Ahmedabad Janmarg Limited (AJL) invites Technical Bids and Price Bids from
Experienced and Interested Bidders for Annual Rate Contract (ARC) for executing
Comprehensive Electrical Maintenance of BRTS Stations, Cabins and Depots of different
BRTS routes of Ahmedabad Janmarg Limited by supplying necessary materials and
labour for year 2026-28 on Different BRTS Routes in Ahmedabad.
The Bids shall be prepared in English and all entries must be typed and written in blue / black
ink. Initials of the authorized representative of the bidder must attest all erasures and alterations
made while filling the Bids. A copy of this tender document with all pages duly stamped and
signed must accompany the bid.
Authority shall not be responsible for any costs or expenses incurred by the Bidders in
connection with the preparation and delivery of bids, including costs and expenses related to
visits to the sites. Authority reserves the rights to cancel, terminate, change or modify this
procurement process and/or requirements of bidding stated in the Tender, without assigning any
reason or providing any notice and without accepting any liability for the same.
The bid evaluation process is detailed in Instruction to Bidders (ITB) in Tender. Only those
firms/companies qualifying in their Technical Bids will be considered qualified for the purpose of
opening of price bids and its evaluation. The date of opening of Price Bids will be communicated
to qualified bidders at a later date.
“AJL” shall mean Ahmedabad Janmarg Limited, a 100% subsidiary of Ahmedabad Municipal
Corporation (AMC), an entity incorporated as a company under The Companies Act, 1956 for
the purpose of planning, establishment, implementation, management, supervision and control
of the BRTS and its authorized successors and assigns at all times.
“Authority” means the Ahmedabad Janmarg Limited (AJL) as the context may require or
“Bid” or “Detailed Bid” or “Tender” shall mean the detailed Bid submitted by the Bidder in
response to this tender including clarifications and/or amendments, if any.
“Bid Security” shall mean the Earnest Money Deposit (E.M.D.) or Security furnished by the
Bidder, as part of the Bid submission.
“Bid Value” shall mean the amount equal to % Above or % Below of Tender estimate quoted
by the service provider for the project
“BRTS” shall mean Bus Rapid Transit System run by the Authority
“Due Date” shall mean the last date for submission of Tender.
“Month” shall mean a period of 30 days.
“Firm” shall mean a single legal entity, which is a registered body, Government agency or
statutory body.
“Letter of Intent (LoI)” or “Letter of Acceptance (LoA)” shall mean the letter to be issued by
Authority to the successful bidder indicating the acceptance of his offer in accordance with the
conditions of this Tender document.
“Operation hours” shall mean BRTS daily operation hours from 0600Hrs to 2245Hrs. The time
duration shall be applicable as operation hours for the service provider also.
“Performance Security” or “Performance Bank Guarantee” shall mean the Bank Guarantee
furnished by a successful Bidder as per terms and conditions of this tender.
“Service Provider” or “Contractor” shall mean the agency/firm/company which is the
successful bidder and has been selected by the Authority for the work as per the terms and
conditions of this tender.
“Taxes and Duties” shall mean all taxes, duties, fees, cess etc. payable as per applicable laws
in India in connection with the discharge of responsibilities as per the scope of work envisaged.
3 INTERPRETATION
In the interpretation of this Tender, unless the context otherwise requires:
- The singular of any defined term includes the plural and vice versa, and any word or
expression defined in the singular has the corresponding meaning used in the plural and
- A reference to any gender includes the other gender;
- Unless otherwise stated, a reference to a Clause, Sub-Clause, Paragraph, Subparagraph,
Annex, Exhibit, Attachment, Schedule or Recital is a reference to a Clause, Sub-Clause,
Paragraph, Subparagraph, Annex, Exhibit, Attachment, Schedule or Recital of this Tender.
- A reference to any agreement is a reference to that agreement and all annexes,
attachments, exhibits, schedules, appendices and the like incorporated therein, as the
same may be amended, modified, supplemented, waived, varied, added to, substituted,
replaced, renewed or extended, from time to time, in accordance with the terms thereof;
- The terms “include” and “including” shall be deemed to be followed by the words “without
limitation”, whether or not so followed;
- Any reference to a person shall include such person’s successors and permitted assignees;
- A reference to a “writing” or “written” includes printing, typing, lithography and other means
of reproducing words in a visible form;
- Any date or period set forth in this Tender shall be such date or period as may be extended
pursuant to the terms of this Tender;
- A reference to “month” shall mean a calendar month, and a reference to “day” shall mean a
calendar day, unless otherwise specified.
- The terms "hereof, "herein", "hereto", "hereunder" or similar expressions used in this
Tender mean and refer to this Tender and not to any particular Article,
- The terms "Article", "Clause", “Paragraph” and “Schedule” mean and refer to the Article,
Clause, Paragraph and Schedule of this Tender so specified;
- In case of inconsistency between the terms mentioned in the Bid Summary and detailed
description, the terms of the Bid Summary shall prevail.

satisfactorily by the bidder, may be rejected as non-

followed till the lowest bid shall be considered for
evaluation of its responsiveness as stated in sub
clause (a) above.

15 Performance Security 5% of the Final Bid Value in the form of Bank
Guarantee from the banks specified in Section-6.11.
This shall be payable on or before signing of
Agreement. The general format of the bank guarantee
for Performance Security is set forth in Annexure-5 of
this Tender. The Performance Security shall be valid
up to the end of Contract period and an additional
period of 90 (ninety) days thereafter.
16 Payment basis Payment shall be made to the Successful Bidder who
has emerged as Service Provider on monthly basis
after the Service Provider has submitted the invoice as
per actual works executed during that particular month.
17 Damages In case of non-performance & non-compliance of
Service Provider for "Scope of Work and Obligations of
Service Provider" and "General Tender Conditions" as
elaborated at Section-8 & 9, penalty amount equal to
"Proportionate Loss calculated because of delay in
attending fault and providing resolution with a
maximum ceiling of 10% " or "Any amount as
decided by the authority" shall be applicable and
imposed on the Service Provider. Such damages shall
be limited to 10% (Ten Percent) of the Amount of
Work Order (Contract Value)/Bid value. In addition to
this, if the cumulative amount of such damages
exceeds 10% of the "Contract Value/Bid value" for
contract period, then it shall be considered as an event
of default on the part of the Service Provider.
18 E-Tender issue date Tender shall be available from 06/08/2026 to

19 Submission of Price Bid (online Price Bid to be submitted only online through

only.” Documents shall be submitted in Sealed

time will not be entertained under any circumstances.
21 Date and Time of Opening of On 29/08/2026 at 17:30 Hrs Onward in the office of

22 Signing of Agreement Agreement shall be signed between Authority and
Supplier incorporating the Terms of the Tender as
directed by Authority.
23 Terms & Condition and As specified in various sections of Tender Document.
Technical Specifications
Tenders, which do not fulfill all or any of condition, are submitted incomplete in any respect, or
are conditional tenders, will not be accepted and hence will be rejected. Chairman Ahmedabad
Janmarg Limited reserves the rights to reduce/increase the scope of work and contract
without assigning any reason thereof and also reserves the rights to reject any or all the
tenders without assigning any reasons thereof.

