Claim or demand for breach of any rules, regulation defaults, etc. On parts of the contractor, his

agents or servants in the course of performance of this contract.

The PGVCL shall not responsible for any loss or damage to the property of the contractor or any

injury or death to him any of his agents during the course of performance of the contractor.

The contractor shall insure his vehicle properly to safeguard against any risk arising out of accident,

fire, theft, riots etc.

It shall be the sole responsibility of the contractor to maintain all relevant forms, register of record in

accordance with the various statures, labour laws, enactments, etc.

The vehicle is to ply in country areas slushy and tarrineous areas as per the requirement of activities.

The contractor must, thereof, exercise a strict supervision in keeping his vehicle road-worthy.

The VALIDITY OF TENDERS shall be up to 120 days from the date of opening of tenders by the PGVCL

and they shall be legally bound to honour any commitment relating to tenders during this period including

accepting of work order and providing vehicle on hire if so ordered by the company. In case of non-

compliances, E.M.D will be forfeited apart from taking any other actions as may be considered suitable, under

the circumstances.

After the tender is accepted, the Engineer shall place a work order on the successful party to provide a requisite

No of vehicle on hire, by giving at least 20 days time to complete RTO formalities of the vehicles.

The parties submitting tenders must ensure that in the event of their tenders being accepted they will have to

meet the FULL QUOTA REQUIREMENT OF VEHICLE for the category or categories for which tenders

are submitted, In case they fail to provide full number of vehicles as per need, it will be considered a breach or

default on part of the party concerned their EMD forfeited.

The parties quoting rates must carefully read and understand the clauses. Terms, and conditions incorporated

herein to avoid any inconvenience late on to themselves and to this office.

CONTRACTOR’S LIABILITY: -

The contractor’s shall insure all vehicle property so as to fully safeguard against any risk arising out of

accidents, fire, theft, riots etc. Full liability of any injury, death damage or loss of human lives (Incl- PGVCL’s

employees traveling in the vehicle, contractor’s driver/servants/agents/or any other human being) any other

vehicle stationary or mobile, and public or private properties will be contractor’s account.

COMPUTATION OF KMS FOR BILLING: -

The PGVCL will allow billing or kms on basis of opening readings as soon on arrival or the vehicle at the

PGVCL’s H.Q and as at the time of departure after completion of duties from the H.Q.

The rates once offered by the party and and accepted by the PGVCL with or without modification, shall remain

unchanged during the contract.

Should there be any statutory increase/decrease in fuel prices by an order of the central of state govt. and

suitable marginal increase /decrease in rates of hiring will be given by PGVCL as per the formula given at

the tender submitted with only payment receipt with temporary registration and if

found lowest due consideration may be given if the documents as required in Sr No-2

are furnished within 15 days. In case of non submission the acceptance of second

lowest tender will be considered without issue of notice.

3. Ernest Money Deposit (EMD) amount according to the tender notice in the form of

online mode in favour of “PASCHIM GUJARAT VIJ CO. LTD”

4. Schedule “A” enclosed to the tender papers, showing rate of hiring chargeable by the

Party. Rates must be quoted both in words and figures.

GENERAL CONDITION: -

The successful tenderer will be required to pay an amount equivalent to 5 % of the value of the order as a

security Deposit for satisfactory performance of the contract. Such amount will be payment either in cash.

Security deposits are not yet being paid in advance i.e. before placing of work order as per GOG norms.

The vehicle provided on hire by the contractor shall remain at the disposal of the Engineer and shall not ply for

any purpose other than the bona field purpose of the PGVCL.

The vehicle shall commence duty at the Head Quarter of Engineer.

The contractor shall provide stand by vehicle’s to ensure prompt substitute arrangement should any hired

vehicle go off road.

In case any vehicle remains absent of fails to report for duty or a vehicle if provided a substitute is not in an

acceptable condition, the PGVCL shall recover penalty at the rate here in after specified and in case of an

unacceptable substituted vehicle any journeys covered by it may also be disallowed apart from recovering

penalty as if the vehicle is “Absent”.

Statutory deduction of various taxes, TDS WCT ,Walfare cess, Service tax etc should be mentioned service tax

reimbursement to be made against submission of challan.

PGVCL shall have right to hire vehicle from other agency at the risk and cost of contractor in case of default.

PENALTY (RATE): -

For an absence beyond two hours and up to one complete shift.

Fully day absence of a vehicle in all the 3 shifts starting in order of Morning, Evening and Night Shift.

