Special Eligibility Criteria

   Bulk procurement of this item shall be strictly restricted to Micro and Small Enterprises (MSEs) that hold a valid BIS Licence for IS:1363 (PARTS 1 AND 3) in accordance with the notification published in The Gazette of India, CG-DL-E-18072024-255511. Original Equipment Manufacturers (OEMs) intending to participate in the tender must submit a valid UDYAM Registration Certificate as proof of MSE status, along with a valid BIS Licence corresponding to the specified IS standard. Offers submitted without these documents shall be rejected.The authorized agents of MSE registered & BIS LICENCE holding manufacturer may quote along with tender specific authorization certificate and along with the valid UDYAM certificate for MSE & BIS Licence of the OEM who have given the authority certificate, failing which their offer shall be rejected. For further details regarding exemption and detailed guidelines, bidders are advised to refer to The Gazette of India, CG-DL- E-18072024-255511, which is enclosed with the tender document. Note : Bidder asking exemption as mentioned in The Gazette of India, CGDL-E-18072024-255511, has to submit past performance of satisfactory execution of contracts to SC Railway, or Other Zonal Railways/Pus for supply of the same / similar items (i.e Bolt or Nut of any size/dimension ) for a quantity of 20 percent or more of tendered quantity against a single contract during last three years prior to, and excluding tender opening date may be considered as responsive to SC Railways requirements for placement of bulk and regular order. Tenderers are requested to submit the past performance report such as Copies of R Notes/CRAC/Proof of acceptance of material by consignee etc. along with their offer; failing which offer will be summarily rejected without making any back reference. However, in cases where the tenderers are having satisfactory past supply performances of tendered items for stock items with SCR, the supply performance data available in iMMIS with SCR shall be taken into consideration while evaluating the offers of the tenderers.

   Firm willing to avail benefits of Micro and Small Enterprises, must submit documentary evidence of being Micro or Small Enterprises for tendered item in the certificate issued by nodal agencies as per Public Procurement Policy (i.e., UDYAM REGISTRATION CERTIFICATE), failing which firms offers will be treated as Non-MSE firm. For detailed instructions refer Para 15 of General Tender Conditions attached with NIT and/or available as Public Document on IREPS website Goods and Services/SCR. Failing which such benefit will not be extended to them.

   Guarantee/ warranty shall be as per governing specification. If there is no governing specs or nothing is specified in Governing Specs then warranty Guarantee will be as per IRS conditions of contract.

   Each tenderer should clearly specify essential technical and commercial parameters in a transparent manner. No deviation to such Essential Technical &Commercial conditions shall be permitted to the vendors in the electronic bid form. Offers with deviations in respect of any condition for responsiveness of offer shall be declared as Ineligible for award of contract.

   If you are not a MSE or a consortia of MSEs formed by NSIC, please indicate percentage of sub contracts in execution of this tender that will be from Micro and Small Enterprise [in percent of order value] with further breakup of MSE owned by SC/ST.    Failure consequences: In case the firm fails to execute the contract within the original delivery period, the purchaser will be entitled to impose liquidated damages for extension of delivery period. For any reason, if the supplier fails to supply goods as per the conditions of contract, as amended from time to time, Purchaser shall have the right to levy damages from the supplier for failing to comply with the contractual conditions, not by the way of penalty, an amount equal to 5% of the defaulted order amount. These damages shall be treated as recoveries outstanding against the vendor and dealt with accordingly.