5 INVITATION FOR BID (IFB)
a) The AHMEDABAD JANMARG LIMITED, (hereinafter called “the Employer”) invites
Online Tender from reputed, experienced and qualified bidders for execution of works detailed

c) Interested bidders shall download the tender documents from website
https://amc.tender.nprocure.com from 06/08/2026 till 29/08/2026.
d) All bids must be accompanied by Bid Security of the amount specified for the Works in
the above Table payable at Ahmedabad and drawn in favour of Ahmedabad Janmarg Limited,
Ahmedabad. Bid Security will have to be in any one of the forms as specified in respective
section of Tender Document.
e) Physical copy of Technical bids must be delivered to General Manager, Janmarg in the
office of Authority at Ground Floor, Dr. Ramanbhai Patel Bhavan, AMC Zonal Office,
Usmanpura, Ahmedabad-380013 not later than 17:00 hrs on 29/08/2026.
f) The physical copy of Technical bids will be opened at 17:30 hrs on 29/08/2026, at the
office General Manager, Janmarg in the office of Authority at Ground Floor, Dr. Ramanbhai
Patel Bhavan, AMC Zonal Office, Usmanpura, Ahmedabad 380013 in the presence of bidders
or their representatives who choose to attend. In the event of the specified date of bid
submission/opening being declared a holiday for the Employer, the bids shall be received
/opened on the next working day at the same place and the same time.
6 INSTRUCTION TO BIDDERS
6.1 About the Contract
The Contract for "Annual Rate Contract (ARC) for executing Comprehensive
Electrical Maintenance of BRTS Stations, Cabins and Depots of different BRTS
routes of Ahmedabad Janmarg Limited by supplying necessary materials and
labour for year 2026-28 " shall be awarded to the successful bidder for the tenure as
mentioned in the Bid Summary of this document.
a) The bidder shall specify and fill in percentage rate above or below and total
amount (both in figures and words) for overall items of the works provided in the Bill of
Quantities along with total bid price derived after application of percentage above or
below (both in figures and words) in the format as per Annexure 6- Price bid and
submit it online only as specified in https://amc.tender.nprocure.com.The Bids of the
Bidder submitting its Price Bid in Physical form as part of Technical Bid shall be
summarily rejected. Chairman, AJL reserves the right to appoint one or more than one
i.e. maximum two service providers for the above works. The Bidder quoting the lowest
charges shall generally be declared as the Preferred Bidder provided such charges shall
not be Non responsive in terms of unrealistically lower or higher than internal estimate or
market rate or Good Industry Practice and which could not be substantiated satisfactorily
by the bidder, may be rejected as non-responsive. The Bidder shall have to provide
break-up as and when demanded by Authority. The Bidder whose quote found to be
non-responsive shall be liable for rejection.
b) In case Lowest Bidder’s price bid determines to be non responsive then second
Lowest Bidder’s Price Bid shall be considered for evaluation of its responsiveness as
stated in sub clause (a) above. In case second Lowest Bidder’s Price Bid is found to be
responsive as per sub clause (a) hereof then it shall be considered Lowest for process of
Award. In case second Lowest Bidder’s Price Bid is found to be responsive as per sub
clause (a) hereof then it shall be considered Lowest for process of Award. In case of
Second Lowest Bidder’s price bid determines to be non responsive then Third Lowest
Bidder’s Price Bid shall be considered for evaluation of its responsiveness as stated in
sub clause (a) above. Subsequently, the process will be followed till the lowest bid shall
be considered for evaluation of its responsiveness as stated in sub clause (a) above.
The Contract shall come into force only if following conditions have been
a) Performance Security has been submitted to the Authority within time period
stipulated at relevant section of the tender or as directed by the Authority.
b) Agreement representing the contract is executed within time period stipulated.
6.2 Award of Tender
The Authority will accept a tender which is the best suited as per the evaluation criteria.
The decision of the Authority shall be final in this regard. The Authority also reserves the
following rights without any kind of liability.
a) To accept or reject any or part of any tender or all the tenders without assigning
any reason thereof.
b) Not to accept the lowest tender or assign reasons for not accepting the lowest
c) Not to proceed ahead in the project without assigning any reason thereof.
6.3 Documents Constituting Tender
The Tender documents comprise the following and are to be read together.
a) This tender document and
b) Other documents constituting the Tender and acceptance thereof and shall be
deemed to include any amendments, modifications to the Tender document or its
constituent document.
6.4 Tender Submission Format
It is mandatory for all participating Bidders to submit their “Technical Bid” by physical
submission only and not by submitting it online. Such “Technical Bid” which is to be
submitted physically only, shall comprise of copy of duly signed Tender Document (In
duplicate), Tender fees, Security Deposit/EMD and all duly signed copy of enclosures
sought by the authority and also listed within the Tender document below and also at
Clause7.3 of Section-7. Participating Bidders who have not submitted their “Technical
Bid” in physical form, as per timeline specified in tender, but have submitted only
“Financial Bid” online will be disqualified and their bids will be summarily rejected.
The Bidders shall submit only “LEGIBLE” and “VALID” copy of all documents as sought
by the authority and which are to be enclosed/attached with the tender while submitting
the “Technical Bid” physically.
It is recommended to all participating Bidders that the “COPY OF ELIGIBILITY
DOCUMENTS” to be enclosed with the tender shall be in same chronological
order/sequence as specified at Clause7.3 of Section-7 in the tender document to
facilitate evaluation process.
The Bidders will submit the Technical Bid in two envelopes, the details for which are
specified as below:
a) Bid Security and
b) Tender fee in the form of Demand Draft in favour of “Ahmedabad Janmarg
Limited”, and payable at Ahmedabad
The envelope shall be titled “Envelope 1 – Tender Fee and Bid Security”.
Following details shall be sealed separately in an envelope.
a) Copy of Tender document (In duplicate) along with “Legible & Valid” copy of
documents to be enclosed/attached as listed at Clause7.3 of Section-7 and all
documents duly signed on each page by the Bidder’s authorized representative

All these two envelopes shall be placed in one single outer envelope titled “E-Tender
for Annual Rate Contract (ARC) for executing Comprehensive Electrical
Maintenance of BRTS Stations, Cabins and Depots of different BRTS routes of
Ahmedabad Janmarg Limited by supplying necessary materials and labour for

c) Indicate the name and address of the bidder.
6.5 Tender Opening Process
On the day of bid opening, Envelope 1 would be opened first and the details of Tender
fee and Bid Security will be verified. Upon successful verification, Envelope 2 will be
opened and the enclosures noted.
Envelope 2 will then be scrutinized in detail later to determine the qualified bidders by
the Authority. Date of opening of Price bid would be communicated to the qualified
bidders only, through e-mail / letter or telephone. Authority reserves the right to ask for
further clarifications/ information from bidders regarding any part of the bid information
submitted by it at anytime during the bid process.
6.6 Examination of Bids and Determination of Responsiveness of Bid
a) The Employer will determine responsiveness of each Tender volume with respect