In case any vehicle remains off the road due to major breakdown/accident/mishap or any other reason beyond

human control, penalty shall be contended up a maximum of 48 hrs. At the discretion of the Engineer. The

contractor may, however in the meantime make best efforts to provide a substitute so as not to allow the work

The contractor must ensure that the vehicle are kept/maintain in neat and clean.

The contractor shall ensure observance of proper discipline by his driver/agents or servants engaged in

performance of the contract in condition. They must behave in a polite and courteous manner with the PGVCL

employees. In case of any complain against any drivers etc, the contractors must change him/them and in case

he fails to do so, such of the driver shall not be accepted on duty and vehicle on which deputed shall not be

accepted on duty and marked absent.

As far as possible, the contractor shall ensure that the drivers are in proper neat and clean uniforms while on

The contractor, his drivers, agents, servants or any other workman engaged in performance of the contract must on serve

safety rules and regulations while going to worksites/installation. Should any mischief take place due to neglect to safety

precaution on parts of any of his workers, the contractor shall be sololy liable for all the consequences.

Vehicle wise and month wise logbooks (in triplicate) in the pattern on the PGVCL shall be maintained by the contractor

in respect of his vehicle playing on hire under the contract. All the entire/columns must be properly fielding /complete as

soon as any journey is completed and got signed from the user as well as by the driver. It shall be the sole responsibility

of the contractor to ensure that logbooks are properly completed and signed. Any entry not properly if legibility recorder

or left unsigned or having cutting/interpolation/ overwriting shall not be taken in to consideration and no payments shall

be made in respect of such journeys, unless the certified by the user officers.

On close of the month, the contractor shall prefer bills of hire (In triplicate) to the engineer enclosing therewith two

copies of the log sheets of all hired vehicle (original and second copy) for checking and verification to each log sheets the

following certificate by enclosed dully signed by the concerned user officer of the vehicle.

Certified that all the entries recorded in the log sheet of the vehicle in question for the month have been duly verified and

checked and found to have been made in the interest of PGVCL bonafied work.

All efforts shall be made to pay the bills within 30 days time to time of submission.

The contractor shall indemnity the PGVCL against all suits, action, proceeding, etc, arising out of any.

The PGVCL reserves the right to award the work either to a single tenderer or split up the same between more than one

AREA OF WORK: -

Normally the vehicle shall be required to run within surendranagar District. But it shall be require moving any where in

Gujarat as per the directions from the engineer.

GENERAL CONDITION: -

The contractor shall be required to supply vehicles strictly in accordance with the specifications laid down in the tender

papers. Any vehicles not confirming to the said specification shall not be accepted.

The vehicle to be offered shall be not older than 2(Two) years as on date of tender opening.

The vehicle intended to be placed for hiring must be of FEB-2024, thereafter registration and must have the following

documents completed in all respects.

1. Insurance certificate covering period up to date.

2. Registration certificate book with Tax paid up to date.

3. Road permit.

4. Fitness certificate.

5. Any other documents relevant relating to hiring of vehicle.

The contractor shall make his own arrangement at his cost for the boarding and lodging of drivers, agents, and servants.

The vehicle when in service shall have to kept parked at the PGVCL premises or as the work site as possible.

The contractor shall ensure that a representative on his behalf is deputed by him to keep in touch with the engineer with

regard to detailing of vehicles, providing arrangement for substitutes in case of any vehicle going off road or looking

after to general need of playing of shift vehicle.

The contractor shall also make his own arrangements for refueling, repairs and maintenance of his vehicle.

Before the vehicles are put on hire, the contractor shall product the same to engineer for his inspection any verification of

The contractor shall be responsible for any fine or penalty if imposed by any authority, state or central authorities

including any local body for any branch, violation or non-compliance statutory rules, regulation etc.

The contractor must follow all the rules, regulation and encasement under the labor laws relating to engagement of

persons by him.

The vehicle once inspected and approved by the engineer for hire all shall not be changed or substituted by the contractor

except on orders from the engineer of on becoming defective off road due to accident breakdown etc. In such an event

the contractor shall give immediate intimation to the engineer. Whereas changed or vehicle is likely to last for more than

one week prior approval of the engineer shall have to be taken.

The speedometers of the vehicle must be maintained within full accurance and in working order in all the times. Any

defect noticed therein must be rectified at the earliest in a period not exceeding two days. Till such time, the mater starts

working, the km of journeys for various places shall be decided by the users/engineer.

No interest shall be paid by the PGVCL on security deposit.

