If the bidder fails to give such declaration, as above, then it will be presumed that the contents of above declaration have been read and unconditionally agreed and accepted by the tenderer. If any tenderer is not agreeable to this declaration they have to categorically mention about the disagreement in Techno- Commercial Deviation.
Bidders to submit details of location(s) where local value addition is made. In case no details are furnished, it will be presumed that works address(es) of manufacturing in India are the location(s) of local value addition.
Participation by Manufacturers is preferred. Agents/Dealers participating in tender on behalf of manufacturers must provide tender specific authorization (TSA) letter issued by the OEM. Bidders must upload above authorization letter with their offer failing which their offer will not be considered as an offer from that manufacturer and that make and shall be dealt accordingly. i) In a tender, either the authorized agent/dealer on behalf of the Principal/OEM or the Principal/OEM itself can bid, but both cannot bid simultaneously for the same item in the same tender and such bids will be summarily rejected. Further, against a particular tender, one Principal/OEM should not issue Tender Specific Authorization to more than one agent/dealer. Such offers with different terms against a particular product, if treated as ambiguous offers, the bidder(s) or their Principal/OEM will have no right to lodge any claim. ii) If an authorized agent/dealer submits bid on behalf of the Principal/OEM, the same agent/dealer shall not submit a bid on behalf of another Principal/OEM in same tender for the same item/product and such bids will be summarily rejected.
The Bidder agrees to supply the tendered stores at the rates quoted by him in accordance with the Standard Governing Conditions of this tender
Bidders shall also give Declaration as below:- "I/We agree to pass on such additional input tax credit as may become available in future under GST scheme, in respect of all the inputs used in the manufacturing and/or supply of final goods/services on the date of supply by way of reduction in price and advise the purchaseraccordingly
In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, the Railway shall deduct the applicable GST from his/their bills under Reverse Charge Mechanism [RCM] and deposit the same to the concerned tax authority
An Indian Agent quoting in INR on behalf of a foreign Principal/OEM should submit a copy of Invoice/Proforma Invoice from OEM along with their offer as well as should undertake to furnish all import documents and should comply to Clause 22.0 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated) JANUARY 2024.
Earnest Money Deposit (EMD) shall be as per Clause 23.0 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated) JANUARY 2024. EMD is compulsory and offers without EMD, except those exempted, will be summarily rejected. Vendors (other than those appearing on Vendor Panels of Approving Agencies) seeking exemption from EMD, shall have to attach scanned copy of requisite document alongwith offer in support of their claim for exemption, failing which their offer will not be considered eligible for exemption from EMD. An Authorised Agent quoting on behalf of a manufacturer shall not be exempted from remitting EMD owing to any of the exemption claimed. Bidders claiming exemption shall understand and declare as follows:- I/We certify that, my/ our offer is eligible for exemption from submission of bid security/ Earnest Money Deposit, in terms of the tender conditions. In case my/our claim to exemption from submission of bid security/Earnest Money Deposit is not found valid as per terms of the tender, I/we understand and accept that Railways has unquestionable right to summarily reject my bid and my offer shall not be considered for ordering. Further, I/we hereby understand and accept that if I/we withdraw or modify my/our bids during the period of validity, or if I/we are awarded the contract and on being called upon to submit the performance security/Security Deposit, fail to submitthe performance security/Security Deposit before the deadline defined in the request for bid document/Notice Inviting Tender, I/we shall be debarred from exemption of submitting Bid Security/Earnest Money Deposit and performance security/Security Deposit for a period of 6 (six) months,from the date I/we are declared suspended disqualified from exemption from submission of EMD/SD, for all tenders for procurement of goods issued by any unit of Indian Railways published during this period .

Handling of warranty Rejections will be dealt as per Railway Board Letter No. 2022/RS(G)/779/7 dated 17.10.2022. (Annexure-20 ) along with amendments vide Railway Board Letter No. 2022/RS(G)/779/7 (E3390005) dated 26.10.2023 ( Annexure 22) along with amendments vide Railway Board Letter No. 2022/RS(G)/779/7 (E3390005) dated 21.08.2024 and along with other amendments issued by Ministry of Railways as applicable from time to time
In case of any change in statutory tax regime after date of closing of a tender, all the offers shall be evaluated as per tax regime as applicable on the date of closing of tender only.
Benefits to Micro & Small Enterprises (MSEs) shall be as per Clause 4.0 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated) JANUARY 2024. Notes:- i). Criteria for classification of Enterprises based on investment and turnover vide Gazette Notification dated 26.06.2020, as amended time to time, issued by the Ministry of MSME is applicable in the tender. In case conditions contained in above notification contradict with any of the tender conditions, conditions contained in above notification, as amended, will prevail. ii). As per extant guidelines an enterprise registered as MSE firm with any other organization under the Ministry of Micro, Small and Medium Enterprises shall register itself under UDYAM Registration for getting MSE benefit under this clause. Classification of Enterprise as Micro, Small or Medium Enterprise shall only be considered on the basis of UDYAM Certificate. Vendors claiming to avail benefits and preferential treatment extended to Micro and Small Enterprises (MSEs) must necessarily upload relevant documents with their offer i. e. complete UDYAM certificate indicating social status of the MSE. iii). MSE benefit will not be applicable for the traders/authorized dealers/agents. iv). Vendors claiming MSE benefits/preferential treatment, despite upward re classification, must upload document confirming their MSE status within a span of 03 years preceding from the date of closing of the tender, else status of such vendors shall not be considered as MSE.

Public Procurement Policy for Preference to Make in India shall be as per Clause 5.0 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated) JANUARY 2024.
Liquidated Damages in delivery period extensions will be applicable as per Clause 15.0 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated) JANUARY 2024. Upper Limit for recovery of LD will be 10% (10 percent) of the value of stores delayed and not the value of contract, irrespective of delays. Orders on developmental vendors shall be developmental orders and treated as such, specifically, with regard to applicability of liquidated damages for delayed supplies and levy of general damages as per Railway Board letter no- No. 2021/RS(G)/779/7 Pt. dated 24/12/2024
Warranty: The PVC supplied shall be deemed to bear a warranty against defective materials/workmanship and performance for a minimum period of 6 years from the date of supply or 5 years from the date of fitment whichever is earlier. The product shall be warranted against any cracking, discolouring/fading and deformation during service. The thickness of PVC flooring should not decrease by more than 10% of original thickness in every year of service of 5 years. In case the material shows any defect/fails within the warranty period, it shall be replaced by new one without any cost.

Validity of offer: Validity of offer should be strictly 90 days as per Clause 1.8.5 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated) JANUARY 2024 (or) as stipulated in the tender document. Offers quoted with lesser validity shall be deemed as commercially unresponsive and shall be summarily Rejected.
The tenderers in their bid shall indicate the details of their GST Jurisdictional Assessing Officers (Designation, Address & email id). In case of a contract award, a copy of Purchase Order shall be immediately forwarded by Purchaser to the GST Jurisdictional assessing officer mentioned in Tenderer's bid This tender complies with Public Procurement Policy (Make in India) Order 2017, dated 15/06/2017, issued by Department of Industrial Promotion and Policy, Ministry of Commerce, circulated vide Railway Board letter no. 2015/RS(G)/779/5 dated 03/08/2017 and 27/12/2017 and amendments/ revisions thereof.
