Community Hall / Hospital / Hotels /
Institutional / Commercial or Residential
Building Work projects in any
Government or public sector
organizations or Semi Government or
Private Organizations.” Form-3A issued
by employer to substantiate successful
experience of similar work.
When employer of similar work does
not have a AMC registration, in this
case the contractor needs to get the
registration of AMC before submission
of 1st R.A bill.
3. The bidder should have experience of
having successfully completed either of
the following similar works during last
Seven Years ending last day of month
previous to the one in which tenders are
(A) One completed similar kind of work
costing not less than the amount
equal to 80% of the estimated
(B) Two completed similar kind of
works costing not less than the
amount equal to 50% of the
estimated Tender amount.
(C) Three completed similar kind of
works costing not less than the
amount equal to 40% of the
estimated Tender amount.
4. Average annual financial turnover of the
bidding firm shall be at least 30% of
estimated project cost in last Five years
ending on dated 31st March,

5. Tenderer to submit the solvency
certificate for an amount equal to 20 %

2 IMPORTANT INFORMATION FOR TENDERERS:
1. Schedule B is to be read for the purpose of pricing in conjunction with
conditions of contract, technical specifications and drawings.
2. The rate of the Schedule B includes all constructional plant, labour,
supervision, materials erection, maintenance, insurance, profit,
overheads, government taxes and duties, Labour well f are cess,
together with all general risks, liabilities and obligations, set out or
implied in the Contract and including remedy of any defects during
the Defects Liability Period
3. The rate of the schedule B shall be all inclusive value of the work
described including all costs and expenses which may be required
in and for the construction of work described together with all
general risks, liabilities and obligation set forth or implied in the
document on which the tender is to be based.
4. The method of measurement and payment shall be as described
under various items and in the Schedule B. Where specific
definitions are not given, the method described in IS code will be
followed. Should there be any detail of construction or materials
which has not be referred to the specification or in the Schedule B
and drawings but the necessity for which may be implied or
inferred therefrom, or which are usual or essential for completion
of the work in the trades the same shall be deemed to be included
5. The quantities stated are to be considered approximate only and the
unit rate of the Schedule B shall apply only to the quantities
actually executed EIC on behalf of AMC reserve the right to
instruct for execution of any item up to any extend and the bidder
bound to execute the same.
6. The bidder must quote his percentage above or below in words and
in figures both in specified columns.
7. The schemes and dimensions shown on the tender drawing are
tentative; the same are likely to vary during actual execution and
no separate charges are payable due to such variations in quantity
8. The rates for RCC work shall be inclusive of giving Architectural
treatment like providing grooves, recess, offset, projection, form
mark, etc. as directed by Engineer-in-charge or as per approved
9. Concrete of grade M25 and above shall be prepared & mixed in
Contractor’s own fully automatic concrete batching plant having
capacity – at least 30 m3 per hours. In exceptional circumstances
Ready Mix Concrete from other batching plant shall be allowed.
10. The specification numbers stated in the detailed description of
items of works against each item are indicated for guidance of the
Bidders. However, any of the specification alluded to the
specifications referred to in the Bill o f Quantities and / or any
other specifications from “Technical Specifications” which in the
opinion of the Engineer are applicable for a particular item is
deemed to have been included in the scope of item and fully
covered by the rates quoted for the item s. In case of any
discrepancies between provision stated in the description of
individual items and those covered by the technical specifications,
the provision in the description of item shall have preference .
11. Grouping of items under sub heads of differen t section is done in
BOQ for the convenience. Any item from any section can be
considered for operation in any other section as indicated and as
directed by the Engineer.
12. For all structural concrete work, cement of ordinary Portland
Cement 53 grade confirming to IS 12269 and having ISI mark shall
be used. For other work cement 43 grade confirming IS
respectively can be used on prior approval from AMC. Cement
shall have ISI mark and from primary manufacturers of cement,
approved by AMC. Samples of cement arranged by the Contractor
shall be taken in presence of the Engineer -in-Charge and got tested
in accordance with provisions of the relevant IS codes. In case test
results indicate that the cement arranged by the Contractor does not
confirm to the relevant IS codes, the same shall stand rejected and
shall be removed from the site by the Contractor at his own cost
within three days.
13. Reinforcement Steel:
Reinforcement bars shall be High Yield Strength Deform (TMT) Fe
500 D bars confirming to IS 1786. Re -rolled steel shall not be used
in the work. The Contractor shall have to obtain and furnish test
certificates to the Engineer-in-Charge in respect of all supplies of
steel brought by him to the site of work. Samples shall also be
taken and got tested by the Engineer-in-Charge as per the
provisions in this regard in the relevant BIS codes. In case the test
results indicate that the steel arranged by the Contractor does not
conform to BIS codes, the same shall stand rejected and shall be
removed from the site of work within three days.
14. Structural Steel:
The Contractor shall procure Structural steel from the primary
manufactures only, as per list of approved material as mentioned in
the tender. The Contractor shall have to Obtain and furnish test
certificates to the Engineer-in-Charge. The Contractor shall have to
obtain and furnish test certificates to the Engineer -in-Charge in
respect of all supplies of steel brought by him to the site of work.
Samples shall also be taken and got tested by the Engineer -in-
Charge as per the provisions in this regard in the relevant BIS
codes. In case the test results indicate that the steel arranged by the
Contractor does not conform to BIS codes, the same shall stand
rejected and shall be removed from the site of work within th ree

manufacturers only confirming to IS 1786. The Contractor shall
have to obtain and furnish test certificates to the Engineer -in-
Charge in respect of all supplies of steel brought by him to the site

Engineer-in-Charge as per the provisions in this regard in the
relevant BIS codes. In case the test results indicate that the steel
arranged by the Contractor does not conform to BIS codes, the
same shall stand rejected and shall be removed from the site of

3. Note for Contractors.
1. Tenders once offered shall not be withdrawn except with the
permission of Municipal Commissioner.
2. Tender once accepted shall be binding upon the contractor even if the
formal agreement is not signed.
3. No Claims shall be paid in case of any variation in the quantities of
Bills of Quantities (BOQ)
4. Contractor is requested to see the site physically before tendering. He
is also requested to quote the rates keeping in view the points
mentioned in relevant pages of tender documents.
5. The contractor shall have to submit the tenders in duplicate i.e. two
sets-original and duplicate.
6. If contractor is not registered with AMC, in that case before taking
first R. A. Bill he shall take approved registration from AMC.

4. Conditions for the Water Supply & Electric Supply
The contractor shall arrange at his own cost, a suitable supply of piped wholesome water for the
construction of the works and provide a satisfactory supply of potable water for drinking., washing,
sanitation and cleaning down, The contractor will be responsible for all the costs where applicable of
connection, meter installation, water consumed, water required for testing purposes, disconnection and
the laying, maintenance and ultimate removal of any distribution system around the site. If supply by
AMC, then AMC same will be charged as per Norms of AMC.
Electric supply shall be made available at the site by Contractor. Contractor must make his own
arrangements with Electricity Supply Authorities and with other contractors to connect to and take a
supply from such services, paying all costs in Connection therewith. Necessary Documents for getting
Electric supply/connection will be arranged by AMC Authority. The Contractor shall be entitled to use
such supply. Electricity as may be available on the site for purpose of the work and shall pay such
charges as is fixed by the appropriate supply Authorities.
In case if there is any delay in supply of power site of any interruption or fault in the power
during the work. No compensation shall be paid for idle labor staff, machineries and for use of diesel
operating sets etc. as the case may be.

I/We the undersigned have carefully gone through and clearly understood the Tender
documents of above-mentioned project comprising of Notice Inviting tenders, Articles of
Agreement, Scope of work, Definition of terms, notes Instructions/Information to Tenderer,
Condition of Contract, special condition of contract, Appendices, Specifications, Schedule of
quantities and tendered drawings furnished by AHMEDABAD MUNICIPAL
CORPORATION. I/We have satisfied myself/ourselves as to the location of site, examined
drawings. I/We have visited site & fully acquainted with local situations regarding materials,
labours & others factors pertaining to work before submitting tenders.
I/We do hereby offer to execute and complete the whole of the work within the time
specified all in accordance with the specification, designs, drawing and instruction in writing
referred to in the said document and with such materials as are provided for, at the respective
rates which I/we have quoted in the Schedule-B or at such other rates as maybe fixed under the
provisions of these conditions.
In the event of this tender being accepted I/We agree to enter into an agreement and
when required and execute the contract, according to your fom1 of agreement as or in default
where of I/we bind myself/ourselves to forfeit the "Earnest Money Deposit."
I/We understand that if I/WE shall not enter in agreement within ten days or decided by
AMC from the date of receipt of letter of acceptance, you will forfeit the earnest money paid by
me/us and take necessary action as deemed fit.
I/We have enclosed a Demand Draft / Bank Guarantee as an “Earnest Money Deposit",
for the sum as mentioned in NIT, the full value of which is to be absolutely forfeited to the
Employer If I/We fail to commence the work specified. Otherwise, the Employer shall retain

I/We agree not to employ Sub-contractors other than those that may be approved in
accordance with Conditions in the aforesaid documents.
I/We understand that Municipal Commissioner is not bound to accept the lowest or any
tender, which are received. I / We also understand & agree that Municipal Commissioner
Reserves the right to allot number of tenders to successful bidders at his sole discretion in case
if I / We am/are lowest in more than one tender.
I/We am/are bound to execute the job if the work order is issued within 120 days from
the date of opening of the tender.
I am bound to execute the work by maintaining all Quality aspects/parameters
mentioned in the tender terms and conditions. I am also bound to submit all supporting Genuine
Original documents as and when asked and if any discrepancy found in such documents as well
as in the executed Work with respect to Quality/Quantity at any stage of work or even after
completion of work, it will be solely my Responsibility. I am bound to prove originality of all
documents submitted by me and if any Documents found false/fake then Municipal
Commissioner/AMC has right to take any action/penalty/punishment against me.
I am also bound that if I/we, indulged into any malpractice and/or used any inferior
quality and/or the construction of road is found to be of an inferior quality under this contract
than in such case Municipal Commissioner/AMC has right to debar/ blacklist permanently.
I/We agree to pay the Government Income-Tax, Sales-Tax (Central and State) Sales Tax
on work consult, and other taxes prevailing from time to time on such items on which the same
are leviable and the rates quoted by me/us are inclusive of the same.

