6 SCHEDULED TIME (3.13) The Firm shall complete the s/stn within 12 (Twelve) months from the date of Award.

7 LIQUIDATED DAMAGES FOR DELAY IN DELIVERY (3.47) @1% of Contract Price per week for the period of delay subject to maximum of 10 % of Contract Price and other conditions.

8 PLACE OF MANUFACTURING, INSPECTION AND TESTING (3.17) One month Notice in writing of the Date & Place at which the Equipment will be ready for Testing.

9 TERMS OF PAYMENT (5.18) As per clause No. 5.18 of volume-1

10 SECURITY DEPOSIT / PERFORMANCE GUARANTEE (2.44) 10 % of the Contract Price, in the Form of Cash / Bank Guarantee / Demand Draft within one month of the issue of Award. Penalty would be charged as per clause in case of late submission of B.G.

11 WARRANTY (2.46) 24 Calendar Months from the date of actual taking over date or Thirty six (36) months after its commissioning which ever expires earlier.

JOINT VENTURE / INDIVIDUAL

2.7.1 TECHNICAL REQUIREMENT:

For the purpose of this particular bid, bidder shall meet the following minimum criteria in past 7 years (up to last completed financial year):

a) Experience in similar work under single contract, costing not less than 70% of the estimated cost. The works under the above contract should be completed works only. Or

c) Experience in similar works under two contracts, each costing not less than 40% of the estimated cost. The works under the above two contracts should be completed works only. Or

e) Experience in similar works under three contracts, each costing not less than 30% of the estimated cost. The works under the above three contracts should be completed works only.

2.7.2 FINANCIAL REQUIREMENT:

For the Purpose of this particular Bid, the Bidder shall meet the following Minimum Financial Criteria:

a) Average Annual Turn Over for the best Three Years out of last Five Years of the Bidder should be at least 30% of estimated cost.

b) Liquid Assets and / or evidence of access to or availability of Credit Facilities of not less than 10% of estimated cost.

c) The bid capacity calculations of bidders shall be submitted with the bid as per the following formula (Minimum equal to estimated cost):

Bid capacity, C= (2xA)-B Where,

A= Maximum Turnover of one year out of last three years.

B= Value of left over existing commitments against various contracts which have already awarded to the firm. Relevant documents may also be submitted.

2.7.3 JOINT VENTURE FIRMS:

1) Collectively the JV partners should meet the criteria of projects mentioned in Sr. No. 9.1 above. However, each JV partner should have completed at least 1 contract costing not less 30% of the estimated cost. For illustration, the various cases possible, along with the number of contracts and the minimum amounts for each of scenarios are shown below:

2) In case of participation in Joint Venture, the following conditions shall also apply:

a) In case of successful Bid, the specified Form of Agreement shall be signed so as to be legally binding on both Partners.

b) One of the Partners shall be nominated as Lead Partner, and this authorization shall be evidenced by submitting a Power of attorney signed by legally authorized signatories of both the Partners.

c) The Lead Partner shall be authorized to incur liabilities and receive instructions for and on behalf of both Partners of the Joint Venture and the entire execution of the Contract, including Payment, shall be done exclusively with the Lead Partner as per Power conferred to him in the Power of Attorney.

d) Both Partners of the Joint Venture shall be liable jointly and severally for the execution of the Contract in accordance with the Contract Terms and a statement to this effect shall be included in the authorization mentioned under b) above as well as in the Bid Form and in the Contract Form (in case of a successful Bid).

e) Agreement entered in to by Joint Venture Partners shall be submitted with the Bid in original.

f) The Share of different Partners of the Joint Venture shall be clearly specified along with responsibility of each of the Partners in case of Award of Work. The share & responsibility, in respect of execution of work, of the partners shall be in conformity to their eligibility & qualification. However, the other partner(s) may associate with the eligible & qualified partner(s) for the execution of works.

2.7.4 The Bidders shall also furnish following Documents / Details with its Bid: -

i) A Certificate from Banker indicating various Funds based / Non Fund based Limits sanctioned to the Bidder and the extent of utilization as on date. Such Certificate should have been issued not earlier than SIX Months prior to the Date of Bid Opening.

ii) The complete Annual Reports together with Audited Statement of Accounts of the Company for Last Five Years of its own (separate) immediately preceding the Date of submission of Bid.

1 The general experience requirement regarding contracts of similar size and nature refer to the execution of projects involving Substations or bays of 66kV or above rating. The performance certificate of the completed 66 kV or above voltage level work shall be submitted with the bid.
