1. The bidder should provide satisfactory evidence, acceptable to the purchaser to show that he is a regular Indian machine tool manufacturer and has adequate plant and manufacturing capacity and has a "Quality Assurance Program". Information as per Annexure-2 Quality control (attached herewith) may please be furnished. The manufacturer should have valid ISO 9001 certificate on the date of closing of tender and a copy of same should be submitted along with the bid. 2. List of past supplies made in last 5 years along with purchaser's name and address, purchase order number & date, quantity supplied, date of supply and commissioning should be submitted along with the offer. 3. The details of similar machine asked shall be furnished in the Annexure-A of section- VI of technical specifications along with purchaser's name & address, P.O. no., copies of POs', phone & fax number, email address, date of supply and commissioning. Copies of POs submitted shall also indicate the parameters/ specification of subject machine to prove similarity aspect of the machine as mentioned in para 4 below. 4. Supply Criteria: For the purpose of similarity, similar machine required under clause 3 means:- 02 nos. of CNC Tandem Under Floor Wheel Lathe or CNC Under Floor Wheel Lathe machine manufactured and supplied in last 05 years for Railway application to Railway/Govt. Organisation/PSUs/ a Public listed company having average annual turnover of Rs.500 crore and above in last 3 financial years excluding the current financial year, listed on National Stock Exchange or Bombay Stock Exchange, registered at least 5 years back from the date of submission of Bid by the Bidder to the authority. However, the track gauge and wheel diameter of the machine supplied may vary. In case of foreign supplies; only to Government bodies shall be considered. 5. Performance Criteria: Performance certificate {(Annexure-A1 (Certificate of certificate {(Annexure-A1 (Certificate of Performance attached with tender))} of at least 02 nos. of such machine (which are counted for the purpose of meeting qualifying criteria) supplied in the last five years and working satisfactorily for at least one year of satisfactory working after date of commissioning as on original date of closing of tender shall be enclosed with clear signature and address of the end user using the machine where it is installed and commissioned. The certificate shall not be older than one year from the original date of closing of tender. 6. All necessary information/documents required for establishing reference requirement as per clause 1,2,3,4 and 5 should be submitted by the bidder along with original offer itself. No clarification/correspondence will be sought/entertained in this regard. In case no information or incomplete information is furnished by the bidder, their offer will be summarily rejected

Micro and Small Enterprises firms In order to avail themselves of benefits and preferential treatments, the MSEs must be registered with any of the following: - (a) UDYAM (UDYAM Registration Certificate). (b) Udyog Aadhar Memorandum (Note :- Terminal date for consideration of this certificate was till 30.06.2022 or as extended by Ministry of Micro, Small & Medium Enterprises from time to time. Thus this certificate (Udyog Aadhar Memorandum) can only be considered if the above terminal date is further extended beyond 30.06.2022). CA certificate: In cases of procurement for a value in excess of Rs. 10 crores, the Class-I local supplier/ Class II Local supplier shall be required to provide certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing Cost accountant or practicing chartered accountant (in respect of suppliers other than companies) giving the percentage of Local content. The certificate should have valid UDIN mentioned in certificate.

Warranty obligations: 1. The warranty obligations shall stand for 2 years from Installation, commissioning and proving out of machine by supplier (Details shall be referred at Clause 7 of Section IV and Clause 16 of Section V of Specification appended with the tender.

All the bidders/tenders should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law. In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGSTAct, The railway shall deduct the applicable GST from his/their bills under reverse charge mechanism (RCM) and deposit the same to the concerned tax authority.

Payment Terms

Payment terms for Basic machine and accomapnied supply items(spares etc.): The standard payment terms subject to recoveries, if any, by way of Liquidated Damages will be as under: (a) 80% payment will be made on receipt of the material duly pre inspected and receipted at site by the consignee in good condition. (b) i) Balance 20% payment will be made on furnishing a Bank Guarantee for an amount equal to 10% of the contract value, fully indemnifying the Purchaser against all losses incurred by the Purchaser during the Warranty period within 30 days of the receipt of Bill alongwith Proving Test Certificate after successful completion of proving test in which the machine performance would have been demonstrated by the supplier or his agent after its \ commissioning at the consignee premises. Where, however, the installation and commissioning of the machine is delayed or put off beyond 90 days of the receipt of the goods at the ultimate destination due to express written instructions of the Purchaser/Consignee, the balance 20% payment shall be released to the supplier on his furnishing the necessary Bank Guarantee of equal amount i.e. balance 20% valid for the period as asked by the purchaser.ii) The Bank Guarantee as mentioned above should be from a Nationalised Indian Bank/Schedule Commercial Bank in India.
Payment terms for Concomitant works: Payment for construction of covered shed, Linkage of track, inside shed, outside shed and power supply connections shall be claimed by the contractor, consignee-wise, as follows: i. 80% Payment of the cost of all taken together (Covered Shed, Linkage of Track and power supply connections), will be made on the issue of completion certificate by the consignee and receipt of machine at site. ii. 20% Payment of the cost will be made upon issue of PTC for the respective CNC Tandem Underfloor Wheel Lathe machine.
Payment terms for turnkey charges: As per PTC of Specification appended with this tender.

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.
