Order will be placed on the manufacturer or its authorized agent having proven performance. The manufacturer firm must have satisfactorily executed order of Zonal Railways/ PUS/CORE, other Govt. ,Semi Govt. organization for the same/similar item against purchase order placed during three preceding completed financial year and current year up to date of tender opening. Similar item means "Supply, installation and commissioning of 200 ton "C" frame hydraulic press". Supply Particulars i.e. R- Notes/CRN/CRAC etc. should be accompanied with satisfactory commissioning report for any consideration.

Manufacturers or their authorized Distributor/ Dealer/Agent with Tenders specific authorization can only quote. OEMs can authorize and give Tender Specific Authorization to its Agent / dealers to quote on their behalf provided the manufacturer takes full responsibility for the quality of the material including warranty obligation and the inspection of product against Railways order is carried out at the manufacturers premises. The offer without Tender Specific Authorisation Letter will be summarily rejected if tenderer is not manufacturer/OEM

In case tenderer participates as an authorized agent, then the performance as required above shall be that of Principal authorizing the agent. It may so happen that the agent has credentials of past supply for a different Principal but this will not be considered as performance for placing order in case of change of Principal.

EARNEST MONEY : Tenderers are required to deposit Earnest Money equivalent to the amount mentioned in the tender document. There shall be no exemption from submission of Earnest Money for any tender or by any tenderer except as per Para 3.3 of Instructions to Tenderers for Electronic Tenders (Version: NFR-Jan 2025). All vendors, exempted from submitting EMD, irrespective of the type of tender, i.e, Single, Limited or Open, shall be required to sign a Bid Securing Declaration as per proforma available on bidders interface for payment of EMD on IREPSportal. Offers of tenderers, who do not submit Earnest Money and are also not exempted formsubmission of Earnest Money shall be summarily rejected.

Response Time : The Bidder must provide a declaration towards response time of 48 hours within Warranty period in case of breakdown to prevent delay in warranty breakdown response. The firm shall ensure that in case a failure is reported by a consignee qualified service engineer of the contractor shall visit the site within the prescribed response time from the date and time of complaint for the machine. This response time shall be 48 hours (for normal/extended warranty period). Complaints shall be lodged by consignee by fax, phone, e-mail, whatsapp or per bearer at address given by the tenderer
