Annual maintenance contract for Centralized Medical Gas Pipeline System (Oxygen)-106 points (40+50+16) installed at Workshop Railway Hospital, Kanchrapara for three(03) Years

Special Eligibility Criteria

   SPECIAL CONDITION OF CONTRACT: 1. The Rly.Admn. will not be held reasonable for death or injury to any operator, Labour during operation of the work. 2. The Rly.Admn. will not be held responsible for accident, breakdown, major or minor repair/Replacement of any machineries during full contract period. 3. All machine operators, skilled labour engaged for the work shall not be less than 18 years of age. 4. Rly. Administration will not make supply of any type of machineries, tools and plants, hygienic chemicals for execution of the work. All materials including machineries and manpower, chemicals will be arranged by the agency for execution of the work with entire satisfaction of the administration. 5. For keeping all machineries, tools and plants to execute the work, contractor will make arrangement at his responsibilities. 6. Successful tenderer will see the requirement of "Power Plugs" and "Water supply points" where necessary, as given in the scope of work which will be under protection of tenderer to avoid unauthorized power tapping and misuse of water. 7. All workers of the contractor should wear uniforms with good outlook during the work with protective clothing as required. The name of the firm should be printed on these uniforms, protective clothing. 8. CMS/WRH/KPA or ACMS(Admn)/WRH/KPA will be responsible for satisfactory management of the contract and for which a log book/Register will be opened to acknowledge satisfactory performance of the work duly signed by CMS/WRH/KPA or ACMS(Admn)/WRH/KPA and representative of tenderer or tenderer himself jointly every day. 9. All payment will be made on satisfactory completion of the work duly certified by any nominated Railway representative. Necessary bill in this regard should be submitted to CMS/WRH/KPA or ACMS(Admn)/WRH/KPA and for signature and sanction of the competent authority. 10. If any machinery, operator, labour and other equipments/ materials are not supplied on any working day by which work as per agreement remained suspended, the Rly.Admn. will deduct the amount as per GCC as penalty for each minor offence from contractor's bill. 11. The rates for each item shall be quoted as per schedule in figures and words. Tenderer should submit with following documents along with tender forms during submission. 12. The tenderer shall keep the offer valid for a minimum period of 45 days from the date of opening of the tender. Within this period the tenderer cannot withdraw his offer subject to the period being extended further, if required. Any contravention of the above condition will make the tenderer liable for forfeiture of his Earnest money for the due performance of the foregoing performance of the foregoing stipulation.

   13. If any incorrect or falls information are furnished or any adverse records are concealed in submitting the tender, the Rly. Administration reserves the right of taking any action in addition to cancellation of the contract/rejection of the tender. 14. Tenderer may contact CMS/WRH/KPA or ACMS(Admn)/WRH/KPA to inspect nature and place of work.Tenderer will act accordingly to all statutory Rules in E.Rly. in all respects. 15. Tenderer will execute the work under supervision of ACMS(Admin)/WRH/KPA of concerned dept. as per Description & Terms & Conditions In Agreement. Tenderer will also depute his Supervisors with full technical knowledge to daily supervise the current work. 16. The Rly. Administration shall the liberty to terminate the contract by giving one month's notice to the Tenderer at any time within contracted period due to unsatisfactory services or any unavoidable circumstances. In such event, Rly. Administration will not be liable for payment of compensation of any kind whatsoever for such changes of contract. 17. Tenderer will be held responsible for proper handling of Rly. Properties during execution of work. In case any damage caused to Rly. Property due to mishandling or loss incurred to the Rly. by tenderer or his worker, the damage or loss will be compensated by Tenderer. 18. Tender Form must be filled up properly by the Tenderer and witnessed as per provision in the Tender Form and failing which the Tender may be rejected. 19. Tenderer while quoting the rates shall take into account the possible fluctuation of market rate during currency of the contract. No escalation of the rate will be accepted. 20. Earnest money will be refunded on non-acceptance and/or rejection of the tender. 21. Tenderer must abide by or comply with all provisions and Rules of contract labour (Regulation and abolition) Act 1970 and contract labour (Regulation and abolition) Control Rules 1971 and shall be bound by that Act and Rules under all circumstances and successful Tenderers shall execute agreement with the Rly. Administration in which the said special condition shall form part thereof. 22. Rly. Admn.is not bound to accept the lowest of any Tender.

