SectionA1–SPECIALCONDITIONSOFCONTRACT

1. This tender is invited for contract. Contractor shall have to execute the work in

allzones simultaneously. He shall have to start the work within the day of

instructionsgivenfromtheengineer.

2. AMC will have to give the instruction to start the work all together for more than

oneplaceindifferentArea.Heshouldhaveminimummachinerystatedineligibilitycriteria.

3. The Bill of Quantities shall be reading conjunction with the Instruction to

Bidders,ConditionsofContract,andTechnicalSpecifications.

4. Thebiddermust havevisitedandexamined

theareaoftheWorksanditssurroundingsandobtainedalldataanditishisownrespo

nsibility.Allinformation that may be necessary for preparing the bid and

entering into acontract for this type of Works. The costs of visiting the site

shall be at thebidder'sownexpense.

5. Bidder must have knowledge ofexisting sewage flow quantity or he must have gotdata

of sewage flow quantity in the sewerage trunk main lines or Branch sewer

linesandhemusthaveawareofrequiredpumpingfordiversionoftheexistingflow.

Biddershallhavetomaintainflowlevelinallmanholeofupstreamlineduringdiversion of flow

by proper pumping system. In this regard bidder shall have

todiverttheflowinsamelinebyalternatemanholedistanceifthereisnoextraline

andheshallnotraiseanyissueofextralinefordiversionofthe flow.

6. The bidder and any of its personnel or agents will be granted permission by

theEmployer to enter its premises and lands for the purpose of such inspection, but

onlyupon the express condition that the bidder, its personnel and agents, will

release andindemnify the Employer and its personnel and agents from and against

all liability inrespect thereof and will be responsible for death or personal injury, loss

of or damagetoproperty andany other loss,damage, costs and expenses incurred

asaresult ofthe inspection.

7. No claim in future for unknown with the site by the bidder shall begranted

octroi and othercharges together with all general risks, liabilities and obligations set

11. BidderisrequestedtofillrateontotalcostoftheBOQconsideringtheContract.

AMC shall evaluate bidders capability to work considering work on hand

andwork in progress in all parts of India. AMC shall evaluate bidder`s capability

ofdoing the work considering working progress and response to the

instructionsdelivered from AMC engineers and authority to him. Bidding

capacity shall beconsideredapplyinggeneralformula.

(Note:Ifanyquarryinthisclausebiddershallclarify/maycontactbeforeenteringintothecontract.)

12. Contractor shall fill percentage rate on amount of BOQ. Items other than in the

BOQwill bepaid for by theEmployer onactual measurement (preferably current SOR

ofanyorganization)onsiteifexecuted.

13. Employer reserves the right to accept the tender of more than one

bidderwithlowest approved rate and also reserves the right to give the work order

to more thanone bidder with same approved rate of the lowest bidder.Any bidder of

lowest quotedrate cannotclaimforhissolelyqualifiedtender.

14. The contractor should have to attend the breakdown if any as early as possible

andshouldhavetocompletetheworkwithoutunavoidabledelay.

15. Contractor shall have to provide experienced operator and workers on hiring of

supersuckeronshiftbases..

16. Paymentshallbegivenwithin15daysontheraiseofmonthlybill.

17. In case of Accident or death of Employer’s of Contractor or third party, A.M.C. will

notbe Responsibleinanymanner/Manners.

18. IncaseofdamageofmachinesduetoAccident,AMCwillnotberesponsible.

19. Inanycase,contractorisnotallowedto workinsidethemanholeorsewerlines.

20. TheoperatorandworkersshallbeContractor’semployees.Corporationstaff(Technical

Supervisor / Engineers) will show only the site where the work is to becarriedout.

21. Contractor shall not raise any claim for too less or too more quantities

executedby him.Quantity may vary withrespect toBOQas wellasplaceof

workalsomaychangecitedinthetender.AMCwillexecutethiscontractsubjectto

MaintainingEnvironmentalmeasureswithhelpofmechanical/anytypeofequipmentforthe

1.3 The scope of work shall consist of full comprehensive operation and maintenance

ofabove equipment including supply of all type of consumable and spares, Diesel

andEngineoilandshallincludethefollowingservices.

