The tenderer must have minimum average annual contractual turnover of V/N crores; where V= Advertised value of the tender in crores of Rupees N= Number of years prescribed for completion of work for which bids have been invited. The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover. The tenderers shall submit requisite information as per Annexure-E, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet.
Bid Capacity: Not applicable.
Credentials if submitted in foreign currency shall be converted into Indian currency i.e., Indian Rupee as under: The conversion rate of US Dollars into Rupees shall be the daily representative exchange rates published by the Reserve Bank of India or entity authorized by RBI to do so for the relevant date or immediately previous date for which rates have been published. Where, relevant date shall be as on the last day of month previous to the one in which tender is invited. In case of any other currency, the GCC April 2022 same shall first be converted to US Dollars as on the last day of month previous to the one in which tender is invited, and the amount so derived in US Dollars shall be converted into Rupees at the aforesaid rate. The conversion rate of such currencies shall be the daily representative exchange rates published by the International Monetary Fund for the relevant date or immediately previous date for which rates have been published.
Explanation for clause - Eligibility Criteria
Substantially Completed Work means an ongoing work in which payment equal to or more than 90% of the present contract value (excluding the payment made for adjustment of Price variation (PVC), if any) has been made to the contractor in that ongoing contract and no proceedings of termination of contract on Contractor's default has been initiated. The credential certificate in this regard should have been issued not prior to 60 days of date of invitation of present tender.
In case a work is started prior to 07 (Seven) years, ending last day of month previous to the one in which tender is invited, but completed in last 07 (Seven) years, ending last day of month previous to the one in which tender is invited, the completed work shall be considered for fulfillment of credentials.
If a work is physically completed and completion certificate to this extent is issued by the concerned organization but final bill is pending, such work shall be considered for fulfillment of credentials.
In case of completed work, the value of final bill (gross amount) including the PVC amount (if paid) shall be considered as the completion cost of work. In case final bill is pending, only the total gross amount already paid including the PVC amount (if paid) shall be considered as the completion cost of work. In case of substantially completed work, the total gross amount already paid including the PVC amount (if paid), as mentioned in the certificate, shall be considered as the cost of substantially completed work.
If a bidder has successfully completed a work as subcontractor and the work experience certificate has been issued for such work to the subcontractor by a Govt. Organization or public listed company as defined in note for item 2.1 of para 2 of tender document, the same shall be considered for the purpose of fulfillment of credentials
In case a work is considered similar in nature for fulfillment of technical credentials, the overall cost including the PVC amount (if paid) of that completed work or substantially completed work, shall be considered and no separate evaluation for each component of that work shall be made to decide eligibility.
In case of newly formed partnership firm, the credentials of individual partners from previous propriety firm(s) or dissolved previous partnership firm(s) or split previous partnership firm(s), shall be considered only to the extent of their share in previous entity on the date of dissolution / split and their share in newly formed partnership firm. For example, a partner A had 30% share in previous entity and his share in present partnership firm is 20%. In the present tender under consideration, the credentials of partner A will be considered to the extent of 0.3*0.2*value of the work done in the previous entity. For this purpose, the tenderer shall submit along with his bid all the relevant documents which include copy of previous partnership deed(s), dissolution deed(s) and proof of surrender of PAN No.(s) in case of dissolution of partnership firm(s) etc.
In case of existing partnership firm, if any one or more partners quit the partnership firm, the credentials of remaining partnership firm shall be re-worked out i.e., the quitting partner(s) shall GCC April 2022 take away his credentials to the extent of his share on the date of quitting the partnership firm(e.g. in a partnership firm of partners A, B & C having share 30%, 30% & 40% respectively and credentials of Rs 10 crore; in case partner C quits the firm, the credentials of this partnership firm shall remain as Rs 6 crore). For this purpose, the tenderer shall submit along with his bid all the relevant documents which include copy of previous partnership deed(s), dissolution deed(s) and proof of surrender of PAN No.(s) in case of dissolution of partnership firm(s) etc.
