1 Submission of Tenders and Access to CPP Portal. The Chief General Manager, Ammunition Fcatory Khadki (A Unit of Munitions India Limited, Pune) invites sealed quotations in electronic form under the two bid system (technical/eligibility bid and price bid) for the Civil Work/Electrical work (the detail is available on website https://etenders.gov.in Interested contractors fulfilling the eligibility criteria to submit e-offer online in the website. Only electronic submission of offer in this website will be valid. The copies of the Documents including EMD sought shall be attached as scanned copies in e-procurement system. All corrigendums will be available in this web site only. New vendors are requested to obtain class III Digital Signature Certificate (DSC) with the company name from any certifying authority licensed by controller of certifying authority. The vendors are also required to get themselves enrolled on CPP Portal e-procurement website by using the DSC, as per instruction available on the website. Vendors should also have valid email address on this website. The DSC for both component (Signing and Encryption) is required to access the CPP Portal e-procurement website.) SELECT
2 Modification and Withdrawal of Bids No bid shall be modified after the deadline for submission of bids. No bid shall be withdrawn in the interval between the deadline for submission of bids and within the period of bid validity specified. Withdrawal or modification of bid during this period will result in forfeiture of Earnest Money Deposit and necessary action as deemed fit may be initiated. SELECT
3 Respond No. Vendors are advised to note/record their Respond No. and also quoted rates in Price Bid for reference. SELECT
4 Validity of Tender The period of validity of tender shall be minimum 120 days from the date of Bid closing and the prices quoted shall be deemed to remain valid for this period. Tender documents are strictly non-transferable i.e. offer can be submitted only by the tenderers to whom tender documents have been issued. Offers submitted by others will be ignored. SELECT
5 Submission of EMD EMD shall be deposited in the form of Demand Draft, Banker's Cheque, Fixed Deposit Receipt, Bank Guarantee and Insurance Surety Bonds from any of the Commercial bank in the name of "Munitions India Limited- Ammunition Factory Kirkee" with minimum validity of six months. EMD amount payable is mentioned in NIT.The SEALED envelope containing EMD in Original, clearly super scripting the Name of Work, TE No and Name of the Contractor should be submitted physically within 05 days of the bid closing date BUT THE SCANNED COPIES MUST BE ATTACHED WITH THE ONLINE TENDER. failing which bid will be summarily rejected. The vendors must write the tender No. on the reverse of DD/STDR/TDR/FDR/ISB for EMD. SELECT
6 Late/Delayed Tender Sealed envelope containing Earnest Money Deposit (EMD), if not received physically within 05 days of the bid closing date & time tender will be assumed as Late/ Delayed Offer and will not be considered. SELECT

8 Opening of Price bid The Price Bid will be opened of those tenderers who meet the evaluation criteria as mentioned in NIT. SELECT
9 Site Inspection The tenderer shall inspect the site if considered necessary and shall satisfy him-self of site conditions and shall collect himself any other information which he may require before submitting the tender. Claims and objections due to ignorance of site conditions will not be considered after submission of the tender. SELECT
10 Checking of specification & Drawing The tenderer shall carefully check the specifications and drawings and shall satisfy himself of the suitability of the work being offered before quoting and shall take full responsibility for the successful completion of the work within PDC. SELECT
11 Technical Specification The offer should confirm to technical specification as per MIL Civil SOP 2023 & Scope of work SELECT
12 PDC Time is the essence of this contract. Hence contractor quoting will have to strictly adhere to the date of completion. The work is to be completed (as per time mentioned in Work order) (in accordance with the phasing, if any, indicated in the tender) from the date of placement/issue of Work Order. SELECT