Ernest Money Deposit (EMD) received along with the tender shall also be converted in to Security Deposit in the event

of awarding the contract to a successful party.For EMD exemption /Waives in tenders notarized copy of both the

certificates are required as per GOG norms. SSI / Udyog aadhar card of NSIC/CSPO/DGS&D/( Specifically mentioned

exemption criteria in tender is mandatory)

Tender fee paid for purpose of tender papers is non refundable.

The security deposit shall be refunded only after completion of the contract or on its termination. The PGVCL reserves

the right to recover any dues, outstanding against the contract from the security or towards any loss causes to the PGVCL

owing to neglect of default of the contractor, his servants or against. The refund shall be done only on production of no

objection certificate of all concerned officers.

The rates quoted by the tenderer in the schedule or rates must include all charges of every type such as fuel, taxes, levies,

maintenance /repairs, driver of contractors servant/agents wages etc.

Commercial terms and condition

1. DEFINATIONS:-

In construction these general condition and the annexed specification. If any, the following works shall have the

meaning herein assigned to them unless there in something in the subject or context inconsistent with such constriction.

(1.A) PGVCL shall means PASCHIM GUJARAT VIJ CO. LTD and shall include its successors and assign.

(1.B) “Contractor” shall means the tenderer whose tender is accepted by the hirer and shall include the tender’s legal

personal representative, successor and permitted assign.

(1.C) “Engineer” shall means such officer as may be duly appointed from time to time by the company to act as Engineer

for the purpose of contractor, it if he is not so appointed the C.E or the PGVCL or his duly authorized representative.

(1.D) “Contract” shall means the agreements, if any, to be entered in to and include subject to the special condition

notified herein., all the documents by which any agreement by the contractor to provide to execute or to carryout the

work or work shall be constituted in or by which the terms of agreement or any of them are contained or set forth

specially, including these general conditions, any special condition attached to or issued with invitations or tenders (If

any) or any other letter or notice document upon or with reference to which the tender is made, the tender and the

acceptance thereof and the schedule of price (if any) furnished by the contractor with the tender.

(1.E) “Specification” shall mean the specification annexed to these general conditions and the schedules thereto (if any)

(1.F) “Contractor price” shall mean the sum accepted or the sum calculated in accordance with the prices accepted by or

on behalf of the company.

(1.G) “Month” shall mean the calendar month.

(1.H) “Approved shall mean the approval of the C.E. or the person deported by him or any particulars purpose.

(1.I) “Writing “ shall include any manuscript, type written, or printed statement under over the signature or seal as the

Each bid shall be accompanied by EMD amount to Rs 9900/-. Earnest Money can be paid through a demand draft on

any scheduled Bank situated at the place where from the tenders have been issued or by cash. Cheques will not be

accepted tenders without earnest money will not be considered for acceptance.

The EMD of those successful tenderers who so not accept PGVCL’s order or of tenderer who withdraw there offers

during the stipulated period of validity of the offers will be liable to be forfeited.

3. PERIOD OF CONTRACT: -

The maximum period of the initial contract shall be for two years. The period can further be extended on mutually agreed

terms as per the same rates, terms, and conditions for the next three years. However, in case of poor services provided by

the contractor, the Circle Head shall be empowered to terminate the contract. In no case shall vehicles be hired beyond

seven years. The contract period can be extended up to seven years, provided the model of the vehicle is not more than

seven years old. After the completion of five years, the extension shall be granted on a yearly basis (one year at a time)

and only if the vehicle passes an annual inspection conducted by the designated tender authority. The extension will be

granted only if the vehicle is certified to be in good condition after inspection.

The vehicle to be offers for hiring shall be in up-to-date condition including its tubes, tyres, engine as well as conditions

of its outside body. The vehicle to be offered must be totally new at the time of offer accepted by company. However in

case of a very poor response or to break off the likely cartel, a relaxation can be granted for one year with the permission

of circle head. In case of remote area offices where it is difficult to get good vehicles on rental, Superintending Engineer

of respective circle will be empowered to relax the criteria for one more year with full justifications. However the

officers placing an order should ensure that the condition of such vehicle is tiptop.

4. SCOP OF CONTRACT: -

Award of a contract to a party shall not by itself entitled it to any exclusive right to supply any add. No of vehicles

against subsequent requirement.

JURISDICTION: -

All disputes relating to proposed contract will be subject to surendranagar jurisdiction only.

OTHER TERMS AND CONDITION: -

(1) The general terms and condition relating to works, as standardized by the PGVCL, but not specifically brought

out herein above shall also be made application to the proposed contract and will be biding to the successful

tendrers . A copy of booklet containing such terms and condition, will be a available for persual of tendreres , at

the office of the authorities issuing this tenders.

(2) The Vehicle should have equipped with GPRS System.