In case of existing partnership firm if any new partner(s) joins the firm without any modification in the name and PAN/TAN no. of the firm, the credentials of partnership firm shall get enhanced to the extent of credentials of newly added partner(s) on the same principles as mentioned in item 6 above. For this purpose, the tenderer shall submit along with his bid all the relevant documents which include copy of previous partnership deeds, dissolution/splitting deeds and proof of surrender of PAN No.(s) in case of dissolution of partnership firm etc.
Any partner in a partnership firm cannot use or claim his credentials in any other firm without leaving the partnership firm i.e., In a partnership firm of A&B partners, A or B partner cannot use credentials of partnership firm of A & B partners in any other partnership firm or propriety firm without leaving partnership firm of A&B partners.
In case a partner in a partnership firm is replaced due to succession as per succession law, the proportion of credentials of the previous partner will be passed on to the successor.
If the percentage share among partners of a partnership firm is changed, but the partners remain the same, the credentials of the firm before such modification in the share will continue to be considered for the firm as it is without any change in their value. Further, in case a partner of partnership firm retires without taking away any credentials from the firm, the credentials of partnership firm shall remain the same as it is without any change in their value.
In a partnership firm "AB" of A & B partners, in case A also works as propriety firm "P" or partner in some other partnership firm "AX", credentials of A in propriety firm "P" or in other partnership firm "AX" earned after the date of becoming a partner of the firm AB shall not be added in partnership firm AB.
In case a tenderer is LLP, the credentials of tenderer shall be worked out on above lines similar to a partnership firm.
In case company A is merged with company B, then company B would get the credentials of company A also.
Tenderer Credentials: Documents testifying tenderer previous experience and financial status should be produced along with the tender. Tender(s) who is/are not borne on the approved list of RDSO/CLW Vendor directory for repair, supply & manufacturing of SL-30 or SL42 of conventional Electric Locomotives, shall submit along with his/their tender. Non submission of the certificate by the tenderer shall result in summarily rejection of the his/their tender :
Certificates and testimonials regarding contracting experience for the type of job for which tender is invited in the form of Annexure-B, with list of works carried out in the past in the form of Annexure-B. The tenderer should also submit the list of works on hand indicating name of work, contract value, bill amount paid so far, due date of completion etc. to be furnished by contract in Annexure-C. Experience Certificate Annexure-D.
Audited Balance Sheet duly certified by the Chartered Accountant regarding contractual payments received in the past in the form of Annexure-E.
The list of personnel / organization on hand and proposed to be engaged for the tendered work in the form of Annexure-G. Similarly list of Plant & Machinery available on hand and proposed to be inducted and hired for the tendered work in the form of Annexure-F.
The Railway reserves the right to verify all statements, information and documents submitted by the bidder in his tender offer, and the bidder shall, when so required by the Railway, make available all such information, evidence and documents as may be necessary for such verification. Any such verification or lack of such verification, by the Railway shall not relieve the bidder of its obligations or liabilities hereunder nor will it affect any rights of the Railway there under.
(a)In case of any information submitted by tenderer is found to be false, forged or incorrect at any time during process for evaluation of tenders, it shall lead to forfeiture of the tender Bid Security besides banning of business for a period of up to five years. (b) In case of any information submitted by tenderer is found to be false, forged or incorrect after the award of contract, the contract shall be terminated. Bid Security, Performance Guarantee and Security Deposit available with the railway shall be forfeited. In addition, other dues of the contractor, if any, under this contract shall be forfeited and agency shall be banned for doing business for a period of up to five years.
In case of other than company/Proprietary firm, Annexure-V(A) shall also be submitted by the each member of Partnership firm/Joint Venture (JV)/Hindu Undivided Family(HUF)/Limited Liability Partnership(LLP) etc. as the case may be. Non-submission of above certificate(s) by the bidder shall result in summarily rejection of his/their bid. It shall be mandatorily incumbent upon the tenderer to identify, state and submit the supporting documents duly self-attested/digitally signed by which they/he is qualifying the qualifying criteria mentioned in the Tender Document and in tender document details.
