Hence, approved sources for the item of tendered specification will not be considered for any order. Offers of developmental sources whose prototype has been cleared (Final Prototype IC issued) may be considered for ordering for that much quantity only so that total developmental quantity orders on them is not more than minimum quantity prescribed for up-gradation to approved vendor category. such firms should mention in their offer the total quantity for which developmental orders have been placed on them in past by BLW/Other production units/Zonal Railways for the tendered item.

   Firms on whom developmental order has been placed for the tendered item either with capacity cum capability assessment and prototype inspection clause or only with prototype inspection clause and their final prototype clearance has not been issued before the date of closing of tender, shall be considered for placement of order for that much quantity only, so that total developmental quantity orders on them is not more than minimum quantity prescribed for upgradation to Approved Vendor category. Such firms should mention in their offer the total quantity for which developmental orders have been placed on them in past by BLW/other Production Units/Zonal Railways for the tendered item.

   New tenderers along with their offer must upload details of testing & measuring equipments/quality control, Machinery & Plant, QAP, Manpower details, ISO, credentials of manufacturing and supply of similar items to substantiate their capacity & capability to develop this item. Failure to furnish requisite details by the tenderers with regard to machinery & plant, testing equipments, QAP, Manpower details etc. may make the offer liable to be ignored.

   Do you confirm unqualified acceptance of Inspection clause mentioned in SOR? Bidders may please note that in case of non acceptance of inspection clause or acceptance with any deviation /rider, the offer is liable to be ignored.    In a tender either the Agent on behalf of the Principal /OEM itself can b i d but both cannot bid simultaneously for the same item/product in the same tender. In cases where both principal /OEM and their agent participate in bidding for same item/product, any or both the bids shall be liable to be rejected.    Manufacture or their sole selling agents may note that an agent can represent only one firm in a tender and any manufacturer cannot submit two offers against a tender through different sole selling agents or one directly and one through sole selling agent. In such a situation both the offers will be rejected.

    Earnest Money (EMD) : A. All bidders shall be exempted from submission of EMD who submits bid securing declaration in the format given below : I/We hereby understand and accept that if I/We withdraw or modify my/our bids during the period of validity, or if I/We are awarded the contract and on being called upon to submit the performance security/Security Deposit, fail to submit the performance security/Security Deposit before the deadline defined in the request for bid document/Notice Inviting Tender, I/We shall be debarred from exemption of submitting Bid Security/Earnest Money Deposit and performance security/Security Deposit for a period of 06(six) months, from the date I/We are declared disqualified from exemption from submission of EMD/SD, for all tenders for procurement of goods issued by any unit of Indian Railways published during this period. B. The firms who are not submitting above bid securing declaration they will have to furnish Earnest Money along with their offers as per clause 1.21.2 of BLW tender document REV. Year 2026 Ver 01.

    The firm shall pass on (as per section 17 (1) of CGST/SGST Act) any reduction in tax rate on supply of goods or any benefit of input tax credit to the Railway through a commensurate reduction in price without any undue delay. To the above effect the firm should give declaration that all the benefits accruing on account of change in tax rate and any additional input tax credit (ITC benefit) shall be passed on the Railway.

    Security Deposit (SD) : The successful tenderer will be required to deposit necessary security money before placement of Purchase Order, without any exemption. Bidders are requested to deposit SD (at the rate of 5% of contract value) ) as per BLW Tender Document REV. Year 2026 Ver 01. No exemption what so ever mentioned in clause 1.22 of BLW tender document REV. Year 2026 Ver 01 shall be applicable in this developmental tender.

General Instructions

   Unless otherwise specified, this tender is governed by BLW Tender Document REV. Year 2026 Ver 01 (uploaded with this tender), other Documents enclosed with this tender and also by latest version of IRS Conditions of Contracts. These are attached with the Tender and also available on website https://www.ireps.gov.in.

   Validity of Offer: Unless otherwise specified, offers should be valid for 90 days after closing date of tender. Any offer having lesser validity shall be deemed as commercially unresponsive and will be summarily rejected.

   The bidder confirms that Rates and other financial terms quoted in relevant columns of financial bid will only be ruling terms for acceptance, and such terms quoted anywhere else should be ignored.

   It will be presumed that the firms who have submitted the e-bid have gone through and accepted all the terms and conditions of tender, until and unless firms specify the deviations from those conditions and so indicated specifically under the eadings - "Technical Deviation Statement" and "Commercial Deviation Statements". If there is any contradiction between any techno commercial terms and conditions quoted in e-offer and documents attached along with the e-offer, the terms & conditions quoted in e-offer will prevail over that of quoted in attached documents. Tenderers in their own interest are advised not to quote any techno commercial terms & conditions in attached documents.