Specifications, Drawings and other relevant requirement of bidding documents.
b) A substantially responsive Tender volume is one which conforms to all the terms,
conditions and specifications of the bidding documents, without material deviation or
reservation. A material deviation or reservation is one (i) which affects in any substantial
way the scope, quality or performance of the Works; (ii) which limits in any substantial
way, inconsistent with the bidding documents, the Employer's rights or the bidder's
obligations under the Contract; or (iii) whose rectification would affect unfairly the
competitive position of other bidders presenting substantially responsive Tender volume.
c) If the Tender volume is not substantially responsive, it will be rejected by the
Employer and may not subsequently be made responsive by correction or withdrawal of
the non-conforming deviation or reservation.
6.7 Correction of Errors
a) The Employer for any arithmetic errors will check tender volume determined to
be substantially responsive. Arithmetic errors will be rectified on the following basis:-
i) Where there is a discrepancy between the figures and words, for % and amount,
the figure in words will govern and
ii) Where there is discrepancy in total amount arrived by addition of percentage
ii) Where there is discrepancy in total amount arrived by addition of percentage
(above or below), the amount arrived by addition percentage (above or below) as
written in word shall govern.
b) The amount stated in the Form of Bid will be adjusted by the Employer in
accordance with the above procedure for the correction of errors and shall be
considered as binding upon the bidder. If the bidder does not accept the corrected
amount of bid, his bid will be rejected, and his Bid Security may be forfeited.
6.8 Language of Bid
The bid, and all correspondence and documents related to the bid exchanged between
the bidder and the Employer shall be written in the English language. Supporting
documents and printed literature furnished by the bidder may be in another language
provided they are accompanied by an accurate translation of the relevant passages in
the English language, in which case, for purposes of interpretation of the bid, the English
translation shall prevail.
6.9 One Bid per Bidder
Each bidder shall submit only one bid per contract package either by himself or as a
partner in a joint venture. A bidder who submits or participates in more than one bid for a
contract package will be disqualified. Not More than one tender shall be submitted by a
contractor or by a firm of contractors. No two or more concerns in which an individual is
interested as a proprietor and / or a patner & / or director shall submit tender for the
execution of the same work / tender. If they do so all such tender shall be liable to be
6.10 Site Visit
The bidders are advised to visit and examine the Site of Works and its surroundings and
obtain for itself on its own responsibility all information that may be necessary for
preparing the bid and entering into a contract for execution of electrical maintenance
works. The costs of visiting the Site shall be at the bidder's own expense. The bidder
and any of its personnel or agents will be granted permission by the Employer to enter
its premises and lands for the purpose of such inspection, but only upon the express
condition that the bidder, its personnel and agents, will release and indemnify the
Employer and its personnel and agents from and against all liability in respect thereof
and will be responsible for death or personal injury, loss of or damage to property and
any other loss, damage, costs and expenses incurred as a result of the inspection.
6.11 Bid Security
A Bid Security as mentioned at Sr.12 of Bid Summary of this tender document shall
accompany bid submitted in response to the Tender Document. The bid security
furnished by the successful bidder shall be refunded after the acceptance of
Performance Security. Bids not accompanied with Bid Security as mentioned in Bid
Summary shall be summarily rejected. Bid security is a non interest bearing deposit.
The bid security shall be returned to the bidder –
a) Whose price bid has not been accepted by the Authority.
b) Whose price bid has been accepted by the Authority but after receipt of
Performance Security.
c) Bid security shall be forfeited in case of revision and/or modification of terms of
bid or withdrawal of bid during the validity period.
Bid security shall be forfeited in the following situations:
a) In case of unclear offer and/or conditional offer. Such tender shall not be
acceptable, and the bid security shall be forfeited.
b) If bidder withdraws the tender before award of tender and before the end of
validity period of tender.
c) For the successful bidder, if the performance security is not deposited within
stipulated time period, and/or cheque of performance security cannot be cleared.
d) If the Agreement is not executed within stipulated time period for reasons
attributable to the bidder, whether or not the performance security has been paid. (In this
case, both bid security and Performance security will be forfeited and LOA will be
e) In the event the bidder, after the issue of communication of acceptance of his bid
by the Authority, fails/refuses to execute the work as herein the bidder shall be deemed
to have abandoned the work/contract and such an act shall amount to and be construed
as the bidder calculated and wilful breach of contract, the cost and consequences of
which shall be to the sole account of the bidder and in such an event the Authority shall
have full right to claim damages thereof in addition to the forfeiture of the Bid security
deposited in terms of this bid documents.

6.12 Discharge of Bid Security of successful Bidder
The Bid Security of a Successful Bidder shall be discharged only after the Performance
Security is furnished by the Bidder as per the requirement. The Successful Bidder’s Bid
Security shall not be adjusted against the Performance Security.
6.13 Performance Bank Guarantee (Performance Security)
a) The Service Provider shall, for due and punctual performance of its obligations
during the Contract Period, deliver to the Authority, simultaneously with the execution of
this Contract an unconditional and irrevocable bank guarantee from banks specified in
Section 6.11 (the "Performance Security”) for a sum mentioned at Sr-15 of the Bid
b) The Performance Security shall be valid up to the end of Contract Period and for
an additional period of 90days (Ninety Days) thereafter.
c) The Performance security shall not bear any interest and the Service Provider
shall not have any claim on the interest on Performance security.
d) Provided that if the Contract is terminated due to any Event of Default other than
the Service Provider’s Event of Default, the Performance Security, shall, subject to the
Authority’s right to receive amounts, if any, due from the Service Provider under this
contract, be duly discharged and released to the Service Provider.
Fresh Performance Security
In the event of the encashment of the Performance Security by the Authority pursuant to
Encashment Notice issued, the Service Provider shall within 10 (ten) days of the
Encashment Notice furnish Fresh Performance Security to the Authority failing which,
the Authority shall be entitled to terminate this Contract in accordance with the
provisions herein.
Performance Security shall be forfeited in following situations:
a) If the Service Provider found guilty of not following any of tender terms and
b) If the Service Provider fails to pay the penalty applied on him for breach of
performance obligations
c) If the contract is terminated in event of Service Provider event of default.
d) If the Service Provider wants to terminate the contract.
6.14 Currency for the Bid
The rates and the prices shall be quoted by the bidder entirely in Indian Rupees and all
payments shall be made in Indian Rupees.
6.15 Mode of payment by the Authority
The payment to the Service Provider shall be paid by the Authority on a monthly basis
for electrical maintenance works executed by the Service Provider during that particular
month. This payment term is applicable only when the Successful Bidder have deposited
5% of the Tender amount as security deposit by demand draft or in the form of bank
guarantee of Nationalized Bank to Ahmedabad Janmarg Limited (AJL) and have signed
a contract with Ahmedabad Janmarg Limited (AJL) as per rules after receipt of work
6.16 Authorisation of Bidder’s signatory
Bidders shall appoint a signatory to sign, discuss, and represent in every way the
bidding firm for the purposes of this tender and shall provide legal and statutorily valid
documentation authorizing the representative to act on behalf of the bidder firm. The
authorization shall be in the format specified in Annexure 4 of this tender document. If
and as required, this Power of Attorney has to be supplemented with supporting
documents like Board Resolution.
6.17 Validity Period
Bids shall remain valid for a period of 120 days (One hundred and Twenty days) after
the due date of bids submission. Authority reserves the right to reject a Bid as non-
responsive if such Bid is valid for a period that is less than specified and Authority shall
not be liable to send an intimation of any such rejection to such Bidder.
6.18 Extension of Period of Validity
In exceptional circumstances, Authority may solicit the Bidder’s consent for an extension
of the period of Bid validity. Any such request by the Authority and the response thereto
shall be made in writing and such extension of Bid validity period by the Bidder should
be unconditional. A Bidder may refuse Authority’s request for such extension without
forfeiting the Bid Security. A Bidder accepting the request of Authority shall not be
permitted to modify its Bid.
6.19 Modification and Withdrawal of Bid
No bid may be withdrawn or modified in the interval between the deadline for submission
of bid and the expiration of the validity period.
6.20 Corrupt or Fraudulent Practices
The Employer will reject a proposal for award if he determines that the Bidder
recommended for award has engaged in corrupt or fraudulent practices in competing for
the contract in question. The Employer will declare the firm ineligible, either indefinitely
or for a stated period of time, to be awarded a contract by AHMEDABAD MUNICIPAL
CORPORATION if it at any time determines that the firm has engaged in corrupt or
fraudulent practices in competing for the contract, or during execution.
a) “corrupt practice” means behavior on the part of officials in the public or private
sectors by which they improperly and unlawfully enrich themselves and/or those
close to them, or induce others to do so, by misusing the position in which they
are placed, and it includes the offering, giving, receiving, or soliciting of anything
of value to influence the action of any such official in the procurement process or
in contract execution; and
b) “fraudulent practice” means a misrepresentation of facts in order to influence a
procurement process or the execution of a contract to the detriment of the
Borrower, and includes collusive practice among bidders (prior to or after bid
submission) designed to establish bid prices at artificial non-competitive levels
and to deprive the Borrower of the benefits of free and open competition.