Non-compliance with any of the conditions set forth therein above is liable to result in the tender being rejected.
Similar nature of work defined as: "Repair/reconditioning or manufacturing of smoothing reactor type SL-30 or SL-42 of electric locomotives"
For firms who are sources approved by RDSO/CLW eligible for manufacturing & supply /repair of SL-30 or SL-42 of Electric Locomotives , the technical and financial eligibility criteria is dispensed as per Railway Board's letter no.94/Elect(TRS)/441/1 Pt III Dated 06.8.09.
Firms not featuring in sources approved by RDSO/CLW eligible for repair, supply & manufacturing of RDSO/CLW eligible for manufacturing & supply/repair of SL-30 or SL-42 of Electric Locomotives Electric Locomotives shall have to fulfill the Eligibility Criteria and shall have to submit the documentary proof in support of their credentials/satisfactory performance till last day of the month previous to the one in which tender is invited to fulfill the eligibility criteria. Non submission of both of these documents would lead to summarily rejection of the Bid.
The tenderer must have successfully completed or substantially completed any one of the following categories of work(s) during last 07 (Seven) years, ending last day of month previous to the one in which tender is invited:
Three similar works each costing not less than the amount equal to 30% of advertised value of the tender, or
Two similar works each costing not less than the amount equal to 40% of advertised value of the tender, or
One similar work costing not less than the amount equal to 60% of advertised value of the tender.
Note for Item 2.1: Work experience certificate from private individual shall not be considered. However, in addition to work experience certificates issued by any Govt. Organization, work experience certificate issued by Public listed company having average annual turnover of Rs. 500 crore and above in last 3 financial years excluding the current financial year, listed on National Stock Exchange or Bombay Stock Exchange, incorporated/registered at least 5 years prior to the date of closing of tender, shall also be considered provided the work experience certificate has been issued by a person authorized by the Public listed company to issue such certificates. In case tenderer submits work experience certificate issued by public listed company, the tenderer shall also submit along with work experience certificate, the relevant copy of work order, bill of quantities, bill wise details of payment received duly certified by Chartered Accountant, TDS certificates for all payments received and copy of final/last bill paid by company in support of above work experience certificate.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.
The following conditions are included over and above the General Conditions of Contract- April 2022, issued and amended from time to time. In case of any variation of these special conditions with GCC- April 2022 of Railways, these special conditions shall prevail. Also, the following special conditions are only indicative & not exhaustive. Tenderers are advised to keep themselves updated with the various instructions issued by the Railway Board that are usually uploaded in the Engineering Directorate section of the Indian Railway's website www.indianrailways.gov.in. The tender shall quote the rate by taking into account all the statutory duties/GST/taxes/cess/royalty etc applicable to the work up to date of opening of tender. Any new impost or revision in the duties/GST/taxes/cess during the original currency of the contract shall be to the Railway's account subject to production of Govt. Notification and documentary evidence. This shall also be applicable for the work done during the extended period, if such extension is on Railways account. However, if the extension of contract period is on account of failure of Contractor, no compensation shall be made towards upward revision or imposition of any new taxes. Any benefit on account of downward revision of duty/GST/taxes/cess either in original contract period or during the extended contract shall be passed on by the Contractor to the Railways.
Commencement of Work: The Contractor shall commence the works within 15 days after the receipt of Letter of Acceptance.
Completion Period :The completion period for the contract would be 24 months.
Consignee: SSE/D/Raipur, Diesel Loco Shed-Raipur
Use of Material: The contractor will use all the materials purchased from OEM/RDSO/CLW/Railway approved sources as per Railway approved drawings and specifications only. Contractor has to produce the documentary evidence for purchase and use of materials to Railway inspecting authority during stage inspection and final inspections as a proof of purchase of various materials from Railway approved sources of the materials along with the Bill.
