Payment of Tender Fee and Earnest Money Deposit

GENERAL CONDITION TO BE NOTED IN TENDER
1) If due to any reason, payment is delayed then tenderer is not eligible to claim/demand any
compensation for loss of interest thereof.
2) AMC reserve the right (i) to change, alter or to waive any technical or commercial terms, condition
and qualification (ii) to reject all the bids or any bid in part or full without assigning any reason
whatsoever (iii) for making changes / relaxation ineligibility criteria at any time (iv) to split the
order work and award the work to more than one tendered with lowest rate quoted in the
tender in the interest of the public. The bidder shall have no cause of action or claim against the
Ahmedabad Municipal Corporation or its Officers / Employee’s successor or assignee for
rejection of his tender/bid,
3) In case of not filling and submitting of documents as mentioned in tender at the time of tendering
the no further correspondence shall be done with bidders for further submission of either technical
or commercial documents or any discount, and at the same time tender will be rejected.
4) To remove all clay, sand, metals, steel, etc; debris accumulated at site from excavation and
construction work or any other kind of waste material from site as per instruction of E-I-C without
any extra cost.
5) To provide the site to E-I-C for inauguration work after completion of tender work in all respect
removing all raw materials, grass, debris or any kind of waste material from site as per instruction
of E-I-C without any extra cost.
6) The contractor shall complete the Preventive maintenance work latest by every 15th May and
shall submit the report along with site photographs of carried out works showing dates to the E-
In case of failure to do so AMC shall carry out proper routine & preventive repairs required
through other agency and the cost of the same shall be recovered from Contractor’s due
In case of any fault / breakdown, during comprehensive repairing & maintenance period /
defect liability period and routine, preventive or break down repairing required the contractor
shall have to attend the same within an hour (1 hour) and shall have to complete the repairing
work in max. One ( 1 ) day.
7) Contractor shall make all arrangements for obtaining power connection, the installation,
operation, maintenance and subsequent removal of temporary supply of electricity. AMC shall
issue only authorization letter to Contractor for obtaining power connection, and yet if power is
not available in time, the work shall not be postponed and the Contractor shall have to arrange
for diesel generating set (s) at his own cost.
8) Contractor must present regularly and timely whenever work progress review meeting regularly
arranged by department during period of starting of tender work at site to the end of project.

