Special Eligibility Criteria

   Railway reserves the right to procure material from OEMs or its authorized dealers/agents only. All the Authorized Dealers/agents are advised to submit the tender specific authorization from the OEM issued on or before the tender opening date along with their offer, otherwise their offers will be summarily rejected / Passover. In case tenderer participates as an authorized dealer/agent, then the performance as requiredabove shall be that of principal authorizing the agent. It may so happen that the agent has credentials of past supply for a different Principal but this will not be considered as performance for placing the order in case of change of Principal.

   The bidder/manufacturer Must have supplied at least 3 sets of same/similar machine in the last 5 Years (to be reckoned from the original date of closing of tender). In case of foreign bidder, out of these 3 machines, at least 01 (one) machine must have been supplied to the customer in a country other than country of manufacturing firm. Statement of past supplies along with, (i) Purchaser's name and (ii) Address (iii) Email address and (iv) Phone/fax number of purchaser (v) Purchase Order (PO) or Supply Order number and (vi) PO date (vii) along with the copies of Purchase Order (PO), (viii) Quantity supplied (with proof of supply) (ix) Date of supply and (x) their commissioning date shall be submitted with the offer. Copies of POs/commissioning/performance certificate submitted shall also indicate the parameters/specification Of subject machine to prove same / similarity aspect of the Machine as mentioned in Para 3 below; technical specification of the machine from the related document of the PO may be attached to supplement the PO inregard to the respective parameters of similarity aspect of the machine. Specifications attached shall have linkages to the PO.

   For the purpose of similarity, similar machine required under clause 2 means "Hydraulic Rescue Device" with same or higher configuration/ capacities in reference to quoted model (in terms of parameters as Specified in schedule-I of RDSO spec, except weights, which should be same/lower.)"

   The tenderer shall, in their offer, submit Performance Certificate of at least 1 (one) such machines (which are counted for the purpose of Clause 2(a) above) supplied in last 5 (five) years and the machines covered by these Performance Certificates must have worked satisfactorily for atleast one year from the date of commissioning as on the original date of closing of tender. In case of foreign bidder, the Performance Certificate of machine shall be from the customer in a country other than country of manufacturing firm The Performance Certificates shall not be older than one year from the original date of closing of tender. The Performance Certificate issued after original date of closing of tender (in cases where tender closing Date has been extended) are also acceptable,

   The tenderer shall provide satisfactory evidence, acceptable to the purchaser to show that he is a regular manufacturer and has adequate plant & manufacturing capacity and has a 'Quality Assurance Program". Information as per Annexure %u2013 2 under Bid Documents Part-I may please be furnished. The manufacturer should have valid ISO:9001 Certificate on the original date of closing of tender and a copy of the same should be submitted along with the bid. Rescue Tools / Cutting Tools /Spreading Tools should be in the scope of ISO Certificate.

   I/We have carefully gone through the IRS conditions of contract (included and uploaded along with the bid document) particularly Para 2500 pertaining to Code of Integrity, Misdemeanor and Penalties. I/We hereby certify that no other concerns or affiliates (such as having common partner/director/promoter/owner/ holding company decision control etc.) have participated in this tender which can give rise to a conflict of interest or fall under anti-competitive practices. We understand that the offers of all such sister concerns including ours are liable to be rejected as per relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of Integrity in general, with specific reference to conflict of interest [Para 2502 (e)], anti-competitive practices [Para 2502(c) ] and obligation to proactive disclosures [ Para 2503]. I/We understand that we are fully responsible for the above declaration and it shall not be the Railways responsibility to verify the same.I/We are aware that we shall be liable for all consequences of violation of Code of Integrity, if detected, at any stage.
