Firm should mention make and model of their offer product. Order to be placed on past proven sources of the subject item to any Railway organization for which firm/ tenderer should attach/upload relevant documents of credential/ past performance i.e. copy of purchase order corresponding challan, inspection certificate & R/Note if any respectively or satisfactory performance letter against supply issued by the concern authority. If firm failed to do so then their offer will not be considered as valid offer and such offer will summarily be ignored. No back reference will be made in this regard on either side.

Sharing of Land Border with India Clause: Bidders are requested to go through Clause No. 32.0 (32.1 to 32.6) of SER Instruction to Tenderers and General Conditions. Bidders should confirm following certificate for Compliance. (a) I have read the clause Sr. No. 32 of Instructions to tenderers and general conditions of tenders for supply contract attached with the tender regarding restrictions on procurement from a bidder of a country which shares a land border with India and on subcontracting to contractors from such countries. (b) I certify that this bidder is not from such a country and will not subcontract any work to a contractor from such countries unless such contractor is registered with the Competent Authority. I also certify that this bidder will not offer any products/services of entity from such countries unless such entity is registered with the Competent Authority. (c) I hereby certify that this bidder fulfils all requirements in this regard and is eligible to be considered. (d) I hereby acknowledge that in the event of acceptance of my bid on above certificate and if the certificate is found to be false at any stage, the false certificate would be a ground for immediate termination of contract and further legal action in accordance with the Law. (Bidders confirming this certificate for Compliance shall select Yes in the Complied column. However in case you do not confirm above certificate for Compliance, select NO in complied column. 100 percent on receipt of material duly countersigned by Gazetted Officer of the consignee on receipted challan and acceptance of materials by the consignee along with consignee inspection certi%uE043cate or as per Railways standard payments terms vide clause No- 18.0 of attached SER instruction to tenderers and general condition of tenders through RTGS subject to submission of Performance Bank Guarantee [PBG] for an amount of 5% in favour of PFA, South Eastern Railway, Garden Reach Kolkata-43 of contract value towards warranty obligation with BG validity up to warranty period plus 6 (Six) months as back up of warranty along with the bill else Railway have right to deduct equal amount from their bill and keep it up to warranty period plus 6 (Six) months as back up of warranty for which Railway will not pay any interest. Mandate form to be submitted indicating Bank A/c number, IFS, MICR code etc.

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of mis-classification by the supplier/ contractor.

General Conditions of Contract: The contract shall be governed by latest version (along with all correction slips) of General Conditions of Contract, and all other terms and conditions incorporated in the tender documents.
IRS terms and condition with latest amendment/correction slip and SER instruction to tenderers & General conditions of tender are applicable.