COLLECTION AND DELIVERY: The contractor shall lift the Smoothing reactors (SL-30) for the subject work after submission of the Indemnity Bond. The quantity to be issued to the contractor may vary, subjected to availability with the Railways. However the number of SL-30 to be issued in each lot shall be on the discretion of the competent authority. The period of 90 days includes to and fro transportation, execution of work, all stage and final inspection at firm's premises, receipt of repaired / rehabilitated SL-30 and their acceptance at DLS/Raipur as per the scope of work & technical specifications. Each lot of the SL-30 will be delivered duly repaired, rehabilitated and modified by the contractor within 90 days time period from the date of collection from DLS/Raipur.
.Payment conditions:- Payment shall be made after the inspection and testing by an authorized representative of Sr.DME/D/Raipur duly certified by the concerned authorized Engineer-in Charge after completion of work of each lot of smoothing reactors (SL-30) and acceptance of each smoothing reactors (SL-30).All the claims for payment shall be produced in Railway's Standard bill proforma after filling the e-measurement book and shall be accompanied with Railway's Inspection Certificate and Guarantee certificate, all test reports, Material receipt challan i.e. material receipt in good condition, Certificate from the contractor and the Railway's Engineer that all the Material used is from approved sources as per latest technical specification and/or any other certificate as applicable for this work. The payment shall be made as per the schedule of work. Procedure for claiming payment shall be as per the provisions contained in General conditions of Contract. The contractor shall submit Tax Invoice/Bill duly segregating the basic cost & GST with SAC/ HSN code for the subject work duly certified as per extant rule along with documentary proof for payment GST. The bills shall be submitted to at the office of Sr.DME/D/Raipur who is the bill-passing officer and the bill-paying officer is Sr. DFM/Raipur. National Electronic fund transfer system (NEFT) for making payments to contractors has become mandatory and hence please submit the bank account details. The attested copy of the NEFT format details by the concerned Bank Manager shall be enclosed with the bill. Contractor shall submit a certificate that "I have uploaded the correct details of contract labours engaged in connection with this contract and payments made to them during the wage period in Railway's Shramikkalyan portal at 'www.shramikkalyan.indianrailways.gov.in' till Month Year."
PENALTY: FOR DELAY IN DELIVERY AND COLLECTION: The quantity spared (in lots)to the firm shall be collected and returned duly after repair and rehabilitation as per 'Collection and Delivery' clause , failing which liquidated damages shall be levied @ ½% per week subject to Max. 10% calculated on total value of the lot spared. Any default while not lifting and/or not returning full or any part of quantity shall entail levy of LD on full quantity of lot spared by DLS/Raipur. Such L.D shall be recovered from the outstanding bills of the contractor as per General conditions of Contract of Railway. The contractor cannot claim for return trips and refuse to carry out the work upon agreement in any circumstances, on the contrary if the contractor so refuses to carry out the work upon agreement, then the contractor shall be deemed to have been liable to determination of contract as per GCC. Token Penalty: Token Penalties shall be imposed in case of any other non performance, misbehavior by the contractor or any other representatives of the contractor, damage caused to the railway properties; as decided by the Sr.DME/D/Raipur from time to time, however the amount of token penalty imposed shall not be more than 5% of the cost of overhauling in a given lot. Note: The penalty amount and its imposition/ exemption due to late delivery on account of delay on Railway account or due to firm's account on valid reasons shall be as per the decision of Sr. Divisional Mechanical Engineer / D /Raipur. His decision shall be final & binding.
8.TAX DEDUCTION: a.Income Tax: In terms of Income tax 1961, as amended from time to time, the Railway Administration shall at the time arranging payment to the contractor for carrying out the work under this contract, be entitled to deduct income tax at the rate of 2% of gross value of bill along with surcharge if applicable. b.GST: TDS@ 2%(1%CGST+1%SGST)on taxable amount shall be deducted. c.Any other tax as levied by state and central government from time to time. d.The above taxes are indicative and may vary as per the applicable tax laws from time to time.