(b) The bid security of the successful bidder, along with second and third lowest

7. Check List before submission of tenders
Tenderer to submit tenders in a sealed big envelope superscribed as Tender for Redesigning and
Necessary Civil Work of Common Lavatory Block on Each Floor of Multistoried P. G.
Hostel Building (Girls Hostel) of Narendra Modi Medical College Campus, Maninagar,
Ahmedabad on or before the scheduled date and time as mentioned in tender notice.
Tenderer to note the last date and time of submission of Tenders. Tender should be sent by Hand
Delivery only, so as to reach before last hour of acceptance. Late tenders received will not be

8. DEFINITIONS AND INTERPRETATION
1 In the Contract, as hereinafter defined, the following words and expressions shall have the
meaning hereby assigned to them, except where the context otherwise requires.
(a) "Client/ Employer" means the "Municipal Commissioner, Ahmedabad Municipal
Corporation, 2nd Floor, Sardar Patel Bhavan”, Danapith, Ahmedabad- 380 001 Who will
employ the contractor and the legal successors in title to the Employer, any assignee of the
(b) "Contractor" means the person(s), firm or company whose tender has been accepted by the
Employer and includes the Contractor's personal representatives, successors and permitted
(c) "Architect" means Architect(s)/ Architect firm(s) designated, or other Architect appointed
from time to time by the Employer and notified in writing to the contractor to act as Architect
for the purpose of the contract, in place of the Architect(s)/

(d) “Construction Management Consultants / Project Management Consultants” (CMC/
PMC) means the Engineer(s)Engineering firm or other Engineer(s)/Engineering firm appointed
from time to time by the Employer and notified in writing to the Contractor to act as EIC for
the purpose of the contract in place of the EIC so designated.
(e) Engineer-in-charge (EIC)/Project Manager (PM):
The EIC / PM shall be duly appointed by the CMC (Consultant). The EIC / PM are authorized
to represent and act on behalf of the Client on a day-to-day basis during all packages of
construction of the Project. All communications, recommendations and decisions to be taken in
connection with the CMC Services and those of the Client shall be communicated to and
enforced by the EIC / PM.
(f) "Contract" means the Conditions of Contract, Specification, approved makes, Drawings,
priced Bills of Quantities, Schedule of Rates and Prices if any, Tender, letter of acceptance and
the Contract Agreement, if completed.
(g) The "Work" shall include both permanent works and temporary works.
(h) "Contract Price" Means the sum named in the Letter of Acceptance, subject to such
additions thereto or deductions there from, as may be under the provisions hereinafter
contained. The Contract Sum is inclusive of all kind of applicable present taxes and it shall be
borne by the Contractor. If there will be any changes in the tax structure after the last date of
submission of tender, then the same will be recovered/ reimbursed as the case may be.
Necessary documents asked for the same by AMC will have to be furnished by the Bidder.
The Contract is neither a item Rate, fixed lump sum contract nor a piece work contract, but is
an % rate contract to carry out the Work according to the actual measured quantities at the rates
contained in the schedule of rates and probable quantities as provided in the Priced Bill of
Quantities with Detailed Specifications.
The Contract Sum shall not exceed as indicated in the Letter of Intent/Purchase
Order/ Work Order, amounts in excess of this number, not approved in advance by the client
shall be at the Contractor’s expense. The Contractor has to closely monitor the quantities and
cost and obtain an Approval from the client/PMC well in advance for any change outside the
scope of the Work which would cause the cost of the Work to exceed the Contract Sum as
indicated in the Letter of Intent/ Work Order. Prices will be firm until the end of the contract.
(i) "Constructional Plant" means all appliances or things of whatsoever nature required or
about the execution or maintenance of the works but does not include materials or other things
intended to form or forming part of the Permanent Works.
(j) "Temporary Work" means all temporary works of every kind required in or about the
execution or maintenance of the works.
(k) "Permanent Works" means the permanent works to be executed and maintained in
accordance with the contract.
(l) "Specification" means the specification referred to in the Tender and any modification
thereof, or addition, thereto, as may from time to time be furnished or approved in writing by
the Architect/Engineer-in-charge.
(m) "Drawings" means the drawing referred to in the specification and any modification of
such drawing supplied in writing by the Engineer and such other drawings as from time to time,
be furnished by the Architect/Engineer-in-charge with the words “Good for Construction”.
(n) "Site" means the land and other places, on, under, in or through which the permanent work
designed by the Architect/Engineer-in-Charge are to be executed and any other lands and
places, provided by the Employer for working spaces or any other purpose which may be
specifically designated in the contract as forming part of the Site.
(o) "Approved" means approved in writing, including subsequent written confirmation of
previous verbal writing approval and "approval" means approval in including as aforesaid.
(p) "Day" means a day from midnight to midnight.
(q) "I.S.S. OR I.S" means Indian Standard Specification (Latest Version).

9. Instruction to Tenderers
The General scope of work includes the Redesigning and Necessary Civil Work of Common
Lavatory Block on Each Floor of Multistoried P. G. Hostel Building (Girls Hostel) of
Narendra Modi Medical College Campus, Maninagar, Ahmedabad as per the architectural/
Structural working drawings prepared by the consultant / AMC.
IT.2 INVITIATION TO TENDER
The Municipal commissioner for and on behalf of Ahmedabad Municipal Corporation here in
after referred as AMC will receive tenders for the work as per the specifications and schedule of prices
in the tender document. The tenders shall be opened in the office of the Additional City Engineer,
HOSPITAL - AMC MET in the presence of tenderers or their representatives who remain present. The
Municipal Commissioner reserves the right to reject the lowest or any other or all tenders or part of it
which in the opinion of the Municipal Commissioner does not appear to be in its best interest and the
tenderer shall have no cause of action or claim against the authority or its officers, employees,
successors or assignees for rejection of his tender.
IT.3 LANGUAGE OF TENDER
Tenders shall be submitted in English and all information in the tender shall also be in
English, Information in any other language shall be accompanied by its translation in English. Failure to
comply with this may make the tender liable to rejection.
IT .4 TENDER DOCUMENTS
Tender documents and set of drawings shall comprehensively be referred before tendering. The several
section form in the document are the essential parts of the contract and a requirement occurring in one
shall be as binding as though occurring in all, they are to be taken as naturally, explanatory and describe
and provide for complete works. The tender documents shall be submitted in two sets.
IT. 5 EXAMINATIONS BY TENDERERS
At this own expense and prior to submitting his tender, each tenderer shall (a) examine the
contract documents. (b) visit the site and determine local condition which may affect the work including
the prevailing wages and other pertinent cost factors.(c) familiarize himself with all central, state and
local license required for the work and (d) correlate his observation, investigation and determinations
with the requirements of the tender documents, site & subsoil investigation.
The tender quantity is fixed as per drawings enclosed herewith. During execution any increase or
decrease in quantity -same will be paid as per the Tender clause.

Copy of the tender Document should be completed, legible in ink, checked in a responsible
manner. Signed stamped and returned together with the tender security Bond by the stipulate date, this
shall form the tender.
The tenderer is required to complete.
The form of tender, including the Appendices enclosed thereto, Tender security bond and the
Tender summary shall be submitted duly signed and stamped.
All the pages in which entries are required to be made by the renderer are contained in the tender
documents and the renderer shall not take out or add to or amend the text of any of. the documents
except in so far as may be necessary to comply with any issue pursuant to Clause IT .19 hereof
IT.7 EARNEST MONEY DEPOSIT.
Each tender must be accompanied by, a receipt of deposit as tender guarantee in the form of
Earnest money mentioned on relevant page. Any tender not accompanied by a tender guarantee in the
form of earnest money deposited for the sum stipulated in the tender's document will be summarily
rejected. The earnest money deposit shall be paid with the tender by B.G. / D.D. payable at Ahmedabad
without which the tender shall not be considered as valid. EMD in the form of Bank Guarantee of the
banks approved by AMC shall also be acceptable.

been finalized.
The Earnest Money Deposit (Tender Guarantee) will be forfeited in the event, the successful
tenderer fails to accept the contract and fails to submit the "Performance Guarantee Bonds to the
Owner as stipulated in this tender documents within ten days (10 days) after receipt of notice of
award of contract.
The Earnest Money Deposit of the successful tenders shall be converted in to security
Deposit amount after acceptance of the tender. Bank Guarantee shall also be acceptable for S.D.
No interest shall be paid by the owner on any tender guarantee.
IT.6 INCOME TAX CLEARANCE CERTIFICATE
Latest Income Tax Clearance Certificates must accompany with the tender without which the
tender is liable to be summarily rejected. The income tax clearance certificate obtained from the
income tax officer shall clearly indicate the income tax circle/ward district and the reference number
of the assessment along with the assessment year.
IT.7 PREPARATION OF TENDER DOCUMENTS
Tenderers are required to note the following while preparing the tender documents.
Tender shall be submitted on the Tender form bound here in English. All appendices and
statements shall be properly filled in. Numbers shall be stated both in words and in figure where so
indicated and the signature of all persons signing shall be in longhand.
Percentage, Prices, wordings and notations must be in ink or type written No erasers
will be permitted. Mistakes may be crossed out and corrections typed or written in ink adjacent
thereof, and shall be checked before submission of the tenders. If there is discrepancy between the
rates quoted in figures and in words, the rates expressed in words shall be considered as

documents and drawing. All witnesses and sureties shall be persons of status and probity and their full
names, occupation and address shall be stated below their signature.
Variation to the contract Documents requested by the tenderer may be affixed and duly