1.4 ProvideServicesoftwosupervisor,twomechanicforallmachines,onedrivercumoperator,on

eskilledandfourunskilledlaboursperunitincludingTechnicalbackupSupportofEngineer/Tec

hnician asperrequirements.

ThesanitarystaffforhandlingthesuctionhoseandJettinghoseshallalsobeprovidedasactualre

quiredonsiteforease&effectiveoutputofmachineathisowncost.

1.5 Routinemaintenanceandservicingofmachineincludingreplacement

offiltersforhydraulicoil,engineoiletcas&whenrequired.

1.6 Provide consumables such as lubricants, hydraulic oil, oil for compressor, filters,

jettinghose,suctionhosesdieselandengineoiletcas&whenrequired.

1.7 AllMinorandmajorrepairsofmachineincludingsparesasperrequirement.

1.13 Bidder shall note that AMC may cancel the work at any stage of the contract. AMC

canterminate the contract incase of curtailment of the scope of the work. Contractor will

notbeentitledto raiseanyclaimregardingcurtailmentofthescopeofthe work.

2. SourceofFunds

2.1 TheexpenditureontheseWorkswillbemetbyAHMEDABADMUNICIPALCORPORATION.

3. EligibilitycriteriaforBidders

Thisinvitationforbidsisopentobidderswhomeetthefollowingrequirements:

3.1 A bidder shall have similar type experience of the work in any Govt., Semi-Govt. or ULBs of

anysuch organisation with the latest de-silting equipment and undertaken as per Supreme

Court/HighCourtGuidelines/DirectionofGovt.G.R.

3.2 BiddershouldhaveregisteredhisclassinAhmedabadMunicipalCorporationwithinsixmonthsafterallo

cation ofthe work.

3.3 Biddershallhavecompleted

(i) onesimilarworkcosting80%ofthePackagecostormore,OR

(ii) twosimilarwork costing60%ofthepackagecostormoreOR

(iii) Three similar work costing 40% of the package costor

moreinlastSeven year.

For the purpose of this clause, pipe de-silting/ cleaning with the help of vacuum technology

shallbeconsideredfor’similarworks’forthisspecial task.

3.4 Joint venture is not allowed for the work.

Payment will be made after getting satisfactory working report from the user Department.

4. QualificationoftheBidder

4.1 TobequalifiedforawardofContract,biddersshall:

a) Submit a written power of attorney authorizing the signatory of the bid to commit

b) Have adequate experience, financial capacity, adequate available bid capacity

andtechnical capability to undertake the Contract.Confirmation of these matters

mayinvolvetheupdating,verificationandreassessmentofinformation,whichmaypreviously

havebeenconsideredduringprequalification.

c) The bidder shall submit the following information (Form1 of General Information)

oneligibility andqualificationdulyupdatedincludinganychangessinceprequalification:-

4. Contractor should have sufficient skilled and unskilled labours so that he shall start work

atdifferent sites simultaneously. Contractor's having labour force available during festivals

shallonly apply. Contractor can not stop the work due to unavailability of labour force. In

caseprogressisdelayed,contractorshallbepenalized0.1%ofTenderamountperdayforworkdoneafter

timelimit, maximumupto 10%forremainingwork.

5. No rate difference will be paid for due to any increase in rate of any item due to any

reasonwhatsoever.

6. Nopriceescalation/ advancepayment/ machineryadvancewillbepaid.

7. Paymentofrunningbillwillbemadeas perrecentA.M.C.policyin force.

8. Noextrapaymentwillbemadedueto increaseofcentral/stateGovt.Taxes.

9. If the work is not completed within time limit the penalty will be recovered from

immediatebillsofcontractors.

10. If the material i.e. MH cover, C.C block etc is supplied from Municipal Corporation store

thencontractorshallnotclaimforanyextraratefornonexecutionofsuchitem,partly/fully.

11. In the specifications, "as directed"/"Approved" shall be taken to mean, "as

directed"/approved"bytheEngineer-in-charge.

12. Wherever a reference to any Indian Standard appears in the specifications, it shall be

taken tomeanas areferenceto thelatest editionofthesamein forceonthedateofagreement.