COMMERCIAL TERMS AND CONDITIONS

The tender fee (Non-refundable) with GST @ 18 % specified in notice inviting tender is payable by Cash or

Demand Draft (DD) at surendranagar drawn on any Scheduled Bank in favour of Paschim Gujarat Vij

Company Ltd. Indian postal orders(IPO‟s) & Cheque are not acceptable.

 Payment of Tender fees can be accepted by RTGS/NEFT.

 In case of payments through DD , the scanned copy of original documents shall have to be

uploaded with the bid and original copy of the same will have to be submitted at the office

address specified in the tender documents within 5 days of bid opening.

The tender fees is non –refundable under normal circumstances. Howerver, if PGVCL authority decides to

scrap/cancel the tender, by one or another reason, in which bidders are not responsible for cancellation/scrap

discretion of the PGVCL.

NSIC or any other certificate such Udhyam Registration, certificate of CSPO,

certificate of DGS&D should not be allowed for exemption of EMD payment in

works/Service tender, Such benefit/exemption is to be allowed in

purchase/supply tender only.

3.SECURITY DEPOSIT(SD):-

The successful bidder will be required to pay an amount equivalent to 5% of the value of the Order as a

Security Deposit before placing the work order for satisfactory performance of the execution of Contract. If the

full Security Deposit amount is not paid within 07 (Seven) days after the receipt of the LOA, then the LOA will

be out rightly cancelled & work order will not be placed (at the discretion of PGVCL). EMD amount of such

bidder/s will be forfeited without entering into any correspondences and this will be binding on the Bidder.

PGVCL will also take action against such bidder/s like stop deal/black list/works at the risk & cost of the bidder

or actions as desired by the Company. Security Deposit will be payable either by/ D.D. / Bank Guarantees.

„Security Deposit‟ & S. D. shall be paid before placing of work order in DD or BG at PGVCL, Surendranagar.

4.PENALTY FOR DELAY IN COMPLETION OF CONTRACT:

In case of delay, penalty shall be levied at 0.5(Zero Point Five) % of contract value per week with maximum

10(TEN) % selling of per bill value per week. This will be deducted from your bill payable either from this

contract or from any other contract with the Company or from EMD or Security deposit amount.

5.CONTRACT AGREEMENT:

Successful bidder shall have to execute the contract agreement Bond on non judicial stamp paper of Rs.

300.00 the cost of the same will be borne by the bidder.

6.TAX: -The prices should be inclusive of all applicable taxes excluding prevailing GST.

In the wider interest of safety you contractor will have to provide all required safety gadgets as per PGVCL

norms to your all workmen while working. Use of same must be ensured by you and for any consequences

that arise out of non use of these safety gadgets, PGVCL will not be responsible. Certificate by contractor

must be given while submission of bill that necessary safety Gadgets is issued to and used by all workmen

working for contractor. For any deviation PGVCL will take action as per norms. It will be the responsibility of

bidder / contractor to cover sufficient amount of insurance of their personnel involved in the erection work of

tender item/s during execution of works. PGVCL shall in no way be responsible for any injury, damages,

accident etc. to their personnel execution / erection work, supervision etc. under the contract.

8.OTHER CONDITIONS OF SUPPLY:-

The PGVCL General Conditions of Contract will apply to all Supplies and Contracts and you will deemed to be

fully aware of the this General Conditions of Contract for the supply of Materials particularly in respect of

Security Deposit, Terms of Payment, Penalty for late delivery etc. and any ignorance of these Conditions will

not exempt you from liability to abide by the same.

9.FAILURE TO EXCEUTE THE CONTRACT:-

On failure to execute the order placed on successful bidder, under the terms & conditions set forth therein, to

the satisfaction of PGVCL, the contractor will be liable to make good the loss sustained by PGVCL. Under

such circumstances, PGVCL shall cancel the order and forfeit the SD. PGVCL may also go for fresh order on

other party at the risk & cost of successful tendered or may carry out

departmentally, debiting the cost to the successful bidder / contractor.

10. TERMINATION OF CONTRACT:-

The PGVCL, upon written notice of default to the contractor, shall terminate in the circumstances detailed as

under: If, in the opinion of the PGVCL, the contract or fails to complete the work specified in the scope of

works given in Schedule-A within the time specified for the same in the contract or within the period for

extension has been granted by PGVCL to the contractor. If, in the opinion of the PGVCL, the contractor fails

to comply with any of the other provision of the contract The PGVCL shall also be empowered to cancel the

contract, if any deficiency in erection work and or bad performance is noticed. The work specified in the scope

of works given in Schedule -A within the time specified for the same in the contract or within the period for

extension has been granted by PGVCL to the contractor.

