“Providing Labour for work of loading, unloading of material, grass cutting,

cleaning of yard, restacking of material of conductor drum and work allotted by

RSO at RSO Narol under Sabarmati Circle”

1. Definitions: -

If construing these general conditions and the annexed specifications, if any, the

following words shall have the meaning herein assigned to them unless there is

something in the subject or context inconsistent with such construction.

1.1 “Company” shall mean Uttar Gujarat Vij Company Limited, Company and

shall include its successors and assign.

1.2 “Contractor” shall mean the tenderer whose tender is accepted by the hirer

and shall include the tenderer’s legal personal representatives, successors

and permitted assigns.

1.3 “Officer” shall mean such officer as may be duly appointed from time to time

by the Company. If he is not so appointed the CE of the Company or his duly

authorized representative.

1.4 “Contract” shall mean the agreement, if any to be entered into and include,

subject to the special conditions notified herein, all the documents, by which

any agreement by the contractor to provide to execute, or to carry out the

work if work shall be constituted in or by which the terms of such agreement

or any of them are contained or set-forth specially, including these general

conditions any special conditions attached to or issued with these conditions,

the specifications, drawings, the invitations of tender (if any) or any other

letter or notice or document upon or with reference to which the tender is

made, the tender and the acceptance thereof and the scheduled price(if any)

furnished by the contractor with the tender.

1.5 “Specification” shall mean the specification annexed to these general

conditions and the schedules thereto (if any).

1.6 “Contract price” shall mean the sum accepted or the sum calculated in

accordance with the prices accepted by or on behalf of the Company.

1.7 “Month” shall mean the calendar month.

1.8 Tender papers are non-transferable and online mode only.

2. Tender Fees: - All the bidders will be required to pay tender fee plus applicable

GST as mentioned in the tender document by RTGS/NEFT/online.

3. Earnest money deposit: All the bidders will be required to pay EMD fee as

mentioned in the tender document by RTGS/NEFT/online. The E.M.D. of these

successful tenderers who do not accept Company’s orders or of tenderer who

withdraw their offer during the stipulated period of validity of the offers will be

liable to be forfeited.

5. Earnest money deposit will be forfeited in case the successful bidder after his tender

has been accepted shall refuse to pay the prescribed security deposit and refuse to

execute the contract.

6. EMD will be released only on payment of security deposit in respect of successful

bidder whereas the same will be refunded to others on finalization of the tender/

placement of order to successful bidder.

7. Offers shall be valid for the period of 120 days from the date of opening of price bid.

Bidders shall not withdraw tenders during the validity period, failing which their EMD

shall be forfeited during the period of 120 days.

8. No Interest will be allowed / paid against payment of E.M.D.

9. Security Deposit

9.1 The successful bidder shall have to pay security deposit amounting 5% of the

approved order value within 15 days from the date of LOA.

9.2 If contractor fail to execute the order successfully, paid security deposit by

bidder to be forfeited.

10. Conflict of Interest among Bidders/ Agents:-

A bidder shall not have conflict of interest with other bidders for particular

quoted item. Such conflict of interest can lead to anti-competitive practices to

the detriment of Procuring Entity’s interests. The bidder found to have a conflict

of interest shall be disqualified. A bidder may be considered to have a conflict of

interest with one or more parties in this bidding process for particular quoted

a) they have proprietor/ partner(s)/ Director(s) in common; or

b) they receive or have received any direct or indirect subsidy/ financial stake

from any of them; or

c) they have the same legal representative/ agent for purposes of this bid; or

d) they have relationship with each other, directly or through common third

parties, that puts them in a position to have access to information about or

influence on the bid of another bidder; or

e) bidder participates in more than one bid in this bidding process. Participation

by a bidder in more than one Bid will result in the disqualification of all bids in

which the parties are involved. However, this does not limit the inclusion of the

components/ sub-assembly/ assemblies from one bidding manufacturer in more

f) in cases of agents quoting in offshore procurements, on behalf of their principal

manufacturers, one agent cannot represent two manufacturers or quote on their

behalf in a particular tender enquiry. One manufacturer can also authorize only

one agent/ dealer. There can be only one bid from the following:

1. The principal manufacturer directly or through one Indian agent on his behalf;

2. Indian/ foreign agent on behalf of only one principal.

g ) a Bidder or any of its affiliates participated as a consultant in the preparation

of the design or technical specifications of the contract that is the subject of the

h) in case of a holding company having more than one independently

manufacturing units, or more than one unit having common business ownership/

management, only one unit should quote. Similar restrictions would apply to

closely related sister companies. Bidders must proactively declare such sister/

common business/ management units in same/ similar line of business.

i) Bidder shall not act in contravention/ violation to the provisions of competition

act, as amended from time to time.

