FINANCIAL ELIGIBILITY CRITERIA: The tenderer must have minimum average annual contractual turnover of V/N crores; where V= Advertised value of the tender in crores of Rupees N= Number of years prescribed for completion of work for which bids have been invited. The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover. The tenderers shall submit requisite information as per Annexure-E, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet.
Bid Capacity: Not applicable.
Credentials if submitted in foreign currency shall be converted into Indian currency i.e., Indian Rupee as under: The conversion rate of US Dollars into Rupees shall be the daily representative exchange rates published by the Reserve Bank of India or entity authorized by RBI to do so for the relevant date or immediately previous date for which rates have been published. Where, relevant date shall be as on the last day of month previous to the one in which tender is invited. In case of any other currency, the GCC (Works) 2022 same shall first be converted to US Dollars as on the last day of month previous to the one in which tender is invited, and the amount so derived in US Dollars shall be converted into Rupees at the aforesaid rate. The conversion rate of such currencies shall be the daily representative exchange rates published by the International Monetary Fund for the relevant date or immediately previous date for which rates have been published.
Explanation for clause of Eligibility Criteria:
Substantially Completed Work means an ongoing work in which payment equal to or more than 90% of the present contract value (excluding the payment made for adjustment of Price variation (PVC), if any) has been made to the contractor in that ongoing contract and no proceedings of termination of contract on Contractor's default has been initiated. The credential certificate in this regard should have been issued not prior to 60 days of date of invitation of present tender.
In case a work is started prior to 07 (Seven) years, ending last day of month previous to the one in which tender is invited, but completed in last 07 (Seven) years, ending last day of month previous to the one in which tender is invited, the completed work shall be considered for fulfillment of credentials.
If a work is physically completed and completion certificate to this extent is issued by the concerned organization but final bill is pending, such work shall be considered for fulfillment of credentials.
In case of completed work, the value of final bill (gross amount) including the PVC amount (if paid) shall be considered as the completion cost of work. In case final bill is pending, only the total gross amount already paid including the PVC amount (if paid) shall be considered as the completion cost of work. In case of substantially completed work, the total gross amount already paid including the PVC amount (if paid), as mentioned in the certificate, shall be considered as the cost of substantially completed work.
If a bidder has successfully completed a work as subcontractor and the work experience certificate has been issued for such work to the subcontractor by a Govt. Organization or public listed company as defined in note for item 2.1 of para 2, the same shall be considered for the purpose of fulfillment of credentials.
In case a work is considered similar in nature for fulfillment of technical credentials, the overall cost including the PVC amount (if paid) of that completed work or substantially completed work, shall be considered and no separate evaluation for each component of that work shall be made to decide eligibility.
In case of existing partnership firm, if any one or more partners quit the partnership firm, the credentials of remaining partnership firm shall be re-worked out i.e., the quitting partner(s) shall GCC April 2022 take away his credentials to the extent of his share on the date of quitting the partnership firm(e.g. in a partnership firm of partners A, B & C having share 30%, 30% & 40% respectively and credentials of Rs 10 crore; in case partner C quits the firm, the credentials of this partnership firm shall remain as Rs 6 crore). For this purpose, the tenderer shall submit along with his bid all the relevant documents which include copy of previous partnership deed(s), dissolution deed(s) and proof of surrender of PAN No.(s) in case of dissolution of partnership firm(s) etc.
In case of existing partnership firm if any new partner(s) joins the firm without any modification in the name and PAN/TAN no. of the firm, the credentials of partnership firm shall get enhanced to the extent of credentials of newly added partner(s) on the same principles as mentioned in item 6 above. For this purpose, the tenderer shall submit along with his bid all the relevant documents which include copy of previous partnership deeds, dissolution/splitting deeds and proof of surrender of PAN No.(s) in case of dissolution of partnership firm etc.
Any partner in a partnership firm cannot use or claim his credentials in any other firm without leaving the partnership firm i.e., In a partnership firm of A&B partners, A or B partner cannot use credentials of partnership firm of A & B partners in any other partnership firm or propriety firm without leaving partnership firm of A&B partners.
In case a partner in a partnership firm is replaced due to succession as per succession law, the proportion of credentials of the previous partner will be passed on to the successor.
If the percentage share among partners of a partnership firm is changed, but the partners remain the same, the credentials of the firm before such modification in the share will continue to be considered for the firm as it is without any change in their value. Further, in case a partner of partnership firm retires without taking away any credentials from the firm, the credentials of partnership firm shall remain the same as it is without any change in their value.