7 EVALUATION CRITERIA AND ELIGIBLE BIDDERS
The following evaluation criteria shall be used for purposes of bid evaluation.
7.1 Evaluation of Technical details as per Qualification Criteria
In order to be qualified for the tender, the bidder must demonstrate that it possesses
capability as per the following criteria.
a) Original Copy of Certificate from registered Chartered Accountant specifying
turnover of specific work and amount specified at Section 7.3 below along with Audited
statement for last three years. Authority may reserve the right to disqualify the bid in
case of non availability of original copy of certificate from registered Chartered
b) Experience in specific areas of work specified at Section 7.3 below in any Central
Govt., State Govt., Municipal Corporation, Power supply utility company such as
UGVCL. (Note: Private contracts like society, clubs etc. will not be considered).
c) The bidder should be a registered organization in terms of being an incorporated
company, partnership, and proprietorship should provide registration details in terms of
appropriate incorporation documents.
7.2 Evaluation of Price Bids
The online Price Bid of only the bidders qualified as per qualification parameters
mentioned would be opened. The Price Bid of the qualified bidder quoting the lowest
amount for execution of subject work shall be considered for award of the tender as
mentioned in the summary. The Price Bid shall be submitted online through
https://amc.tender.nprocure.com only. The Bids of the Bidder submitting its Price
Bid in Physical form as part of Technical Bid shall be summarily rejected.
7.3 Eligible Bidders
This invitation for bids is open to bidders who has necessary bid capacity and who meet
the following requirements.
1. Tenderer must have to submit demand draft in favour of “Ahmedabad Janmarg
Limited” Payable at Ahmedabad of Rs.2,400/- as tender fee along with the tender.
2. Tenderer must have to submit Earnest Money Deposit (E.M.D.) in the form of
demand draft in favour of “Ahmedabad Janmarg Limited” payable at Ahmedabad
of Rs.2,99,354/- with their tender documents.
3. The tenderer must possess current validity valid Electrical Contractor License
from Gujarat State or Any State Licensing Board of India.(Copy of license must be
attached along with tender)
4. The contractor must possess latest validity Class “D” registration certificate in
Electrical category with Gujarat state Road and Building Or any other state PWD
or CPWD in Electrical category.(Copy of registration certificate must be attached
along with tender)
5. Experience of having successfully completed similar works during last 7 years
ending last day of month previous to the one in which tenders are invited should
be either of following.
(i) One similar type of work completed costing not less than the amount of
Rs.79,82,764/- (80% of the estimated cost .) OR
(ii) Two similar type of works completed costing not less than the amount of Rs.
49,89,228/- (50% of the estimated cost.) OR
(iii) Three similar type of works completed costing not less than the amount of Rs.
39,91,382/- (40% of the estimated cost.)
Tenderer must have to submit satisfactory work completion certificate for above
work experience along with work order.
Contractor having experience as a sub-contractor for the above work will not be
considered for the evaluation of tenders.

Similar works mean “SITC of Electrical projects" (OR) "Electrical maintenance work”
in Public Rapid Transit System involving LIVE Operations similar to BRTS" (OR)
"Electrical installation & maintenance of Public Transport Infrastructure/ Data
Center/ Control Center Buildings Only in any Central Govt., State Govt. and
Municipal Corporation (Copies of Work order and work completion certificate & BOQ
/ details of nature of work must be submitted with tender in proof of above criteria).
6. The tenderer shall possess current validity GST registration with Govt. of Gujarat./
Any state of india.
7. The tenderer shall possess current validity PF Registration certificate.
8. The tenderer shall possess current validity ESIC Registration certificate.
9. Tenderer must have Sound financial capacity and having Average Annual
financial turnover of Rs. 29,93,537/- (30% of estimated value.) during last three
financial years.

or false representation in the forms, statements, and attachments submitted; or Been
debarred or terminated or blacklisted by Central Govt. organization / State Govt.
organization / AMC / Any Municipal Corporation / ULBs etc.
b) If any of the directors, partners or the proprietor has a criminal history or has
been convicted by any court of law for any of the offenses under any Indian laws.
c) If, any criminal proceeding is pending in any court of law in India against any of
the directors, partners or a proprietor and if any such proceeding culminates into
Record of poor performance such as abandoning the work, rescinding of contract for
which the reasons are attributable to the non-performance of the contractor, consistent
history of litigation awarded against the applicant or financial failure due to bankruptcy.

Notwithstanding the above, the Employer may debar or blacklist any of the bidder(s) for

decided by the Employer.