13 Security Deposit The Contractor shall have to pay Security Deposit as 5 % of the contract amount in the form of Demand Draft, Banker's Cheque, Fixed Deposit Receipt, Bank Guarantee and Insurance Surety Bonds from any of the commercial bank in the name of "Munitions India Limited- Ammunition Factory Kirkee" SD may be deposited online through e-Payment gateway, e-BG, and submit the proof of e-payment/receipt/Transaction ID etc. and the same will be retained with Factory authorities against SD for the period of one (01) year from the date of completion of the said work. Firm has to submit Security Deposit as mentioned in the contract within 30 days from the date of placement of order. . The Security Deposit will be forfeited in the event of breach of contract by the contractor. SELECT
14 Queries/Clarifications Queries/Clarifications of all nature, if any that may arise should be referred by the tenderer through Letter/Email ([email protected]) direct to the signatory at the AMMUNITION FACTORY KHADKI. SELECT
15 Accept/Reject of Application/Tender CHIEF GENERAL MANAGER, AFK, RESERVES THE RIGHT TO ACCEPT/REJECT ANY OR ALL BIDS WITHOUT ASSIGNING ANY REASON AND ALSO RESERVES THE RIGHT TO CANCEL/DROP THE TENDER WITHOUT ASSIGNING ANY REASON. SELECT
16 Verification of original documents Firm has to provide all the original documents for verification whenever asked during scrutiny of documents. SELECT
17 Note to adhere Clause/Sub Clause All tenderers are requested to take special note of the above instruction and observe the same strictly. Non-adherence to any of the clauses/sub-clauses above is liable to disqualify the tenderer. SELECT
18 Debar/Blacklist Firm has to confirm that that their firm is not debarred/Blacklisted from any Govt Department, PSU etc. as a contractor. SELECT
19 Awareness of Contract Condition Firm has to confirm that they have read and understand all the clauses, sub-clauses etc. as mentioned in the Tender Attachment, Instruction to tenderers, Standard conditions of Contract, Special Conditions of Contract etc. SELECT
20 Restricted area Agreed for execution of work inside the factory (Restricted Area.) by adhering all Factories, Security & Safety Rules & regulations which are in force. SELECT
21 Material as per IS Standard Agreed for bringing material for incorporation in the work as specified / as directed / as per IS specified and approved. SELECT
22 Certificate from Labour Commissioner Contractor has to obtain a Certificate from Labour Commissioner (C), Pune if he employee more than 20 workmen under Building & Construction Works (RE-CS) Act-1996 & Central Rules 1998. SELECT
23 Material storage The contractor should make his own arrangements for stores required for execution of work. The CGM / Accepting Officer gives no guarantee for the supply/ release of such stores to the contractor. Under no circumstances the contractor should hold the work / progress of the work for want of stores as the contractor shall be wholly responsible for the execution of work / contract. SELECT
24 Debarring/Blacklisting the Firm Firm has to confirm that all the information submitted in Evaluation Criteria & Vendor Attachment/EMD are true. For any False statement or Documents if came to notice at any stage, CGM/GM/AFK may take suitable action against any firm including cancellation of contract and debarring/Blacklisting the Firm and Forfeiture of EMD.. 25 Typographical Error Nobody shall claim for the spelling mistakes in the specification, scope of work, Schedule of items, drawings, terms and conditins and other documents of the tender. For any abmiguity one shall seek clarification from Ammunition Factory Khadki. SELECT
26 Code of Integrity for public Procurement Procuring authorities as well as bidders, contractors and consultants should observe the highest standard of ethics and shold not indulge in the following prohibited practices, either directly or indirectly, at any stage during the procurement process or during execution of resultant contracts: i). 27 Punitive Provisions If the procureing entity comes to a conclusion that a (prospective) bidder/contractor directly orthrough an agent has violated this code of integrity in competing for the contract, the procuring entity may take appropriate measures including one or more of the following i) Forfeiture or encashment of bid security ii) Rejection and exclusion of the bidder from the procurement process. 2 Effective Date of the Contract after Site Handover The contract shall come into effect on the date of signatures of both the parties on the contract after the site handover (Effective Date) and shall remain valid until the completion of the obligations of the parties under the contract. SELECT
3 RAR Bill RAR Bill payment will be made in stages as per the progress/value of work done based on the certificate/report rendered by the Site-Incharge Charge, Engineer In Charge & Technical Examiner. The RAR bill shall be claimed by the contractor stating the progress of different activities. SELECT