A:1 NOTICE INVITING TENDER
Sub : Tender for Providing wireman, Liftmen and HVAC Supervisor at Various
AMC buildings of Central zone.
A.1.1 The Ahmedabad Municipal Corporation (A.M.C.) invites the item rate tenders in two bid
system for Providing, wireman, Liftmen and HVAC supervisor at various premises of
Ahmedabad Municipal Corporation from the Tenderers who qualify the eligibility criteria.
A.1.2 Tender documents consisting of –
Volume – I: General– Tender Notice, General Conditions of Contract,Instruction to
Tenderer etc.(Section – ‘A’, ‘B’)
Volume –II: Financial Bid. ( B.O.Q.)
Price Bid-For Tender for Providing wireman, Liftmen and HVAC Supervisor at Various
AMC buildings of Central zone.
A.1.3 A Seperate demand draft of Rs.900/- for Tender fee drawn on Nationalized Bank in favour
of "Municipal Commissioner, Ahmedabad". must be attached with the Tender offer, without
tender fee tender will not be considered.
A.1.4 A Seperate demand draft of Rs.23,458/- for Earnest Money Deposit drawn on
Nationalized Bank in favour of "Municipal Commissioner, Ahmedabad". must be attached
with the Tender offer without E.M.D. tender will not be considered.
A.1.5 Successful tenderer shall have to deposit 5% of the Tender amount as security deposit by
demand draft or in the form of bank guarantee of nationalized bank and shall have to sign a
contract with Municipal Corporation as per rules within 15 days after receipt of order.
A.1.6 Our standard payment term is after 30 working days after satisfactory completion of work
No advance payment or Performa invoice payment or bank through payment will be
considered even if any discount is offered for the same. This standard payment term is
applicable only when the tenderer fulfills above condition No.3.
A.1.7 Two sets (One Original + One Xerox copy) of tender documents duly completed in all respects
shall be submitted, so as to reach at the above stated address on or before the date and time
mentioned in tender notice.
A.1.8 E.M.D and Tender Fee in the form of Demand Draft should be sealed in separate envelope
and the same shall be enclosed along with Tender document Volume-I (put original copy in
original document envelop and one Xerox copy in Xerox copy document envelop).
A1.9 Both Original and Xerox copy tender document envelope should be sealed in One large
envelope. On this envelope, the Name and address of Tenderer, Name of Work, date of
opening of the tender shall be written invariably.
A.1.10 Municipal Commissioner reserves the right (i) to change, alter or to waive any technical or
commercial terms, conditions and qualification (ii) to reject all the tenders or the lowest
or any other tender in part or full without assigning any reason whatsoever (iii) for
making changes / relaxation in eligibility criteria at any time (iv) to split the tender and
award to more than one tenderer in the interest of public. The tenderers shall have no
cause of action or claim against the corporation or its officers, employees, successors or
assignee for rejection of his tender.
A.1.11 The Municipal Commissioner reserves the right to terminate the contract at any
stages after award of the contract without giving any reasons.
A.1.12 Bidder shall have to submit Name of Bank, Name of branch with address, A/C. No.,
MICR No.and PAN No of his firm. for refund of E.M.D.
A.1.13 The tender submitted with any tenderer’s condition will not be accepted and will be rejected
outright,unless,the nature of condition(s) put up by the bidder is acceptable to AMC.Any
suggestions / alterations from the tender, if suggested in specifications, must be mentioned
in the main forwarding letter.
A.1.14 The renderer shall also work out the total tender amount and shall write this tender amount
in words and figures as per the quoted rates.
A.1.15 Incomplete tender which does not fulfill any of the above conditions will be liable
for rejection. Tender will also be liable to be rejected if-
i) The renderer proposes any alteration in the work specified or make corrections in
Schedule of Quantities.
ii) Any of the page or pages in the tender is / are removed or replaced.
iii) All corrections, additions or pasted slips are not initialed by the tenderer.
iv) Any erasure is made in the tender.
v) The tenderer or in the case of a firm, each partner or the person holding the power of
attorney thereof does not sign or the signature(s) is (are) not attested by the witness,
wherever it is required.
vi) Demand Drafts of Earnest money and Tender Fee for required amount are not
submitted with the tender.
vii) The tenderer returns the tender document without signing relevant pages of the bid and
amendments, if any.
A1.16 The tenderer shall clearly state in the forwarding letter (in duplicate) to be enclosed with the
tender documents, the deviations from General Terms and Conditions, if any with cross-
references. If no such letter is received, it will be presumed that the Tenderer agrees entirely
with the General Terms and Conditions.
A.1.17 It must be clearly and distinctly understood that the conditions of contract and specifications
shall be rigidly enforced and no relaxation on the grounds of customs prevailing shall be
A.1.18 The Price quoted for work must be of Site / Store delivery of Corporation without prevailing
applicable taxes rates. GST will be paid extra as actual.
After awarding Contract and during contract implementation if any type of Government
taxes increases or addition of any type of taxes which is applicable to contract , the
same rise /addition will given to Contractor upon submission of necessary documents as
mentioned below.

However during Implementation of work if any types of taxes reduces in future
then the same shall be recovered from Contractor .However it is Contractor’s
responsibility to inform the same to Client with supporting documents.
A. 1.19 The Tender for the work shall remain valid for a period of 120 days from tender price
bid opening date and the tenderer shall not be allowed to withdraw or modify the offer on
his own and during this period any modifications or additions in terms and conditions of his
tender not acceptable to the Ahmedabad Municipal Corporation(AMC). The A.M.C reserves
the rights to forfeit in full the said earnest money deposit absolutely.
A.1.20 If the tenderer wishes to offer discount in the event of this entire work being awarded to him,
he shall state so in the Tender. Tender documents are not transferable.
A.1.21 On the occurrence of any accident on site while working, which results in death of workman,
employed by the contractor or any disability likely to be occurred, in respect of which
compensation may become payable under workmen's compensation Act has to be born by the
Tenderer. AMC is not responsible for the same.
A.1.22 Tenderer must have 24 hours landline and mobile telephonic contact facility.
A.1.23 The tenderer is required to check the AMC website for Addendum if any before 48 Hrs. of
last date and time of tender submission. The tenderer who quotes the tender without
attaching the addendum will be rejected.
A.1.24 Not More than one tender shall be submitted by a contractor or by a firm of contractors. No
two or more concerns in which an individual is interested as a proprietor and / or a partner &
or director shall submit tender for the execution of the same work / tender. If they do so all
such tender shall be liable to be rejected.
A.1.25 The tenderer shall possess GST registration with Govt. of Gujarat./Any state of India.
A.1.26 The tenderer shall possess current validity PF Registration certificate.
A.1.27 The tenderer shall possess current validity ESIC Registration certificate.

