   MII-Class-1 restriction:- In keeping with the Public Procurement (Preference to Make in India) Order, 2017 as amended, it has been found that there is sufficient local capacity and competition in supply of the tendered item of required quality and therefore public procurement of the item is restricted to Class I local suppliers only and the vendors who do not qualify to be Class I local suppliers should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a Class I local supplier for the tendered item participates in the tender it does so at own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor .Details of Public Procurement (Preference to Make in India) order 2017, as amended, is given in Para 3.2 of Instructions to tenderers & General Conditions of tenders for supply contract.

   Annexure-19 :- "Bidders must submit a certificate as per ANNEXURE-19 of "Instructions to Tenderers and General Conditions of Tender for Supply Contract (For Indigenous Tenders)" Amendment no. - 25 pdf (attached) along with the bid for compliance of OM dated 23.07.2020 of Department of Expenditure, Ministry of Finance. If such certificate given by a bidder whose bid is accepted is found to be false, this would be a ground for immediate termination and further legal action in accordance with law."

If two or more bidders are found to be sister concerns or affiliates (having common partner/director/promoter/owner/holding company decision control etc.) the offers of all such sister concerns are liable to be rejected as per relevant provisions of tender conditions." They are therefore earnestly urged to refrain from committing violation of code of integrity in general and conflict of interest and anti-competitive practices.