11. CHANGE AND QUANTITIES:-

The PGVCL shall have the rights to make any changes /addition / deletions or modification in any terms /

conditions of the tender and / or specifications as may be deemed necessary by PGVCL at its sole discretion

at any time before the due date of opening of the tender. The quantities mentioned in the accompanying

Schedule are only approximate. Actual quantities may increase or decrease according to the requirements.

The Company reserves the right of revising or deleting any of the quantities to be executed against the

contract and final quantities actually executed by the contractor will be calculated and paid at the rate given in

contract schedule of rates.

12. The erection work shall be carried out strictly as mentioned in Schedule-A and as per standard

specification relevant ISI & approved by PGVCL authority & Concern authority i.e. PWD, NHAI, Western-

Railway, BSNL, Local Gram Nagar Panchayat Municipality, etc.

13. PGVCL reserves the right to cancel any or all the offer / bids or to accept any offer without assigning any

reasons. PGVCL reserves the right to place the order by split ting the tender items / quantity by awarding to

more than one contractor. The technical scrutiny committee of PGVCL shall evaluate the techno-commercial

view of the tender. PGVCL reserves the right to open or not to open the price bid of the bidders on the basis

of their past performance of their work/supplied materials.

14. JURISDICTION:-

All questions, disputes or differences arising under out of or in connection with the Tender / Contract if

concluded shall be subject to the exclusive jurisdiction of the court under whose jurisdiction the place from

which the tender / Acceptance of tender is issued, is situated.

15. PGVCL as well as supplier / contractor will be bound by rules and regulation of Indian Contract act.

16. Income Tax (TDS), GST(TDS) & CESS whenever applicable will be deducted / recovered as per Govt.

17. Contractors must have valid solvency as per Company‟s rules. Contractor Licence, Bank Solvency,

Registration of line / cable laying work & Experience certificate to be attached as per requirement of tender.

18. Bidder has to upload scanned copies of original ( Notarized/Self attested copies of original as

specified in tender documents) documents with bid and no physical documents to be called from

bidder. Uploaded scanned documents remain legible and should not be password protected.

19. Bidder shall mention Registered E.P.F. & I.T. Dept Pan -Card, GST etc in his offer and submit the

photocopy of certificate of each, otherwise Tender shall not be considered in competition.

20. It is declared that we have no any stop deal / black list with GUVNL & its subsidiary company.

21. No tools, tackles nor their maintenance and labor for execution of order will be provided by PGVCL.

22.PERIOD OF CONTRACT:-

The contract will be remained in force for period of 24 Month. The contractor shall call / indent the required

material from S/dn / Dn Store in advance & on completion of the work, prepare and render the final detailed

material account of the received by him from the SDn./ Dns store within one month from the date of

completion of work.

23.INDEMITY BOND:-

The contractor will have to executed an indemnity bond on stamp paper of Rs.300/-at his cost before

commencement of work stating the matter conversing that for any accident to the contractor‟s staff/equipment

or any person, either fatal or non fatal, due to non observing of safety measures,

PGVCL, shall not be responsible.

24. CONTRACTOR LIABILITY:- For any accident either fatal or non-fatal to the workers due to non

observances of the safety measures as per rules or due to lack of proper care by the contractor‟s labor,

PGVCL shall not be responsible.

25. VALIDITY:- All offers should be kept valid for acceptance for a period 120 (One Hundred Twenty) days

from the date of opening of tender. Offers with short validity will be liable for rejection without any

correspondence.

26. Contractor shall submit the bill of work at regular period of stipulated time.

27. STATUTORY VARIATION:-

Any statutory increase or decrease in the taxes subsequent to contractor / bidder offer if it takes place within

the original contractual delivery date will be to PGVCL account subject to the claim being supported by

documentary evidence. However, if any decrease takes place after the contractual delivery date, the

advantage will have to be passed on to PGVCL.

28.PAYMENT TERMS:- Payment of works shall be made in 45 Days after scrutinizing of Bill submitted by

contractor if found in order.

29.The contractor has to store all the allotted materials in safe custody on their end. The allotted materials by

PGVCL should be insured at their cost towards theft, loss, damaged etc. The contractor is fully responsible for

storing of all the materials allotted by PGVCL for the works under contract.

30.PGVCL shall issue the required materials under the contract from any store of PGVCL and the contractor

has to carry out all the transportation at their cost up to the sites.

31.PGVCL reserves the right to cancel any or all the offer/bids or to accept any offer without assigning any