Tenders and tender security (E.M.D.) shall be enclosed with the tender documents and shall be put in a

IT. 8 SUBMISSION OF TENDER DOCUMENTS
Tenderers are requested to submit the Tender Documents on following lines. Volume containing
following documents.
i. Tender security bond (Earnest Money)
ii. Certificate as registered contractor with Government of Gujarat or appropriate authority. (Not
applicable for private sector)
iii. Tender's financial capability and standing over at least past five years.
iv. Current Income Tax Clearance Certificate.
v. Tenderer's experience in the field relevant to this contract.
vi. Tenderer's present commitments.
vii. The technical ability and qualifications of the tenderer. Details of technical personnel with their
qualification & experience.
viii. A list of the equipment the tenderer possessed and that which he proposed to acquires and use for
the purpose related to the work
ix. Tenderer should submit all the drawing which they have received along with tenders (Architectural
x. Bank Solvency Certificate.
xi. Details to be submitted as per the Statement No 1 to
Tender document submitted by the post, same should be submitted by registered post or by RPAD
or speed post or courier or hand delivery only. The time limit for receipt of tender shall strictly apply in
all cases. The tenderers shall have therefore ensure that their tender is received by the competent
authority (AMC) at the required place before expire of the time limit. No delay on account of any cause
of receipt of tender shall be entertained. Tender's received after the time limit is over will not be accepted
and inadvertently accepted will not be opened and will be returned unopened. Tenders which may get
opened before the due date with no indication having been given on the envelopes containing a tender
therein is liable to be rejected.
Mailed tender must be sent in a covering envelope by registered post, Acknowledge Due. The
return receipt will be endorsed to show the date and time of receipt. Mailed Tenders not received at the
required place before the date and time set for the receipt will not be accepted from post.
The tender must contain name address of residence and place of business of the person or person
submitting the tender and must be signed and sealed by the tenderer with his usual signature.
Tenders by partnership firm must be furnished with the full names and address of all partners and
be signed by one of the members the partnership or by a legally authorized representative holding power
of attorney followed by signature and designation of the person of person signing.
Tenders by corporations/company must be signed with the legal name of the corporation companies
by the president or by the secretary or other person or person legally authorized to bind the
corporation/company in the matter.
IT . 9 TENDER VALIDITY PERIOD
The validity period of the tender submitted for this work shall be of hundred & eighty (180)
calendar days from the date of opening of the tender and that the tenderer shall not be allowed to
withdraw or modify the tender offer on his own during the validity period. The tenderer will not be
allowed to withdraw the tender or make any modification or addition in the terms and conditions on his
own tender. If this is done then the owner shall, without prejudice to any other right or remedy, by at
liberty to reject the tender and forfeit the earnest money deposit in full.
IT . 10 GENERAL PERFORMANCE DATA
Tenderers shall present all information which sought for in the tender document in form of
various schedules. Tenders may not be considered if every Blank and the Schedule are not properly
filled in before submission of the tender.
IT.11 SIGNING OF TENDER DOCUMENTS
If the tender is made by an individual, it shall be signed with his full name above his current
address. If the tender is made by proprietary firm, it shall be signed by the proprietor above his name
and name of his firm with his current address.
If the tender is made by a firm in partnership, it shall be signed by all the partners of the firm
above their full names and current address, or by a partner holding the power of attorney for the firm, in
which case a certified copy of the power of attorney shall accompany the tender. A certified copy of the
partnership deed, current address of all partners of the firm shall also accompany the tender.
If the tender is made by limited company or a limited corporation, it shall be submitted duly
signed by an authorized person holding the power of attorney, & shall accompany the tender. Such
limited company or corporation may be required to furnish satisfactory evidence of its existence before
the contract is awarded.
If the tender is made by a group of firms, the sponsoring firm shall submit complete
information pertaining to each firm in the group and state along with the bid as to which of the
firms shall have the responsibility for tendering and for completion of the contract documents and
furnish evidence and responsibilities for completion of contract documents. The full information
and satisfactory evidence pertaining to the participation of each member of the group of firm in
the tender shall be furnished along with the tender.
All witness and sureties shall be persons of status and probity and their full names, occupations
and address shall be stated below their signature. All signatures in the tender document shall be dated.
IT. 12 WITHDRAWL OF TENDERS
If during Tender validity period, the tenderer withdraws his tender, the tender security (Earnest
Money Deposit) shall be forfeited.
IT .13 INTERPRETATIONS OF TENDER DOCUMENTS
Tenderer shall carefully examine the Tender Document and fully inform themselves as to all the
conditions and matters which may in any way affect the work or the cost thereof. Should a tendered find
error, omissions or discrepancies from the specifications or other documents or should be in doubt as to
their meaning, he should at once address query to the Additional City Engineer, HOSPITAL - AMC
MET, AMC. The correct interpretation of the same will be issued to all tenderers as addendum.
IT .14 ERRORS AND DISCREPANCIES IN TENDERS
IN CASE OF CONFLICT BETWEEN THE FIGURES AND WORDS IN THE RATES THE
RATE EXPRESSED IN WORDS SHALL BE CONSIDERED.
IT. 15 MODIFICATIONS OF DOCUMENTS
Modification of specifications and extension of the closing date of the tender, if required will be
made by an addendum. Copies of each addendum will be sent to all tenderers. These shall be signed and
shall form a part of tender. The tenderer shall not add to or amend the text of any of the documents
except in so far as may be necessary to comply with any addendum.
IT. 16 ADDENDUM
Addendum shall form part of the contract documents. The full consideration shall be
given to all Addenda in the preparation of tender. Tenderers shall verify the number of
Addendum issued. if any and acknowledge the receipt of all addenda ( i.e. before 24 hrs. of last
date for tender on web-site ) in the tender failure to so acknowledge may cause the tender to be
The Owner or the in charge may issue Addenda to advise tenderers of changed requirements.
Such addendum may modify previously issued addendum.
IT .17 TAX AND DUTIES ON MATERIALS
All charge on account of excise duties, terminal tax, sales tax and Govt. duties etc. on
material procured for the works from any source shall be borne by the contractors. No (P) or "C"
or "D" form shall be supplied.
IT. 18 EVALUATION OF TENDERS
In comparing tenders, the AMC shall consider factors such as the time of completion, efficiency
and reliability of construction method proposed, compliance with the specification, relative quality, the
operation, maintenance and replacement cost of structure and plant and also the qualifying criteria for
the evaluation of tenders. The price bids of only those tenderers who are pre / post qualified will be
opened in the presence of the contractors. During evaluation process bidders are responsible to provide
the details asked by Evaluation Consultant / AMC with in that stipulated time if any.
IT .19 TIME REQUIRED FOR COMPLETION
The completion period / time limit mentioned in this schedule is to be reckoned from the date of
issue of work order to the date by which physical completion of the work take place. The completion
period / time shall be in accordance with the calendar months.
IT .20 POLICY FOR TENDER UNDER CONSIDERATION
Tender shall be termed to be under consideration from the opening of the tender until such time
any official announcement or award is made. While tenders are under consideration, tenderers and their
representative or other interested parties are advice to refrain from contracting by any corporation
personnel or representative on matters related to the tenders under study. The AMC representative if
necessary will obtain clarification on tenders by requesting such information from any or all the
tenderers, either in writing or through personal contacts may be necessary. The tender will not be
permitted to change the substance of his tender after tenders have been opened. This includes any post
tender price revision. Non compliance with his provision shall make the tender liable for rejection.
IT .22 PRICES AND PAYMENTS
The tenderer must understand clearly that the prices quoted are for the total works or the part of
the total works quoted for inclusive of all costs of materials, labour, equipment, supervision, other
services, royalties. etc. and also inclusive of the Govt. taxes excluding GST. No claim for payment
beyond the prices quoted for will be entertained. The tenderer will not be entitled subsequently to make
any claim on any ground. However, client will pay GST on each work done bill submitted by bidder as
per prevailing rate.
Award of the contract or the rejection or tenders will be made within the tender validity period stated in
the notice inviting tenders.
After all contract contingencies are satisfied and the Notice of award is issued, the successful
Tenderer shall execute the Contract Agreement within 10 days and shall furnish the
Bond as required herein. The contract agreement shall be executed, in form stipulated by the Owner.
If tenderer receiving the notice of award fails or refuses to execute the contract Agreement
within the stated time limit or refuse to furnish the Bond as required herein, the owner may annual his
award and declare the tender security forfeited and will take action as deemed fit.
A corporation, partnership firm or other consortium acting as the Tenderer and receiving the
award shall furnish evidence of its existence and evidence that the officer signing the contract agreement
and Bonds for AMC, partnership firm or other consortium acting as the Tenderer is duly authorized to
IT.24 SIGNING OF CONTRACT
The successful tenderer shall be required to execute the contract agreement within 10 days of
receipt of intimation to execute the contract, failing which the AMC will be entitled to annual the
award and forfeit the Earnest Money Deposit. The person to sign the contract document shall be as per
IT.25 DISQUALIFICATION
The tender shall be disqualified and will not be taken for consideration if
a. The envelope does not show on the outside the reference of bid and thus gets opened before the
due date of opening.
b. The tender Security Deposit is not deposited in full and in the manner as specified
i. e. Earnest Money Deposit.
c. The tender is in a language other than English or dose not contains its English Translation in
case of other language adopted for tender preparation.
d. The tender documents received are not duly signed by authorized person.
e. The general performance data for qualification is not submitted fully.
f. Tenderer does not agree to payment terms.
g. Made misleading or false representations in the forms, statements, affidavits and
attachments submitted in proof of the qualification requirements; and/or
h. Record of poor performance such as abandoning the works, not properly completing the
contract, inordinate delays in completion, litigation history, or financial failures etc. or
debarring from AMC work etc.
i. Tampered the bid document in any manner.
j. Indulged in inducement of any official of AMC and/or their consulting engineer and other
advisors in any manner whatsoever.
k. During validity of the proposal, or its extended period, if any, the bidder changes his
commercial terms.
l. Proposal not submitted in accordance with this tender.
m. Proposal is received after due date and time.
n. The bidder qualifies the proposal with his own conditions.
o. The tender may further be disqualified if,
i) The Price variation is proposed by the tenderer on any principal other than those provided in
the tender documents.
ii) The Completion schedule offered is not consistent with the completion schedule defined and
specified in tender document.
iii) The validity of tender is less than what is stated in the tender.
iv) Any of the page or pages of tender is/are removed or replaced.
v) All corrections or posted slips are not initialed by tenderer.
vi) Any erasure is made in the tender.
vii) Any condition which affect the cost.
viii) Any statement is missing mentioned in tender.
Debarment / Black listing
Notwithstanding the above, the Employer may debar or blacklist any of the bidder(s) for
their misleading or false representations in the forms statements etc. for the period to be
decided by the Employer.
IT.26 PERFORMANCE GUARANTEE & SECURITY DEPOSIT
As a contract security the tenderer to whom the award is made shall furnish a security
deposit & performance guarantee each (Security Deposit) for the amount of 5% of the contract price
to guarantee the faithful performance, completion and maintenance of the works of the contract in
accordance with all condition and terms specified herein and to the satisfaction of the Engineers-in
charge and ensuring the discharge of all obligations arising from the execution of contract in one of
the forms mentioned below.
a) In cash or demand draft of approved nationalized Bank in favor of the Municipal
Commissioner AMC amount of 5% of the Contract value as per E-l form format. OR
b) In form of B.G. of any nationalized bank amount of 5% of contract value
The performance guarantee shall be delivered to the AMC before ten (10) days of the
completion of work under contract or as instructed by the Engineer -in-charge. In case of security
deposit, the contractor may at his option may deposit an amount of 2.5% of the value of the contract
price in cash or Bank Guarantee within ten days and the balance 2.5% to be recovered in
installments through deduction @ the rate of 5% of the running bill amount.
IT.27 STAMP DUTY
The successful tendered shall have to enter into an agreement on a non-judicial stamp paper
as per the form of the agreement approved by the AMC. The cost of stamp paper and adhesive
stamp shall be borne by the contractor.
IT .28 BRAND NAMES
Specific reference in the specification to any material by manufacturer's name, or catalogue
shall be constructed as establishing a standard or quality and performance and not as limiting
competition and the tenderer in such cases, may at his option freely use only other product, provided
that it ensures an equal of higher quality then standard mentioned and meets AMC approval.
IT. 29 NON TRANSFERABLE Tender
documents are not transferable.
IT .30 COST OF TENDERING
The owner will not defray expense incurred by tenderers in tendering.
IT.31 EFFECT OF TENDER
The tender for the work shall remain for a period of 180 calendar days from the date of opening
of the tenders for this work and that the tenderer shall not be allowed to withdraw or modify the offer in
his own during the period. If any tenderer withdraws or make any modifications or additions in the
terms and conditions of his own tender, then the AMC shall without prejudice to any other right or
remedy, be liberty to reject the tender and forfeit the earnest money in full.
IT .32 CHANGES IN QUANTITY OR QUALIFYING CRETERIA:
AMC reserves the right to waive any qualifying criteria or information in any tender as special
case and to reject one or all tenders without assigning any reasons for such rejection and also to vary the
quantities of items or group or quantum of work as specified in the schedule of prices as may be
necessary in the interest of Public work a large for which no any claim shall be entertained.
IT .33 NEW EQUIPMENT AND MATERIAL
All materials, equipment and spare parts thereof shall be new, unused and originally coming
from manufacturer's plant to the AMC. The rebuilt or overhauled equipment/materials will not be
allowed to be used on works
IT.34 RIGHTS RESERVED
The owner reserves the right to reject any or all tenders, to waive any informality or irregularity
in any tender without assigning any' reason. The owner further reserves the right to withhold issue of work
order even after agreement and no payment will be made to the successful tenderer on account of such
withholding. The owner is not obliged to give reasons for any such action
Municipal Commissioner reserves right to increase / decrease the scope of work & also split the
tender in two or more contracts without assigning any reason even after the work is awarded.
IT .36 MOBILIZATION ADVANCE
No mobilization advance or advance on machinery will be given.
The scope of work is clearly mentioned in the tender documents. The contractor shall have to
carry out the work in accordance with the details specifications. No condition will be accepted. The
conditional tender will liable to be rejected.
The contractor will have to construct shelter for storing valuable materials like cement etc. The
contractor shall arrange for construct, maintain and afterwards remove and reinstate any temporary
access required for and in connection with the execution at the work at his own cost. Reinstatement shall
include restoring the area of the access route to at least the degree of safety stability drainage &
appearance that existed before the contractor entered the site.
In the event of any discrepancy the following order or precedence should apply

