Special Eligibility Criteria

   Tenderer(s) who have designed, supplied & commissioned maintenance Simulator for transportation sector involving the work of electric circuit simulation/ Microprocessor Logic Simulation/ Fault generation and Troubleshooting including Computer-Based Training Modules for system understanding and procedures, in preceding three financial years (including the current financial year up to tender opening date), and that are in use by Indian Railways or renowned Metro Railways or Public Sector Units in India and have been successfully operational for at least one year as on the tender opening date, are eligible. 2. Submission of a performance certificate from the user Railway / Renowned Metro Railways/ Public Sector Unit in India, confirming the successful operation of the supplied and commissioned maintenance Simulator for at least one year, as specified under item no. 1. Failure to submit this document will be interpreted as a lack of past performance, and their offer may not be evaluated further. 3. The tenderer (s) must be the Original Equipment Manufacturer (OEM) & should have ISO9001 certification as a manufacturer of Railway / Metro maintenance Simulator for transportation sector. Bidder other than OEM require specific authorization from OEM.

   scheduled and unscheduled maintenance : Scheduled Maintenance The Contractor shall perform its Maintenance Obligations at the periodic intervals notified in the Scheduled Maintenance (Preventive Maintenance Program) for the Simulators. The Contractor agrees and acknowledges that it shall be allowed to carry-out Scheduled Maintenance of Simulators in accordance with the procedure set out in the Preventive Maintenance Program or otherwise agreed in advance with the Contractor. The Preventive Maintenance Program submitted by the contractor shall be reviewed by Metro Railway Kolkata and the Simulator demanded shall be made available within the permitted maintenance tolerance limits decided jointly. Unscheduled Maintenance Any maintenance or repair of Simulator, not being Scheduled Maintenance, and arising during the warranty out of any reason including fault, unsatisfactory performance, defects, deficiencies, accident, vandalism, natural calamity, fire, riots, arson, or negligence, shall be undertaken by the Contractor as Unscheduled Maintenance. The Contractor expressly agrees that any and all Unscheduled Maintenance shall be undertaken by them promptly to ensure efficient, safe, and reliable operation of the Simulator. The Contractor shall minimize the Unscheduled Maintenance requirements on the Simulators as it may adversely affect the overall simulator training. Fault means, in relation to a Simulator that such Simulator does not comply with the requirements of the Contract or is not fit to be operated for training services, whether on account of, including but not limited to, a defect, faulty design, faulty materials, bad workmanship or negligence of, or for any other reason which is not solely and directly attributable to Metro Railway Kolkata or occurrence of a Force Majeure Event. In the event any failure occurs which is solely and directly attributable to Metro Railway Kolkata or due to the occurrence of a Force Majeure Event, then Metro Railway Kolkata shall at its sole discretion consider the operational suitability of such simulator and may operate/return such simulator to the Contractor for undertaking Unscheduled Maintenance as required. Any and all Unscheduled Maintenance shall form part of Maintenance Obligations and shall be undertaken by the Contractor.

   Unscheduled Maintenance due to Fault(s): : Unscheduled Maintenance due to Fault(s): Maintenance arising on account of Fault(s). Unscheduled Maintenance solely and directly attributable to Metro Railway Kolkata. The Contractor shall determine the cost & time required of such repair work and share the same with Metro Railway Kolkata along with the basis of the assessment of the repair cost &time and Metro Railway Kolkata shall bear such costs. Metro Railway Kolkata can however ask the Contractor to review its assessment of cost or repair time based on its own experience, good industry practices, and or other inputs from third-party suppliers/manufacturers. The contractor shall however be obliged to share its internal costing and pricing details in order to reach a mutual agreement expeditiously. The Contractor shall be fully responsible to ensure availability of adequate competent manpower for carrying out all maintenance and overhauling activities during the Maintenance Period
