In case the tenderer is authorized agent/ dealer/ distributor of the specified OEM i.e., M/s.Caterpillar , firm should upload the current authorization/ dealer ship certificate/tender specific authorization certificate issued by OEM with validity of authorization to cover entire period of proposed AMC. In case, the validity of authorization does not cover the entire period of proposed AMC, the authorized dealer should submit an undertaking along with the offer to the effect that necessary extension of the validity of the authorization would be ensured before the expiry of the current validity.

Please submit your bank details i.e. Name of Bank along with Bank Branch Code, Accounts Number as appearing in the cheque book, IFSC Code and PAN Number, duly certified by the authorised official of the bank, to facilitate payment through ECS/NEFT/RTGS.In lieu of Bank Certificate,scanned copy of a cancelled cheque may be attached for verification of the above particulars. The prescribed format of Bank Mandate form is enclosed along with tender schedule.
Security Deposit/EMD: The tenderer is exempted from depositing Earnest Money as per the provision contained in MSOP-2018, item no.31(G) of Part-A Works Matters. The bidder shall submit the bid security declaration as per the prescribed proforma of Bid Security Declaration attached to the tender schedule.
Performance Guarantee : Contractor shall have to submit a Performance Guarantee (PG) of 5% of the contract value within 30(Thirty) days from the date of issue of letter of Acceptance (LOA) .The PG has to be submitted in four separate parts of 1.25% each of the contract value. All the provisions along with Extension of time , Penalty etc as specified in clause 4.11 of GCC for Services 2018 are applicable.
Variation in Ordered Quantity: Applicable as per GCC for Service 2018 para No 5.3.2.
Price Variation Clause: The Price Variation Clause (PVC) of General Conditions of Contract (GCC) shall not be applicable to this Annual Maintenance Contract (AMC) as per Railway Board's Letter No. 2013/CE-I/CT/O/10/PVC/Pt.1, dated 27.01.2015
Payment: Railway shall make payment through NEFT on submission of bill by the contractor, duly certified by the authorized Railway officer in-charge of the work that the work has been completed to the satisfaction of the Railway. Spare parts and components are charged during the repairing work are as per the accepted rate list, terms &conditions of the agreement. Bill passing authority as " Dy.CE/TM/HQ till Dy.CE/TM/Lines/SC is posted" and bill paying authority as "AFA/Exp/HQ, office of PFA/SC" for re-organized SCR b) 100 percent payment on or before 45th day from the date of delivery of goods/service along with inspection certificate at the nominated place/depot in good condition by the supplier. Where the department makes any objection in writing regarding acceptance of goods or services with in fifteen days from the day of the delivery of the goods at the nominated place/depot, the 100percent payment will be made on or before the 45th day from the day on which such objection is removed by the consignee.
Statutory Variation Clause: Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof),within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/contractor.
Fall Clause: Fall Clause is applicable as per IRS Conditions of Contract as amended up to date. During every billing, the Contractor has to give certificate stating that no spares are supplied to other parties less than these rates.
TAXES & DUTIES: While quoting, the rates should clearly indicate the rate of applicable taxes. Tenderer should submit the rates duly specifying the taxes and same shall be charged at the rate applicable at the time of delivery of spares and date of servicing the machine for the Railway. The payment will be made only on production of documentary evidence. Tenderer should also furnish HSN code, GSTIN number representing the States in which they are registered for GST along with the address of registered office, place of Business in state etc.Firm should ensure that they are GST compliant and their quoted tax structure/rates are as per GST law.
A certificate is to be submitted that the firm does not charge higher rates than any other authorized dealer for Caterpillar Engines and the rate is uniform. The rates quoted by the contractor should not be above the rates quoted for any railway/ govt agency.
The contractor has to provide the Railway the services of their Engineer for carrying out inspections to check the condition of engines periodically, attend maintenance schedule [Checking and changing of all the filters, lube oil etc., in accordance with the engine manufacturers standard instructions/ practices after expiry of warranty period & warranty conditions] and take necessary action as required in order to prevent failures to the maximum extent. The service representative shall also submit the recommendations regarding the requirement of spares for healthy running of the engine, including the maintenance spares which may be procured well in advance enabling the service representative to carry out the job during each visit. The periodical inspection of the engines shall include imparting necessary guidance to machine operators for conducting routine maintenance.
The Service Engineer can be called by Dy. CE/TM/TM/HQ till Dy.CE/TM/Lines/SC is posted .Even when Service Engineer is not specially called by Railway all engines shall be inspected by Service engineer once in 3 months for preventive schedule maintenance.