In case of defective description as ambiguities, due Engineer in-charge should issue further
instruction and direction in what manners the work is to be carried out. The contractor should further
within comply with such instruction.
Irrelevant mistakes, discrepancies or errors made through over sight leading to
misunderstandings may be got corrected properly by the Additional City Engineer, HOSPITAL - AMC
The contractor shall take no advantage of any apparent error or omission in drawing as description
or specification. The Engineer-in-charge shall make such correction as may be necessary to fulfill intent
of specification plan.
Proper procedure shall have to be taken by contractor at all the time during the progress of the
work, failing which the contractors shall be held responsible for all damages to the work under
execution or to any property or to lives of persons during the work in progress and also during the defect
liability period.
All work shall be measured by standard method according to rules & customs of AMC. The
engineer-in-charge decisions to what is usual method in use will be final.
Tender once accepted shall be binding on the contractor even if the formal agreement is not
signed / executed.
The contractor shall have to give in writing the date of completion of work within a fortnight
from date of work completed by him otherwise the date noted on record by department shall be
reckoned as final & no excuse as representation in that behalf shall be granted at later date.
Specimen signature of contractor will be cross checked whenever contractor receives payment
in account section of AMC OR in case of representative of contractor receives payment along with
letter of authority of contractor who sign an agreement.
The details / contents / information mentioned in the tender document may be read
as final binding on the contractors. Any difference found in regards to these related items
may be treated as cancelled
Contractor should make arrangement to cordon the construction site by way of proper supports and
barricades at his own cost and risk as per the direction of EIC.
Contractor should make inspection lift at site for minimum 4 persons for inspection of various
construction activities at his own cost and risk.
Contractor should provide safety net and should take sufficient precaution for the safety of their staff
& labour, AMC’s staff, TPI’s staff and Consultant’s staff at his own cost and risk.
Bidders shall not have any dispute or claim for any kind of compensation in case of,

thereby total amount of work increases / decreases up to any extent.

• If the works gets delayed / postponed for some administrative / technical decision
• If the items stipulated in the tender shall not be executed as per site condition/
requirements. No claim shall be entertained for the same.
• No idle charges shall be paid to contractor for machinery and man power if remain idle
and no claim shall be entertained for the same.
IT 50 Late Bids
Any Bid received by the Employer after the deadline prescribed in NIT will be
returned unopened to the bidder.
IT 51 Personnel
a) The Contractor shall employ the key personnel named in the Schedule of Key
Personnel as referred to in the Bid document to carry out the functions stated in the
Schedule or other personnel approved by the Engineer. The Engineer will approve any
proposed replacement of key personnel only if their qualifications, abilities, and
relevant experience are substantially equal to or better than those of the personnel
listed in the Schedule.
b) If the Engineer asks the Contractor to remove a person, without assigning reasons
thereof, for his misconduct or inadequacy of technical skills and experience, who is a
member of the Contractor’s staff or his work force, the Contractor shall ensure that the
person leaves the Site within seven days and has no further connection with the work
in the Contract.
c) No residential accommodation is allowed at the site of work. The labour huts shall not
be erected on the site of work and contractor shall make his own arrangements to
provide such accommodations as per the rules of the local bodies. He shall make his
own arrangements for housing, stores, field office etc. He shall submit a site layout
plan indicating the location of various site facilities to be created by him at his cost for
the execution of work. The Owner shall in no way be responsible for any delay on this
account and no claim on this account whatsoever shall be entertained. All Basic
amenities shall be provided by the Contractor to Labours as per the prevailing labour
IT 52 Bills of Quantity
a. The schedule-B shall contain Memorandum showing items for the construction,
installation, testing, and commissioning work to be done by the Contractor.
b. The quantities stated in the schedule B are estimated quantities. The Contractor shall
be paid only quantities calculated after taking measurements of executed work. The
rate stated in the schedule B for each item of work shall apply. The works shall be
measured by the Contractor jointly with the authorized representative of the
Engineer and all particulars required by the representative of the Engineer shall be
supplied by the contractor.
c. The work shall be measured net. No allowance for general or local custom, working
space etc. is to be made.
IT 53 Variations
a) The Engineer in Charge shall have power to make any variation of form, quality or
quantity of the works or any part thereof that may, in his opinion, be necessary and for
that purpose, or if for any other reason it shall, in his opinion, be appropriate, he shall
have the authority to instruct the Contractor to do and the Contractor shall do any of the

b) No such variation shall in any way vitiate or invalidate the contract, but the effects, if