Starting time of Operation Contractor has to deploy required manpower after date of
(Providing Manpower) and successfully completion and handed over SITC work.

INSTRUCTIONS TO TENDERERS
1. EXAMINATION BY TENDERERS:
1.1 Prior to submitting the tender, each tenderer must do following steps.
(a) Examine all instructions, eligibility criteria and specifications in the tendering
(b) Familiarize him with all central, state & local laws, ordinance, rules,
regulations & codes affecting the services including the cost of permits &
licenses required for the work at site.
(c) No additional claim, discrepancy etc. shall be entertained after opening of
(d) Tenderers must familiarize themselves with the local conditions and visit to all
places for site verification then submitting the tender.
2. LITIGATION HISTORY:
The bidder should provide accurate information’s on any litigation history or arbitration
resulting from contract's completed or under execution by him over the last ten years. This
should also include such cases, which are in process / progress. A consistent history of awards
against the bidder may result in failure of the bid. In case the bidder has not provided such
information and later on has come to the notice of the authority, the tender will be rejected at
what so ever stage and in such case all the losses that will arise out of this issue will be
recovered from the tenderer / contractor and he will not have any defense for the same .
3. TENDER PRICES
Document. The prices filled, shall remain firm and unchanged throughout the Contract period
4. EARNEST MONEY DEPOSIT
The Tenderer shall furnish, as part of its Tender, Earnest money Deposit for the
amount as indicated in the invitation for tender.
4.1 The EMD shall be denominated in Indian rupees and shall be in one of the following
E.M.D by D.D. of Nationalized Bank in favor of “Municipal Commissioner”
4.2 Any Tender without EMD will be rejected by the corporation as non-responsive.
4.3 Unsuccessful Tenderer’s Earnest Money will be discharged / returned as promptly as
possible after the award has been finalized.
4.4 No interest will be paid on Earnest Money deposit. Unsuccessful Tenderer’s(i.e.
L2&L3) Earnest Money will be refund after submission of security deposit of lowest
tenderer(i.e. L1). No interest will be paid on Earnest Money deposit.
5. SIGNING OF CONTRACT
5.1 On receipt of the notification of Award / order the successful tenderer has to execute
the necessary agreement with the corporation as per the prevailing rules & regulation
of corporation, along with performance / security deposit.
5.2 Contract shall be constituted according to and subject to laws of India and State of
Gujarat and under the jurisdiction of court of Gujarat at Ahmedabad only.
6. TENDER SHALL BE LIABLE TO BE REJECTED:-
6.1 Not more than one tender shall be submitted by contractor or by a firm of contractors.
No two or more concerns in which an individual is interest as a proprietor and /or a
partner&/or director shall submit tender for the execution of the same work/tender. if
they do so all such tender shall be libel to be rejected.
6.2 DISQUALIFICATION:
- Even though the applicants meet the required criteria, they are subject to be
disqualified if applicant or any of its constituent partner/s, director/s has:-misleading or
false representation in the forms, statements and attachments submitted; or -been
debarred or terminatedorblacklisted by central govt.organisation/state
Govt.organisation/AMC/Any municipal corporation/ULBs etc.
- If, any of the the directors, partners of the proprietor has a criminal history or has been
convicted by any court of law of any of the offenses under any Indian laws.
- If, any criminal proceeding is pending in any court of law in India against any of the
directors, partners or a proprietor and if any such proceeding culminates into

6.3 JOINT VENTURE:-
7. BANK SOLVENCY:-
The Tenderer should submit a solvency certificate from a Nationalized Bank/
Scheduled Bank of an amount of at least 20 % amount of estimated cost of tender.
Bank Solvency shall not be older than one year period.
8.1 The Contractor shall indemnify the Employer against all losses and claims in respect of :
- Death of or injury to any person, or
- Loss of or damage to any property (other than the works)
Which may arise out of in consequent of the Operations of the Facility and the
rectifying of any defects therein, and against all claims proceedings, damages costs, and
expenses whatsoever in respect thereof or in relation thereto.
8.2 The Employer shall not liable for or in respect any damages or compensation payable to
any workman or other person in the employment of the Contractor or any Sub-
contractor, resulting from any act or default of the contractor, his agents or servants.
8.3 The contractor must require group accident policy of all contractors' employees /
8. EXTENSION OF CONTRACT PERIOD:-
The duration of the Contract shall be for twelve (12) months; however, the
Corporation reserves the right to extend the Contract period by another six months (6)
at mutually agreed price. The corporation will give one month (1) advance notice to
the Contractor if desired to extend the contract. You have to submit 5% S.D. extended
up to six months if required.

