b.​ OEM published Specifications Datasheet shall have to be submitted for

each offered make & model with seal and signature of the Bidder.

c.​ The quantity may vary at the time of actual issuance of purchase order.

During the validity of the Bid, the High Court of Gujarat can place

purchase order for above items of more or less quantity at the finalised

rates under this Tender, hence the successful Bidder will have to accept

purchase order during the validity of the Bid period.

d.​ The High Court of Gujarat may issue two or more purchase orders for

each Part of the quantity as per the requirement.

e.​ The Bidder may quote for either Part-1 or Part-2 or Part-3 or Part-4 or

Part-5 or Part-6 or Part-7 or Part-8 or Part-9 or Part-10 or Part-11 or

Part-12 or Part-13 or Part-14 or Part-15 or Part-16 or Part-17 or Part-18

or Part-19 or Part-20 or more than one Part or all the Parts. The Bidder

can offer more than one make & model for each or any of the parts for

each of the warranty and technical specification options. The High Court

of Gujarat may choose any of the options while selecting the product.

Purchase Order for each Part will be issued separately.

f.​ The High Court of Gujarat may place single/multiple Repeat Purchase

Order(s) of quantity not more than 50% of total quantity given in the

Purchase Order, for either a Part or Parts or all, within the period of

months from the date of Purchase Order at the finalised rate.

2.​ Eligibility Criteria of the Bidder:

a.​ The Bidder shall be a firm/company registered in India under the relevant

rules/regulations.

b.​ The Bidder must have one office in Ahmedabad/Gandhinagar and a copy

of any two documents i.e. Property Tax Bill/Electricity Bill/Telephone

Bill/VAT/CST Registration/Lease agreement shall be submitted in

support of the same.

c.​ The Bidder must be actively involved in supply of ICT Hardware for at

least three continuous years prior to the publication of this RFP, as

authorised distributor / dealer / seller / reseller of ICT Hardware with

OEM authorisation certificate in this behalf, to be submitted.

d.​ The Bidder must bid with an OEM authorisation certificate specifically for

total for all three years taken together) in the three financial years i.e.

2023-2024, 2024-2025 and 2025-2026; and turnover of the financial year

b.​ EMD shall be submitted in the form of Demand Draft (D.D.) or in the form

of an unconditional Bank Guarantee (B.G.), in a separate Cover (which

should be valid for 3 months from the date of Bid submission for this

RFP) of any Nationalised Bank including Public Sector Bank or Private

Sector Banks or Banks (operating in India having branch at

Ahmedabad/Gandhinagar) as applicable vide Government Resolutions /

instructions issued by the Finance Department from time to time.

c.​ The D.D. / B.G. should be in the name of “Registrar, High Court of

Gujarat" payable at Ahmedabad. The proforma of EMD in case of Bank

Guarantee is attached herewith at Proforma P3.

d.​ Failing to submit EMD, while submitting Technical Bid Documents and

Bidder Eligibility Documents, shall lead to rejection of the Bid.

e.​ Unsuccessful / disqualified Bidder’s EMD will be returned without any

interest as promptly as possible, OR upon the successful Bidder signing

the Contract and furnishing the Performance Bank Guarantee @ 5% of

the total order value, whichever is later.

f.​ In exceptional circumstances, the High Court of Gujarat may solicit the

Bidder’s consent to an extension of the period of validity of the EMD. The

request thereof and the responses thereto shall be in writing. A Bidder

may refuse the request without forfeiting its EMD. A Bidder agreeing to

the request will not be permitted to modify the submitted Bid.

g.​ EMD of successful Bidder of the concerned Part will be returned, without

any interest, upon the Bidder signing the Contract and furnishing the

unconditional Performance Bank Guarantee @ 5% of the total order

h.​ EMD may be forfeited:

i.​ If the Bidder withdraws its Bid during the period of Bid validity.