4 Retention of Money Reserve money will be retained from the work done value as per IAFW 2249 and the same will be released at the time of final bill. SELECT
5 Final Payment Final payment will be made only after satisfactory completion of the work as per Contract Conditions & Specification and based on the certificate rendered by the SIC, EIC and TE. SELECT
6 Income Tax Income Tax shall be borne by the contractor. The contractor will be responsible to furnish Income Tax declaration and file returns with respective Income Tax Authorities as required under Indian Income Tax Act. SELECT
7 GST Goods & Service Tax (GST) and other Government taxes as applicable from time to time and which are all in force shall also be borne by the contractor and the quotation/offer shall be inclusive of all. It will be the duty of contractor to completely update him-self about prevailing taxes and rates and this office will not issue any certificate regarding taxes etc. The contractor should have valid Goods & Service Tax Identification No. (GSTIN) or Any other valid statutory registration as required by law. 8 Welfare Cess Welfare cess will be deducted from contractor's bill at the rate of 1% as per provision of Maharashtra Building & other Construction Workers Act-2007 SELECT
9 Payment of Royalty Firm has to submit Royalty for minor minerals in relevent state govt. office at the prevailing norms. SELECT
10 Workmen’s Compensation Act The contractor himself will be responsible against all claims for death or injury caused to any person, whether workman or not while engaged in any process connected with the contractor’s work or for dues of any kind whatsoever, and the AFK shall not be bound to defend any claim brought under Workmen’s Compensation Act, 1923 or payment of Wages Act 1936, or any other statutory Act or Law or revisions in force from time to time and applicable against said work. 11 Other Conditions The contractor will have to take extra precaution that the production activities are not affected/hampered at any way. The contractor is required to work in close co-operation with departmental Staff & Officers engaged to supervise the work. That the contractor should not make damage to any of the factory property and if so done, the factory authorities will initiate for suitable deduction from bills due to him. SELECT
12 Minimum Wages Act and Bonus Act (a) The workers shall be paid as per the Minimum Wages Act 1948 and to be followed as per the notification issued from Ministry of Labour from time to time. (b) The contractor has to follow all the provision of payment of Bonus Act 1965. SELECT
13 Rectification of Defect Work The firm shall undertake to rectify any defect including replacement of defective parts resulting from faulty design, poor workmanship, bad materials etc. during the erection as well as within guarantee period on free of charge. SELECT
14 Water & Electricity charges Water & electricity will be supplied by AFK at the prescribed / prevailing charges and the same will be deducted from the contractor's Bill. Water will be charged @ 5.00 per Rs. 1000/- worth of value of work done of the contract. Electricity charges given by 'Electrical' Section may be deposited in the account: Ammunition Factory Khadki, Munitions India Limited and submit the acknowledgement. SELECT
15 Compensation for delay if the contractor fails to complete the work in all respect on or before the date fixed for completion, he shall without prejudice to any other right or remedy of Govt. on account of such breach be liable to pay compensation as per MIL Civil Works SOP 2023 SELECT
16 Submission of Bar Chart/PERT Chart The contractor shall submit a Bar chart / PERT chart showing the completion of the work vis-a-vis the simultaneous progress of independent works/different activities at the same time so as to complete the work within the stipulated time. The chart shall indicate the planning of the work with progress and completion in time. SELECT