8 SCOPE OF WORK, TECHNICAL SPECIFICATIONS AND OBLIGATIONS OF THE
SERVICE PROVIDER
8.1 Scope of Work and General Requirements of Work
A) The work required as per scope of subject tender for BRTS Bus shelter includes
COMPREHENSIVE MAINTENANCE of Electrical distribution system along with
electrical components installed at each BRTS Shelter, which are operating on Raw
Power and not on UPS Power supply. It is pertinent to note that at each BRTS Shelter
components such as Automatic Doors, Station lighting, Raw Power switchboards, UPS
are supplied with “Raw Power” that is power supply available from Torrent Power or
UGVCL whereas majority of the ITMS components are supplied & operates on UPS
power i.e. the power supply available from the UPS output. Therefore, it can be
understood that the Scope of Work for service provider as per this tender includes, but
not limited to, executing the COMPREHENSIVE ELECTRICAL MAINTENANCE of
Electrical distribution system which distributes RAW POWER SUPPLY to discrete
components operating on RAW POWER whereas the maintenance of UPS distribution
systems shall not be in work scope.
B) The Comprehensive Electrical Maintenance shall generally include Corrective
and Preventive Electrical Maintenance. The Corrective maintenance covers attending
and providing resolution to daily occurring electrical faults whereas the Preventive
maintenance shall cover activities to be executed proactively to minimize and eliminate
the probable & foreseeable risks prevailing in the electrical distribution system. Such
preventive maintenance shall be carried out as per time intervals specified in relevant
section of this tender or as per instructions provided by the Authority.
C) Necessary rectifications work as required as per scope of tender shall generally
be carried out in accordance with the best industry practices as per requirement of
Indian Electricity rules, 1956, as amended from time to time and the relevant regulation
of the electricity supply.
D) All materials, fittings etc. used in for installations shall confirm to IS/IEC/BS/IEEE
specification wherever applicable.
8.2 Requirement for Electrical Maintenance and Maintenance Plan
8.2.1 Requirement for Electrical Maintenance
A) The Service Provider shall ensure the deployment of a minimum of six (6)
technicians throughout the BRTS operational period.
B) The Service Provider shall deploy full time Electrical Maintenance staff on
permanent staff and on temporary basis at BRTS Shelters and who shall be available on

upon the directives of the Authority, the authority may ask the Service Provider to log the
attendance of their manpower at BRTS CCC also and Service Provider shall abide to

8.2.2 Maintenance Plan and Maintenance Schedule:
The comprehensive maintenance shall include Preventive and Corrective maintenance
(Proactive inspection and checking). The Corrective maintenance shall include attending and
resolving routine/daily occurring electrical faults in the BRTS Stations whereas Preventive
maintenance shall cover the activities of inspection and checking of electrical systems and
components on pre-defined schedule as tabulated below.

8.3 Obligations of the Service Provider
A) It will be the responsibility of Service Provider to check and identify any potential risk,
which may cause life hazard to any individual or system components, and the service provider
shall execute regular and rigorous inspection on daily basis/regular basis. If any mishap such as
event of electrocution occurs, then it will be entire responsibility of Service Provider. Therefore,
it is advised to Service Provider to execute a thorough inspection and checking of all electrical
system and to highlight same to AJL proactively to avoid and eliminate any possible occurrence
of any kind and type of mishap.
B) Above all conditions are applicable for the Service Provider in all working seasons
including Monsoon season. It will be the responsibility of the Service Provider to arrange
transportation facility in case of BRTS Bus operation is not available but shall ensure to execute
work as per his responsibility and Tender Conditions.
C) Before One (01) month of monsoon, the Service Provider shall do a thorough inspection
with AJL team to identify any equipment/components needs to be replaced immediately and
shall intimate AJL on same.
D) Before monsoon arrival, the Service Provider shall ensure that all electrical systems
shall be in a healthy and safe/risk-free situation. As, any fault or mishap happening thereafter,
then the sole responsibility of same shall be of the Service Provider and not of AJL. The Service
Provider has to bear all the damages associated with same and AJL in such cases will not bear
any such cost and such cases will be treated as negligence on part of Service Provider and not
E) Service Provider shall submit any kind of recommendations for improving the
performance/reliability of the Electrical system and same may be implemented post discussion
with AJL and approval from the competent authority of AJL.
F) All safety tools and gloves shall be provided by the Service provider to their maintenance
personnel’s to avoid any mishap occurrence to their team. It will be the sole responsibility of the
Service Provider to ensure this and any mishap happening due to lack of safety will be
responsibility of Service Provider and not of AJL.
G) The service provider shall take utmost care to identify each area of risks arising within
the Station and which may cause any risk to life of humans, solely due to any kind of
unattended faults, for which Service Provider shall be solely responsible and all necessary
rectifications for same shall be carried from their end only.
H) Following activities are to be executed in presence of the representatives of the
i) All critical Electrical Checks and Inspections.
ii) Installation of any electrical items.
iii) Critical checks advised by AJL electrical staff and its representatives.
iv) Earthing connection and its reliability.
I) All activities of electrical maintenance work shall be executed as per Indian Electricity
Act/Rules 2003 and as far as possible the Service provider shall try to comply as close as
possible to requirements of Indian Electricity Act 2003 and other National Electricity
Rules/Codes/Other applicable mandatory regulations not listed in this Tender but are applicable
to subject work.
J) The Service Provider shall execute the works as per scope of this tender and other
additional works, if required and demanded, during site conditions strictly as per terms and
conditions specified in this tender and without damaging the existing infrastructure and also
without interfering the normal operation.
K) CRITICAL: The works in scope of tender is a highly critical as post occurrence of
fault the BRTS ticketing operation in addition to all other equipments comes to a halt and
thereby such a scenario of power redundancy imposed due to fault occurrence in turn
causes “huge revenue loss” and “inconvenience to passengers and other staff deployed
at BRTS Stations”. Considering aforesaid submission, it can be therefore understood that post
occurrence of such incidents of cable fault, the service provider shall immediately do a site visit
and immediately initiate necessary rectification works which would be in mutual interest of AJL
and Service Provider.
L) The service provider shall execute necessary works only in the presence of the
representative of the AJL and as per instruction of Engineer In charge deployed from AJL at site
M) It is strongly advised and recommended that prospective Bidders shall contact
AJL authority and shall do a site visit prior bid submission in order to acquaint
themselves with Working environment at BRTS, to acquaint on exact kind of works
required as per tender and also to get clarification on their queries, if any. For this,
vendor may contact authority at AJL office during office hours 10:00-18:30Hrs.
N) The service provider must ensure safety of placement of products at BRTS Shelter. If
any product during installation would be found missing, then the sole responsibility of same
would be of service provider only and not of AJL and further AJL would not be liable to make
payment for any such loss of materials.
O) The Service Provider also undertakes to keep and get renewed such license, permission
etc. from time to time. The Service Provider shall be responsible for any contravention of the
local, municipal, central, state, any other laws, rules, regulations, etc.
P) Any discrepancy arising out of a conflict between the specifications as mentioned in this
chapter and the Bills of Quantities shall be brought to the notice of the Engineer in charge prior
to execution and clarification sought for the same.
Q) All works of repair and maintenance shall be carried out in a manner to achieve the
finishes, line, levels, slopes and surfaces to match the finishes of the existing bus shelter and
should be carried out as per the best Engineering practices. The works carried out shall not in
any case look patchy and shall not hamper the structural stability of the existing bus
shelter/building nor shall affect the character of the existing bus shelter/building.
R) The works are to be carried out in heavy traffic conditions and hence safety or every
worker and general public and adjacent properties shall be strictly taken care.
S) The Service Provider shall never employ any child heaving age 5 years to 14 years, as it
is prohibited by the Child Labour Prohibition and Regulation Act, 1986.The Hon. Supreme Court
has given certain guidelines and as per the guidelines, if employment of child labour is detected
on the site work, the employer i.e. the Contractor shall have to deposit Rs.20,000/- (Rupees
Twenty Thousand only) in the Child Labour welfare Fund. If the employer refuses to deposit,
then action will be taken for contempt of Court of the Supreme Court Judgment and also will be
prosecuted by the concerned authority.
T) Ahmedabad Janmarg Limited (AJL) shall not be responsible for any personnel injury or
loss to the representative of the firm or any other loss to the firm while they are on the job at
BRTS working shelter/route for cable fault repair. AJL will also not be responsible for any
accidents (In case of the death of a person or an injury) occurred in the premises of BRTS
route/shelters while working and the compensation for the family of the person affected. It will
be in the scope and responsibility of the contractor to deal with the legal proceeding such as
court matter, police case compensation etc which arises due to the above reason.
U) The Service Provider will be responsible for any type of accident happened during
repairing work at site like short circuits, electric shock to any person or operator and due to
which serious injury or death occurs for any person. Any compensation claimed has to be given
by the Contractor as per labour compensation act. It will be in the scope and responsibility of
the contractor to deal with the legal proceeding such as court matter, police case compensation
etc which arises due to the above reason.
V) The contractor shall barricade the bus shelter or working site whenever required and all
safety measures shall be adhered to while the execution of the works.
W) The works in scope of tender and other associated works are to operate highly sensitive
and sophisticated IT equipments and therefore utmost care by service provider shall be taken
during works execution.
8.4 Performance and Damages
A) The Authority retains the absolute right to supervise, monitor and oversee the
performance of the Service Provider at all times by itself or through any of its agents or
representatives.
B) Officers or representative appointed by the authority shall have rights to visit and
inspect the performance of the service provider as per the conditions prescribed in the
tender, at any bus station and at any point of time during the operation hours
C) In general, the Authority shall retain the right to demand, by notice, payment of
the "Penalty/Damages" as specified in Bid summary per every instance of repeated non-
performance in terms of non-compliance of scope of work on any count. A record of
such instances shall be maintained and the total payment due to the Authority as
damages shall be deducted from the next monthly payment/s due to the Service
D) The amount of such cumulative damages of the bidder shall not exceed the
amount specified at Sr-17 of Bid Summary and also at Para(E) of Clause 9.21 of
Seal and Signature of the Bidder General Manager