ii.​ In case of a successful Bidder of the concerned Part, if the Bidder

4.​ Tender Timelines:

a.​ This tender RFP has been made available on the High Court of Gujarat

b.​ Online submission of financial and technical bids on eprocurement portal

(https://tender.nprocure.com/) will be accepted till 05:00 PM on

18/09/2026. There shall be no submission of financial bids in hard

c.​ The Bidders shall submit EMD, technical bid documents and bidder

eligibility documents, duly signed and sealed, in hard copy (except the

financial Bid), at 12 noon on 19/09/2026 i.e. next working day of the

closure of timeline for submission of online Bids on the eprocurement

portal, at the office of the IT Cell of the High Court of Gujarat before any

officer(s) of the Authorised Team of the IT Cell. Bidders and/or their

representatives authorised as mentioned at Annexure A1 shall have to

remain present on that date and time with EMD, technical bid document

and bidder eligibility documents, duly signed and sealed, in hard copy

(except the financial Bid) at the IT Cell of the High Court of Gujarat. No

Bid cover will be accepted through any messenger / delivery person in

absence of the authorised representative. All these documents (except

the financial/commercial Bid) shall be opened at that time and an

acknowledgement in the prescribed proforma i.e. Proforma P4 shall be

given to the Bidders by the team of officers and also counter signed by the

Registrar (SCMS & ICT). The eligibility criteria and technical evaluation

shall be undertaken based on these physically submitted documents only.

d.​ Bids shall be valid for 60 days from the date of submission of the Bid. A

Bid valid for a shorter period shall be rejected as non‐responsive. The Bid

validity may be extended for a further period from the date of expiry of Bid

validity in consultation with the successful Bidder(s). Any delay caused by

the Bidder in resolving any queries raised during Technical Evaluation

will be considered as extension of validity of the Bid.

e.​ If required, the High Court of Gujarat may modify the Last date and time

of submission of online Bid by prior notice to be published on the

eprocurement portal and also official website & Telegram Channel of the

High Court of Gujarat.

5.​ Evaluation & Negotiation:

a.​ Evaluation:

i.​ Evaluation of the EMD, technical bid documents and bidder

eligibility documents that are physically submitted, will be carried

out by a Team of the High Court of Gujarat and thereafter

Financial Bids submitted online as per Proforma P5 by the

bidder(s) who have qualified in evaluation of EMD, technical bid

documents and bidder eligibility documents, will be opened.

ii.​ For arriving at L1 Bidder for any particular warranty option, the

quoted price for a particular Part will be compared with the other

quotes received for that item of that particular Part. In case of only

a single quote received, it would not be necessary to compare such

quote with any other quote to decide the L1 bidder. The High Court

of Gujarat may choose any warranty option and/or technical

specification option while selecting the final successful Bidder.

iii.​ The products may also be shortlisted considering the OEMs' brand

image, their service support, reputation and prior experience of the

High Court of Gujarat with OEMs in such hardware performance &

iv.​ For the purpose of technical evaluation, a demo/test unit of the

exact product offered will have to be submitted by the successful

Bidder within 7 days from the date of request made.

b.​ Negotiation: ​ ​ ​ ​

i.​ The price offers (financial/commercial Bids) that would be submitted

by the bidder(s) on the eprocurement portal, shall be preliminary

offers while the High Court of Gujarat reserves its right to negotiate

with all technically qualified bidders; so as to achieve the best

possible competitive rates of the offered products.

ii.​ The method of negotiation for the same would be as given in Method

of Negotiation before the Hon’ble Committee of the High Court of

iii.​ The successful Bidder shall be selected after negotiation with all

qualified bidders upon the rates offered by them, subject to final

approval of the Hon’ble Competent Authority. The Committee may

also opt for selection of more than one Bidder as successful Bidders

with mixed quantities / vendor / OEM / warranty / technical

specifications options etc.

iv.​ The Bidder who has quoted less than the successful bidder during

the negotiation of the concerned Part, but could not succeed, shall

be informed about the reasons concerning the particular Bidder

v.​ After Negotiation, if successful bidder of the concerned Part fails to

comply with the terms & conditions of timelines and/or other

formalities to be carried out as per this RFP, the High Court of

Gujarat reserves the right to take up further evaluation/negotiation

process as mentioned above to decide the lowest Bidder from the

remaining Bidder(s) and also negotiate to get L1 or better offer for

the concerned Part.

vi.​ For the purpose of ascertaining the best offer possible for the

products being procured, if and as required, the High Court of

Gujarat may resort to the process of price discovery of the products

in the open market while also keeping in consideration the

requirements of this RFP.

vii.​ At the end of the aforesaid exercise, the High Court of Gujarat

reserves the rights to select the best suitable product.

viii.​ Bidders may offer a higher specification product against the quoted

product, provided that such upgraded model is offered at no

additional cost to the High Court of Gujarat and meets or exceeds

all minimum technical specifications stipulated in the tender

document, subject to acceptance by the High Court.