In a partnership firm "AB" of A & B partners, in case A also works as propriety firm "P" or partner in some other partnership firm "AX", credentials of A in propriety firm "P" or in other partnership firm "AX" earned after the date of becoming a partner of the firm AB shall not be added in partnership firm AB.
In a partnership firm "AB" of A & B partners, in case A also works as propriety firm "P" or partner in some other partnership firm "AX", credentials of A in propriety firm "P" or in other partnership firm "AX" earned after the date of becoming a partner of the firm AB shall not be added in partnership firm AB.
In case a tenderer is LLP, the credentials of tenderer shall be worked out on above lines similar to a partnership firm.
In case company A is merged with company B, then company B would get the credentials of company A also.
Tenderer Credentials Documents testifying tenderer previous experience and financial status should be produced along with the tender. Tender(s) who is/are not borne on the approved list of for Manufacture & Supply of Dynamic Braking Resistance of Electric Locomotives, shall submit along with his/their tender. Non submission of the certificate by the tenderer shall result in summarily rejection of the his/their tender :
Certificates and testimonials regarding contracting experience for the type of job for which tender is invited in the form of Annexure-B, with list of works carried out in the past in the form of Annexure-B. The tenderer should also submit the list of works on hand indicating name of work, contract value, bill amount paid so far, due date of completion etc. to be furnished by contract in Annexure-C. Experience Certificate Annexure-D.
Audited Balance Sheet duly certified by the Chartered Accountant regarding contractual payments received in the past in the form of Annexure-E.
The list of personnel / organization on hand and proposed to be engaged for the tendered work in the form of Annexure-G. Similarly list of Plant & Machinery available on hand and proposed to be inducted and hired for the tendered work in the form of Annexure-F.
The Railway reserves the right to verify all statements, information and documents submitted by the bidder in his tender offer, and the bidder shall, when so required by the Railway, make available all such information, evidence and documents as may be necessary for such verification. Any such verification or lack of such verification, by the Railway shall not relieve the bidder of its obligations or liabilities hereunder nor will it affect any rights of the Railway there under.
(a)In case of any information submitted by tenderer is found to be false, forged or incorrect at any time during process for evaluation of tenders, it shall lead to forfeiture of the tender Bid Security besides banning of business for a period of up to five years. (b) In case of any information submitted by tenderer is found to be false, forged or incorrect after the award of contract, the contract shall be terminated. Bid Security, Performance Guarantee and Security Deposit available with the railway shall be forfeited. In addition, other dues of the contractor, if any, under this contract shall be forfeited and agency shall be banned for doing business for a period of up to five years.
Verification of Tenderer's Credentials: The tenderers shall submit a copy of certificate stating that all their statement/documents submitted along with bid are true and factual. Standard format of certificate to be submitted by the bidder is enclosed as Annexure-V. In addition to Annexure-V, in case of other than company/Proprietary firm, Annexure- V(A) shall also be submitted by the each member of Partnership firm/Joint Venture (JV)/Hindu Undivided Family(HUF)/Limited Liability Partnership(LLP) etc. as the case may be. Non-submission of above certificate(s) by the bidder shall result in summarily rejection of his/their bid. It shall be mandatorily incumbent upon the tenderer to identify, state and submit the supporting documents duly self-attested/digitally signed by which they/he is qualifying the qualifying criteria mentioned in the Tender Document and in tender document details.
Bidder shall enclose the certificate regarding declaration of information regarding Employment/ Partnership/Relatives employed in Gazetted Capacity etc. of Retired Railway Engineer /Manager with the tenderer as per Annexure -H.
Non-compliance with any of the conditions set forth therein above is liable to result in the tender being rejected.
Similar nature of work defined as: "Manufacture & Supply" OR "Repair/Reconditioning" of Dynamic Braking Resistance of Electric Locomotives.
For firms who are sources approved by RDSO/CLW/BLW for Manufacture & Supply of Dynamic Braking Resistance of Electric Locomotives, the technical and financial eligibility criteria is dispensed as per Railway Board's letter no. 2019/Elect(G)/165/1, dated 22.04.2020.
Firms not featuring in sources approved by RDSO/CLW/BLW for shall have to fulfill the Eligibility Criteria and shall have to submit the documentary proof in support of their credentials/satisfactory performance till last day of the month previous to the one in which tender is invited to fulfill the eligibility criteria. Non submission of both of these documents would lead to summarily rejection of the Bid.