SECTION B :- SPECIAL INSTRUCTIONS & TECHNICAL
The eligibility criteria which will be applied for evaluation of tenders are as follows:
1. Tenderer must have to pay Tender Fee of Rs.900/- through Demand Draft only in favour of “Municipal
Commissioner, Ahmedabad” payble at Ahmedabad from banks mentioned in Annexure-I only with their
tender documents.
2. Tenderer must have to pay EMD of Rs.23,458/- through Demand Draft only in favour of “Municipal
Commissioner, Ahmedabad” payble at Ahmedabad from banks mentioned in Annexure-I only with their
tender documents.
3. Qualification shall be based on meeting all the following minimum pass/fail criteria regarding the Supplier’s
general and particular experience, personnel and financial position, as demonstrated by the bidder’s
responses in the forms attached.The AMC reserves the right to waive minor deviations, if they do not
materially affect the capability of a bidder to perform the contract. Tenderer must have Experience of
satisfactory completed Similar type of works during last 7 years ending last day of month previous to the
one in which tenders are invited should be either of following.
1.1 One successfully completed work order of Rs.18.76 lacs (80% of Tender Value)

4. Tenderer must have to submit satisfactory work completion certificate for above work experience along with
work orders. (Similar type of work means Comprehensive Maintenance (Electrical) for single phase/Three
phase Electric fault Related Operation And Maintenance of Electrical items like Transformer,H.T./L.T.
Panels, Distribution board, Electrification Work etc.work in any Central Govt., State Govt. or Municipal
Corporation.) Contractor having experience as a sub-contractor for the above work will not be considered
for the evaluation of tenders.
5. Tenderer must have sound financial capability and having average turnover of Rs.7.07 Lacs (30% of Tende
Value) during last three years. Copies of certificates, audit reports for last three years shall be submitted.
6. The contractor must possess solvency certificate of value not less than Rs.4.69 Lacs (20% of Estimated
Cost Of tender) from Nationalized / Scheduled Bank only. Solvency Certificate should not prior to one
year old from last date of online tender submission.
7. The tenderer must possess current validity valid Electrical Contractor License from Gujarat State or
Any State Licensing Board in India.(Copy of license must be attached along with tender)

B 1.2 Scope of work:
1. Tenderer must has to attend immediately all the single phase/Three phase electrical related fault
rectify the same as and when complaint given. to him by telephonic order or when instruction
given by AMC Engineer including Sundays & Holidays.(i.e.All 365 Days.)
2. The accepting authority or the Add. Chief Engineer (Electrical) reserves the right to terminate the
contract at any time after giving 30 days prior notice of his intension to do so without assigning
reasons there of.
3. Minor repairs will be attended immediately And Rectify As early as possible.
Penalty Cluase:-In case of major/minor faults, whenever AMC handover fault to contractor will
rectify fault within 24 hours. If contractor will failing to do same, penalty will be deduct by AMC
from contractor bill. Penalty will be (1) Emergency single /three phase short circuit/current/power
supply failure etc. electric fault not attend complain immediately, Rs.500/- penalty per complain will
be imposed. (2) Major electric fault not attend up to 2 day after receive complain Rs.500 penalty per
complain will be imposed as per annexure -1A.
(If any above situation continues for three times .then AMC reserves the right to terminate the
contract forfeits S.D.)
4. In the event of any damage, theft, fire, accident etc. in conveying the equipment from site to
workshop and back while carrying out repairs or testing, the contractor shall be considered
responsible and for that compensation and the cost of unit will be recovered from the contractor at
the Market rate without any excuse. The decision of the Department will be binding to the

