SectionA1–SPECIALCONDITIONSOFCONTRACT

1. Thistenderisinvitedforcontract.Contractorshallhavetoexecutetheworkin allzones

simultaneously. He shall have to start the work within the day of

instructionsgivenfromtheengineer.

2. AMC will have to give the instruction to start the work all together for more than

oneplaceindifferentArea.Heshouldhaveminimummachinerystatedineligibilitycriteria.

3. The Bill of Quantities shall be reading conjunction with the Instruction to

Bidders,ConditionsofContract,andTechnicalSpecifications.

4. Thebiddermust havevisitedandexamined

theareaoftheWorksanditssurroundingsandobtainedalldataanditishisownresponsi

bility.Allinformationthatmaybenecessaryforpreparingthebidandentering into

acontract for this type of Works. The costs of visiting the site shall be at

thebidder'sownexpense.

5. Biddermusthaveknowledgeofexistingsewageflow quantity orhemusthave gotdata of

sewage flow quantity in the sewerage trunk main lines or Branch sewer

linesandhemusthaveawareofrequiredpumpingfordiversionoftheexistingflow.

Biddershallhavetomaintainflowlevelinallmanholeofupstreamlineduringdiversionofflowby

proper pumping system. In this regard bidder shall have

todiverttheflowinsamelinebyalternatemanholedistanceifthereisnoextralineandheshal

lnotraiseanyissueofextralinefordiversionofthe flow.

6. The bidder and any of its personnel or agents will be granted permission by

theEmployer to enter its premises and lands for the purpose of such inspection, but

onlyupon the express condition that the bidder, its personnel and agents, will release

andindemnify the Employer and its personnel and agents from and against all liability

inrespect thereof and will be responsible for death or personal injury, loss of or

damagetoproperty andany other loss,damage, costs and expenses incurred asaresult

ofthe inspection.

7. No claim in future for unknown with the site by the bidder shall begranted

11. BidderisrequestedtofillrateontotalcostoftheBOQconsideringtheContract.

AMCshallevaluatebidderscapabilitytoworkconsideringworkonhand andwork in

progress in all parts of India. AMC shall evaluate bidder`s capability ofdoing the

work considering working progress and response to the

instructionsdeliveredfromAMCengineersandauthoritytohim.Bidding capacity shall

beconsideredapplyinggeneralformula.

(Note:Ifanyquarryinthisclausebiddershallclarify/maycontactbeforeenteringintothecontract.)

12. ContractorshallfillpercentagerateonamountofBOQ.Itemsotherthaninthe BOQwill bepaid

for by theEmployer onactual measurement (preferably current SOR

ofanyorganization)onsiteifexecuted.

13. Employer reserves the right to accept the tender of more than one

bidderwithlowest approved rate and also reserves the right to give the work order to

morethanonebidderwithsameapprovedrateofthelowestbidder.Anybidderof lowest

quotedrate cannotclaimforhissolelyqualifiedtender.

14. The contractor should have to attend the breakdown if any as early as possible

andshouldhavetocompletetheworkwithoutunavoidabledelay.

1.12 Theworks under this Contract shall becarried out inaccordance

withthebiddingdocumentsconstitutingthecontractandshallconsistofvarioussalientitemsasg

enerallydescribedinthetenderdocument:

1.13 Bidder shall note that AMC may cancel the work at any stage of the contract. AMC

canterminate the contract incase of curtailment of the scope of the work. Contractor will

notbeentitledto raiseanyclaimregardingcurtailmentofthescopeofthe work.

2. SourceofFunds

2.1 TheexpenditureontheseWorkswillbemetbyAHMEDABADMUNICIPALCORPORATION.

2.2 Payment will be made after getting satisfactory working report from the user Department.

3.1Contractor should have AMC Regestration.

3.2 Contractor must have submit 3a form of completed similar work

3.3Contractor should have the past working experience of executing minimum 10No. of

constructing Kacha/Pakka Paradi.

3.4Contractor should be having past experience of cleaning MH/CH cleaning work.

Contractor should be owning the equipments like Electric and pnuemathammer both.

3.5 18% GST will be paid as per circular.

3.6 Contractor must have own machinery on its name no JV allowed

GENERALCONDITION

1. ContractorshallproducetherelevantregistrationcertificateofAMC/StateGovt/CentralGovt.

2. Contractorshallregistertheworktolabourcommissionerasperlabouract.

3. Contractorshallnotsub-lettheworkwithoutpermissionoftheauthority

4. Contractor should have sufficient skilled and unskilled labours so that he shall start work

atdifferent sites simultaneously. Contractor's having labour force available during festivals

shallonly apply. Contractor can not stop the work due to unavailability of labour force. In

caseprogressisdelayed,contractorshallbepenalized0.1%ofTenderamountperdayforworkdoneafter

timelimit, maximumupto 10%forremainingwork.

