The tenderer must have minimum average annual contractual turnover of 1.5 V/N or 'V' whichever is less; where V= Advertised value of the tender in crores of Rupees N= Number of years prescribed for completion of work for which bids have been invited. The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover. The tenderers shall submit requisite information as per Annexure-VIB, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet

The tenderer must have successfully completed or substantially completed any of the following during last 07 (seven) years, ending last day of month previous to the one in which tender is invited: 1. Three similar works each costing not less than the amount equal to 30% of advertised value of the tender, or 2. Two similar works each costing not less than the amount equal to 40% of advertised value of the tender, or 3. One similar work each costing not less than the amount equal to 60% of advertised value of the tender.

Work experience certificate from private individual shall not be considered. However, in addition to work experience certificates issued by any Govt. Organisation, work experience certificates issued by any Public listed company having average annual turnover of Rs.500 Crore and above in last 3 financial years excluding the current financial year, listed on National Stock Exchange or Bombay Stock Exchange, incorporated/registered at least 5 years prior to the date of closing of tender, shall also be considered provided the work experience certificate has been issued by a person authorized by the Public listed company to issue such certificates

In case tenderer submits work experience certificate issued by Public listed company, the tenderer shall also submit along with work experience certificate, the relevant copy of work order, bill of quantities, bill wise details of payment received duly certified by Chartered Accountant, TDS certificates, for all payments received and copy of final/last bill paid by company in support of above work experience certificate. And if a bidder has successfully completed a work as subcontractor and the work experience certificate has been issued for such work to subcontractor by a Govt. organisation or public listed company as defined in Note for item 10.1 part-I of GCC, the same shall be considered for the purpose of fulfilment of credentials. For this Tender No.EC_T_Tr-Alt_OT-26_25-26 All the recent documents need to be submitted 1.PAN card, 2.Tax clearance certificates [ITR forms, audited balance sheets and profit & loss statement for last three financial years regarding contractual payments], 3.Non-blacklisting declaration, 4.Insolvency declaration, 5.Recent bank statements, 6.Valid Electrical Supervisor's License, 7.Partnership deeds / proprietorship declaration/MOA or AOA as applicable as per GCC April 2022 [Para 14, 15-second sheet-TENDER FORM], 8.List of proposed engagement of personnel and machineries for the tendering work - as per tender condition are mandatorily required in evidence of tenderer's capacity to carry out the work efficiently.

Without such mandatory documents/certificates and testimonials & for incomplete tender document in any form [Like non submission of credentials, required information as asked for, Principal Chief Engineer/E. Rly/ Kolkata or Chief Planning & Design Engineer/E. Rly/Kolkata or Chief Works Manger/Eastern Railway, Kanchrapara, the accepting authority of these Tenders, reserves the right to reject such Offer of the tenderer, with forfeiture of earnest money/ bid security.

The tenderer shall have submitted an undertaking that he is not blacklisted or debarred by Railways or any other Ministry / Department of Govt. of India from participation in tender on the date of opening of bids, either in individual capacity or as a member of the partnership firm or JV in which he was/is a partner/member (Format in Annexure- V). Concealment/ wrong information in regard to above shall make the contract liable for determination under Clause 62 of the General Conditions of Contract.

The tenderers shall submit a copy of certificate stating that all their statements/documents submitted along with bid are true and factual. Standard format of certificate to be submitted by the bidder is enclosed as Annexure-V. In addition to Annexure-V, in case of other than Company/Proprietary firm. Non submission of above certificate(s) by the bidder shall result in summarily rejection of his/their bid. It shall be mandatorily incumbent upon the tenderer to identify, state and submit the supporting documents duly self-attested/digitally signed by which they/he is qualifying the Qualifying Criteria mentioned in the Tender Document.

The tenderer is advised to visit the site of work to acquaint themselves with the site conditions and expected quantum of works in their own interest.