Provided that where the issue of an instruction to vary the Works is necessitated by
some default or breach of contract by contractor or for which he is responsible, any
additional cost attributable to such default shall be borne by the Contractor.
c) The Contractor shall not make any such variation without an instruction of the
Engineer. No instruction is required for quantities varying from those provided for the
items in the contract schedule B.
IT 54 Extra Items
1 The basis for the valuation of variations for addition to the Contract Price shall be as
follows in the same order of priority.
a) Variations in the quantities of work in schedule of quantities shall not vitiate the

Engineer-in-charge.
c) Contract unit rates for individual items shall apply to varied quantities where there
is a quantity variation.
d) The price variations on extra item will not be given.
e) In case of other non tender items following procedure shall apply.
2 If any extra item crops up during the progress of work the same shall be carried out by
the Contractor and he shall be paid at the rate fixed by Employer which shall be fixed as
lowest of the rates derived by rate analysis based on the following three methods., the
priority of the documents forming the Contract shall be as follows:
(i) If the extra item is included in the S.O.R. of Road & Building Department, Year
2023-24, the rate of extra item shall be that rate and premium (above or below)
quoted by contractor.
(ii) Rate analysis based on prevailing Govt. of Gujarat’s SOR rates.
(iii) Rate analysis based on current market rates. This shall be based on
The material costs, the labour costs, the cost of use of all plant, machinery and
equipment, the cost of all temporary and incidental works, the overheads and the
Contractors profit.
The overheads shall be taken at 5 % of the sum of material costs, the labour
costs, the cost of use of all plant, machinery, and equipment, the cost of all
temporary and incidental works.
In case of the rate is to be derived from prevailing market rate, the Contractors profit
shall be taken at 10 % of the final rate derived.
4 In the event of disagreement, the Engineer in Charge shall fix such rates and prices as
are, in his opinion appropriate and shall notify the Contractor accordingly with a copy to

payments to be included in the Interim Payment Certificates, until rates and prices are
agreed as final by the Employer, the Contractor, and the Engineer.
6 The Contractor shall not be entitled to additional payment for costs, which could have
been avoided by giving early warning.
1 Payments shall be adjusted for deductions for advance payments, retention, other
recoveries in terms of the contract and taxes at source, as applicable under the law. The
Employer shall pay the Contractor the amounts certified by the Engineer.
2 If an amount certified is increased in a later date certificate due to corrections in
previous certificates or as a result of an award from disputes review experts, Contractor
shall be paid such amount only. The Contractor shall not be paid any interest upon such
delayed payment.
3 Items of the work for which no rate or price has been entered in will not be paid for by
the Employer and shall be deemed covered by other rates and prices in the Contract.
4 All payments shall be made in Ahmedabad.
IT 56 Taxes and duties
The rates are inclusive of all the prevailing taxes and duties of the Central, State and
Local Governing bodies prevailing on the date of award of the contract. The Contractor
will have to pay all such taxes and duties for the performance of this Contract. The
Employer will deduct from the Contractor’s monthly and other payments all taxes and
duties, which he is bound to recover in accordance with the applicable law.
The Contractor shall keep himself fully informed of all acts and laws of the Central &
State and local Governing bodies, all orders, decrees of bodies, tribunals having any
jurisdiction or authority which in any manner affect those engaged or employed, and
anything related to carrying out the work. All the bye-laws lay down by AMC/AUDA
and any other local bodies while executing the work shall be adhered to. All taxes of
local bodies shall be borne by the contractor. The Contractor shall arrange to give all
notices required by any authority and to pay to such authority all the fees that may have
to be paid for the material, plants, equipments etc. The Contractor shall also adhere to
all traffic restrictions notified by the local authorities. He shall protect and indemnify
the Owner and its officials & employees against any claim or liability arising out of
violations of any such laws, ordinances, orders, decree, whether by himself or by his
employees or his authorized representatives. Nothing extra shall be payable on these
accounts. However, client will pay GST on each work done bill submitted by bidder as
per prevailing rate.
IT 57 Labour Welfare Cess
As per circular No. GHR/2005/04/CWA/2004/841/M-3 dt. 3/1/05 and G.R. No.
CWA/2004-1831-M(3) dt. 9/12/05 issued by G.O.G. 1 % cess tax (non-refundable)
shall be deducted from every bills which shall be deposited to Govt. Labour
Department for Labour welfare fund.
IT 58 Termination
1 The Employer shall be entitled to terminate the contract if the contractor:
(a) Fails to carry out any obligation under the contract.
(b) Without reasonable excuse fails –
1. To commence the works on site within the period stated in the Appendix to Bid
after receipt by him of a Notice to this effect from the Engineer/Employer after
signing the agreement or
2. To proceed with the works, or any section thereof, within 28 days after received
3. Has failed to comply with a notice issued or an instruction issued within 28 days
after having received.
4. Abandons the works or otherwise plainly demonstrates the intention not to
continue performance of his obligation under the contract.
5. Sub-contracts the works or assigns the contract without the specific prior written
permission of the engineer.
6. Has failed to furnish the required securities or extension thereof in terms of the
7. Becomes bankrupt or insolvent, goes into liquidation, has a receiving or
administration order made against him, compounds with his creditors, or carries
on business under receive, trustee or manager for the benefit of his creditors, or
if any act is done or event occurs which (under applicable Laws) has a similar
effect to any of these acts of event.
2 In any of these events or circumstances, the Employer may, upon giving 14 days notice
to the contractor, terminate the contract and expel the contractor from the site. However,
in the case of sub-paragraphs (h), the Employer may be notice terminate the contract
3 The Employer’s decision to terminate the contract shall not prejudice any other rights of
the Employer, under the contract or otherwise.
4 After termination, the Employer may complete the works and/or arrange for any other
entities to do so. The Employer and these entities may then use any goods, contractor’s
documents and other design documents made by or on behalf of the contractor.
The Employer or the Contractor may terminate the Contract if the other party
causes a fundamental breach of the Contract.
Fundamental breaches of Contract include, but shall not be limited to the
(a) the Contractor stops work for 14 days when no stoppage of work is shown on the
current Program and the stoppage has not been authorized by the Engineer;
(b) the Employer or the Contractor is made bankrupt or goes into liquidation other than
for a reconstruction or amalgamation;
(c) The contractor fails to fulfill requirements;
(d) the Engineer gives Notice that failure to correct a particular Defect is a fundamental
breach of Contract and the Contractor fails to correct it within a reasonable period of
time determined by the Engineer;
(e) the Contractor does not maintain a security which is required;
(f) the Contractor has delayed the completion of works by the number of days for
which the maximum amount of liquidated damages becomes payable as defined in
the Contract data;
(g) if the Contractor, in the judgment of the Employer has engaged in corrupt or
fraudulent practices in competing for or in the executing the Contract.
(h) For the purpose of this paragraph: “corrupt practice” means the offering, giving,
receiving or soliciting of anything of value to influence the action of a public
official in the procurement process or in contract execution. “Fraudulent practice”
means a misrepresentation of facts in order to influence a procurement process or
the execution of a contract to the detriment of the Borrower, and includes collusive
practice among Bidders (prior to or after bid submission) designed to establish bid
prices at artificial non-competitive levels and to deprive the Borrower of the benefits
of free and open competition.”
When either party to the Contract gives notice of a breach of contract to the
Engineer for a cause other than those listed above, the Engineer shall decide
whether the breach is fundamental or not.
Notwithstanding the above, the Employer may terminate the Contract for
If the Contract is terminated the Contractor shall stop work immediately,
make the Site safe and secure and leave the Site as soon as reasonably possible
and handover the site to the Employer including all materials and plant and
equipment existing there upon.
IT 59 Contractor's own responsibility
The contractor is to set out and level the works and will be responsible for the accuracy
of the same. He shall also be responsible for the correctness of the positions, levels,
dimensions, and alignment of all parts of the structures as per instructions given to him.
If at any time any error shall appear during the progress of any part of the work, the
contractor shall at his own expense rectify such error if called upon to the satisfaction of
the Engineer in charge.
IT 60 Overpayment & Underpayment
Whenever any claim Fifths payment of a sum to the Municipal Corporation arises out
of or under this Contract against the contractor the same may be deducted by the
Municipal Corporation from any sum then due or which at any time thereafter may
become due to the contractor under this contract and failing that under any other
contract with the Municipal Corporation or from any sum due to the contractor with the
Municipal Corporation (which may be available with Municipal Corporation), or from
his retention money, or he shall pay the claim on demand. The Municipal Corporation
reserves the right to carry out post payment audit and technical examination of the final
bill including all supporting vouchers, abstracts, etc.
The Municipal Corporation further reserves the right to enforce recovery of any over
payment when detected notwithstanding the fact that the amount of the final bill may be
included by the Contractor.
If as a result of such audit and technical examination any over payment is discovered in
respect of any work done by the Contractor or alleged to have been done by him under
the contract, it shall be recovered by the Municipal Corporation from the contractor by
way of all the means prescribed above or if any under payment is discovered by the
Municipal Corporation, any amount due to the contractor under this contract or under
payment may be adjusted against any amount then due or which may at any time
thereafter become due before payment is made to the contractor from him to the
Municipal Corporation on any other contract account whatsoever.
IT 61 Cost of Repairs
Loss or damage to the Works or Materials to be incorporated in the Works between the
Start Date and the end of the Defects Correction periods shall be remedied by the
Contractor at the Contractor's cost if the loss or damage arises from the Contractor's acts
IT 62 Materials obtain from dismantling
If the contractor, in the course of execution of work is called upon to dismantle any part
for reasons other than on account of bad or imperfect work, the materials obtained from
dismantling will be the property of the A.M.C. and will be disposed of as per instruction
of Engineer-in-charge in the best interest of the A.M.C.
IT 63 Drawings and Photographs of the Works
The contractor shall do photography/ videography of the site as and when asked by
AMC. No separate payment will be made to the contractor for this. The contractor shall
have to submit the same in hard copy as well as soft copy as and when demanded by the
No photograph of the works or any part thereof or plant employed thereon, except shall
be taken, or permitted to be taken by the Contractor or by any of his employees or any
employees of his sub-Contractors without the prior approval of the Engineer in writing.
No photographs/ videography shall be published or otherwise circulated without the
approval of the Engineer in writing.
“EHS plan” means Environmental, Health and Safety Plan prepared by the Contractor
for implementation at site, based on and including, without limitation to various Clauses
of the Conditions of Contract pertaining to Safety, Health and environment; and
approved by the Project Manager.
IT 65 “QUALITY CONTROL (Q-C) Manual”
Contractor shall prepare and submit the same prior to the commencement of Work
at site as per the construction industry requirement with all Q-C Manual shall
include all check lists, Quality Control procedures to be carried out at site
with necessary tables, list of Quality Control Equipment etc. The same shall be
reviewed and approved by PMC.
IT 66 Material Testing Laboratory
The Contractor shall provide and maintain a well-equipped “Material Testing
Laboratory” and site office for the Engineer and hire staffs for the complete
duration of the contract at no cost to the Employer.
IT 67 Measurements
All work shall be measured by standard method as per latest IS codes, rules and
customs of AMC. The decisions of engineer-in charge as to what is usual method in use
will be final binding on the contractor.
Method of Measurement
Contractor to Verify Site Measurements:
A. The Contractor shall check and verify all site measurements whenever requested
by other specialists, Contractors or by nominated or other subcontractor to enable them to
prepare their own measurement sheets and pass on the information with sufficient promptness
as will not in any way delay the works. A copy of all such information passed on shall be
given to the Construction Management Consultant/EIC.
B. Measurement to be recorded before work is covered up: The contractor shall
take joint measurements with the CMC’s representative/EIC before covering up or
Otherwise placing beyond the reach of measurement any item of work. Should the
contractor neglect to do so, the same will be uncovered at the contractor’s expense
or in default thereof, no payment or allowance shall be made for such work or the
materials with which the same was executed. No claim for interim bill payment
will be entertained unless the bill is accompanied with detailed measurements.
C. Typographic or clerical errors: The Architect's clarifications regarding partially
omitted particulars or typographical or clerical errors shall be final and binding on
the Contractor.
D. The Works shall be measured as per method of measurement detailed in
Technical specification of this contract. In absence of these details relevant practice
shall be followed, as laid down in relevant IS codes, IS – 1200 and SP 27 (latest
IT 68 Defects Liability Period:
Defects Liability Period” as stated in the Contract data means the period
calculated from:
i. The date of completion of the works certified by the Engineer in accordance
with Clause and its sub clauses of these Conditions of Contract.
ii. The respective dates in case different dates of completion of the part works
are Certified by the Engineer In Charge.
Completion of outstanding work and remedying defects:
a. The Contractor shall complete the outstanding work with due diligence all
such work as listed by the Engineer at the time of issue of “Taking over
Certificate and also.
b. Execute all such work of amendment, reconstruction and remedying defects,
shrinkages or other faults as the Engineer may, during the Defects Liability
period or within 14 days of its expiration, as a result of an inspection made
by or on behalf of the Engineer, prior to its expiration, instruct the Contractor
Costs of remedying defects:
Costs of all works referred to in the tender shall be borne by the Contractor,
unless otherwise expressly stated in the contract.
Correction of Defects during Defects liability period
a. The Engineer shall give notice to the Contractor of any Defects before the end of
the Defects Liability Period, which begins at Completion and is defined in the
Contract Data. The Defects Liability Period shall be extended for as long as
Defects remain to be corrected.
b. Every time notice of a Defect is given, the Contractor shall correct the
notified Defect within the length of time specified by the Engineer’s notice.
Uncorrected Defects during Defects liability period
a) If the Contractor does not rectify or correct a defect within the time specified in
the Engineer’s notice, the Engineer will assess the cost of having the Defect
corrected, and the Contractor will bear the costs of such defective work as well as
all works carried out over such defective work until the defect is removed to the
satisfaction of the Engineer.
b) Only the Defects Liability Certificate referred to in following clause shall be
deemed to constitute the approval of the works.
c) Defects Liability Certificate: The Defects liability certificate shall be given by
the Engineer to the Employer, with a copy to the Contractor, within 28 days of the
expiry of the Defects Liability Period. The Contract shall remain incomplete until
issue of the Defects Liability Certificate.
The defects Liability Certificate shall mention clearly that the Contractor
Has completed his obligations to execute and complete the works and
Remedy defects therein to the satisfaction of the Engineer.
Unfulfilled Obligations: Despite issuance of the Defects Liability
Certificate, the contract between the Employer and the Contractor shall
remain in force in respect of unperformed obligations incurred under the
provisions of the Contract prior to the issue of the Defects Liability
IT 69 Record of Materials
The Contractor shall maintain a record in the format specified by the Engineer-
In-Charge, of all materials brought to the site. The Engineer-in-Charge may
carry out inspection /at any time to check the record and whether they have
been properly stored.
IT 70 Housing, Water Supply and Drainage etc.
Housing accommodation on hire is likely to be available in this area around the
site. The Contractor has to make his own arrangements for the housing of
labourers. The land required for setting up batching plant, stacking of materials,
site office, labour quarters, testing laboratory, etc. will be arranged by
contractor at his cost and risk.
IT 71 Security:
The Contractor shall at his cost provide at all times adequate number of watchmen to
guard the Site, materials and equipment, to the satisfaction of the Client. The Contractor shall at
all times be fully responsible for the security of all materials
and equipment on the Site, whether his own or those of any Sub-Agency. Owner
shall not be responsible for any loss due to theft, burglary, fire, accident or any
other reasons, whatsoever.
IT 72 Temporary Lighting:
The Contractor shall make his own arrangement in respect of the provision of adequate
lighting at all places where his workmen are engaged for carrying out the Work and also
provide general lighting of site as a whole in a proper safe and satisfactory manner.
Contractor shall ensure that all staircases, lobbies and basements are well lighted by
providing at least one tube light at each landing of every staircase and also in each lift
lobby. The Contractor shall provide general lighting in basement by installing at least one
tube light per 100 sqm area at his own cost, which will be done in co-ordination with all