Warranty: Each repaired, rehabilitated of smoothing reactor SL- 30 shall be under warranty for a period of 30 months from the date of delivery or 24 months from the date of commissioning, which ever is earlier towards the defect free service. Failed Smoothing reactor (SL30) shall be attended/repaired by the firm for the defects noticed during the warranty period which may be due to bad material used or bad workmanship or any other reason on the part of contractor within 10 days time at Diesel Loco Shed ,Raipur , SEC Railway upon intimation by the consignee. The transportation involved for repair of the failed SL-30 (if any) shall be arranged and borne by the contractor. The warranty period of the failed smoothing reactor(SL30) shall be extended after attention for such number of days for which the failed equipment has taken for rectification after intimation by the consignee. In case of conflict between the contractor and authorized representative of DLS/Raipur, the decision of Sr.DME/D/Raipur , SEC Railway at shall be final and binding.
OTHER CONDITIONS: The contractor shall be responsible for any damage to Railway materials, or accident/ safety of his labour etc., during the course of work. The contractor shall submit a report immediately to the supervisor/ in charge of DLS/Raipur in case any un-usual occurrence or loss/damage occurred during the course of work, by his men. Contractor shall co-operate with the consignee/ authorized railway representative in maintaining register, charts and records etc. connected with the work and materials. The contractor and Railway representative shall maintain a register to record the details of materials supplied, materials used, progress of work during the execution of the contract. The consignee shall be at liberty to inspect the work at any stage. Railways has full right to reject the tender without assigning any reasons without any compensation on unsatisfactory performance of the firm. Any losses/damages occurred to the property of the Railway administration during the course of execution of work would be the responsibility of firm/contractor. The same shall be borne by the contractor/firm. The tenderer shall study and get clarified about all doubts, discrepancies if any, on the scope of work etc, before submitting their offer from the office of the Sr. DME/D/Raipur, Diesel Loco Shed, Raipur. No excuses for delay of work on this account shall be entertained at latter stage.
INSPECTION: i.The work and material shall be inspected by the Sr.DME/D/Raipur, SEC Railway or his authorized representative for quality of material used / workmanship at various stages as per the details mentioned in the Scope of Work and Technical specification No. RSW/DHD/SL30/21.. ii.The successful tenderer shall make available all the material and tools for inspection by the Sr.DME/D/Raipur, SEC Railway or his representative at all stages as and when required. In case of dispute regarding the quality of material, quality of work and methodology, the decision of the Sr.DME/D/Raipur, SEC Railway , shall be final and binding on the contractor.
INSPECTION STAGES:
i)INITIAL INSPECTION: Before lifting of smoothing reactor a joint inspection will be carried out in the presence of firm representative and the consignee to ascertain the suitability of the Smoothing reactor (SL-30) for the subject work. Before handing over of each lot of smoothing reactors for repair, rehabilitation & conversion from DLS/Raipur, consignee shall ensure that copper coils of the smoothing reactors have been damaged to the extent that they cannot be reused. The joint inspection report shall be prepared for each lot of the Smoothing reactor lifted from DLS/Raipur, duly signed by Railway's and Contractor's representative.
ii)STAGE INSPECTION: Joint stage inspection shall be carried out by Railway and firm's representative at firm's premises. It shall be ensured that after receipt of smoothing reactors SL-30 for rehabilitation at firm's premises, they are dismantled and after removal of already damaged coils from the core, before offering for stage inspection. The core lamination shall be examined jointly by Railway and contractor's representative. If the core lamination is healthy, no replacement is required. If the core laminations are found to be defective / damaged, the contractor shall replace the core lamination free of cost with all other items as specified at Para 3.0 of scope of work(Refer tender document attached below). Contractor shall produce all relevant proof for the raw materials being used for repairs, reconditioning & rehabilitation during the stage inspection. These should be as per the specification mentioned on the Railway drawings. In addition to above, joint inspection at firm's premises can be carried out by authorized Railway representative at any stage of work to check the quality of workmanship, use of approved make materials & physical dimensions during the progress of the work. The Inspector shall have full and free access at any time during the execution of the contract to the contractor's works. The contractor shall accept all reasonable suggestions that may be made by Railway's representative during the progress of the work. During this inspection the Railways inspecting official will examine the compliance of quality assurance plan of the firm and any other thing, which he may consider, should be checked and inspected for successful execution of the work at firm's premises.