9 GENERAL TENDER CONDITIONS
9.1 Rejection of tender
The tender will be rejected in following situations:
a) If all the information required in the tender is not provided
b) Tender is not signed by the bidder
c) Tender is submitted late (after the stipulated time limit)
d) Tender is not in sealed at the time of submission
e) Tender fee and/or bid security is not provided
9.2 Letter of Acceptance & Agreement
As the first step for the assignment, Authority will issue Bidder a Letter of Acceptance.
This letter will refer to the proposal and confirm its acceptance. The parties agree to
enter into a detailed Agreement in due course which shall consist of these Project Terms
and Conditions- as mutually agreed between the parties. The Agreement constitute a
contract shall between the Authority and the Service Provider under the Indian Contracts
9.3 Tax liability
The Prices mentioned in the proposal should include all taxes applicable as on the date
of submission of this proposal. Any financial deviations due to change in the rate of
taxes and duties or any introduction of new taxes and duties may be adjusted at actual
at the sole discretion of the Authority. The Authority shall be entitled to deduct tax at
source as may be applicable. The TDS certificate (S) shall be submitted as per the due
date specified in the Income Tax Act.
9.4 Termination of Agreement by the Service Provider
If the Service Provider wants to terminate the contract he will be allowed to do so after
giving three (3) months notice. However, Security deposit of the Service Provider will
stand forfeited.
9.5 Jurisdiction of Courts
The Court at Ahmedabad shall have the exclusive jurisdiction to try all disputes between
the parties arising out of the Contract.
9.6 Events of Default and Termination
9.6.1 Event of Default
Event of Default means the Service Provider Event of Default or the Authority Event of
Default or both as the context may admit or require.
(a) Service Provider Event of Default
Any of the following events shall constitute an event of default by the Service Provider
("Service Provider Event of Default") unless such event has occurred as a result of
Authority Event of Default or a Force Majeure Event;
i) In case the repeated non performance of the Service Provider even after
adequate notice where the performance is found to be unsatisfactory or violated /
contravened any of the terms and conditions contained herein.
ii) Any representation made or warranties given by the Service Provider under this
Tender is found to be false or misleading.
iii) The Performance Security has been encashed and appropriated in accordance
with clause and Service Provider fails to replenish or provide fresh Performance Security
within a period of 15 (fifteen) days.
iv) The Service Provider failed to make any payment to Authority within the Period
specified in this Tender.
v) The Service Provider submits to the Authority any statement which is false in
material particulars and which has a material effect on Authority’s right, obligations or
vi) The Service Provider suspends or abandons the operations of the Contract
without the prior consent of Authority, provided that the Service Provider shall be
deemed not to have suspended/ abandoned operation if such suspension/ abandonment
was as a result of Force Majeure Event and is only for the period such Force Majeure is
vii) The Service Provider repudiates this Tender or otherwise evidences an intention
not to be bound by this Tender.
viii) The Service Provider is otherwise in Material Breach of any conditions of the
contract entered into or commits a default in complying with any other provisions.
ix) The Authority, without prejudice to any other remedy for breach of Contract by
written notice sent to the Service Provider, may terminate the Service Provider’s
Services in whole or in part if the Service Provider fails to perform his obligation (s)
under the contract.
x) In case of major accident / loss on account of negligence on part of the Service
Provider the contract shall be terminated and performance security shall stand forfeited.
xi) In case the Service Provider assigns or sub-assigns the contract without written
approval of the Authority.
(b) Authority Event of Default
The following events shall constitute events of default by Authority (each a "Authority
Event of Default”), unless any such Authority Event of Default has occurred as a result of
Licensee Event of Default or due to a Force Majeure Event:
i) Authority repudiates the Contract or otherwise evidences an intention not to be
bound by the Contract.
ii) The Authority fails to make any payments to the Service Provider for its services
consecutively for a period of six months or beyond for any invoice generated.
iii) Authority or any Governmental Agency has by an act of commission or
commission created circumstances that have a Material Adverse Effect on the
performance of its obligations by the Service Provider and has failed to cure the same
within thirty (90) days of notice thereof by the Authority.
iv) Any representation made or warranties given by the Authority under this Tender
is found to be false or misleading.
9.6.2 Termination due to Event of Default and Termination Payment
(a) Termination for Service Provider Event of Default
Without prejudice to any other right or remedy which Authority may have in respect
thereof under this Tender, upon the occurrence of a Service Provider Event of Default,
Authority shall, subject to the provisions of the Tender, be entitled to terminate the
Contract by issuing a Termination Notice of 30 days to the Service Provider, provided
that before issuing the Termination Notice, Authority shall by a notice in writing inform
the Service Provider of its intention to issue the Termination Notice (the "Preliminary
Notice"). In case the underlying breach/default is not cured within a period of 7 (seven)
days from the date of the Preliminary Notice (Cure Period) Authority shall be entitled, to
terminate the Contract by issuing the Termination Notice. Provided further, that:
i) if the default is not cured within 7 (seven) days of the Preliminary Notice,
Authority shall be entitled to encash the Performance Security with a notice to the
Service Provider (Encashment Notice),
ii) if the default is not cured within 7 (seven) days of the Encashment Notice and a
fresh Performance Security is not furnished within the same period, Authority shall be
entitled to issue the Termination Notice.
iii) Upon Termination the Authority shall be entitled for any legal remedies for
compensation as may be prescribed by law.
(b) Termination for Authority Event of Default
The Service Provider may, upon the occurrence and continuation of any of Authority
Event of Default may terminate the Contract by issuing Termination Notice of 30 days to
9.6.3 Rights of Authority on Termination
Upon Termination of the Contract for any reason whatsoever, Authority shall have the
power and authority to:
a) Appoint another party or Service Provider that may carry of the remaining
obligations of the Service Provider.
b) In the case of the Authority terminates the Contract in part the Service Provider
shall continue the performance of the Contract to the extent of which is not terminated.
9.6.4 Termination Payments
Upon termination of the Contract, the Service Provider shall not be entitled for any Termination
Payment from the Authority.
In no event shall Bidder or Authority be liable, one to the other, for special or, indirect
damages in connection with or arising out of the furnishing, performance or use of the
services or deliverables provided by Bidder under the terms of this Tender.
The Service Provider shall at all times, i.e. during the subsistence of the Contract and at
any time thereafter, defend, indemnify and hold Authority harmless from and against all