IT 74 SALIENT FEATURES OF SOME MAJOR LAWS APPLICABLE TO
ESTABLISHMENTS ENGAGED IN BUILDING and OTHER
CONSTRUCTION WORK.
Workmen Compensation Act 1923:- The Act provides for compensation in case
of injury by accident arising out of and during the course of employment.
Payment of Gratuity Act 1972: Gratuity is payable to an employee under the
Act on satisfaction of certain conditions on separation if an employee has
completed 5 years service or more on death at the rate of 15 days wages for
every completed year of service. The Act is applicable to all establishments
employing 10 or more employees.
Employees P.F and Miscellaneous Provision Act 1952: The Act Provides for
monthly contributions by the employer plus workers @ 12%/8.33%.
The benefits payable under the Act are:
(i) Pension to family pension on retirement or death, as the case may be.
(ii) Deposit linked insurance on the death in harness of the worker.
(iii) Payment of P.F accumulation on retirement/death etc.
Maternity Benefit Act 1951: - The Act provides for leave and some other
benefits to workmen/ employees in case of confinement or miscarriage etc.
Contract Labour (Regulation and Abolition) Act 1970: - The Act provides for certain
welfare measures to be provided by the Contractor to contract labour and in case the
Contractor fails to provide, the same are required to be provided,
by the Principal Employer by Law. The Principal Employer is required to- take
Certificate of Registration and the Contractor is required to take license from the
designated Officer. The Act is applicable to the establishments or Contractor of Principal
Employer if they employ 20 or more contract labour.
Minimum Wages Act 1948: The Employer is supposed to pay not less than
the Minimum Wages fixed by appropriate AMC as per provisions of the Act if the
employment is a scheduled employment Construction of Buildings, Roads,
Runways are scheduled employment.
Payment of Wages Act 1936: - It lays down as to by what date the wages are to be paid
when it will be paid a n d what deductions can be made from the wages of the workers.
Equal Remuneration Act 1979: - The Act provides for payment of equal wages for
work of equal nature to Male and Female workers an d for not making discrimination
against Female employees in the matters of transfers, training and promotions etc.
Payment of Bonus Act 1965: The Act is applicable to all establishments employing
or more employees. The Act provides for payments of annual bonus subject to a
minimum of 8.33% of wages and maximum of solvency of wages to employees drawing
Rs. 3500/- per month or less. The bonus to be paid to employees getting Rs. 2500/- per
month or above up to Rs. 3500/- per month shall be worked out by taking wages as Rs.
2500/- per month only. The Act does not apply to certain establishments. The newly set-
up establishments are exempted for five years in certain circumstances. Some of the State
AMCs have reduced the employment size from 20 to 10 for the purpose of applicability
Industrial Disputes Act 1947: - The Act lays down the machinery and procedure for
resolution of Industrial disputes, in what situations a strike or lockout becomes illegal and
what are the requirements for laying off or retrenching the employees or closing down the
Industrial Employment’s (Standing Orders) Act 1946: - It is applicable to all
establishments employing 100 or more workmen (employment size reduced by some of
the States and Central AMC to 50). The act provides for laying down rules governing the
conditions of employment by the Employer on matters provided in the Act and get same
certified by the designated Authority.
Trade Unions Act 1926: - The Act lays down the procedure for registration of trade
union of workmen and employers. The Trade Union registered under the Act has been
given certain immunities from civil and criminal liabilities.
Child Labour (Prohibition and Regulation) Act 1986: - The Act prohibits employment
of children below 14 years of age in certain occupations and processes a n d provides for
regulation of employment of Children in all other occupations and processes.
Employment of Child Labour is prohibited in Building and Construction Industry.
Inter-State Migrant workmen’s (Regulation of Employment and Conditions of
Service) Act 1979: - The Act is applicable to an establishment which employs 5 or more
inter-state migrant workmen through an intermediary (who has recruited workmen in one
state for employment in the establishment
situated in another state). The Inter- State migrant workmen, in establishment to which
this Act becomes applicable, are required to be provided certain facilities such as
housing, medical aid, travelling expenses from home upon the establishment and back,
The Building a n d Other Construction workers (Regulation of Employment and
Conditions of Service) Act 1996 and the Cess Act of 1996:- All the establishments who
carry on any building or other construction work and employ 10 or more workers are
covered under this Act. All such establishments are required to pay cess at the rate not
exceeding 2% of the cost of construction as may be modified by the AMC. The Employer
of the establishment is required to provide safety measures at the Building or
Construction work and other welfare measures, such as Canteens, First-Aid facilities,
Ambulance, Housing accommodations for workers near the work place etc. The
Employer to whom the Act applies has to obtain a registration certificate from the
Registering Officer appointed by the AMC.
Factories Act 1948:- The Act lays down the procedure for approval at plans before
setting up a factory, health a n d safety provisions, welfare provisions, working hours,
annual earned leave and rendering information regarding accidents or dangerous
occurrences to designated authorities. It is applicable to premises employing 10 persons
or more with aid of power or 20 more persons without the aid of power engaged in
manufacturing process.
IT 75 First Aid
The Contractor shall at his cost provide, equip and maintain throughout the construction
period and so far as may be necessary during the period of maintenance, In a position on
site approved by the EIC, suitable and sufficient first aid facilities for the general use of
his and his subcontractors staff and work people.
IT 76 AS BUILT DRAWINGS
As part of the handing over documents after successful completion of the work, the
Contractor shall submit to the Client & its Authorized representatives AS BUILT
drawings drawn at approved scale indicating the complete system "As installed"/Photos
of All Equipment Layouts if required by Engineer-in-Charge. These drawings shall be
prepared in Autocad latest version.