17 Arbitration & Dispute (i) Any dispute or difference whatsoever arising between the parties out of relating to the construction, earning, scope, operation or effect of this contract or the validity or the breach thereof shall be settled by bilateral discussions. (ii) Any dispute or difference whatsoever arising between the parties out of or relating to the construction, meaning, scope, operation or effect of this contract or the validity or the breach thereof, which cannot be settled amicably within sixty (60) days or such longer period as may be mutually agreed upon, from the date on which either party informs the other in writing by a notice that such dispute, disagreement or question exists, shall be settled by arbitration. (iii) The Arbitration Proceedings shall be conducted in India under the Indian Arbitration and Conciliation Act, 1996 (amended time to time) and the award of such Arbitration shall be enforceable in Indian Court only. The law applicable to an arbitration shall be Indian law. In case of Foreign Seller, Indian law of foreign law to be decided by contracting parties is applicable. (iv) For Indigenous Seller: The arbitration tribunal shall be consisting of sole arbitrator. The sole arbitrator shall be nominated by the parties within ninety (90) days of the receipt of the notice mentioned above through mutual discussions and referred to CMD, Munitions India Ltd for appointment of the Sole Arbitrator with the mutual consent of the parties. The Arbitrator so appointed (with mutual consent) who had not dealt with matters to which this agreement relates and in course of his duties had not expressed views on all or any of the matter in disputes or differences. Failing which the arbitrator shall be nominated under the provision of Indian Arbitration and Conciliation Act, 1996 (amended time to time) at the request of either party or by dispute resolution institutions like Indian Council of Arbitration or ICADR, but said nomination would after consultation with both the parties. The Award of arbitration shall be final and binding on the parties to this contract. (v)For MSEs only: The Micro, Small and Medium Enterprises Development (MSMED) Act, 2006 provides parties to a dispute (where one of the parties is a Micro or Small Enterprise) to be referred to Micro and Small Enterprises Facilitation Council if the dispute is regarding any amount due under Section 17 of the MSMED Act, 2006. If a Micro or Small Enterprise, being a party to dispute, refers to the provisions in MSMED Act 2006, these provisions shall prevail over the Indian Arbitration and Conciliation Act, 1996. SELECT

The Arbitration and Conciliation Act, 1996 (amended time to time) shall not be applicable to the disputes, provided, however, any party aggrieved by such award may make a further reference for setting aside or revision of the award to be Law Secretary, Department of Legal Affairs, Ministry of Law & Justice, Government of India. Upon such reference the dispute shall be decided by the Law Secretary or the Special Secretary/ Additional Secretary, when so authorized by the Law Secretary, whose decision shall bind the Parties finally and conclusively. Or Fails to comply with any of the terms and conditions of the Contract, even after reasonable notice in writing with orders properly issued there under, Or Fails to complete the Works, Work order and items of Works, with individual dates for completion and clear the Site on or before the date of completion. The CFA may, without prejudice to any other right or remedy which shall have accrued or shall accrue thereafter to Ordnance Factories/ units under MIL, cancel the Contract as a whole or only such Work Order(s) or items of Work in default from the Contract. Whenever the CFA exercises his authority to cancel the Contract as a whole or in part under this Condition he may complete the Work by any means at Contractors risk and cost, provided that in the event of cost of completion or after alternative arrangements have been finalized by the Ordnance Factories/ units of MIL to get the Works completed, estimated cost of completion (as certified by SIC and EIC) being less than the Contract cost, the advantage shall accrue to the Ordnance Factories/ units under MIL. Cancellation of Contract in part or in full for contractor’s default .......Continued from Clause No.19.......If the cost of completion or after alternative arrangements have been finalized by the Ordnance Factories/ units under MIL to get the Works completed, estimated cost of completion (as certified by SIC and EIC) exceeds the moneys due to Contractor under this Contract, the Contractor shall either pay the excess amount ordered by CFA or the same shall be recovered from the Contractor by other means. The Ordnance Factories/ units under MIL shall also be at liberty to hold and retain in their hands materials, tackle, machinery and stores of all kinds on Site, as they may think proper and may at any time sell any of the said materials, tackle, machinery and stores and apply the proceeds of sale in or towards the satisfaction of any loss which may arise from the cancellation of the Contract as aforesaid.

