1. The contractor will have to give the following undertaking.

A. Should this tender be accepted I/we hereby agree to abide by and fulfill all terms and

provisions of the Tender and contract of works as applicable and default there of to forfeit

and pay to the PGVCL the sum of money due.

B. The full value of earnest money deposit paid herewith should be absolute forfeited to the

PGVCL, should I/We not deposit the full amount of specific security deposit, within specified

of appropriate value.

J. Should this tender be accepted, I/We hereby agree to abide by and fulfill all the terms and

condition of "Tender contract for “work" as applicable and in default thereof to forfeit and

pay to the Company the sum of money due.

K. The full value of the "Earnest Money Deposit" paid herewith should be absolutely forfeited

to Company should I/We do not deposit the full amount of specified Security Deposit.

L. Every contactor shall except the registered contractor on the approved list of the Company

unless exempted by the Superintending Engineer/ Account Officer jointly of the concerned

within which he resides or Banker's certificate of his financial stability. If he fails to produce

M. Contract booklet of Paschim Gujarat Vij Company Limited for General terms and conditions

of this work is applicable to the contractor quoting for this tender is deemed to have gone

through this book of contract booklet and same will be treated as binding of him.

N. Hard rock rates will be given after approval of S.E. Botad.

O. The contractor should be responsible for any damage/accident to their staff/personal and

company's materials.

P. All work executes as per REC rules and design.

Q. The contractor must work anywhere in jurisdictions of Botad division as per instruction of

executive engineer as per requirement of office.

GENERAL CONDITIONS OF CONTRACT

1. Earnest Money Deposit.

lf the EMD amount is more than Rs.3 Lakhs, it should be paid either by RTGS/NEFT /Online or Demand Draft

or Banker's Cheque or Pay Order or Bank Guarantee. Otherwise it should be paid either in Cash (up to Rs.

10,000/- only) at the office address specified in the tender document or by RTGS/ NEFT /on line and as per

the modified clause, for Tender fees & EMO (up to Rs.3 Lakhs), no any physical documents with bids will be

required from bidders and on completion bid submission period, bids can be opened immediately.

2. Validity of Tenders

All tenders shall be open for acceptance by the PGVCL period of 120 days from the date of

opening the tenders and may be further extended to 30 days if required and the tenders shall

be bound to execute the work on acceptance of his tender within this period.

3. Acceptance of Tenders.

(a) The PGVCL does not bind it self to accept the lowest or any tender neither will any reason be

assigned for the rejection it is also not binding on the PGVCL to disclose any analysis reports

(b) Accepting authority reserves the right of rejection of any or all tenders without assigning any

reason thereof.

(c) Any tender which does not comply with the above requirements is liable to be rejected.

4. Security Deposit

The lowest tenderer whose tender is accepted shall have to pay 5% security deposit of the tender

cost on receipt of LOI & payable in cash/DD before issuing of order.

The security deposit will be refunded only after the completion of guarantee period of 1 year of work

completed or finalization of final bill whichever is later.

If Security Deposit is not paid within 7 days of issue of LOI, EMD paid will be forfeited and PGVCL will

not deal with party for the period of two years & tender will be cancel without any notice.

5. Documents Required.

1. Solvency Certificate: The tenderer shall have to produce the solvency certificate from the

Collector/Mamalatdar of District/Taluka within which he resides or a banker’s certificate of his

financial stability for 20% of estimated amount as or deemed fit by the undersigned.

2. Provident Fund Code: The agency should obtain P.F. code number in tenderer’s name from the

Regional Provident Fund Commissioner. Without P.F. code Number, Tender will not be

considered for acceptance. Also you should comply with the provisions of the EPF and MP Act –

3. PAN Card No.: The contractor shall have PAN No. in the name of Tenderer. The contractor has

to submit attested copy of PAN Card along with tender

4. GST Registration: The contractor has to submit the attested copy of GST Registration documents

in the name of Tenderer.

5. Experience certificate: The tendered has to submit the attested copy of experience certificate

for Construction work carried out by him satisfactorily.

6. Electrical Contractor License: The contractor has to submit the attested copy of Electrical

Contractor License documents in the name of Tendered.

7. Notarized Self Declaration: The contractor has to submit the Notarized Self Declaration. For

term & condition No.11.

6. Contract Documents

The lowest tenderer whose tender is accepted will have to execute as stamped agreement

and bond on Rs 100 stamp in standard from of the PGVCL and will have to sign the contract

booklet in viz. Tender and contract for works at his own cost in case of partnership firms,

necessary partnership documents, records will have to be produced for verification by authority

to sign the bills measurements and enter into contract as well as correspondence with the PGVCL

wherever required necessary power of attorney will have to be produced specially when the

partnership deed is silent on the point of authority to deal with the PGVCL. The contract will

have to execute the documents and sign the booklet tender and contract for works before starting

It a contractor happens to be a sole trader he will have to produce an affidavit made before

Magistrate to that effect.

7. Jurisdiction

Any disputes difference arising under out of or in connection with the contract shall be

subject to the exclusive jurisdiction of BOTAD.

