Special Eligibility Criteria

   Firm should invariably comply each and every parameter of the tender specification as per the given format in enclosed ANNEXURE-1 and upload/attach the same. Failing of which offer of the firm will not be considered a valid offer and summarily be ignored. No back reference on either side will be made or entertained in this regard .

   If Firms offering make other than the required makes mentioned in ANNEXURE- 1 should have attached/upload successful past performance of supplying the same item to Railways and the performance statement as per ANNEXURE-2 for last 3 years with breakdown particulars of the subject item duly certified by the consignee (Railway's representative) of its owning Railway, should be uploaded with their offer for evaluation, failing of which offer of the firm will not be acceptable.

   The procurement of the item is restricted to Class I /Class II local suppliers only and the vendors who do not qualify to be Class I / Class II local suppliers should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a Class I / Class II local supplier for the tendered item and participates in the tender it does so a at their own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor. Requirement of a vendor to be a Class I / Class II local supplier for the this item, shall be a mandatory condition in addition to other qualifying eligibility criteria/conditions. Please refer para 29.0 of GCC attached to tender for details.

   Reciprocity Clause: Bidders may please note that- Entities of countries which have been identified by the Nodal Ministry/Department as not allowing Indian companies to participate in their Government procurement for any item related to that Ministry/ Department shall not be allowed to participate in Government from in India for all items related to that nodal Ministry/Department, except for the list of items published by the Ministry/Department permitting their participation. The term entity of a country shall have the same meaning as in the FDI policy of DPIIT as amended from time to time.

   MSE sources, for availing benefits under MSME Act, should upload valid documents maintained under MSME Act such as NSIC Certificate etc. duly marking the tendered item in the certificate . Otherwise, claim for benefits under MSME Act may not be entertained.

   MSE sources owned by SC/ST, should upload necessary documents to get the benefits being owned by SC/ST. Otherwise, claim for benefits under MSME Act may not be entertained.

   If you are not a MSE or a consortia of MSEs formed by NSIC, please indicate percentage of sub contracts in execution of this tender that will be from Micro and Small Enterprise (in percent of order value ) with further breakup of MSE owned by SC/ST.