6.​ Inspection and Sample Testing:

a.​ The High Court of Gujarat, if required, will select at least 1 sample unit

for testing purposes for the item quoted by the successful bidder of the

concerned Part. The successful bidder may also have to offer the

inspection of the sample, as may be selected by the High Court of

Gujarat, at EQDC (Electronics and Quality Development Centre),

Gandhinagar or in the manner as decided by High Court of Gujarat

before/after delivering to the respective sites or at the customer sites.

The cost of the same has to be borne by the successful Bidder. Any

deviation found in the specification of the produced goods or delivered

goods after inspection from the tender specifications will lead to the

cancellation of the order, forfeiture of EMD/PBG and prohibition from

participation in the future purchase of the High Court of Gujarat.

b.​ The High Court of Gujarat will not be responsible for any delay which

may arise due to any deviation from the technical specifications bid,

found at the time of inspection. The successful bidder has to supply,

install, test and commission the ordered goods within the prescribed

due to technical reasons, i.e. End of Life (EOL) of quoted model etc.,

then the High Court of Gujarat will also test the new higher model to be

offered at the same quoted price.

d.​ All the charges, if any, to carry out testing shall be borne by the

successful bidder. Selection of the sample(s) shall be done by the

technical inspection team of the High Court of Gujarat as per the

standard norms and procedure.

e.​ The High Court of Gujarat’s right to inspect, test and where necessary,

reject the Goods after the arrival of the Goods at the customer site shall

in no way be limited or waived by reason of the Goods having previously

been inspected, tested and passed by the High Court of Gujarat or its

representative.

f.​ In case the successful bidder fails to submit a demo/test unit of the

exact offered product within 7 days from the date of request made, the

next L1 bidder will be considered for further process as mentioned in

7.​ Delivery, Installation, Testing & Commission:

a.​ Delivery, Installation, Testing and Commission of the product shall

have to be done as expeditiously as possible not later than 60 days

from the date of issuance of purchase order.

b.​ The location for Delivery, Installation, Testing and Commission of the

products will be at the High Court of Gujarat and all the district /

taluka places of the Gujarat State.

c.​ Exact distribution of the number of items and places of delivery,

installation, testing and commission will be provided along with the

Purchase Order.

d.​ Successful bidder has to paste a non-removable sticker on the item(s)

with details of Tender No., bidder’s Name, address, contact details,

service centre/help line number and warranty expiry date, as may be

finalised by the High Court of Gujarat at the time of delivery and

installation of the item.

e.​ Copy of delivery challan and installation certificate shall be submitted

by the successful Bidder within 7-10 days of delivery, installation,

testing and commissioning with counter signing of the authorised Court

defect, damage or broken, if found during the delivery, installation,

8.​ Payment Terms:

a.​ Upon successful delivery, installation, testing and commissioning of

item(s) with compliance of all requirements as per this RFP, full

payment, as per the Purchase Order, shall be made.

9.​ Penalty Clause for Delays, Termination etc.:

a.​ Penalty Clause for delay in delivery, installation, testing and

commissioning :

i.​ If the successful Bidder fails to deliver, install, test or commission

all or any item(s) as per this RFP and Purchase Order within

days from the date of issuance of the purchase order or any

1.​ If the successful Bidder fails to deliver, install, test and

commission any or all the items within 60 days from the date

of issuance of purchase order, or within any extension thereof

granted by the High Court of Gujarat or within delay of 4 weeks

therefrom with late delivery penalty.

2.​ If the successful bidder fails to submit reports of delivery and

installation of any or all the supplied items within 7-10 days of

iv.​ In the event of High Court of Gujarat terminating the Contract in

whole or in part, for default of the successful Bidder(s), under this

clause, the High Court of Gujarat may procure, upon such terms

and in such manner as it deems appropriate, item(s) similar to

those undelivered and the Bidder shall be liable to the High Court

10.​ Warranty & Maintenance Support:

a.​ The Comprehensive onsite warranty and maintenance support by the

successful Bidder(s), directly or through the OEM, with back to back

spare parts support of the OEM, for the item(s) for full term of the

warranty period as mentioned in the respective Purchase Order, shall

have to be efficiently and promptly provided.

b.​ The onsite warranty support will be at the respective locations at the High

Court of Gujarat and Gujarat District Judiciary, where the product would

quarterly / half yearly basis shall be provided by the successful Bidder

during the period of warranty.

1.​Fault with any part of the item causing issues in working of the

item will be considered for levying the penalty.