iii)FINAL INSPECTION: On completion of the repair, rehabilitation work, the firm will give the call for final inspection at their premises. During the final inspection, the repaired/ rehabilitated SL-30 shall be examined thoroughly to ascertain compliance of the scope of work and relevant specifications with the routine test as specified in the scope of work will be carried out on each repaired / rehabilitated smoothing reactors to be in accordance with technical specifications and drawings mentioned therein type test will be carried out on the repaired/rehabilitated smoothing reactors. The inspection report will be jointly signed and the inspecting official shall not to allow the firm to dispatch the rehabilitated & converted smoothing reactors to DLS/Raipur unless fully satisfied that the work is in accordance with the scope of work. All the released and replaced parts shall be shown to the Railway representatives during joint inspection at firm's premises.
RELEASED MATERIAL: The smoothing reactor type SL-30, shall be given to the contractor for repair /rehabilitation / modification along with core frame. The coils shall be damaged to the extent that they cannot be reused. Scrap material released at firm's premises will be retained by firm. All the released and replaced parts shall be shown to the Railway representatives during joint inspection at firm's premises. The firm shall consider the credit for the released materials to be retained by them while quoting their offer.
PACKAGING AND TRANSPORTATION: i.All to and fro arrangements for transportation of the smoothing reactors(SL- 30) for the subject work shall be arranged by the contractor including the loading, unloading, transit insurance, packing handling and forwarding charges shall be borne by the contractor. ii.All incidental arrangements for safe transport of material will be responsibility of the contractor.
.LOADING AND UNLOADING: The crane facility for loading while dispatch of the lot to the firm and while unloading the Repair, Rehabilitation Reactor SL-30 i.e. in the shed premises shall be provided by the shed. Other expenditure on loading and unloading shall be borne by the contractor.
INDEMNITY BOND: The Railway's materials handed over to the contractor shall be at contractor's works until they are returned to railway, duly carrying out repairs. It is a practice that whenever any machinery/material belonging to railways are handed over to any outside agency for any work, the estimated cost of machine/material is either deposited in cash with the railways in the form of FDR in favour of Senior Divisional Finance Manager, Raipur, SEC Railway or any Indemnity Bond on the railway's prescribed form by contractor for an equivalent amount in favour of Senior Divisional Mechanical Engineer( Diesel)/Raipur , Diesel Loco Shed, SEC Railway is to be submitted to railways duly indemnifying safe custody of the machine/material at contractor's works. To ensure safe custody of the Smoothing reactors for the subject work at their premises, the contractor is required to deposit an additional security @ Rs. 6,00,000/- (Rupees Six Lakh) per smoothing reactor. The firm has to indemnify for a total amount of Rs.30,00,000/- (RUPEES THIRTY LAKH ONLY) an amount equivalent to the value of 05 Nos. smoothing reactor that may be retained by the firm for Repair, Rehabilitation of Smoothing Reactor SL-30 at a time. The Contractor's Indemnity Bond/FDR for indemnifying railway material shall be released on receipt of entire contracted quantity for repaired equipments by railways.
PACKING CHARGES: Safe transportation of material of this contract shall be the responsibility of firm in all circumstances. The quoted rate shall be inclusive of packing charges and no reimbursement shall be made in this regard by Railway.
.INSURANCE CHARGES: The quoted rate shall be inclusive of insurance charges and shall be borne by Firm for safe transportation of Rly materials. No reimbursement shall be made for insurance charges by Railway.
GCC April 2022: GCC April-2022 conditions and updated amendments, correction slips are applicable to this contract.