claims (including without limitation claims for breach of contract, death or injury to person
or injury to property, or other tort claims), all suits, proceedings, actions, claims,
demands, liabilities and damages which the Authority or Authority indemnified persons
may hereafter suffer, or pay by reason of any demands, claims, suits or proceedings
arising out of claims including third party claims and expenses (including court costs)
arising out of or relating to the breach by Service Provider of any covenant
representation or warranty or from any act or omission of the Service Provider or his
agents, employees or sub-Service Providers.
9.9 Force Majeure
Should either Party be prevented from performing any of its responsibilities (as detailed
in this proposal) by reason caused by an Act of God or any cause beyond its reasonable
control including but not limited to work stoppages, fires, riots, terrorist strikes, accidents,
explosions, floods, cyclones, storms wars, revolutions, acts of public enemies,
blockages, embargos, orders, proclamations, ordinances, demands or requirements for
any government or authority or representative of any such government including
restrictive trade practices or regulations, general strikes and shutdowns, the time for
performance shall be extended until the operation or such cause has ceased, provided
the party affected gives prompt notice to the other of any such factors or inability to
perform, resumes performance as soon as such factors disappear or are circumvented.
Under this clause, if either party is excused performance of any obligation for a
continuous period of thirty (30) days, the two parties shall by mutual consultation decide
about the further implementation of the Contract, and in the event of the non agreement
in this regard, the Authority reserves the right to determine the Contract. However, the
aforementioned reasons do not include lack of personnel and non-performance of third
parties hired. The Service Provider shall not be entitled to any payment form the
Authority in case of force majeure, including termination of Contract due to force
9.10 Independent Service Provider
Bidder shall be deemed to be acting as an independent Service Provider of Authority
and shall not be deemed an agent, legal representative, joint venture or partner of
Authority. Neither party is authorized to bind the other to any obligation, affirmation or
commitment with respect to any other person or entity.
9.11 No Assignment
Neither party shall assign or transfer all or any of its obligations under this Arrangement
including any Statement of Work to any person without the prior written consent of the
other party, which consent shall not be unreasonably withheld or delayed.
9.12 Formation of Consortiums or Joint Ventures
The Bidders shall not be permitted to form consortium or joint ventures. Only registered
single entities in the form of companies, partnerships, cooperative societies,
proprietorships may apply.
9.13 Understanding of terms
By submitting a proposal, each Bidder shall be deemed to acknowledge that it has
carefully read all parts of this Tender, including all forms, schedules and annexes hereto,
and has fully informed itself as to all existing conditions and limitations.
9.14 Conflict of Interest
Bidder shall furnish an affirmative statement as to the existence of, or potential for
conflict of interest on the part of the Bidder or any prospective Service Provider due to
prior, current contracts, engagements, or affiliations with Authority in case such a
situation exists. Additionally, such disclosure shall address any and all potential
elements (time frame for service delivery, resource, financial or other) that would
adversely impact the ability of the Bidder to complete the requirements as given in the
9.15 Authority’s right to accept any proposal and to reject any proposal
Authority reserves the right to accept or reject any proposal, and to annul the bidding
process and reject all proposals at any time prior to award of Contract, without thereby
incurring any liability to the affected Bidder or Bidders or any obligation to inform the
affected Bidder or Bidders of the grounds for Authority's action.
9.16 Notification of Award and Signing of Contract
Prior to the expiration of the validity period, Authority will notify the successful Bidder in
writing or by fax or email, to be confirmed in writing by letter, that its proposal has been
accepted. The Authority would enter into a formal Agreement with the successful bidder
at a date later than the date of Letter of Acceptance upon the successful Bidder's
furnishing of performance security. The successful bidder would be bound to enter into
such Agreement within sixty days of date of Letter of Acceptance. The Authority may, at
its sole discretion, extend this period of sixty days. The Contract period shall commence
from the date of handover of the bus station sites to the Service Provider for the
purposes of discharge of its obligations.
The Agreement above shall incorporate all correspondence between Authority and the
successful Bidder. Additionally, it may contain other provisions that the Authority may
like to include, and unless they can reasonably be said to be of a nature that would have
materially impacted the bid value, the successful bidder shall not refuse to include them.
9.17 Failure to agree with the terms and conditions
Failure of the successful Bidder to agree with the Terms & Conditions of the Tender shall
constitute sufficient grounds for the annulment of the award, in which event Authority
may award the Contract to the next best value Bidder or call for new proposals.
9.18 Severability and Waiver
If any provision of this tender, or any part thereof, shall be found by any court or
administrative body of competent jurisdiction to be illegal, invalid or unenforceable the
illegality, invalidity or unenforceability of such provision or part provision shall not affect
the other provisions of this tender or the remainder of the provisions in question which
shall remain in full force and effect. The Authority and the Service Provider shall
negotiate in good faith in order to agree to substitute for any illegal, invalid or
unenforceable provision a valid and enforceable provision, which achieves to the
greatest extent possible the economic, legal and commercial objectives of the illegal,
invalid or unenforceable provision or part provision. No failure to exercise or enforce and
no delay in exercising or enforcing on the part of either Party to this of any right, remedy
or provision of this Tender shall operate as a waiver of such right, remedy or provision in
any future application nor shall any single or partial exercise or enforcement of any right,
remedy or provision preclude any other or further such right, remedy or provision or the
exercise or enforcement of any other right, remedy or provision.
9.19 REPRESENTATIONS AND WARRANTIES, DISCLAIMER,
9.19.1 Representations and Warranties of the Service Provider
By bidding in this tender, the Service Provider represents and warrants to Authority that:
a) it is duly organised, validly existing and in good standing under the laws of India;
b) it has to execute, deliver and perform its obligations under this Tender and to
carry out the transactions contemplated hereby;
c) it has taken all necessary corporate and other action under Applicable Laws and
its constitutional documents to authorize the execution, delivery and performance under
d) it has the financial standing and capacity to undertake the Project;
e) this tender constitutes its legal, valid and binding obligation enforceable against it
in accordance with the terms hereof;
f) it is subject to civil and commercial laws of India with respect to this tender and it
hereby expressly and irrevocably waives any immunity in any other jurisdiction in respect