Cancellation of Contract in part or in full for contractor’s default Continued from clause no 19.........The Ordnance Factories/ units under MIL shall also be at liberty to use the materials, tackle, machinery and other stores on Site of the Contractor as they think proper in completing the work and the Contractor will be allowed the necessary credit. The value of the materials and stores and the amount of credit to be allowed for tackle and machinery belonging to the Contractor and used by the Ordnance Factories/ units under MIL in completing the work shall be assessed by the SIC and EIC and the amount so assessed shall be final and binding. In case the Ordnance Factories/ units under MIL completes or decides to complete the Works or any part thereof under the provision of this Condition, the cost of such completion to be taken into account in determining the excess cost to be charged to the Contractor under this Condition shall consist of the cost or estimated cost (as certified by SIC and EIC) of materials purchased or required to be purchased and/or the labour provided or required to be provided by the Ordnance Factories/ units under MIL as also the cost of the Contractors materials used with an addition of such percentage to cover superintendence and establishment charges as may be decided by the CFA, whose decision shall be final and binding.
20 Execution/Supervision of Work Execution of the subject work shall be carried out strictly as per the specifications mentioned in MES SSR-2009 Part-I and the materials shall be used as per IS specifications. The work shall be executed as instructed / directed by Site In-charge / Engg. In-charge of the work from time to time. The contractor shall follow and execute all works as per the instructions of SIC/EIC with the approval at every stage and then progress the work. 23 Security Instruction Agreed for execution of work inside the factory (Restricted Area) by adhering all Factories and Security Rules & regulations which are in force. Contractor shall engage Indian Nationals after verifying their antecedent and Liability. Contractor should furnish the detail particulars of labourers / workman while engaging inside Factory and Estate area. 25 Character/Antecedents The Contractor would, at his own responsibility expenses get the character/antecedents of his Employees verified through the local policy authority and would employ only such persons in the work. SELECT
26 Temporary entry till PVR Clearance The contractor or his representative or every workman so engaged by the contractor for any civil/electrical work should possess PVR clearance. Alternative temporary arrangement like temporary character certificate and Notary affidavit for maximum period of 21 days only pending PVR is allowed. No extension beyond 21 days relaxation shall be allowed. SELECT
27 Wearing of Identification Jackets by Contractor’s Labourers The contractor’s labourers having PVR clearance should have invariably in their possession, the identity by wearing distinguished jackets(As per security rules) all the time during the working hours or during their stay period inside factory or Estate area for easy identification. 28 Violation of Security Instruction Punitive action will be taken as deemed fit by the Factory authority, if a contractor is found to be violating the security instructions. It will be at the discretion of the Fy. Authority that a contractor may be banned for further works, in the event of violation of security instructions. SELECT
29 Wearing of Identification Jackets by Contractor’s Labourers The contractor’s labourers & their supervisors entering the Factory shall be required to wear the “MAROON COLOURED JACKET” and the cost of the jacket shall be borne by the contractor only. If the required condition is not followed, the Security officer will have the right to stop the entry of contractor’s labour / Supervisor inside the factory for working. SELECT
30 Identity Card passes The contractor, his agent and representative are required individually to be in possession of identity cards of pass duly verified by the Police Department, the identify card of pass will be examined by the security staff at the time of entry into or exit from the restricted area (s) and also at any time or any number of times inside the restricted area (s). The identity cards shall be issued after the search, investigation of the Coincident of workmen by the contractor and attested by the Security In Charge of the area in accordance with the standing rules and regulation of the factory authorities. 32 Returning of passes identity cards after completion of the work All identity cards and passes shall be returned by the contractor, to the factory authority after the completion of work under this contract. 33 Search The contractor/labourers have to undergo search any time at sites in restricted areas. SELECT
