Railway reserves the right to procure the material only from Proven Sources having satisfactory past performance of supplying any of the Tendered items to any Zonal Railway/PSUs/ Other Govt. organizations (in last 03 year plus the current year) and relevant documents i.e. copy of receipted challan, inspection certificate, R-Note, CRAC, CRN etc. to be uploaded / attached in support of the successful supply. . If firm failed to upload/attach the said documents then, Railway reserve the right to check bidders past performance in Railway through IMMS (Vendor Performance), hence if any Firm failed to upload the said documents, its past performance would be checked in IMMS (Vendor Performance) and evaluation will be done accordingly and if no credential found so far then the offer will summarily be rejected. No back reference will be made in this regard.

For all items — Commencement : Within 0 Days of issue of Contract, Completion As and when required : Within 6 Months thereafter by the Consignee . The firm shall effect supply within 02 working days from the date intimation given by the Consignee either by issuing letter or by e- mail or over phone. The supply shall be 1:1 ratio i.e. 01[one] no. filled cylinder will be supplied against receipt back of 01 [one] no. empty cylinder.

Payment Terms

Payment:- 100 percent payment through RTGS against inspection certificate and acceptance of materials duly signed by the Gazetted officer at consignee end. Mandate form to be submitted indicating bank A/c Number, IFS, MICR code etc. Part payment against part supply on monthly basis is admissible.

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

IRS terms & condition with latest amendment/correction slip and SER instruction to tenderer & General conditions of tender are applicable.
General Conditions of Contract: The contract shall be governed by latest version (along with all correction slips) of General Conditions of Contract, and all other terms and conditions incorporated in the tender documents.