ELIGIBILITY CRITERIA :
TECHNICAL ELIGIBILITY CRITERIA:The tenderer must have successfully completed or substantially completed any one of the following categories of work(s) during last 07 (Seven) years, ending last day of month previous to the one in which tender is invited:
Three similar works each costing not less than the amount equal to 30% of advertised value of the tender, or
Two similar works each costing not less than the amount equal to 40% of advertised value of the tender, or
One similar work costing not less than the amount equal to 60% of advertised value of the tender.
Note for Item 2.1: Work experience certificate from private individual shall not be considered. However, in addition to work experience certificates issued by any Govt. Organization, work experience certificate issued by Public listed company having average annual turnover of Rs. 500 crore and above in last 3 financial years excluding the current financial year, listed on National Stock Exchange or Bombay Stock Exchange, incorporated/registered at least 5 years prior to the date of closing of tender, shall also be considered provided the work experience 2.1.4 certificate has been issued by a person authorized by the Public listed company to issue such certificates. In case tenderer submits work experience certificate issued by public listed company, the tenderer shall also submit along with work experience certificate, the relevant copy of work order, bill of quantities, bill wise details of payment received duly certified by Chartered Accountant, TDS certificates for all payments received and copy of final/last bill paid by company in support of above work experience certificate.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.
GENERAL: These special conditions should be read in conjunction with the general instructions to tenderer and general conditions of contract. If any of these special conditions stipulated hereunder is found to be contradictory to that specified elsewhere in the Tender-documents, it should be understood that the conditions stipulated hereunder namely 'Special conditions of Contract' shall prevail over and above that specified elsewhere.The contract is governed strictly by the general conditions of contract as well as special conditions and technical specifications. Where there is any conflict between the "Special Conditions and Specification" and the General condition of contract, the former shall prevail. The General Conditions of contract will mean the Indian Railways Standard General Conditions of Contract (GCC) for Works Contract, April 2022 or latest as amended and/or corrected from time to time and obtaining at the time of acceptance of the tender and at the time of execution of the agreement. It should be the responsibility of the contractor before submitting his tender and again before entering in to said agreement to ascertain all amendments and/or corrections made to the said General conditions of contract.Price Variation: Price Variation (PV) clause shall not be applicable to this tender/contract. No claim on account of PV shall therefore be entertained under any circumstances. The rates accepted shall be firm during the currency of contract.
REQUIRED FACILITIES: RDSO approved sources are eligible to quote for the subject work. The tenderer who are not appearing in approved list of RDSO, should have following minimum facilities. a)Vacuum impregnation Plant for impregnation the Asbestos Components with silicon Varnish. b)Power source suitable for conducting the air delivery test. c)Computerized data logger sensor to record the temperature rise of the resistor unit. d)Dynamic Balancing arrangement for blower motor. e)Measurement of Resistance valve. f)Dielectric test facility.
COMPLETION PERIOD: The entire work shall be completed within 24 (Twenty four) months from the date of issue of the Letter of Acceptance. The completion of work includes execution of entire scope of work as per contract conditions including all tests, stage and final inspection, associated transportation of materials between contractor's works and shed and acceptance of work by Railway to the entire satisfaction of Engineer.
LOT SIZE: The lot size is as below: The lot of 04 nos RF block as per availibility of RF Block at DLS/R.
DELIVERY PERIOD FOR EACH LOT: The firm has to deliver the repaired lot within 45 days from the date of lifting from DLS/Raipur. Fan lifted along with lot shall be returned in the same lot. For every addition of lot, 30 days will be added in delivery period of that lot. If added lot is in part, then for each equipments (i.e. RF block ) additional 08 days will be added in delivery period.
TRANSPORT: The entire to & fro cost of transportation including transit insurance to and fro between DLS/Raipur & contractor's works shall be borne by contractor and inclusive in quoted prices. All the transport required for carrying out and completion of work, various stage & raw material tests & sending all the material required for the work from contractor's works to DLS/Raipur and vice versa and for rectification of defects noticed at the time of commissioning as well as during warranty period on both the direction will be arranged by contractor at his own cost & risk. However the material handling facilities within Railway Shed (covered) shall be afforded by Railway to the contractors transport by way of OH EOT crane etc for loading & unloading in Railway premises. Contractor's road crane etc material handling equipment shall not be permitted to operated within shed. No transport, no material handling equipment other than mentioned above, no water, no electricity no space and no tools, tackles, machines & equipment shall be provided by Railway except that for testing and commissioning at Railway's shed and crane for loading & unloading in Railway premises.