Every bidder should, at the time of submission of bid, give a declaration, that

bidder shall not have conflict of interest with other bidders for particular quoted

item, as above.

GENERAL CONDITIONS :-

1. The tender must be submitted online only.

2. The Rates must be filled in the schedule ‘B’ attached exclusive of all taxes, ST, GST, etc.

3. The rates to be quoted online only for Loading, Unloading, Stacking, and Lifting of Materials &

Cleaning – Grass Cutting Work & all other types of Labour work at R.S.O. Narol & any where

place of Circle Office Sabarmati.

4. Contractor shall ensure with all safety rules and regulations while carrying out the work.

5. In case of any fatal or non fatal accident or injuries to any person, the responsibilities of

tenderer, for any claim arising due to above, the tenderer will be solely responsible. The

tenderer shall execute guarantee on stamp paper of Rs. 300.00 for above risk.

6. For any liabilities under Labour Laws, ID Act., minimum wages rules, Workman compensation

Act. Or any other law or Act. Tenderer will be solely responsible.

7. The tenderer shall have to provide Minimum 8 Nos of Labour to carry out the work

immediately. If the tenderer fails to carry out the works or its parts the same will be carried out

from others party at your cost risk and penalty should be charge Rs.4000/- per day.

8. The tenderer shall keep 8 [ Eight ] persons present in R,S,O, Narol Store during the all working

days from 10.00 A.M to completion of work [ i. e . up to closing of RSO ]. In case of less labour

available, Rs 500/- per labour will be deducted from the Bidder.

9. The bill shall be prepared every month on the base of actual work carried out day to day

and the payment will be made by A/c. payee cheque/RTGS subject to an advance stamp

receipt being received from tenderer.

10. Income Tax will be deducted at the prevailing rates.

11. Jurisdiction will be Ahmedabad.

12. The tenderer shall have to pay security deposit at 5 % of the order Value Amount.

13. The rates shall be in force for a period of 12 months from the date of placing the Order & till the

order value is completed.

14. The rates shall be valid up to completion of time period from the date of placing the order.

15. Any loss of damage while Loading, Unloading, Stacking, Lifting of Materials & Cleaning – Grass

Cutting Work, the tenderer shall be responsible for the same.

16. Conditionally tender will not be considered.

17. The description in Schedule “B” is for Loading, Unloading, Stacking, Lifting of Materials &

Cleaning – Grass Cutting Work & all other types of Labour work. Internal material shifting /

material re-arrangement, Office furniture shifting, Filling up of Drinking Water Jug / Watering to

the Plantation , Outsider program in Company’s/ hired Vehicle for Loading / Unloading work will

be included in labour work. The cleaning of Measurement Shed, Physical Section will also be

included in labour work.

18. All necessary tools and equipments required for the work shall be arranged by the contractor.

19. The payment shall be made as per actual work carried out day to day and certified by the

concerned officer.

20. In case of any difference or dispute the decision of Addl. Chief Engineer, UGVCL, C.O. Sabarmati

shall be final and binding to the tenderer.

21. Other terms and conditions as per the contract booklet of U.G.V.C.L. shall be applicable to this

time limit at the same terms and condition or till the order value gets completed; whichever is

24. Tenderer must submit bid documents and bid through online only.

25. Tender who do not fulfill all of any of the above conditions or are incomplete in any respect are

liable to summary rejection.

26. The submission of tender by a tenderer implies that he has read these instructions, the

condition of contract etc. and has made himself aware of the specification of work to be done.

27. The contract or any part thereof shall not be sublet the written permission of the ACE. or his

authorized representative.

28. The company or its officers who accept the tender shall have the right to reject all or any of the

tender in part of full not be bound to accept the lowest not assign any reason whatever for the

rejection of any tender or any item or all tenders.

29. The labour has to carry work as per instruction of Dy.Engr / Jr Engr / SK / Sr Asst .

30. Any of the labour should not below the age of 18 Years.

31. As and when required, the labours shall have to carry labour work anywhere in the

jurisdiction of Sabarmati Circle.

PREQUALIFICATION CONDITION (Technical Bid)

The Tenderers / Bidders have to furnish / enclose the following documents for subject

work along with the Technical Bid of their offer otherwise their offer will liable to be

ignored without any reference / correspondence.

1. Photocopy of Professional Tax Number certificate.

2. Party shall have to submit the Latest Bank Solvency Certificate of at least 20% of

estimated cost .(Not more than one year old)

3. Certified copy of P.F. Code Number is to be attached.

4. Certified copy of Group Insurance Policy.

5. Party shall have to certify that the submitted Tender is “UN CONDITIONAL”.

6. Income-tax Number & Certified copy of PAN Number of the firm.

7. Certified copy of Labour License Number.

8. Certified copy of GST Registration Number.
