/We engage to supply the Western Railway with the articles specified above upon the terms of the Indian Railway Standard Conditions of contract (latest revision) and upon the terms of t he R e v i s e d Special Conditions and instructions for the guidance of the contracts issued by the Western Railway S/137/F Revised May 2011 Amendment No. 10 of November 2017.
Procurement to be done through RDSO approved vendors. (List attached in Documents -RDSO's letter no.MW/CS/PEWB dt 11.11.2025).Vendor should be approved by RDSO for manufacturing and supply of Pit-less electronic in-motion weighbridge (15 KMPH) and any other vendor added by RDSO till date of tender opening.The firm should upload the vendor approval copy and valid quality audit certificates along with its offer, else the offer submitted shall be summarily rejected.
SPECIFICATION IS AS PER RDSO SPECIFICATION AND NOT AS PER COFMOW WHICH MAY BE NOTED BEFORE QUOTING.

Validity : Tenderers to quote minimum 60 days validity of offers.
Make In India Preference policy :- In keeping with the Public Procurement (Preference to Make in India) Order, 2017 as amended, procurement of the item is restricted to Class I and class II local suppliers. Minimum local content requirement for Class-I local supplier is minimum 50 % . For Class-II local supplier is minimum 20 % . Non local suppliers: The bidders offering imported products will fall under the category of Non-local suppliers- As per MINISTRY OF RAILWAYS RAILWAY BOARD letter ..2020/ RS(G)/779/2-Part-1 Dated: 17/05/2021. The vendors with local content less than 20% should not quote in the tender who do not qualify to be Class I and class II local suppliers, as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a Class I and class II local supplier for tendered item participates in the tender it does so at its own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor
LIQUIDATED DAMAGE (LD) ON DELAYED SUPPLY: Recovery of Liquidated Damage (LD) shall be levied @ 1/2% (half percent) of the price of the store per week or part of the week during which delivery is accepted and the upper limit for recovery of LD in supply contracts is 10%(ten percent) of the value of contract irrespective of delays, unless otherwise provided, specifically in the contract.

ADVANCE ACCEPTANCE/COUNTER OFFER AND DELIVERY PERIOD: The delivery period in Store Procurement cases shall be reckoned from the date of issue of Advance PO/Letter of Advance Acceptance/Letter of Acceptance.

Warranty : (a) Warranty period for M&P will be 24 (Twenty four) months from the date of commissioning and proving out of M&P. A maximum period of 2 (Two) weeks will be allowed for attending and rectification of faults during the warranty period. (b) Maximum down time during the warranty period will be 2% (Two percent) of the warranty period for on line M&P and 10% (Ten percent) for off line M&P calculated on quarterly basis. (c) A penalty of 0.5% (Zero point five percent) per week of the contract value wil be levied for delay in response time for attending and rectification of faults beyond specified time during the warranty period as detailed above. (d) Maximum penalty to be levied on account of warranty failure will be 5% (Five percent) of the contract vale calculated during whole of warranty period and after that if there is any delay on the part of supplier, purchaser shall be entitled for encashment of WG Bonds. In such cases of bad performance of firm during the warranty period, the same should be recorded and circulated to all Railways. The same should be given due regard in deciding future orders on the firm and when evidence to the contrary is not available, the firms offer may be even rejected. (e) The WG Bond can also be encashed at any time if any of the warranty obligations are not complied with satisfactorily. (f) WG Bond for 10% of contract value should be submitted in the prescribed format for the period of warranty plus 6 months.
Timely Commissioning of M &P items : Firm to install and commission the machine within a period of 15 days from the date of receipt at consignees end or as specified in the purchaser order / contract. In the event of contractors failure to have M&P commissioned by the time or times respectively as specified, purchaser may withhold, deduct or recover from the contractor as penalty, a sum @ 2% (Two percent) of the price of M&P which the contractor has failed to commission as a aforesaid for each and every month (part of a month being treated as a full month) during which the M&P may not have been commissioned, subject to an upper limit of 10% (Ten percent) of contract value.
Insurance up to ultimate consignee must be ensured by the firm at their cost. They should clearly indicate whether it is being absorbed by them or quote clearly.
Warranty clause : As per attached specification.
Tenderers are required to quote for post warranty comprehensive annual maintenance contract for a period of 10 years of the M&P along with their offers from the date of expiry of warranty period (02 years) or from the date of commissioning whichever is later.