   Bank Guarantee @ 5% as Performance Guarantee in f/o FA&CAO/E.Rly/Kolkata. Validity of BG: Contract period + 60 days) should be submitted by the firm within 21 days after receiving the work order. A penal interest @ 15% p.a. shall be charged for delay beyond 30 days and delayed submission of same after 60 days the tender will be terminated. Books of reference: Tenderer should purchase a copy the following books of Engineering department of the Eastern Railway from the office of the Principal Chief Engineer, Eastern Railway, 17, N. S. Road, Kolkata- 700 001 on payment of prescribed cost and should go prescribed cost and should go though them: The General Conditions of Contract and Specifications, 1969 edition, hereinafter referred to as'GCC- 1969', for the purpose of specifications of works and materials only, The General Conditions of Contract, 2018 edition, hereinafter referred to as 'GCC-2022' for the purpose of general condition of contract and The Labour and Material Schedule, 1996 edition, hereinafter referred to as 'L & M Schedule-1996' for specifications and rates. Contractor: Tenderer, whose tender is accepted by the Railway, shall thereafter be referred to as 'contractor' and shall mean the person/firm/co-operative society or company, whether incorporated or not, who enters into contract with the Railway and shall include his executor, administrator, successor and permitted assignee. This tender document of the successful tenderer shall form part of contract agreement between the contractor and the Railway after acceptance thereof by the Railway. Singular and Plural: Words importing singular number shall also include plural and vice versa where the context requires in this tender document and vice versa. Inconsistency between the documents: The GCC-1969, the GCC- 2019 and the L & M Schedule-1996 shall be read with all correction slips issued there to from time to time and shall form integral part of this tender document. However, in case of any inconsistency and contradictions between the same and the special conditions and specifications laid in various chapters of this tender document, the later shall prevail. SCOPE OF THE TENDER: Tenders have been invited in the present case for and on behalf of the President of India for the work of Comprehensive Annual maintenance contract for Centralized Medical Gas Pipeline System (Oxygen) at Workshop Railway Hospital , Kanchrapara ,for three(03) Years. INSPECTION OF SITE: Before submitting tender, tenderer will be deemed to have satisfied himself, by actual inspection of the site and locality of the work, that all conditions liable to be encountered conditions liable to be encountered during execution of the work are taken into account and that the rates, he enters in this tender document, are adequate and all inclusive to accord with the provisions in GCC- 2022 for completion of the works to the entire satisfaction of the Railway.

   Before issuing letter of acceptance, Railway Inspecting Officer have the power to inspect the availability of machineries under control of tenderer to fulfill the condition for execution of the contract. Inspecting Officer's decision as regards the rejection of the machineries for the said purpose shall be final and binding on the Contractor which may reject the offer of tenderer if not rectified or replaced within stipulated time. During execution of the work, Inspecting Officer has the power to reject any defective machineries which to be replaced by tenderer immediately and failing which necessary penalty may be imposed for improper execution of the work due to said reason. Tender form will be submitted in scheduled date and time along with following documents, otherwise the tender form may be treated as invalid. a) Original Equipment Manufacturer Certificate or authorization from the OEM as a Sales & Servicing Agent should be submitted. b) List of spares and consumables with price. c) GST registration certificate. d) PAN e) Power of attorney in favor of signatory authority or Board's Resolution or Memorandum of Article PAYMENT TERMS: Half yearly basis payment will be made to the firm/contractor on completion of the work satisfactorily duly certified by the concerned department and other Railway authority. The tenderer must ensure that the condition laid down for submission of offers detailed in the preceding paras are completely fulfilled.