WARRANTY: (i)The repaired DBR assembly shall carry a warranty of 12 months from the date of Commissioning OR 18 months from the date of receipt of DBR assembly at DLS/Raipur, whichever is earlier. (ii)If any defect/failure noticed during the warranty period, contractor will rectify the same free of cost. (iii)The defect/failure of DBR during warranty period shall be intimated through e-mail communication by DLS/Raipur. The repaired DBR shall be returned to DLS/Raipur within 60 days from the date of e-mail communication.
BILL PASSING AND BILL PAYING OFFICER: Sr.DME/D/Raipur will be Bill passing officer and Sr.DFM/Raipur shall be the Bill paying Officer.
PRICE SCHEDULE: (i)GST is applicable to this contract & documentary evidence of deposit of GST shall be submitted by Contractor. If there is any statutory change in the taxes / reforms by the Government, the same will be applicable as per the extent rule during the currency of contract. The firm will bring out the changes to the notice of Railway Authorities along with the relevant documents. (ii)The rates quoted by the tenderer shall be firm during the currency of the contract there will be no change in the rates. (iii)The rates to be quoted inclusive of GST & other levies if any. (iv)No claim of reimbursement of any kind whether due to statutory variation or otherwise shall be entertained under any circumstances except for GST. (v)If desired a certificate stating that material is required for Railway's own use shall be issued. Tenderer(s) are advised to take into account the financial implications of these stipulations before quoting the rates.
PRICE VARIATION: Price Variation Clause (PVC) shall not be applicable to this tender. The rates accepted shall be firm and no claim on account of PVC shall therefore be entertained under any circumstances.
PAYMENT TERMS: The payment to the extent of 100% of the work done will be made to the Contractor after the entire satisfaction of the Railways on the basis of certification of authorized Railway's representative subject to submission of necessary documents. All the claims for payment shall be accompanied with the following documents- i.Material Receipt Certificate i.e. receipt of material by shed in good condition, duly repaired. ii.Railway's inspection certificate iii.Railway's acceptance certificate. iv.All test reports. v.Transit insurance certificate. vi.Certificate from the Contractor and Railways Engineer that all the material used is of OEM/RDSO approved make.,
SECURITY DEPOSIT AND PERFORMANCE GUARANTEE & REFUND : Refer GCC (Works) April 2022 along with all amendments.
DEVIATION:.Deviation from any of the clauses of the above must be clearly pointed out in a letter which must accompany the tender. Clauses not so commented on will be taken as having met with the approval of the Tenderer and will therefore be binding on the Contractor.
PENALTY: i.In case of not adhering to the overall completion period, the penalty will be deducted as per clause No.17-B of General Conditions of contract. ii.Also the competent authority while granting extension to the currency of contract under clause 17(B) of GCC may also consider levy of token penalty as deemed fit based on the merit of the case. iii.The penalty will normally be deducted from the bills & total penalty to be deducted shall be subject to the maximum limit as per GCC clause. The decision of controlling officer of respective shed in this regard will be final and binding. iv.Not adhering to delivery schedule will result in penalty of '200/- per day or part thereof for each DBR with maximum penalty of 25% of accepted rate of DBR. v.Not attending the warranty failure within time limit will result in deduction of payment made for that DBR to contractor from subsequent bill if any. If no bill is due, penalty amount will be adjusted against SD/PBG etc. vi.Besides penalties specified above, Sr.DME (Diesel)/Raipur reserves the right to impose any other penalty/penalties for non-compliance of any of the terms & conditions of the contract or unsatisfactory work. The decision of Railway Administration in this respect shall be final and binding and no claim in this respect shall be entertained.
LIABILITY FOR THE COST OF LABORATORY TEST: In the event of rejection of material by the inspector in consequence of the sample hereof, which is removed to the laboratory or other place of test being found on test to be not in conformity with the contract or in the failure of the contractor for any reason to deliver the raw material passed on tests within the stipulated period of the contract or shall on demand pay to Engineer all cost incurred in the inspection and/or tests. Cost of test shall be assessed at the rate charged by the laboratory to private person for similar work.