34 Female Search If the contractor desires to employee female labour on works to be carried out inside the AFK and female searcher is not borne on the authorized strength of the factory at the time of submission of the tender, he shall be deemed to have allowed on his tender for pay and allowance etc., for female searcher if employed by the contractor inside the area. The Chief General Manager/AFK decision in regard to the amount recoverable on this account from any contractor shall be final and binding. SELECT
35 Entry of manpower & Vehicle Within the restricted areas: - 1) The contractor or his agent (s)/ representatives working/ materials carts, truck etc. will be allowed to enter the restricted area through the Main Gate of this factory. Thorough search will be through conducted by the security staff for as many time on the Gate is used for entry and / or for exit date for security reasons to any time or any number of times to work site. The contractor shall note that certain time may be lost on account of restriction mentioned in this clause, such as searches etc. thus affecting working hours and therefore the contractor should ensure before quoting against tender. 36 Condition of Working The work under this contract is in “Restricted/under restricted area” The following are the condition for working with in restricted area. SELECT
37 Definition: Restricted area For the purpose of this contract means the area declared as such by factory authorities. Visit to site within restricted area (s). SELECT

41 Account of Restricted area after completion of the work After the completion of work, surplus stores etc. are to be removed by the contractor or his agents & make the area clean. pointed out to him by the SIC, EIC. SELECT
42 Firm precaution: - Firm/contractor should take following precautions The contractor, his agent, representatives, workmen etc., shall strictly follow the order pertaining in firm precaution prevailing within the restricted area. Motor transport vehicle if allowed by the authorities to enter into restricted area must be fitted with serviceable fire extinguishers. Gas welding will not be carried inside the factory area. Advance intimation of 3-4 days will have to be given by the contractor to factory authorities before any electric welding is required to be carried out so that necessary permission can be taken. 46 Appoint of Technical Staff The contractor shall give details of Engineers, Technical persons skilled persons with their qualifications & experience along with the details of plant & machineries, Trucks & other machineries owned by him for execution of the work. SELECT
47 PPEs for Workmen The workmen should be well equipped with protective items like hand gloves, safety goggles, safety shoes, helmet, safety belt etc. SELECT
48 Working on Height The workers engaged to work above 3 mtr. height shall be medically checked and necessary medical certificate shall be produced. physical and mental fitness and to be certified by registered medical practitioner at least once in six months. The fitness will include freedom from epilepsy, High BP, obesity and vertigo SELECT
49 Use of Scaffolding While doing work at height, Scaffolding must be rigidly tied and adequate. Platform if any used must be spacious, safe for movement of men over it. The opening should be avoided so that there is no chance of man falling through it. SELECT
51 Painting Work at Height Ladder used for painting must be tied by rope at the top of beams where it is leaned for white washing in nearby area. It should be also held by the helper on the platform. White washer and helper must have adequate experience of work at such height. SELECT
53 Safety Measure Supervisor of contractor must be efficient, technically sound and experienced enough to ensure full safety measures before start of the work. SELECT
54 Inspection of Site Contractor himself inspects the site and gives clearance prior to start the work. SELECT
55 Clearance of Work Commence Unless Engg-In-Charge/Site-In-Charge gives the clearance about adequate safety measures taken by contractor, no work should be started. SELECT
56 Prohibition of drink/drug Workmen should not be under influence of any drinking/drug SELECT

66 Shut-down of electric supply If The contractor is required to take the shutdown of electric supply, day-to day basis, before commencement of work for the purpose, he has to obtain a permit from factory (E Section) every day in prescribed Proforma and discharge the same after the end of the day work (The shut down can be given between 8.30 A.M. to 4.00 P.M. on all working days). All Safety precaution will be taken by the contractor with regard to safety of workmen working at height on the poles to avoid any electric or other accidents. SELECT

73 ISO certified Unit Ammunition Factory Khadki, Pune 411003 is an ISO certified unit. Hence, the Contractors / Suppliers are required to comply with various statutory and regulatory provisions related to quality while delivering their products and services at Ammunition Factory Khadki.