2.​While the complaint is in the process of being resolved, if during

the aforesaid penalty durations, similar or higher configuration

11.​ Security Deposit / Performance Bank Guarantee (PBG):

a.​ The successful Bidder has to submit unconditional Performance Bank

Guarantee (Proforma P6) of any Nationalised Bank including Public

Sector Bank or Private Sector Banks or Banks (operating in India having

branch at Ahmedabad/Gandhinagar) as per applicable Government

Resolution / instructions issued by the Finance Department from time to

time @ 5% of total order value within 7 days from the date of issuance of

e.​ Upon satisfactory completion of the contract period and after 90 days

from the date of completion of the contract, if there are no liabilities or

dues in any manner to be recovered from the successful bidder, the

security deposit / Performance Bank Guarantee shall be refunded

without any interest.

12.​ Other Terms & Conditions:​

a.​ Prospective Bidders shall not approach the High Court of Gujarat or its

Officers in person or in writing, for any technical query or request for

change in technical specifications. No request for any change in the

technical specifications will be entertained or responded to.

b.​ Prospective Bidders are specifically directed NOT to make or cause to

make any contact with any Officer/Staff of the High Court of Gujarat for

meeting or discussions to influence the procurement process or its

outcome. Any such unauthorised / unofficial contact shall cause for

immediate disqualification / debarment of the Prospective Bidder.

c.​ The Bidder is expected to examine all instructions, forms, specifications,

terms and conditions of this RFP. The Bid must be precise, complete and

in the prescribed format as per requirement of this RFP. Failure to

d.​ The Bid shall be non‐transferable.

e.​ Incomplete Bids will be treated as non‐responsive and will be rejected.

f.​ The Bidder shall bear all the costs associated with the preparation and

submission of the Bid, and the High Court of Gujarat, in no case, will be

responsible or liable for these costs, regardless of outcome of Bidding

supported for spares / OEM support during the offered warranty period.

i.​ The Bidder has to submit the compliance on Non Judicial Stamp of

Rs.300/- duly attested by the First Class Magistrate/Notary Public along

with other supporting documents as per Proforma P2. Failing to submit

the same or non‐compliance/deviation from any terms and conditions,

eligibility criteria, may result in rejection of the Bid.

j.​ Amendments / Corrigendum:

i.​ At any time, prior to the last date for submission of the Bid, the High

Court of Gujarat may, for any reason, modify the RFP.

ii.​ The High Court of Gujarat, at its discretion, may extend the last

date and time for the online submission of Bids, in case of

amendments / corrigendum, in order to allow prospective Bidders to

have reasonable time for preparing their Bids.

k.​ The High Court of Gujarat reserves the absolute right to alter, modify,

amend, add, or waive any of the terms and conditions of this tender, or to

cancel the tender process at any stage, without assigning any reasons

r.​ The successful Bidder shall not be allowed to assign the issued Purchase

Order or subcontract the Purchase order, to any other person, firm and

company. Any such act shall render the EMD/PBG forfeited and make

the contract liable to be cancelled.

s.​ Wherever the term ‘working days’ is mentioned in this RFP, the same

would mean the working days as per the calendar of the High Court of

Gujarat and/or District Court published on the official website.

13.​ Force Majeure:

a.​ Force Majeure shall mean and be limited to the following:

i.​ War / hostilities.

ii.​ Riot or Civil commotion.

iii.​ Earthquake, flood, tempest, lightning or any other natural disaster.

iv.​ Restrictions imposed by the Government or other statutory bodies

which prevents or delays the execution of the order by the

successful Bidder(s).

b.​ The successful bidder(s) shall apprise the High Court of Gujarat by a

registered letter duly certified by the local statutory authorities, the

beginning and end of the above causes of delay within seven (07) days of

the occurrence and cessation of such Force Majeure conditions. In the

event of delay lasting over two months, if arising out of causes of Force

Majeure, the High Court of Gujarat reserves the right to cancel the order.

c.​ The completion period may be extended due to circumstances relating to

Force Majeure by the High Court of Gujarat. Successful Bidder shall not

claim any further extension for completion of work. The High Court of

Gujarat shall not be liable to pay extra costs under any conditions.

d.​ The successful Bidder(s) shall categorically specify the extent of Force

Majeure conditions prevalent in their works at the time of submitting

their Bid and whether the same has been taken into consideration or not

in their Quotes.

f.​ It will be the prerogative of the High Court of Gujarat to take the decision

on Force Majeure conditions and the decision of the High court of Gujarat

shall be binding to the Bidder(s).