Contractor shall provide Supervisory services provided by the Service Engineer for each engine free of charge for inspection of engine at any location of S. C. Railway prior to dispatch for overhauling.
This is a single tender for "Annual maintenance contract for for Overhauling /Maintenance (Both TOH & COH) of Caterpillar Make Diesel Engines model C-18 & C-9 working over South Central Railway for two years at a cost of Rs: 1,75,69,740.00 /- [Rs. 86,83,587.00 for the year 2026-27 and Rs. 88,86,153.00/- for the year 2027-28] against the authorized dealer of OEM M/s. GMMCO LTD- VIJAYAWADA ".So only M/s. GMMCO LTD- VIJAYAWADA is requested to submit their offer. Offer submitted by any other firm will not be considered for evaluation and consideration.
Contract shall come into force from issue of letter of acceptance and shall be in force for a period of two financial years i.e.,2026- 27 & 2027-28 and valid upto 31.03.2028. However the validity can be extended if mutually agreed.The firm should ensure that the validity of their Authorization/Dealership certificate is current/valid during the AMC period.
Skilled and unskilled labor and small consumables like grease, oil etc. required for servicing the machines in Railway premises shall be arranged by Railways at site as per availability. However, Tools & Plants for the job shall be brought by Service Engineer himself.
During maintenance/servicing, the Service Engineer will replace spare part(s) if necessary. Such spares duly certified by the machines in-charge will be paid at the rates agreed. Supply of these spares alone also can be requested by Dy. CE/TM/HQ till Dy.CE/TM/Lines/SC is posted. Contractor has to supply the spares at the rates agreed. The contractor shall return the released materials to the Railway.
At the end of each deputation of their Service Engineer, the authorized agency will raise the bills directly on the Railways, with a certificate from the in charge of the machine, that the engineer attended the machine for the number of days and hours claimed and carried out the job satisfactory.
Spares are to be supplied in advance by the Contractor on a formal requisition from Railways and immediately on its receipt of the Railway will make them available at site for use when the maintenance/service of the machine is undertaken. The contractor shall ensure that the spares as requisitioned by Service Engineer are available on the price list of spares in the AMC.
The components /Sub-assemblies removed from the engine/ equipment for the purpose of repairs will be brought by Railways to contractor's Service Center at Chennai/Nagpur/Vijayawada office and after repairs, the repaired components will be collected and taken to site by Railway shall be brought to the work site and to be fitted on engine.
FOR: Destination.The destination address for supply of spares shall be: Zonal Track Machine Depot (ZTMD/CVB), Cavalry Barracks Railway Station, Beside CTW Barracks, Near Nagamma Temple, Lal Bazar, Secunderabad - 500087.
On receipt and dismantling of engine, Contractor shall submit component wise inspection and estimate shall be submitted to Railways for approval of Railways. 100% test check will be exercised by the Railways before approval of estimate. The reasons for replacement of major subassemblies will also be informed along with the estimate. Railway also reserves the right to ask reason for replacement any component. The inspection by Railway official will be based on the availability of officials. However, Railways will minimize the time taken once the offer for inspection is made.
All the defective/unserviceable components, which are released, shall be returned to the railway by the firm and the same shall be accounted for by concerned Senior Section Engineer. The engines overhauled at Chennai/Nagpur all the spare parts replaced during overhauling are to be returned except Perishable / Consumables items, if any, however same also should be recorded during accountal by Senior Section Engineer.
On completion of overhauling, the testing shall be done at OEM premises on full load at Dynamometer and to this effect the test certificate shall be provided. The Contractor shall inform the tentative date of testing at Chennai/Nagpur. However, testing shall not be withheld for want of ZTMD/Railway representative.
Test certificate with test observations is to be provided by the contractor.
The contract shall provide necessary supervisory services as & when required to assess condition of engine on the basis of performance parameters and case history so that suitable decision can be taken by Railways whether engine needs major repairs or not.
Contractor shall arrange to dispatch engine to & from destination i.e., from any location of S. C. Railway. Railways shall declare & certify value of engine being sent through certificate. Transit insurance shall be arranged by the Contractor. Insurance charges shall be included in the invoices.
a) For repairs / overhaul of engines, the contractor shall provide guarantee for six months from the date of commissioning or 1800 EWH (One thousand eight hundred Engine working hours) of working on machine whichever is later. b) In case warranty replacement is not completed by the firm within 3 months period from the date of failure for a overhauled engine, the amount of expenditure/loss incurred by railways will be borne by the agency, and the amount will be deducted from the account bills or from the future bills or from the bills pending with other railways. Also the performance of the firm for such incidents may be recorded as poor performance of the firm.