USE OF MATERIAL: i.The successful contractor will use the material purchased from OEM/RDSO/CLW approved sources as per Railway approved drawings and specifications only. ii.All the material and workmanship shall confirm to the Railway Specifications (Railway Board/RDSO/CLW/Zonal Railway etc), the ISS, the BSS, the IEC and other slandered Codes of Practices. iii.Contractor has to produce the documentary evidence for purchase and use of material to Railway's inspecting authority during stage inspection and final inspections as proof of purchase of raw material/spares from OEM/RDSO/CLW approved sources.
RELEASED MATERIAL: The DBR assembly shall be handed over to the firm deficient of grid resistances, copper connecting links, all types of terminal boards, cables, insulators, airflow switch and thermostat switch. All the other released material shall be retained by the firm. Tenderer shall take into consideration this aspect while quoting the rates.
SAFE CUSTODY OF RAILWAY MATERIAL: The contractor shall ensure safe custody of the DBR assembly at their premises sent for repair. For this purpose the contractor has to submit the Indemnity Bond in the Railway's Prescribed format (Annexure AI) on the stamp paper of Rs.500/- duly attested by Notary for Rs.3,00,000/- (Rs. Three Lakh Only) per defective DBR assembly in favour of Sr.DME/D/R. The contractor's Indemnity Bond for indemnifying Railway material shall be released after the completion of warranty period of the contract. The firm has to submit Indemnity bond as per Annexure AI.
PACKING (i)The contractor has to collect the defective DBRs from respective shed. Special care shall be taken by firm, to prevent the damage during transit. (ii)While returning the repaired DBR assembly, the contractor has to ensure that the DBR assembly is packed properly to avoid any damages, moisture and dirt absorption or electrostatic/ electromagnetic damage. (iii)Transit insurance of the equipment is to be arranged by the contractor. Responsibility of packaging and sealing for receiving /sending of DBR assembly lies with the contractor. (iv)All expenditure towards packing and forwarding will be borne by contractor.
GENERAL: (i)No claim for idle labour and or idle machinery etc on any account will be entertained. Similarly no claims shall be entertained for business loss or any such loss. (ii)Tenderer may inspect DLS/Raipur to assess the nature and quantum of work before quoting. (iii)The work shall be executed by properly skilled staff under supervision of qualified supervisor/engineer. (iv)The responsibility for safe custody of the Contractor's materials, tools etc. will be of the Contractor. (v)It will be the responsibility of the Contractor to ensure that all his workmen observe industrial safety rules, procedures, methods, practices etc. Railway will not be responsible for any accident (fatal or non-fatal) or injury minor/major to the personnel of contractor or the financial implication arising there from. (vi)In case of injury/ death of Contractor staff, no claim of compensation will be entertained by the Railway. (vii)The Contractor shall be liable to pay for direct losses, damages caused to Railways by him or his workmen knowingly/unknowingly while they are in Railway premises working or not working. The amount shall be determined by the Controlling officer of respective shed. (viii)All disputes, differences, arising in connection with this contract if concluded shall be subject to the exclusive jurisdiction of Raipur court.
USE OF CONTRACTORS VEHICLES & EQUIPMENTS FOR DISASTER MANAGEMENT: Railway reserves the right to draft in vehicles and equipments of Contractor in case of accidents/ natural calamities involving human lives. For payment purpose, the item may be operated as a Non-Schedule item as per existing norms.
TAXES AND DUTIES: The contractor shall bear all types of taxes and duties in full viz., levied by the State Government/ Central Government/local bodies from time to time. This would be entirely a matter between the contractor and or Central Government and no claim what so ever on this account shall be entertained by the Railways. Income Tax, Toll tax, Entry Tax, Green tax etc. if recoverable will be deducted at source, for which no reimbursement will be made to the contractor by Railways. In other words, the tenderer should quote their rates taking in to consideration all taxes & duties whatsoever as Firm cost. No variation of Taxes & duties during the period of contract will be considered. (i) GST: The accepted rates are inclusive of GST. GST, as applicable from time to time, will be reimbursed by Railways, on production of documentary proof regarding the payment of GST to Government by contractor. TDS on GST will be deducted (ii) DEDUCTION OF INCOME TAXES AT SOURCE: The Railway shall deduct applicable taxes at source at the time of arranging payments to the contractor as per proceeding rates and laws. (iii) Statutory Deductions that are required to be remitted directly by the Railway, if any, to the appropriate authorities shall be recovered from the contractor's bill. NB: The above taxes are indicative and may vary as per applicable tax laws from time to time.