5. No rate difference will be paid for due to any increase in rate of any item due to any

reasonwhatsoever.

6. Nopriceescalation/advancepayment/machineryadvancewillbepaid.

7. PaymentofrunningbillwillbemadeasperrecentA.M.C.policyinforce.

8. Noextrapaymentwillbemadeduetoincreaseofcentral/stateGovt.Taxes.

9. If the work is not completed within time limit the penalty will be recovered from

immediatebillsofcontractors.

10. If the material i.e. MH cover, C.C block etc is supplied from Municipal Corporation store

thencontractorshallnotclaimforanyextraratefornonexecutionofsuchitem,partly/fully.

11. In the specifications, "as directed"/"Approved" shall be taken to mean, "as

directed"/approved"bytheEngineer-in-charge.

12. Wherever areferenceto any IndianStandard appearsin thespecifications,it shall be taken

tomeanas areferenceto thelatest editionofthesamein forceonthedateofagreement.

13. In "Mode of Measurement" in the specifications wherever a dispute arises in the absence

ofspecific mention of a particular point or aspect, the provisions on these particular points,

oraspectsin therelevantIndianStandardsshallbereferredto.

14. All measurements and computations, unless otherwise specified, shall be carried out nearest

tothefollowinglimits:

27. All tools, templates, machinery and equipment for correct execution of the work as well as

forchecking lines, levels, alignment of the works during execution shall be kept in

sufficientnumbersandingoodworkingconditiononthesiteofthework.

28. Themode,procedureandmannerofexecutionshallbesuchthatitdoesnotcause damage orover

loading of the various components of the structure during execution or after completion

ofthestructure.

29. Allnecessary safetymeasuresandprecaution(includingthoselaiddowninthevariousrelevant Indian

Standards) shall be taken to ensure the safety of men, materials and machineryontheworksas

alsooftheworkitself.

30. The testing charges of all materials shall be borne by the Contractor unless recovery at

onepercenttowardstestingchargesis separatelymade.

31. Contractor has to provide Sale Tax, Vat no., PF code no. etc.If contractor failes to

providesuchdocumentsthenhis/herTenderwillbecancelled.

GENERALSPECIFICATION

1. Timelimitfortheworkshallbe6Monthsaftertheordertostartthework.

2. Thecontractor shall have to maintain account ofsteel,cement and other materials that may bebrought

by him on site. This account shall be regularly maintained and kept open for inspection

byMunicipalStaff.

3. Watering of all the items shall be as per instructions otherwise no payment shall be made

tocontractors.Mixingofconcreteshallbedonebyconcretemixermachine.

4. ThecontractorshallberesponsibleforWorkmen’scompensationifanyaccidentoccurs.

5. The contractor shall arrange for barricading at night and arrangement of Pagi at night to direct

thetraffic.Heshallberesponsibleforanydamagetopublic.

6. if any incident happen, during the execution of work. In case of dispute for unseen or

overlookeditems,thedecisionoftheAdd.C.E.(CZ)shallbefinal.

7. The contractor shall have to give site clean of all rubbish during the work and at the time

ofcompletionofworkandhandoverthesitewithfinalfinishingoftheworkas directed.

8. Ifanyextraitemcropsupduringtheprogressofworkthesameshallbecarriedoutby thecontractor and he shall

be paid at the rate fixed by Add..C.E. as per the rate analysis based on latestSOR or if item is not

available in SOR than based on current market rates. In case of extra

itemdecisionofAdd.CityEngg.shallremainfinalregardingrate.

9. Ifin the interest of the Corporation it is necessary to change either any site or the design ofthepropose

work the contractor shall carry out the same at his quoted rates without charges any extraand the

contractor will have to carry out the works and he will be paid atthe rate quoted by him.Noclaim

forextrarateforsubsequentchangesinsiteanddesignentertained.

10. The cubical contents of the cement bag shall be taken as 1-20 cft. Per bag and the contractors

shallhaveto preparethemeasuresboxesaccordingto thismeasure.

11. Octroiexemptionpassesshallnotbegivenforanymaterialsrequiredforthework.

12. Contractor will be fully responsible for compliance of the various provisions under contract

Act.1970andtheRulesframedto under.

13. The tender for the work shall remain open for a period (120) days from the date of opening of

thetenders for this work and that the tenderer shall not be allowed to withdraw on modify the offer

onhisownduringtheperiod.Ifanytendererwithdrawsor marksany modifications

oradditionsinthetermsandconditionsofhistender,notacceptabletotheMunicipal

Corporation,thenMunicipalC orporationshall,withoutprejudicetoanyr ightorremedy,be at l