9. All precautions should be taken while executing the work to avoid damage / accidents. Any damage
due to contractor’s negligence to be attended to match the original at no extra cost.
10. Firm must visit and shall carry out site inspection before quoting their rates.
11. All the decisions taken by Add. Chief Engineer (Electrical) should be binding to both parties in
respect of any dispute arising due to tenure of this work.
12. Material require while attending fault will be supply by AMC.
13. The Payment Terms for the Annual Maintenance Contract will be on Quarterly basis i.e. Payment
will be made after completion of each quarter (3 Months) on equal sharing basis. Bill will be put-up
in Triplicate Copies with attaching documents of Bank details & Copy of current year paid
Professional Tax.
14. Tenderer shall have to keep the Register and maintain the record of Faults given by AMC Engineer
Day to Day Month wise by details of work done with Complete Satisfactory Work done Certificate
of all sites by Authorized Person’s Signature with Stamp & Name, Telephone / Mobile No. All
such records and copy of register will have to submit along with bill of every month. Without
which Payment will not be paid by AMC.
15. The scope of contractor also includes attending the fault as per instructions given by AMC Engineer
even in abnormal condition such as RIOTS, HULLADS, FLOODS, HEAVY RAINS,
EARTHQUAKE, FIRE, NATURAL CALAMITES etc.
16. The Contractor will be responsible for security and safety of the staff, each & every equipments of
all above sites. On Site during the above work.
17. AMC will not be responsible for any accidents (In case of the death of a person or an injury)
occurred in the any premises of AMC Area due to the above reason and the compensation for the
family of the person affected. It will be in the scope and responsibility of the contractor to deal with
the legal proceeding such as court matter, police case compensation etc which arises due to the
18. No Contractor shall employ any child heaving age 5 years to 14 years, as it is prohibited by the Child
Labour Prohibition and Regulation Act, 1986.The Hon. Supreme Court has given certain
guidelines and as per the guidelines, if employment of child labour is detected on the site work, the
employer i.e. the Contractor shall have to deposit Rs.20,000/- (Rupees Twenty Thousand only)
in the Child Labour welfare Fund. If the employer refuses to deposit, then action will be taken
for contempt of Court of the Supreme Court Judgement and also will be prosecuted by the
concerned authority.
19. During the contract Period, Contractor has to carryout of the Maintenance Service on the units
during normal working hours. Also maintain service job card/ register regularly & attend A.C.
complains on regular basis within time.
20. The contractor shall provide HVAC supervisor in general shift having knowledge of A.C. Plant
system & fully service on the AC plants, will lay emphasis on planned preventative maintenance
practices, safety requirements and proper care of machinery & equipments to achieve proper
inside conditions.
21 Register will have be supplied by the contractor and have to be filled in by the contractor’s staff &
also maintain attendance register for the staff. The Register will be kept in the Maintenance room
which will be checked by the Engineer Incharge at any time during his visit. The contractor will
have to take action as per direction of Engineer Incharge from time to time.
22. The contractor must follow of Govt. rules and regulations during any Epidemic Diseases.

Note:- The above staff shall be distributed in first shift as per mutual agreement between contractor and
corporation. The above staff should be deployed at the various building premises of AMC on shift
basis.Electrical faults should be attended immediately and rectify as early as possible 24x7
by qualified and experienced personnel. For the same as and when needed contractor has
to deploy suitable category of additional staff with necessary equipments and
consumables and transportation without any additional cost. Any fault occurred during
Office Hrs time, it must be attended immediately and it will be responsibility of the
contractor to see that electrical faults Attened immediately and rectify as early as
The arrangement of reliever for weekly off / all holidays / absents etc. shall be made by the
contractor separately which shall be in addition to above mentioned persons.
The contractor shall have to provide statement of daily presence of each and every total person
deployed. ALL staff has to be provided I-card and Apron/Dress.
The staff of the contractor will always remain in contact with engineer in charge and follow his
instructions. The contractor shall have to issue identity cards with photograph to all staff
employed for operation and will be required to keep the same while on duty.
All the staff deployed by the contractor must be of Indian nationality and must have knowledge
of Hindi & Gujarati. He must understand & conversant with in Gujarati language compulsorily.
He must talk politely to all Municipal officers or any political person and other public.
The contractor shall employ all the required staff (and in no case less than the number specified
in the tender) within 7 days of the award of contract, otherwise payment will not be made. In
such case, the commencement of contract period and payment thereof shall be reckoned only
from the date of employment of full numbers of staff.
The contractor has to fulfill all safety rules and regulations. The corporation will not be
responsible for any accident / injury to the staff of the contractor. Further the Corporation will
not provide any insurance or medical facility to the staff of contractor.
It is in the scope and responsibility of the contractor to follow and obey all central / state
government / semi-government / local body’s rule and regulation pertaining to this contract, all
legal formalities pertaining to provident fund, factory act, all legal formalities without any extra
charges to the corporation. Please not that failure in complying so, all liabilities arising as per
laws will be to the contractor’s account.
It will not be responsibility of AMC (Ahmedabad Muni Corporation) for staff deployed by the
contractor in any case. (e.g. Salary, employment, leave, any claim etc.)
As per electricity rule, factory act, or any other act, if inspection, permission is required to