10. Tenderers to please note this carefully:
1. The percentage must be given in words and figures amount thus worked out must
also be entered in the Financial Bid.

A. SAFETY POLICY

Client and their employees, Consultants, Contractors, Suppliers and any Visitors
of site who are directly or indirectly related to project work shall have to adhere
all norms of safety at site. This Safety policy is to provide a safe and healthy
place of employment for every employee and every person who is associated to
project shall have to abide by regulations set herewith.
Accident prevention is essential in maintaining an efficient operation. It is our
policy that our safety rules shall be strictly observed at all times. Although these
rules are to be considered very important, it is impossible to publish a rule that
circumstance. If a rule that might cover a specific hazardous condition has been
omitted, that shall not be an excuse for disregard of common sense in the safe
performance of your work.
The possession or consumption of alcohol, drugs or any other mind altering

Contractor has overall responsibility for the Project’s safety program and

A Motor Vehicle Record (MVR) check will be made on the employees
described above at the time of employment and at least every two years
thereafter. When the MVR shows accidents or violations, the employee’s
supervisor will counsel this employee to promote a better driving record, and
take other administrative action as appropriate.
Crane operator / fabricator should require proper experience in respective area
and he /she shall be well versed with his / her duties during the project work
compromising in safety policy.
C. Orientation and Training
When a new employee is hired, orientation training of the employee will be done
by the Contractor to cover such areas as: company safety rules and procedures,
emergency procedures including fire extinguisher use, personal protective
equipment that is required on the job, what the company expects from the
employee, and our Hazard Communication Program. Refresher Haz-Com
training will be completed at any time that new materials used in the operations
offers any new exposure potential. Training and learning program schedule to be
maintained at Contractor’s office under supervision of client / PMC of project.
Any special training regarding special equipment / machineries any arise that
should be given to respective employee and proper certification to be made.
Accident Reporting and Discussion:
An employee must report any accident or injury, regardless of how minor, to the

All inquiries concerning an incident/accident/injury/property damage shall be
referred to the In charge of project. The employee will make no comments,
provide no details, or express any opinion as to the cause of the incident, who

D. Accident Investigation:
Every personal injury accident or illness, property damage, and vehicle accident
will be investigated by Site in charge in consultation with safety in charge or the
Supervisor in charge of the operation. The investigation will be recorded on the
ACCIDENT INVESTIGATION REPORT. Every report will be reviewed by In
charge of project. Personal injury or illness will be recorded on the site accident
log sheet with accident date, time, place, cause, area, floor etc, as required. The
completed Accident Investigation Reports will be reviewed during the monthly
Supervisory Safety Meetings.
E. Personal Protective Equipment:
Hard Hats Helmet - All employees are required to wear a hard hat helmet on
every job site at all times.
Eye Protection - All employees are required to wear safety glasses (with side-
shields) on the job site at all times.
Fall Protection - All employees exposed to falls over 6ft are required to be
trained on and use proper fall protection. On scaffolds, the trigger height is 10ft.
For steel erection activities, the trigger height is 15 feet (see 1926.750 for
details/exceptions).
Hand Protection - All employees involved in operations exposing hands to cuts,
chemicals, burns,etc. are required to wear gloves.
Rubber Boots - Employees involved in operations exposing the feet / legs to
such hazards as concrete burns during placing uncured concrete are required to
wear rubber boots in good condition.
Safety Shoe - Every employee must wear safety shoe during work on site.
Apron- Every employee on site area should wear Apron / Jacket with self-glow
highlighting color.
Other - Specific jobs may cause the need for other personal protective
equipment. When this occurs, the employee is expected to utilize this equipment.
Superintendent’s responsibility to see that equipment in use is appropriate and in
good condition.
F. Safety Rules and Procedures:
The safety rules and procedures are developed to assist in achieving job safety
by having no employee accidents. Every employee is expected to abide by the
safety rules and procedures at all times. Any updating required in safety process
and terms needs to be done as and when required on site to achieve more
competency in safety.
Every Employee and other all associates who is associated with project must
follow the safety policy, rules and procedures established here with to give safe
working environment. Violations may result in disciplinary action, which could
include termination.
Employees shall report any equipment or condition considered to be unsafe, as
well as what they consider to be unsafe work practices. This type of information
shall be immediately reported to the Site In charge or to the person in charge of

accidents. Do not engage in horseplay on the job.
When lifting, bend your knees, grasp the load firmly, then raise the load with
your legs, keeping the back as straight as possible. Don’t twist body with a load,
move your feet.

When in doubt about the safety of a situation that is out of the norm, contact the
Site in Charge to find the proper procedure.
Good housekeeping practices improve safety for everyone. When you create
clutter, clean it up. When clutter is left in the work area by someone else, clean it
up and report this to the Site In charge. The possession or consumption of
alcohol, drugs or any control substance is against policy and violators are subject
G. Disciplinary Policy:
Employees and all associate of project are expected to us good judgment when
doing their work and to follow established safety rules. We have implemented a
disciplinary policy to provide appropriate consequences for failure to follow
safety rules. This policy is designed not so much to punish as to bring
unacceptable behaviour to the employee’s attention in a way that the employee
will be motivated to make corrections. The following consequences apply to the
violation of the same similar rule or the same/similar unacceptable behaviour:
• First Instance—verbal warning, and retraining.
• Second Instance—written reprimand, and retraining.
•Third Instance—1-5 day suspension without pay, written reprimand and

The Safety in charge is responsible for providing orientation and safety training

utilize on the job; ladder use, fire extinguishers, and other appropriate topics.
The Safety in charge will record the meeting as to the topics discussed, date, and
attendance by obtaining employee signatures. The original should be sent to the
main office with a copy retained with the job documents. All employees are
expected to attend and participate in the weekly job safety meetings. Areas that
concern safety on the job should be brought forward during these meetings. All
contractors will also be invited to these weekly meetings.
Supervisory Safety Meetings - Top management will plan and arrange for
meetings to be held once each month. Top management and all supervisors will
attend and participate in this meeting to review jobsite accidents, near misses,
required training, unsafe conditions/acts noted on safety inspections, etc.

Employees driving company vehicles or their personal vehicle on company
business must have a current valid driving license and an acceptable driving
record. Employees driving their personal vehicle on company business must
provide proof of liability insurance.

