Bidders shall ensure upload of relevant document certifying his/her status as Scheduled Caste/ Scheduled Tribe/other reserved category as prescribed in the tender document.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

The intending bidder should have in last 5 years i.e. from 2021-22 to 2025-26, satisfactorily completed (not less than 90% of contract value) as a prime contractor, one similar work costing not less than 50% of the amount put to tender i.e., Rs. 2516.00 Lakhs in last five years. The work done certificate should be obtained duly signed from an officer not below the rank of Executive Engineer of the concerned Division and counter signed by the Superintending Engineer of the same circle or equivalent in case of other Government undertaking within India. The cost will be updated to the present value by giving a weight age of 10% for each year.Note- 1) Similar nature of work means, Earthwork Excavation, Earthen Embankment, CC lining, concrete structures such as CTC/SP/SP/CTC/Bridge/Barrage/Aqueduct etc.,

The intending bidder in his / its name should have in the last 5 years i.e., 2021-22 to 2025-26 achieved in at least 2 financial years, a minimum financial turnover of Rs.6709.00 Lakhs (usually not less than two times the estimated annual payments under this contract). The turnover prior to FY 2025-26 will be updated to the Present Price Level (FY 2026-27) by giving weight age of 10% each year . Audited Profit and Loss account certified by a practicing Chartered Accountant bearing UDIN along with copy of Income Tax returns filed for the years indicated above should be furnished.

The intending bidder should have executed minimum quantity of A. Earthwork in excavation/ Embakment is 4,51,460 Cum in any one financial year, during the last five financial years (2021-22 to 2025-26). B. CC Lining is 10,100 Cum in any one financial year, during the last five financial years (2021-22 to 2025-26). C. Structure concrete quantity Grade M-15 and above) is 7,240 Cum in any one financial year, during the last five financial years (2021-22 to 2025-26). D. Reinforced steel is 250.00 tonne in any one financial year, during the last five financial years (2021-22 to 2025-26). The work done certificate should be obtained duly signed from an officer not below the rank of Executive Engineer of the concerned division and counter signed by the Superintending Engineer of the same Circle or Equivalent in case of other Government undertaking.

Note -1: The statements showing the value of existing commitments and on-going works as well as the stipulated period of completion remaining for each of the works listed should be certified by Statutory Auditors of the Company or by the proprietor of the company through an affidavit. Note: -2: Even though the Tenderers meet the above criteria they are subject to be disqualified if they have: a. made misleading or false representation in the forms, statements and attachments submitted in proof of the qualification requirements and or. b. record of poor performance such as abandoning the works, not properly completing the contract, inordinate delays in completion, litigation history or financial failure etc, and or. c. Participated in the previous tender for the same work and had quoted unreasonably high tender prices and could not furnish rational justification. If the bidder/ bidders have participated in more than one work, the available tender capacity will be assessed and number of works will be awarded as per his available bid capacity

However, it is obligatory for the contractor to use the following machineries for various activities of roadwork/ Irrigation works involved in construction as per MORTH specification and Irrigation manual. 1. Self-loading concrete mixer 4.00 cum capacity - 4 nos- 02 own & 02 hire/ lease. 2. Tippers - 8 nos - 04 own & 04 hire/ lease. 3. Excavator like JCB & Hitachi - 06 nos - 03 own & 03 hire/ lease. 4. Water Tanker - 06 nos - 03 own & 03 hire/ lease. 5. Vibratory Roller - 03 nos - 02 own & 01 - hire/ lease

To qualify for a package of contracts made up of this and other contracts for which tenders are invited in this IFT, the tenderer must demonstrate having experience and resources to meet the aggregate of the qualifying criteria for the individual contracts

General Conditions-1.The bid shall be technically evaluated based on the specifications indicated in Section-3 titled Qualification information in bid document. 2. The Bidder or any of his partner shall not be under Corporate Debt Restructuring (CDR) / Strategic Debt Restructuring (SDR) or Bureau of Industrial and Financial Reconstruction (BIFR) in the last 5 Years prior to bid submission date. In this regard, the Bidder shall submit along with Bid, a certificate from their Statutory Auditor with a declaration that, the Bidder is not under CDR / SDR or BIFR. 3. During technical evaluation, if the employer finds that any certificates/ information furnished is false, such bidders will be disqualified and barred from participation in the bid. 4. If any bidder fails to satisfy the conditions mentioned above, such bids will be rejected and their financial bids will not be opened. 5. The bidder should enclose the detailed methodology of execution of the scheme as per the scope of work.

6.The Bidder shall be responsible for successful performance of the contract. 7. The Bidder to participate in the tender under single bid basis only. Any violation will attract disqualification of the bid. 8. The contractor/authorized signatory should attach his/her scanned signature to the Schedule-B before uploading and also submitting their tenders. 9. 11.Conditional tenders are liable to be rejected. The officer competent to accept the tender shall have the right to reject any or all the tenders without assigning any reason whatsoever. 12. Corrigendum will be published in the web site/ newspapers/e-portal of all modifications /corrections if any. 13. Mineral Dispatch Permit (MDP) shall be paid (as per Mines and Geology Circular dated 7/11/2023 )as per the prevailing rates issued by the department of Mines and Geology from time to time together with GST at the applicable rates. 14. The contractor is to be abide to pay the royalty charges as per the prevailing Government Orders. 15. The intending bidders should note that, if any of lands either in part/ parts or in whole required for the work is not acquired by the Nigam, it shall be the responsibility of the bidder to take the possession of such land and start the work by obtaining consent of the land owners before commencement of work at no extra cost to the Nigam and no claim / delays whatsoever relating to on account of non-availability of land would be entertained.

16.They should abide by the directions of Government towards recovery of 1perecnt (or as modified by the Government from time to time) Cess from the contractors bill under the provisions of building and other constructions worker welfareness Act 1996. 17. The intending bidders are advised to visit the site of work, make themselves familiar with local situation about the availability of construction materials, workmen, land required for construction activities, etc. 18. The contractor is responsible for any damages due to natural calamity the government or Nigam will not give any compensation for until the completion of maintenance period. 19. The intending bidder/firm/company are advised to visit the work site before submission of the tenders. 20. The contractor should mention their recent correct portal address & mail address in declaration forms.

21.The tender processing charges paid by the bidder/firm/company are not refundable even if the tender is cancelled. 22. The bidder/firm/company shall send the authorization letter for their representation duly attesting their signature. 23. Defect liability period for this work is 12 months from the date of completion of work. 24. Useful rubble and Stone chips obtained from excavation shall be issued to the contract or for use on works (including enabling works and aggregate crushing) at the rates specified for those materials in the prevailing Schedule of Rates. 25. The bidder/firm/company shall adhere to accepted execution plan submitted by him under any circumstances without linking to the pending payment of the work & also land acquisition problems if any

26.Typographical errors if any will not be the ground for any claims by the bidder/firm/company. 27. The contractor shall also abide by the other conditions as laid down in Bid document. 28. The contractor should take design approval of the structures before commencing of the work. 29. The bidder/firm/company shall adhere to accepted execution plan submitted by him under any circumstances without linking to the pending payment of the work & also land acquisition problems if any. 30. As per GO FD 5 EXP -12 / 2023 dated 15.05.2023, the contractor shall be abide to provide e Bank Guarantee towards Security Deposits. 31. Debarment of tenderers: The procurement entity may debar tenderer for a period not exceeding 3 years from participation in its tenders following such procedures as may be prescribed on the ground that tenderer is engaged in corrupt or fraudulent practices in competing or executing the contract including misleading the procuring entity or any stage of procurement activity with a fraudulent intention.( KTPP Act 26A).