INDEMNITY BOND/Deposit against issue:-The Railways materials handed over to the contractor will be at contractors works until they are returned to railway, duly carrying out repairs. It is a practice that whenever any machinery/material belonging to railways are handed over to any outside agency for any work, the estimated cost of machine/material is either deposited in cash with the railways in the form of FDR in favour of FA&CAO/BSP/SEC Railway, or any Indemnity Bond on the railway's prescribed form by contractor for an equivalent amount in favour of Diesel Loco Shed-Raipur is to be submitted to railways duly indemnifying safe custody of the machine/material at a contractors works. Estimated cost of each DBR is approx. Rs 3.00 Lakhs (Rupees Three Lakhs only). The firm has to submit indemnity for a total amount equivalent to the value of numbers of DBR that may be retained by the firm for overhauling purpose at a time. The Contractors Indemnity Bond/FDR for indemnifying railway material shall be released on receipt of entire contracted quantity for repaired equipments by railways.
Tenderer should provide the details of bank account No., Banker's name & address, MICR, IFSC code & NEFT code of the bank.
GST / INCOME TAXGST shall be payable / deducted from bill as per extent rules. Income tax @ 2% shall be deducted from bill.Tenderer may consider this aspect while quoting for the work.
DAMAGE TO RAILWAY PROPERTY: The contractor shall ensure that all the Railway equipments, fittings, parts are well protected and do not suffer any damages during the course of the work or afterwards as a result of his work. The contractor shall be liable to pay for direct losses, damages caused to the Railways by him or his workmen knowingly/unknowingly while they are in Railway premises working or not working. The amount shall be determined by the railway.
Shramikkalyan portal A.Contractor is to abide by the provisions of payment of wages act & Minimum wages act in terms of clause 54 and 55 of Indian railways general condition of contract. In order to ensure the same, an application has been developed has beendevelopedandhostedonwebsite 'www.shramikkalyan.indianrailways.gov.in'. Contractor shall register his firm/company etc. and upload requisite details of labour and their payment in this portal. These details shall be available in public domain. The registration/updation of portal shall be done as under: a)Contractor shall apply for onetime registration of his company/firm etc. in the shramikkalyan portal with requisite details subsequent to issue of Letter of Acceptance. Engineer shall approve the contractor's registration on the portal within 7 days of receipt of such request. b)Contractor once approved by any Engineer, can create password with login ID(PAN No) for subsequent use of portal, for all LOAs issued in his favour. c)The contractor once registered on the portal, shall provide details of his Letter of Acceptance (LOA)/Contract Agreements on shramikkalyan portal within 15 days of issue of any LOA for approval of concerned engineer. Engineer shall update (if required) and approve the details of LOA filled by contractor within 7 days of receipt of such request. d)After approval of LOA by engineer, contractor shall fill the salient details of contract labours engaged in the contract and ensure updating of each wage payment to them on shramikkalyan portal on monthly basis. e)It shall be mandatory upon the contractor to ensure correct and prompt uploading of all salient details of engaged contractual labour & payments mode thereof after each wage period. B.While processing payment of any 'On Account bill' or 'Final bill' or release of 'Advances' Or 'Performance Guarantee/Security deposit', contractor shall submit a certificate to the Engineer or Engineers representatives that ''I have uploaded the correct details of contract labours engaged in connection with this contract and payments made to them during the wage period in railways Shramikkalyan portal at 'www.shramikkalyan.indianrailways.gov.in' till ------ Month---------- --------Year------------
Conditions for issue of identity cards by contractors: The contractor is bound to issue Identity card to each and every person employed by him and deployed for execution of the contract work as given below, at his own cost. Failure on the part of the contractor to issue identity cards to their employees will be treated as breach of contract conditions and therefore will be dealt as per GCC. It is mandatory on the part of every employee, deployed by the contractors to keep in his possession, the identity card, issued by the contractor throughout the execution of the work. Failure to possess such identity will be treated as unauthorized persons in the Railway premises. Such persons shall be liable for prosecution as per law. It is mandatory for the contractors to submit the list of employees issued with the identity cards and deployed for execution of the particular contract, to the Railway's Engineer at site before commencement of the work and also for any subsequent changes made during the execution of work. No claims whatsoever arising out of implementation of special conditions pertaining to issue of Identity cards shall be admissible. As soon as the contract work is over or a contract worker leaves the contractor, the contractor must cancel the identity card. Contractor shall submit the police verification certificate of the labour deployed by him for this contract. Concerned SSE shall signed the I-card ensuring the police verification certificate of labour deployed by the contractor.