(1) The disputes relating to this contract, so far as they relate to any of the following
matters, whether such disputes arise during the progress of the work or after the
completion or abandonment thereof, shall be referred an independent Arbitrator
appointed by AMC as far possible in consultation with the agency if it is
necessary and such disputes shall be settled in accordance with the arbitration
and conciliation Act.
(i) The rates of payment under clause 5 for any tools, materials and stores,
in or upon the works of the site thereof or belonging to the contractor or
procured by him and intended to be used for execution of the work or
any part thereof possession of which may have been taken by the
Engineer-in-charge under the said clause –5.
(ii) The reduction in rates made by the Engineer-in-charge under clause
from the items of works not accepted as completed fully in accordance
with the sanctioned specifications.
(iii) The rate of part of payment for any class of work which is included in
the additional or altered work carried out by the contractor in accordance
with the instructions of the Engineer-in-charge under clause 14 and the
rates for which is to be determined under the said clause
(iv) The rates of payment for materials already purchased or agreed to be
purchased by the contractor before receipt of notice given by the
Engineer-in-charge under clause 15 and/or amount of compensation
payable to the contractor under the said clause for loss in respect of such

12. General conditions:
1. In the specification "as directed" / "approved" shall be taken to mean "as directed /
"approved" by the Engineering in charge.
2. Wherever a reference to any Indian standard appears in the specifications, it shall be
taken to mean as reference to the latest edition of the same of force on the date of

absence of specific mention for a particulars point / aspect, the same in the relevant Indian

5. The distance which constitutes lead shall be determined along the shortest practical route
and not necessarily the route actually taken. The decision of the Engineer in charge in this
regards shall be taken as final.
6. Where no lead is specified, it shall mean "all leads".
7. Lift shall be measured from ground level.
8. Definite particulars covered in the items of work, though not mentioned or
elucidate in its specifications shall be deemed to be included therein.
9. Reference to s p e c i f i ca t i o n s ma t e r i a l s as made in the detailed specifications of
the work is in the forms of a designation containing the number of the specifications
of the materials e.g. "M-6".
10. Approval of the samples of various material given by the Engineer in charge shall
the contractor from the responsibility of replacing defective materials brought on
site or materials used in the work found defective at a later date. The contractor shall
have no claim to any payment or compensation whatsoever on account of any such
materials being rejected by the Engineer in charge.
11. The contractor’s rate for the item of work shall be for the work completed in

13. Stacking of approved materials shall be done at site of work in a systematic
manner. Materials of ensured quality to be used for the work shall be stored in such

14. Materials, as and when rejected by the Engineer in charge shall be removed from
the site of work within 24 hours.
15. No materials shall be stored during and after execution of a structure in a way
causing damage or overloading of the various components of the structure.
16. All work shall be carried out in a manner applying the best technique.
17. All tools, templates, machinery and equipment for correct execution of the work as
well as for checking lines, levels, alignment of the works during execution shall
have to be kept in sufficient numbers and in good working condition at the site of the
18. Special modes of the construction not adopted in general Engineering practice, if
proposed to be adopted by the contractor shall be considered only if the contractor
provided satisfactory evidence that such special mode of construction and
completion of work to the required strength and quality. Acceptance of the same b y
the Engineer in charge shall not however, absolve the contractor from the
responsibility of any adverse effect and concordance of adopting the same in the
course of exaction or completion of the work.
19. The contractor shall be responsible for observing the rules and regulation imposed
under the "Child Labour Act", and such other laws and rules prescribed by the
Government from time to time.
20. All necessary safety measures and precautions (incl. those laid down in the various
relevant Indian Standard) shall be taken to engrave the safety of men, materials and
machinery on the work and also of the work itself. carried out as stipulated in
relevant I.S. code / general specifications and instruction by Engineer in charge.
21. The testing charges of all materials shall be borne by the contractor; The test shall be
carried out as stipulated in relevant I.S. code / general specifications and instruction by
Engineer in charge.
22. The contractor shall not escape from his responsibility for the correctness, soundness
and strength of structure as per the drawings and specifications.
23. OFFICE ACCOMODATION FOR THE SITE ENGINEERING
The contractor shall provide, erect and maintain at his cost a separate simple watertight
office accommodation for the Site Engineer. These accommodations shall be well
lighted and ventilated and provided with windows, door, with a lock. The office of Site
Engineer shall be Centrally Air-conditioning with minimum of 250 sft containing with
meeting room, toilet and panty facilities and the contractor shall provide minimum
desks with minimum 12 chairs, drawers for keeping drawings, 2 steel cupboard having
proper lock and a tack board for displaying drawings. Contractor has to provide
minimum 02 Laptop (HP/Dell/Sony/Lenovo) and 02 desktops (HP/Dell/Sony/Lenovo)
of latest configuration (i5) with broad band & laser printer facilities one number of
2TB size external hard disk (WD/HP/Seagate/Sony) during construction phase & up to
completion period of the project. The accommodation shall be demolished when
Sanitary Arrangement:
The Contractor shall provide and erect all necessary sanitary convenience for the Site
staff and the workmen maintain in a clean orderly condition and clean and deodorize the
ground after removal.
24. Insurance in respect of damage to persons and property :
The contractor shall be liable for and shall indemnify the Employer against any
liability, loss, claim or proceedings whatsoever arising under any statute or at common
law in respect of personal injury to or the death of any person whomsoever arising out
of or in the course of or caused by the carrying out the works, unless due to any act or
neglect of the Employer or of any person for whom the Employer is responsible.
The contractor shall be responsible for all injury to persons, animals or things, and for
all structural and decorative damage to property which may arise from the operation or
neglect of himself or of any nominated sub-contractor's employees, whether such injury
or damage arise from carelessness, accident or any other cause whatever in any way
connected with the carrying out of this contract. This clause shall be held to include,
interalia, any damage to buildings, whether immediately adjacent or otherwise and
damage to roads, streets, good paths, bridges or way as well as all damage caused to
the buildings and works forming the subject of this contract by frost or other
inclemency of weather. The contractor shall indemnify the employer and hold him
harmless in respect of all and any expenses arising from any such injury or
damage to persons or property as aforesaid and also in respect of any claim made in
respect of injury or damage under any acts of government or otherwise and also in
respect of any award of compensation or damages consequent upon such claim.
The contractor shall reinstate all damages of every sort mentioned in this clause, so as
to deliver up the whole of the contractor works complete and perfect in every respect
and so as to make good or otherwise satisfy all claims for damage to the property of
The contractor shall indemnify the employer against all claims which may be made
against the employer by any member of the public or other third party in respect of
anything which may arise in respect of the work or in consequence thereof and shall
at his own expense arrange to effect and maintain until the virtual completion of
the contract, with an approved office and policy of insurance in the joint names of the
employer and the contractor against all claims which may be made upon the
employer whether under the workmen's compensation act or any other statute in
force during the currency of this contract or at common law in respect of any
employee of the contract or any sub-contractor and shall at his own expense effect
and maintain, until the virtual completion of the contract, with an approved office a
policy of insurance in the joint names of the employer and contractor against such
risks and deposit such policy or policies with the Architect from time to time
during the currency of the contract.
The contractor shall be responsible for anything which may be excluded from the
insurance policies above referred to and also for all other damages to any property
arising out of and incidental to the negligent or defective carrying out of this contract.
He shall also indemnify the employer in respect of any costs, charges or expenses
arising out of any claim or proceeding and also in respect of any award of or
compensation of damage arising their form.
The employer with the concurrence of Architect shall be at liberty and is hereby
empowered to deduct the amount of any damage, compensation, costs charges and
expenses arising or accruing from or in respect of any such claim or damage from any
sum or sums due or to become duet to the contractor.
25. Insurance : (CAR)
The contractor shall in joint names of the Employer and contractor insure against loss
or damage by fire, storm, tempest, lighting, flood, earthquake, aircraft or anything
dropped therefrom, serial objects, riot and civil commotion for the full value thereof all
work executed and all unfixed materials and goods intended for, delivered to and
placed on or adjacent to the work, but excluding temporary building plant, tools and
equipment owned or hired by the contractor or any sub-contractor and shall if such
work material and goods so insured until virtual completion of the work such
insurances shall be with insurers approved by the Architect and contractor shall deposit
with the Architect the policy or policies and the receipts in respect of premiums paid
and should the contractor make default in insuring or continuing to insure as aforesaid
the Employer may himself insure against any risk with respect of which the default
shall have occurred and deduct a sum equivalent to the amount paid by him in respect
of premium from any monies due to or to become due to the contractor.
Provided always that if the contractor shall independently of his obligations under this
contract maintain a policy of insurance which covers (interalia) the said work,
materials and goods against the aforesaid contingencies to the full value thereof then
the maintenance by the contractor of such policy shall if the Employer interest is
endorsed thereon, be a discharge of the contractors obligation to insure in the joint
names of the Employer and contractor and the production by the contractor as and
when may reasonably be required by the Architect of a current certificate of insurance
from the company or firm which shall have issued the said policy shall be a discharge
of the contractor's obligation to deposit with the Architect a policy or policies and the
receipts in respect of premium paid.
Upon survey of any claim under the insurances aforesaid the contractor with due
diligence shall restore work damaged, replace or repair unfixed materials or goods
which have been destroyed or injured, remove all dispose of any debris and proceed
with the carrying out and completion of the work. All monies received from such
insurances shall be paid to the contractor by installments under certificates of the
Architect issued at the period of interim Certificates named in the appendix to this
conditions. The contractor shall not be entitled to payment in respect of the restoration
of work damaged, the replacement and repair of any unfixed materials or goods and the
removal and disposal of debris other than the monies received under the said
26. Workmen Compensation
The Employer shall not be liable for or in respect of any damages or compensation
payable according to Law In respect or in consequence of any accident or injury or loss
of life to any workman or other person in the employment of the contractor or any
subcontractor, except an accident or injury resulting from any act or default of the