13. In "Mode of Measurement" in the specifications wherever a dispute arises in the absence

ofspecific mention of a particular point or aspect, the provisions on these particular points,

oraspectsin therelevantIndianStandardsshallbereferredto.

14. All measurements and computations, unless otherwise specified, shall be carried out nearest

tothefollowinglimits:

24. Materials,ifandwhenrejectedby theEngineer-in-

25. Nomaterialsshallbestoredpriorto,duringandafterexecutionshallbekeptinsufficientnumbersandin

goodworkingconditiononthesiteofthework.

26. Allworksshallbecarriedoutinworkmanlikemannersasperthebesttechniquesfortheparticularitem.

27. All tools, templates, machinery and equipment for correct execution of the work as well as

forchecking lines, levels, alignment of the works during execution shall be kept in

sufficientnumbersandingoodworkingconditiononthesiteofthework.

28. The mode, procedure and manner of execution shall be such that it does not cause

damage orover loading of the various components of the structure during execution or after

completion ofthestructure.

29. Allnecessary safetymeasuresandprecaution(includingthoselaiddowninthevariousrelevant Indian

Standards) shall be taken to ensure the safety of men, materials and machineryontheworksas

alsooftheworkitself.

30. The testing charges of all materials shall be borne by the Contractor unless recovery at

onepercenttowardstestingchargesis separatelymade.

31. Contractor has to provide Sale Tax, Vat no., PF code no. etc.If contractor failes to

providesuchdocumentsthenhis/herTenderwillbecancelled.

GENERALSPECIFICATION

1. Timelimit fortheworkshallbe6Monthsaftertheordertostartthework.

2. The contractor shall have to maintain account of steel, cement and other materials that may

bebrought by him on site. This account shall be regularly maintained and kept open for inspection

byMunicipalStaff.

3. Watering of all the items shall be as per instructions otherwise no payment shall be made

tocontractors.Mixingofconcreteshallbedonebyconcretemixermachine.

4. ThecontractorshallberesponsibleforWorkmen’scompensationifanyaccidentoccurs.

5. The contractor shall arrange for barricading at night and arrangement of Pagi at night to direct

thetraffic.Heshallberesponsibleforanydamagetopublic.

6. if any incident happen, during the execution of work. In case of dispute for unseen or

overlookeditems,thedecisionoftheAdd.C.E.(CZ)shallbefinal.

7. The contractor shall have to give site clean of all rubbish during the work and at the time

ofcompletionofworkandhandoverthesitewithfinalfinishingoftheworkas directed.

8. If any extra item crops up during the progress of work the same shall be carried out by

thecontractor and he shall be paid at the rate fixed by Add..C.E. as per the rate analysis based on

latestSOR or if item is not available in SOR than based on current market rates. In case of extra

itemdecisionofAdd.CityEngg.shallremainfinalregardingrate.

9. If in the interest of the Corporation it is necessary to change either any site or the design of

thepropose work the contractor shall carry out the same at his quoted rates without charges any

extraand the contractor will have to carry out the works and he will be paid atthe rate quoted by

him.Noclaim forextrarateforsubsequentchangesinsiteanddesignentertained.

10. The cubical contents of the cement bag shall be taken as 1-20 cft. Per bag and the contractors

shallhaveto preparethemeasuresboxesaccordingto thismeasure.

11. Octroiexemptionpassesshallnotbegivenforanymaterialsrequiredforthework.

12. Contractor will be fully responsible for compliance of the various provisions under contract

Act.1970andtheRulesframedto under.

13. The tender for the work shall remain open for a period (120) days from the date of opening of

thetenders for this work and that the tenderer shall not be allowed to withdraw on modify the offer

onhisownduringtheperiod.Ifanytendererwithdrawsor marks any modifications

oradditionsinthetermsandconditionsofhistender,notacceptabletotheMunicipal

Corporation,thenMunicipalCorporationshall,without prejudice to any r ight orremedy, be

at l iberty to forfeit in full the said earnest money absolutely and black list thecontractor.

Contractorsshouldnotethefollowingconditionscarefully:-

1. Conditionaltendershallnotbeaccepted.

2. Alltendersareto besubmittedin duplicatewithoutwhichthetenders areliableto berejected.