4.Bid Security deposited by the successful tenderer will be forfeited if the tenderer shows resiliencies form his/her/their offer or modify the terms and condition thereof in a manner not acceptable to the Railway within the stipulated period of validity of offer. If the successful tenderer fails to execute the agreement bond/security deposit or start the work within the stipulated period, or as may be stipulated in the letter of acceptance, the entire earnest money shall be liable to be forfeited to the Rlys. Earnest money is liable to be forfeited in cases where any of the statements/declarations/information made by the tenderer is proved wrong/false/incomplete or such as to withhold any information relevant for consideration of the tenderer.

5.The amount of Bid Security will be refunded to the un- successful tenders after finalization of the tender. The earnest money remitted by the successful tenderer, will be refunded on deposition of full security money of the contract or may be adjusted against security deposit.

3.Vide Railway Board's letter No. 2018/E(LL)/AT/CNR/3 dated24.01.2018, every contractor must abide by and ensurecompliance to statutory provisions of applicable Labour Lawand various Labour Legislations, as applicable, when they areengaging workmen for execution of Works Contracts awardedby Railways. Details of the above are clearly mentioned in the said letter of Railway Board; copy of which can be seen in theDocument Section of this Tender. 'Successful Bidder/tenderer' or'Contractor' shall have to submit an Undertaking stating that hey shall abide by the above instructions meticulously, to paythe Minimum Wages and others facilities as per provisions ofthe above Labour Legislations/Laws; and in case of anydeviation/noncompliance in respect of above laws/legislations;or any complaint is received to that effect, the Contractor willbe solely responsible and Railway will take up necessarypunitive/penal proceedings under relevant laws against thedefault/accused Contractor in consultation with LabourAuthorities and black list them nationally. All bidders are onceagain advised to take a serious note of these issues and followthe instruction laid in the said letter of Railway Boardthoroughly, both in letter and spirit. Copy of the said latter ofRailway Board is furnished at the Document Section

4.The contractor shall make his own arrangement for theaccommodations of his staff, materials; tools , yellow colouruniform etc, Electricity for the purpose of the execution of workagainst this contract may be arranged by Railway from itssources, if available near the work site on payment of Railway'sspecified charges

5.The Railway reserves the right to verify all statements,information and documents submitted by the bidder in histender offer, and the bidder shall, when so required by theRailway, make available all such information, evidence anddocuments as may be necessary for such verification. Any suchverification or lack of such verification, by the railway shall notrelieve the bidder of its obligations or liabilities hereunder norwill it affect any rights of the railway there under.

6.In case of any wrong information submitted by tenderer, thecontract shall be terminated, Earnest Money Deposit (EMD),Performance Guarantee (PG) and Security Deposit (SD) ofcontract forfeited and agency barred for doing business onentire Indian Railways for 02 (Two) years.

7.The rate offered by tenderer must be in accordance with thecurrent 'Government Labour Rate' as per Clause No. 54 of GCC, 2022.

8.Contractor is to abide by the provisions of Payment of WagesAct & Minimum Wages Act in terms of Clause 55 and 54 ofIndian Railways General Condition of Contract, 2022. In order toensure the same, an application has been developed andhosted on website 'www.shramikkalyan.indianrailways.gov.in'.Contractor shall register his firm/company etc. and uploadrequisite details of labour and their payment in this portal.

9.Contractor shall apply for onetime registration of hiscompany/firm etc. in the Shramikkalyan Portal with requisitedetails subsequent to issue of Letter of Acceptance. TheCompetent Railway Authority shall approve the contractor'sregistration on the portal within 7 days of receipt of such request

10.Contractor once approved by the Competent Railway Authority,can create password with login ID (PAN No.) for subsequent useof portal for all LOA's issued in his favour

11.The contractor once registered on the portal, shall provide details of his Letter of Acceptance (LOA)/ Contract Agreementson Shramikkalyan Portal within 15 days of issue of any LOA forapproval of concerned Railway Authority and shall update (ifrequired) and approve the details of LOA filled by contractorwithin 7 days of receipt of such request

12.The tenderer shall have sound financial capability to undertake the job successfully

13.The tenderer shall income tax, PAN on the name of agency orthe proprietor as the case may be.