SUBMISSION OF DOCUMENT Tenderer shall go through clause 14 of GCC 2022 Part 1 and tenderer shall also clearly specify whether the tender is submitted on his own (Proprietary Firm) or on behalf of Partnership Firm/Company/Registered society/ Registered trust/ Hindu undivided family/Limited Liability Partnership etc. The tenderer(s) shall enclose the attested copies of the constitution of their concern, and copy of PAN Card along with their tender. Tender documents in such cases are to be signed by such persons as may be legally competent to sign them on behalf of the firm, company, association, trust or society as the case may be. Note:- In case a Tenderer is participating as sole proprietor in a tender , it is mandatory for him to submit an undertaking on suitable stamp paper to this effect clearly mentioning PAN number also along with tender document at the time of submission of tender.
EPF & MP Act 1952 : (Refer Railway Board's letter no. 2016/E/(LL)/AT/EPF/1, dated 12.8.2016) Contractor shall follow the provisions of EPF & MP Act 1952. "Wherever applicable, PF deductions have been made and deposited with the EPFO along with prescribed contribution by the Employer Contractor." If Applicable.
LABOUR LICENCE & ESIC REGISTRATION (i)Contractor shall submit Labour licence for individual contract, Licence number, and date of expiry of Licence, If Applicable. (ii)Contractor shall submit the documents regarding ESIC registration, if applicable.
Payment To Contractor's Labour : It is mandatory for the contractor that he shall make the payment through Nationalized Bank to the Labour deployed by him for this contract. Necessary documentary proof shall be submitted by the contractor for bank payment made to labours and observance of minimum wage act.
ACCIDENTS The Contractor shall indemnify and keep the Purchaser/ Consignee indemnified and harmless against all actions, suits, claims, demands, costs, charges or expenses arising in connection with any death or injury sustained by any person or persons within the Railway premises and any loss or damage to Railway property sustained due to the acts or omission of the Contractor, his sub-contractors, his agents or his staff during the execution of this contract irrespective of whether such liability arises under the Workmen's Compensation Act, or Fatal Accident Act or Factory Act or Payment of Wages Act or any other statute in force for the time being.
Work executing/inspecting authority : Sr.DME/D/R or his authorized representative nominated by Sr.DME/D/R will be the work executing authority and inspecting authority.
SAFETY PRECAUTIONS TO BE TAKEN AT RAILWAY PREMISES The contractor shall take all precautionary measures not only for protection of his own personnel moving about or working on the Railway premises, but also conform to the rules and regulations of the Railways in this respect.
All safety measures shall be taken to prevent accidents while executing the work either to his workmen or the others. No compensation towards any accident will be paid by the Railways Any work in the shed must be carried out very carefully without affecting the proper functioning or cause damage to any railway equipment, structure or rolling stock.
Right of Railway to determine the contract: As per GCC clause 61 & 62, the Railway shall be entitled to determine and terminate the contract at any time should, in the Railway's opinion, the cessation of work becomes necessary owing to paucity of funds or from any other cause whatever.
In case of any dispute of any nature arising on / during the execution of the contract, the decision of the Sr. DME/D/DLS/Raipur will be final and binding on both parties.
In case of any difference of opinion regarding quality of work or quality of the materials, the decision of the Sr DME/D/DLS/Raipur or his authorized representative shall be final.
If there are varying or conflicting provisions in the documents forming part of contract the Engineer- In charge shall be the deciding authority with regard to the intentions of the provisions and his decision shall be final and binding on the Contractor.
The programme and method of work shall have to be furnished by the contractor well in time in consultation with Engineer -in- charge of the work duly obtaining his approval.
No claim whatsoever will be entertained by the Railway on account of any delay or hold up of the work(s) arising out of delay in approval of changes, modifications, alterations, additions, omission or due to any other factor on Railway account.
All decisions on behalf of Railway administration will be taken by Sr.DME (D)/Raipur, S.E.C. Railway and shall be final and binding on the contractor.
All other terms & conditions will be applicable as per GCC Works Tender April 2022 of Indian Railway with latest amendments.