The work should be completed within ……12………………..Month from the date of

receipt of commencement order otherwise penalty (a) 0.5% per day subject to maximum of 10%

of the work order value will be imposed for late completion of the work.

9. In case of accident occur to the workmen engaged by the contractor; the contractor must

deposit the amount of Employee’s compensation to the Employee’s compensation

Commissioner as per rules. if contractor not paid amount to the Employee’s

compensation Commissioner than same will be paid by PGVCL and deducted from

contractor’s bill as per rules.

10. As per the Employee’s Compensation Act 1923 section 12 of Act, Principal employer is

Ultimately responsible for depositing Employee’s compensation as per provision of the

act and PGCVL has right to recover the same amount from the amount payable to the

contractor. Therefore the compensation is to be deposited within one month from the

date of Accident else 18% interest and penalty may be levied on the principle employer.

11. “if Any Agency is accused in criminal case or is having pending Civil suite,

against him/her firm by PGVCL or against PGVCL filed by him/her firm, is not

eligible to take part in this tender:” ) All agencies taking part in this tender has

to submit notarized self declaration for above matter along with technical bid).

4.23 Conflict of Interest among Bidders/ Agents.-

A bidder shall not have conflict of interest with other bidders for particular quoted item. Such

conflict of interest can lead to anti-competitive practices to· the detriment of Procuring Entity's

interests. The bidder found to have a conflict of interest shall be Disqualified. A bidder may be

considered to have a conflict-of-interest Wi.th one or more· Parties in this bidding process for

B ) they receive or have received any direct or indirect subsidy/ financial 'stake from Any of them:

C) They have the same legal representative/agent for purposes of this bid; or

D) They have relationship with each other, directly or through common third parties, that puts

them in a position to have access to information about or influence on the bid of another bidder:

E) bidder participates in more than one hid in this bidding process, Participation by a bidder in

more than one Bid Will result in the disqualification of all bids in which the parties are involved.

However, this does not limit the inclusion of the components/ sub-assembly/ assemblies from

one bidding manufacturer in more than one bid.

one agent cannot represent two manufacturers or quote on their behalf in: a particular tender

H) in case of a holding company having more than one independently manufacturing units, or more

than one unit having common business ownership/ management, only one unit should quote.

GENERAL CONDITIONS OF CONTRACT

1. The design and the configuration is given at SCHEDULE – A, attached to the tender conditions, to this

2. The successful bidder has to take the measurements at site to decide the exact dimension of each job.

For the same, the awarded contractor will remain in contact of the concerned SDO, and take the primary

measurements at site, of each job, as per the directives of the concerned SDO and, in presence of the

staff deputed by the SDO concerned.

3. The successful contractor, after observing due formalities for the award of the works, will purchase the

material, as mentioned in the SCHEDULE – A, attached to this tender copy; and get it pass through the

inspection of the inspector, deputed by this office.

4. The approved specimens of entire supply of the members, with the paper seal duly discharged by the

supplier and the PGVCL authority; will be kept at Division Office, PGVCL, botad. In case of any

discrepancies/ litigation arising out of any issue related to the works/ supply; the specimen kept at this

office will be taken in to accounts, only.

5. The colours to the various sections will be applied according to the instructions of the E-I-C. All the M S

members will be applied with two coats of lead oxide prior to the installation at the site and providing oil

6. The supplier will produce the manufacturer’s certificate for the zinc coating to the Chain Link mesh. The

zinc coating will not be less than 60microns and the same will be checked by the E-I-C.

7. The installation of the entire cage will be such that the over all height at all places will be 5’ minimum,

above ground level.

8. The chain link mesh fixed in the M S angle 25 x 25 x 3 mm frame; will be fixed in the frame of 32 x 32 x3

mm hollow square pipe.

9. The ground clearance between the M S Square pipe frame and the ground will not be more than 6” at

10. The space between the M S Square pipe frame and M S Angle frame holding the chain link mesh will not

be more than 40mm.

11. The Hinges will be of M S Nut/Bolts of 2” x 3/4”, fixed in the M S socket befitting and welded properly,

12. The M S aldrop (HADO) will be provided with locking arrangement at the frame to be used as the door. A

swing stopper will be provided on the upper part of the same frame as shown in the drawing.

13. Minimum 4 posts of 75 x 75 x 6 mm M S Angle will be provided. The additional post/s will be provided as

per the site requirements. In no case, the length of the 25x 25 x 3 mm M S angle frame holding the chain

link mesh, will not be more than 4’. The height of Minimum 4 posts of 75 x 75 x 6 mm M S Angle will be

5 foot above ground level and 1.5 foot under ground.

14. All the posts of 75 x75 x 6mm M S Angles will provided with foundation in ratio of 1:3:6 PCC; with proper

curing at site.

15. The entire job will be prepared with proper care, welding and fine finish to give decent aesthetic look, to

the satisfaction of the E-I-C.

16. The measurements will be taken in Running Foot unit and the rates will be submitted in the same unit.

17. In case of any discrepancy, the E-I-C will provide the guide lines and the contractor will have to follow the

same. The discretion of the authority issuing the tender and above will be binding to the contractor.

18. The height of fencing 5 foot above the ground level.