g) the execution, delivery and performance of its obligations under this tender will
not conflict with, result in the breach of, constitute a default under or accelerate
performance required by any of the terms of the Bidder’s Memorandum and Articles of
Association or any member of the Consortium or any Applicable Laws or any covenant,
agreement, understanding, decree or order to which it is a party or by which it or any of
its properties or assets is bound or affected;
h) There are no actions, suits, proceedings, or investigations pending or, to the
bidder’s knowledge, threatened against it at law or in equity before any court or before
any other judicial, quasi judicial or other authority, the outcome of which may result in the
breach of its obligations to be carried out under this tender.
i) it has no knowledge of any violation or default with respect to any order, writ,
injunction or any decree of any court or any legally binding order of any Government
Agency which may result in any material adverse effect or impairment of the its ability to
perform its obligations and duties under this Tender;
j) no representation or warranty by the bidder contained herein or in any other
document furnished by it to Authority or to any Government Agency in relation to
Applicable Permits contains or will contain any untrue statement of material fact or omits
or will omit to state a material fact necessary to make such representation or warranty
not misleading; and
k) no sums, in cash or kind, have been paid or will be paid, by or on behalf of the
bidder, to any person by way of fees, commission or otherwise for securing the tender or
for influencing or attempting to influence any officer or employee of Authority in
connection therewith.
9.20 Condition of Particular application
A) The scope of work, project description mentioned in the document is indicative
and is likely to change during execution of actual works.
B) Conditional tenders will not be accepted.
C) AJL’s decision for selection or rejection of the offers shall be final and binding to
D) Tenderers/Bidder should provide information as mentioned in the prescribed
forms. Information provided in formats other than that provided in tender shall not be
considered for evaluation.
E) If Chairman AJL is convinced that the Bidder has resorted to material
misrepresentation or provided fraudulent information / statement, the said Bidder will be
liable for disqualification / rejection at any stage.
F) Proof for fulfillment of eligibility criteria should be submitted along with Tender
volume. If the Tender volume is submitted without valid documents and without proof of
eligibility, criteria will be rejected.
G) Those who do not meet with the eligibility criteria need not submit the Tender
H) Tenders, which do not fulfill all or any of condition or are submitted incomplete in
any respect or are conditional tenders, will be rejected.
I) Chairman AJL reserves the rights to reduce/ increase the scope of work and
contract without assigning any reason thereof.
J) The Service Provider shall have to make his own arrangements for water and
electricity for the purpose of work execution whenever required at site at his own
K) Safety and Signage: Contactor has to arrange for the complete safety of the
persons working for project, users of the road i.e. public and vehicles also. All the
arrangements of traffic drums, metal / fiber cones, traffic blinkers, traffic signs as per
design, safety tapes etc. to be arranged at site. Further, necessary florescent marking on
traffic signs to be provided so that it should be visible at night. During night working
hours’ safety in charge personnel’s shall be provided with florescent jackets.
L) Tax, Duties on Materials: All charge on account of applicable taxes on material
procurement or any other component for the works from any source shall be borne by the
M) Tax Liability: The Prices mentioned in the Price Bid should include all taxes
applicable as on the date of submission of the Tender. Any deviations due to change in
the rate of taxes and duties or any introduction of new taxes and duties would be
adjusted at actual with mutual consent from the Supplier and the Authority. The authority
shall be entitled to deduct tax at source as may be applicable. The TDS certificate(s) shall
be submitted as per the due date specified in the Income Tax Act.
N) Contractor shall make arrangement for “Annual Rate Contract (ARC) for
executing Comprehensive Electrical Maintenance of BRTS Stations, Cabins and
depots of different BRTS routes of Ahmedabad Janmarg Limited by supplying
necessary materials and labour for year 2026-28” on site as per instruction of
Engineer in charge as same may be required for achieving desired/acceptable
performance of complete system.
O) Quantity shown in Bill of Quantity (BOQ) is approximate nature. Work on
site will be carried out as per actual requirement and accordingly quantity may
9.21 Special Condition of Contract
(A) The Service Provider/Contractor must attend, rectify, resolve and thereby
complete the fault rectification work within time limit (03 Hours
). This service period includes the period of both the operational hours of BRTS (0600 to
2245Hrs) and non-operational hours of BRTS (2245 to 0600Hrs).
(B) From the time of cable fault reporting by Janmarg CCC and/or AJL electrical
staff, the Service Provider shall attend site of BRTS Station having fault occurred within
maximum of "2Hours" with intent to identify the prospective cause of fault, if identifiable,
through visual inspection. Such visit should be done preferably under presence and with
the representatives of AJL electrical staff.
(C) The requirements given in this section of tender document along with other
Terms and Conditions and Obligations of Service Provider/Contractor are firm and
deviations of any kind are neither acceptable nor permitted.
(D) Applicable Penalty and its Considerations:
(i) The contractor must be resolved the fault occurrence within 03 hours
of fault occurrence.
(ii) If it is felt by AJL electrical staff that work can be finished within 03 hours
and Service Provider is delaying work due to any reasons or the Service Provider
is not deploying the Manpower Staff as per requisite requirement or not
executing works as per requirements of Tender then penalty amount Equal to
"Proportionate Loss calculated because of delay in attending fault and
providing resolution with a maximum ceiling of 10% " or "Any amount as
decided by the authority" shall be applicable and imposed on the Service
(iii) The above factor of penalty has been considered as the BRTS operation
is a "LIVE" operation and therefore works as per this Tender demand that any
such incidents of cable fault needs to be considered on top priority and needs to
be resolved immediately or at the earliest. It is imperative for all Bidders/Service
Providers to understand that any such incident of cable fault imposes power
redundancy within station, which ultimately halts "TICKETING OPERATION"
and thereby affecting core operation in addition to operation of all other
equipments such as ITMS Equipments, Automatic Doors, Station lights, etc.
(iv) Most importantly such faults directly affects the "REVENUE"
generation and have outcomes such as Revenue generation at station
stops immediately, Passengers faces extreme difficulty, AJL Staff members
faces a huge criticism from the Passengers, Safety of Passengers is
hampered and therefore based upon these factors the time frame for completion
of each cable fault incidents as elaborated above has been prepared.
(E) The Time limit for the fault rectification will start from the time of communication
of fault occurrence to the Service Provider and communication about fault will be
acceptable and binding on the Service Provider if it is from any of the media such as
Letter, E-Mail, Telephone/Mobile, Whatsapp.