New spares shall be guaranteed/Warranteed as per IRS conditions.
The cost of spare parts supplied and repair or calibration of components will be as per the agreed prices [suggested price list of OEM i.e. M/s Caterpillar will be applicable at the time of execution of the specific job. Copy of price list is to be made available to the concerned bill paying authority of Railways].
In case major overhaul of engines is not done within 10 weeks of informing, a penalty of half percent of complete overhauling cost will be recovered per each week of default from the agency (provided wherever Railway has to arrange spares, the Railway delivers required spares at site on the day of commencement.)
The quantity of each item/spare cannot be specified as the type of repairs/breakdown is not known. However, quantities of the item to be procured will be on need basis. The piecemeal orders will be issued by Dy. CE/TM/HQ till Dy.CE/TM/Lines/SC is posted has to be honored. The firm should supply the spares within 60 days from the date of requisition by Railway. If firm fails to adhere the delivery period for spares. Liquidity damages will be levied as per extent rules. (0702 of IRS condition).
Contractor should submit documentary proof (original/attested/notarized bill of lading/entry, original/attested/notarized Packing slip & Warranty certificate) for imported spares supplied from OEM.
In case of Breakdown/ Emergency the Service Engineer must reach the site within 4 days (Excluding the day of intimation), after receipt of any telephonic/fax/e-mail/written message from Railway. If service engineer does not the site within 4 days (Excluding the day of intimation) the service charges of service engineer shall be reduced by 25% for the number of days delayed or days spent on deputation whichever is lower.
Contractor shall be wholly responsible for the statutory observations performing to his staff viz PF, ESI, WCA etc and he will be responsible for the maintenance of necessary records in this connection and also comply with all statutory requirements in force from time to time. The Contractor shall pay minimum wages to his staff as fixed from time to time under the laws in force.
The Contractor shall not be entitled to be provided with any facilities by way of accommodation, free passes or material or transport. The arrangements for stay and lodging of the staff of the tenderer shall be the responsibility of the tenderer.
Arbitration : In the event of any dispute, differences etc, in interpreting the various clauses of the agreement or in actual working of the contract, the same will be referred to by either of the parties to the General Manager, South Central Railway or to any one specially nominated by him on his behalf for arbitration and his award is binding on both the contractor and the Railways. The Arbitration and Conciliation Act 1996 and rules there under and any statutory modification thereof shall apply to the Arbitration proceedings under this clause.
A request for supply of spares or deputation of service engineer shall be honored till last date of currency of the AMC. Execution of such request will be obviously after expiry of AMC and delivery date or deputation period will go beyond it depending upon the terms of delivery/deputation stipulated in the AMC. No additional extension of validity for such cases is required and bills for such work/supplies will be honored by Railways as per the delivery schedule for spares mentioned in the agreement
Based on the certification by inspector-in-charge of the Machine about satisfactory completion of services or satisfactory supply of spares requested, bill will be passed by Dy. CE/TM/HQ till Dy.CE/TM/Lines/SC is posted as the case may be and payment will be arranged by "AFA/Exp/HQ, Office of PFA/SC"
During the period of contract if it is found that the contractor is not able to discharge his duties to the satisfaction of the railway administration it would be open for the railway administration to terminate the contract as per general condition of contract.
Force Majeure Clause: Railway's Standard Force Majeure Clause shall only be applicable which is as follows: "In the event of any unforeseen event directly interfering with the supply of stores arising during the currency of the contract such as war, insurrection, restraint imposed by the Govt. act of legislature or other disorganization of labour, acts, of public enemy, acts of God, Sabotage, etc. The contractor shall within a week from the commencement thereof notify the same in writing to the purchaser with reasonable evidence thereof. If the Force Majeure Clause mentioned above has in force for a period of 90 days of commencement of such force majeure, the same should be brought to notice of the purchase by giving 14 days' notice in writing. In case of such terminations no damages shall be claimed by either party against the others are except those which had accrued under any clause of this agreement prior to such terminations".

The contract will be governed by Indian Railways Standard General Conditions of Services-2018 with up to date correction slips in accordance with GFR 2017, IRS Conditions of Contract and Terms and conditions of this contract & special conditions of contract to the extent applicable & accepted.
